Brief Note

The proposal of M/S Power Band Industries Pvt Ltd ., is for setting up a new unit in theDahej-SEZ. They have import of Rs.2000.00 Lakhs capital goods for the proposedproject. FOB value of exports for the 5 years period is projected as Rs. 203000.00Lakhs with NFE of Rs.113500.00 Lakhs (226.82 %). The Developer (Dahej SEZ) hasagreed in principle approval for allotment of plot of about 80,000 Sq. Mtrs. in theprocessing zone of Dahej SEZ for the proposed project in Dahej SEZ for setting up ofunit.

The proposal is eligible for approval under AlA route. We may therefore if approved,place the same before the Approval Committee for consideration, after personalinterview of the Promoters/Directors. The proposal is recommended for approval interms of the Rule-18 of the SEZ Rules, 2006.

Item No. 67.3.01 MIs. Sigachi Cellulos Pvt. Ltd., Dahej - SEZ -Request for broad banding of LoA to include additionalitems for trading and enhancement in production capacity ofMicrocrystalline Cellulose.

M/s. Sigachi Cellulos Pvt. Ltd., Dahej-SEZ, were approved by this ApprovalCommittee in its 1st meeting held on 19-08-2008, and LOA dated 11-09-2008 wasissued to them for manufacture and export of "Micro Crystalline Cellulose". In termsof the approval granted, they have implemented the project and started commercialproduction with effect from 30-08-2012.

They have requested vide letter No. SchCI70'0115-16/236 dated 18.03.2016 forenhanced production capacity of Microcrystalline Cellulose (ITC (HS)- Code-39129090) from 1200 MT to 6000 MT per annum. They envisage an additionalinvestment of Approx Rs. 200 Lakhs and they will generate employment of 20 Persons.

They have also requested to broad-banding of LoA to add new products fortrading activity i.e. a) Sodium Carboxy Methyl Cellulose CITC (HS)- Code- 39123100);b) Calcium Carboxy Methyl Cellulose CITC (HS)- Code- 39123100); c) Sodium StarchGlycolate (ITC (HS)- Code-29420090) ; d) Lactose Monohydrate (ITC (HS)- Code-17021190); e) Purified Talc (ITC (HS)- Code-25262000); f) Pregelatinized Starch (ITC(HS)- Code-35051090); g) Maize starch CITC (HS)- Code-ll081200); h) Calciumcarbonate CITC (HS)- Code-28365000); i) Polythylene Glycol (ITC (HS)- Code-334049020). As the unit is working and exporting from the SEZ, the ApprovalCommittee may kindly like to accord approval for the new items sought enhancementof capacity and trading activity, in terms of Rule-19(2) of the SEZ Rules, 2006 subjectto the normal terms and conditions.

Item No. 67.3.2. MIs P & J Cretechem (P) Ltd -Request for broad-banding of Letter of Approval -inclusion of additional products/new products to theLOA.

M/s P & J Cretechem (P) Ltd. was issued LOA on 26/09/2008, as amendedfrom time to time, for manufacture and export of Sigunit -5000 MT PA, MagnesiumSilicate 2000 MT PA, Hydrotalcite 3000 Mt PA & Aluminium Hydroxide 2000 Mt PA.They had commenced commercial production w.e.f. 22-03-2016.

Now the unit has requested vide their letter dated 30.03.2016 to broad-band theLOA by including new product for manufacture and export of Viz. 1) AluminiumSulphate CITC (HS)- Code- 28333090) - 400 MT per month. As the unit has startedworking from the SEZ, the Approval Committee may kindly like to accord approval forthe new items sought, in terms of Rule-19(2) of the SEZ Rules, 2006 subject to thenormal terms and conditions.

Item No. 67.3.3. Approval of list of services in respect ofunits in Dahej - SEZ.

In terms Section-26 of the SEZ Act, 2005, read with Rule-31 of the SEZ Rules, 2006;quote "Exemption from service tax:- The exemption from payment of service tax ontaxable services under section-65 of the finance Act, 1994 (32 of 1994) rendered to aDeveloper or a Unit (including a Unit under construction) by any service provider shallbe available for the authorized operations in a Special Economic Zone" unquote.

Under the above SEZ provisions a Developer or a Unit was exempted from payment ofService Tax on taxable services. However, the Government of India, in the Ministry ofFinance, had amended the aforesaid provision vide CBEC Notification No. 9/2009-Service Tax, dated 03-03-2009, as amended from time-to-time, wherein the developeror units of SEZ shall have to get the list of services approved from the ApprovalCommittee, as specified services, for the required exemption, etc.

The Department of Commerce, in view of bringing uniformity, in the list of taxableservices applicable for all SEZs in India, devised a default list of 66 (sixty-six) services.These 66 services were approved as default services in the 55th Approval Committee forDahej - SEZ held on 27-08-2014. Now, the following SEZ units have soughtapproval/permission for new additional taxable services, as under:-
