a Waste Water Discharge Authorisation Application Form

This form is for the purpose of making an application for a Waste Water Discharge Licence under the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007) or for the review of an existing Waste Water Discharge licence.

The Application Form must be completed in accordance with the instructions and guidance provided in the Waste Water Discharge Licensing Application Guidance Note. The Guidance Note gives an overview of Waste Water Licensing, outlines the licence application process (including the number of copies required) and specifies the information to be submitted as part of the application. The Guidance Note and application form are available to download from the Licensing page of the EPA's website at www.epa.ie.

A valid application for a Waste Water Discharge Licence must contain the information prescribed in the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007). Regulation 16 of the Regulations sets out the statutory requirements for information to accompany a licence application. The application form is designed in such a way as to set out these questions in a structured manner and not necessarily in the order presented in the Regulations. In order to ensure a legally valid application in respect of Regulation 16 requirements, please complete the Regulation 16 Checklist provided in Annex 2.

The procedure for making and processing of applications for waste water discharge licences, and for the processing of reviews of such licences, appear in the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007) and is summarised below. The application fees that shall accompany an application are listed in the Third Schedule to the Regulations.

Prior to submitting an application the applicant must publish in a newspaper circulating in the area, and erect at the point nearest to the waste water treatment plant concerned or, if no such plant exists, at a location nearest the primary discharge point, a notice of intention to apply. An applicant, not being the local authority in whose functional area the relevant waste water discharge, or discharges, to which the relevant application relates, takes place or is to take place, must also notify the relevant Local Authority, in writing, of their intention to apply.

An application for a licence must be submitted on the appropriate form (available from the Agency) with the correct fee, and should contain relevant supporting documentation as attachments. The application should be based on responses to the form and include supporting written text and the appropriate use of tables and drawings. Where point source emissions occur, a system of unique reference numbers should be used to denote each discharge point. These should be simple, logical, and traceable throughout the application.

The application form is divided into a number of sections of related information. The purpose of these divisions is to facilitate both the applicant and the Agency in the provision of the information and its assessment. Please adhere to the format as set out in the application form and clearly number each section and associated attachment, if applicable, accordingly. Attachments should be clearly numbered, titled and paginated and must contain the required information as set out in the application form. Additional attachments may be included to supply any further information supporting the application. Any references made should be supported by a bibliography.

All questions should be answered. Where information is requested in the application form, which is not relevant to the particular application, the words "not applicable" should be clearly written on the form. The abbreviation ",/A" should not be used.

Additional information may need to be submitted beyond that which is explicitly requested on this form. Any references made should be supported by a bibliography. The Agency may request further information if it considers that its provision is material to the assessment of the application. Advice should be sought from the Agency where there is doubt about the type of information required or the level of detail.

Information supplied in this application, including supporting documentation will be put on public display and be open to inspection by any person.

Applicants should be aware that a contravention of the conditions of a waste water discharge licence is an offence under the Waste Water Discharge (Authorisation) Regulations; 2007.

It should be noted that it will not be possible to process or determine the application until the required documents have been provided in sufficient detail and to a satisfactory standard.

The provision of information in an application for a waste water discharge licence which is false or misleading is an offence under Regulation 35 of the Waste Water Discharge (Authorisation) Regulations, 2007 (S.I. No. 684 of 2007).

Note: Dra winas. The following guidelines are included to assist applicants:

All drawings submitted should be titled and dated. All drawings should have a uniaue reference number and should be signed by a clearly identifiable person. All drawings should indicate a scale and the direction of north. All drawings should, generally, be to a scale of between 1:20 to 1:500, depending upon the degree of detail needed to be shown and the size of the facility. Drawings delineating the boundary can be to a smaller scale of between 1 :lo00 to 1 :10560, but must clearly and accurately present the required level of detail. Drawings showing the waste water treatment plant location, if such a plant exists, can be to a scale of between 1 :SO 000 to 1:126 720. All drawings should, however, be A3 or less and of an appropriate scale such that they are clearly legible. Provide legends on all drawings and maps as appropriate. In exceptional circumstances, where A3 is considered inadequate, a larger size may be requested by the Agency.

Advice on completing this section is provided in the accompanying Guidance Note.

A non-technical summary of the application is to be included here. The summary should identify all environmental impacts of significance associated with the discharge of waste water associated with the waste water works. This description should also indicate the hours during which the waste water works is supervised or manned and days per week of this supervision.

The following information must be included in the non-technical summary:

A description of:

- the waste water works and the activities carried out therein, - the sources of emissions from the waste water works, - the nature and quantities of foreseeable emissions from the waste water

works into the receiving aqueous environment as well as identification of significant effects of the emissions on the environment,

- the proposed technology and other techniques for preventing or, where this is not possible, reducing emissions from the waste water works,

- further measures planned to comply with the general principle of the basic obligations of the operator, i.e., that no significant pollution is caused;

- measures planned to monitor emissions into the environment.

SECTION. A NON-TECHNICAL SUMMARY .I 1 ’ I -= I *

Templemore Agglomeration consists of Templemore and its immediate surrounding areas. Templemore is a small North Tipperary town located in the East of the County of North Tipperary. Templemore is located at the upper reaches of the River Suir approximately 15 km north of Q Thurles along the N62.

Templemore has primarily a residential catchment with an estimated current population of 2,255 persons in the census of 2006. The main expansion of Templemore Agglomeration has occurred along the main routes to the town centre. There are still large areas of land available for development. The main National Garda Training College is located at Templemore and is a significant contributor to the WWTP. There are also 5 schools in Templemore. There is no significant waste water contribwtion from agriculture or from tourism/leisure facilities as tourism is limited in the area.

The Agglomeration is approximately 194ha in size.

Templemore Agglomeration is served mainly by Templemore Town Council. Part of the Agglomeration is outside Templemore Town Council’s Boundary and is served by North Tipperary County Council.

North Tipperary County Council is the Water Services Authority for the Templemore Agglomeration.

Templemore Town Council is the Planning Authority for most of the Agglomeration, while North Tipperary County Council is the Planning Authority for the remainder.

The agglomeration has an existing combined gravity sewerage system with only one pumping station, which drains to a Waste Water Treatment Plant (WWTP) on the banks of the Suir at Kiltillane, Templemore, East of the railway station. The agglomeration historically has been served by a combined sewer network, but for the last decade new developments are required to separate storm waters from foul water. In addition it has been the policy of North Tipperary County Council Water Services section to use Sustainable Urban Drainage Systems (SUDS) to minimise the impact of storm flows for new developments.

The WWTP which was designed and constructed in the 1950s, is not producing a consistent final effluent of the required standard at present day loadings. As a result North Tipperary County Council has commissioned a Design Build Operate (DBO) Scheme for a new WWTP approximately 500metres from the existing WWTP. This new plant is currently at advanced stage of construction. The current Templemore WWTP was originally built in the 1950s on a Greenfield site and consists of traditional inlet works, Imhoff tanks and sludge drying beds, which are now being used as sludge storage tanks. No major upgrading work has been carried out since its construction in the 1950s. The Treatment Plant currently occupies an area of 0.64 hectares.

This plant is very outdated and hence is being replaced. The wastewater undergoes only primary treatment and due to the antiquated design has to be replaced completely to satisfy current legislation. Its current final effluent frequently does not satisfy the criteria of the Urban Waste Water Regulations. It currently has no phosphate removal facilities.

For some years now, new multiunit developments in Templemore Agglomeration have been required to provide interim waste water treatment ("package plants") prior to discharge to the public sewer.

Under Section 4 of the Planning and Development Act 1963, Local Authorities are exempt from the obligation to obtain planning permission for developments in their own functional areas. Under Part 8 of the 2001 Planning Regulations Local Authorities are required to publicly advertise and make available for public inspection proposals including treatment works and outfalls. As a result Templemore Town Council underwent a Part 8 process in January 2003 as both the existing and the then proposed wastewater

treatment plant are located in the Templemore Town Council jurisdiction. Notices were published in January 2003. No Submissions were received on foot of these notices and the Planning Officer had no objections to the proposal. The scheme was then approved by Templemore Town Council on Monday, 2Sth April 2003 at 8.00 pm.

The DBO contractor is Response Engineering, Westlink Business Park, Mallow Road, Cork. The DBO contract will last 20 years. This new plant is expected to be built by Mid 2009. This will replace the existing WWTP, which will be decommissioned. The new plant is expected to cost €4m. 75% of the funding is coming from the Department of the Environment, Heritage and Local Government (DEHLG), with 25% coming from the Local Authorities. The running costs will be met by the Local Authority. The new plant which is currently under construction is located on a green field site approximately 250m from Station Road to the South of Templemore. The Site is approximately 2.33 hectares in area. The Site is relatively close to the town with a residence located approximately 150m to the west. The area immediately adjacent to the site is used as grazing area for cattle production. The new WWTP will discharge its effluent to the River Suir at the same discharge point as the current plant. The new plant will operate in compliance with the Urban Waste Water Regulations.

The agglomeration has 2 No. Combined Sewer Overflows. One exists at Regents Bridge, Church Avenue which discharges to the Mall River, which is a tributary river to the River Suir. This river confluences with the Suir downstream of Templemore WWTP. A Stormwater overflow also exists at the current WWTP. This discharges to the River Suir via the primary discharge point. The quantity of wastewater which is discharged from these overflows is difficult to quantify. These overflows only operate in stormwater conditions. The overflow at the current plant will no longer exist when the new plant is commissioned. The new plant will have a new potential storm water overflow point from the storm water tank after the preliminary treatment works. This storm water overflow will be metered if it occurs. Neither the River Mall nor the River Suir are designated Sensitive or Salmonid Rivers. The Agglomeration has one pwmping station which is located at Manna South which is adjacent to and serves the Ma Teine Housing Estate. This is currently in private ownership. It has no emergency overflows discharges to waters (all emergency flows enter a storm tank and are returned to the pumping station after the storm event) and it is operating at significant undercapacity at present. The sludge is used as agricultural fertiliser via environmental friendly soil injection into tillage land in the general region around Templemore, fully in accordance with the relevant regulations. Detailed traceability is fully recorded in accordance with the relevant regulations. The new plant will produce cake sludge with a minimum dry solids content of 20%. This sludge will be disposed off-site. The DBO contractor will be obliged to dispose of the cake sludge in an environmentally friendly manner. A sludge register will be maintained.

relevant legislation in force in Ireland. It is expected this will be disposed of to a Licensed Landfill.

The current WWTP is manned on a part-time basis by a caretaker. An Executive Engineer also devotes some time to it. There is presently no full time staff at the WWTP.

The maintenance of the sewer network is carried out by Local authority Staff and by network contractors where necessary.

There is no drinking water abstraction from the River Suir in the vicinity of Tem ple more.

The new WWTP is currently at advanced stage of construction and includes:

There are currently no licensed discharges into the Templemore Agglomeration (Section 16 Water Pollution Act).

There is currently no importation of wastewater or sludge from any external source into the Templemore Agglomeration nor is it envisaged that there will be.

The new plant will have a larger working staff than at present. It will have a dedicated Plant Manager and other staff. The normal working hours will be 08.00 - 20.00 Monday to Friday and 8.00 - 14.00 on Saturday. Work outside these hours will not be undertaken unless it is an emergency or other breakdown. Plant operatives will be on-call in case of plant breakdowns. The plant will be operated on a 24hr basis and provide a high level of automation and monitoring of all key process components by state of the art SCADA and telemetry systems. During the night hours and at weekends the telemetry and SCADA system shall trigger immediate call- up of operational personnel in the event of equipment malfunction outside of normal working hours. The system will also have a web-based access to allow North Tipperary County Council's Water Services personnel to remotely view data generated by the system.

A PMS (Performance Management System) will closely monitor the performance of the DBO Contractor in its management of the new facility.

The SCADA system will be located in the Administration Building Control Room. The most modern wastewater plants have a SCADA system. This is very useful and is capable of the following functions.

Display, log and store all instrumentation readings and status of plant and equipment. Display and log all alarms. This system will also send out alarms via the mobile phone network to plant operatives.

The effluent from the new plant will be piped to the existing primary discharge point via a new 750mm pipe, the invert of which will allow the effluent to discharge under gravity even when the River Suir is in flood.

When the new plant is operating and the wastewater flow exceeds the hydraulic capacity of the Wastewater treatment plant the excess flow shall be diverted automatically, via an overflow weir, to a storm water holding tank. The overflow weir is located downstream of the preliminary treatment facilities. The maximum wastewater flow at the inlet to the works is 1,976m3/hr. the Stormwater Holding Tank will have a capacity of 700m3. If the Stormwater Holding Tank fills to capacity it is equipped with a stormwater overflow. This combines with the final effluent and discharges to the River Suir via the Primary Discharge Point.

Q

When the incoming wastewater flow drops below the capacity of the Wastewater Treatment Plant, the collected storm water shall be automatically pumped back to the plant.

The storm water holding tank is designed to ensure that the operation of the stormwater treatment system and the return of the storm tank contents does not cause odour nuisance. Automatic washing facilities and mixing to prevent sludge settlement shall be provided in order to ensure that, after tanks are drained, all exposed surfaces are cleaned and that no residual sludge remains in the tank. A scum baffle will be installed at the overflow from the storm tank.

This data will be digitally stored for long periods and can be printed out or stored in the new PMS (Performance Management System) developed by the Water Services National Training Group which is due to be rolled out in the coming years. All the monitoring points with have suitable safe access for the collection and taking of samples. All staff will hold the Safe Pass Certificate. The most important sampling points have flow proportional sampling with refrigeration capacity for extra accuracy and integrity of samples. Under the DBO Contract, samples taken for compliance testing are split, one half of which are refrigerated in the administration building for a period of 3 months in case of dispute or non-compliance.

The analysis of samples taken at the works by the DBO Contractor shall be carried out in accordance with the most up to date edition of "Standard Methods for the Examination of Water and Wastewater'' produced by the American Public Health Association(APHA); the American Water Works Association(AWWA) and the Water Environment Federation(WEF). The DBO Contractor will also abide by the requirements of the 1994 and 2001 regulations with respect to analytical methodology.

For compliance purposes with the 1994 and 2001 Urban Wastewater Treatment Directive Regulations, the DBO Contractor will take a minimum of one sample per week of the final effluent. These samples will be analysed by an independent accredited laboratory approved by North Tipperary County Council. North Tipperary County Council's Water Laboratory may also take additional samples if it wishes.

All chemicals will be stored in bunded chemical storage.

The new plant will have a standby diesel generator to ensure that any breakdown of the main power supply will not affect the smooth operation of the Treatment Plant at any time. It may also be used during periods of maximum demand to win a better electricity tariff from the ESB or any other electricity supplier.

The new plant will also have telephone, fax and e-mail facilities.

The new plant will have within 6 months of commission, an Environmental Management System (EMS) in operation. This EMS will be fully compatible and compliant with the requirements of PMS. This will help the WWTP's operations become more environmentally friendly.

The new plant will have a 2.4m high plastic coated palisade fence erected along the entire perimeter of the site for security purposes. This fence is designed to prevent and discourage climbing and unauthorised

entry. The Entrance will have heavy duty construction gates together with a remote control and swipe card system.

Noise and odour nuisance from the new plant is expected to be minimal as various mitigation measures to minimise nuisance are being undertaken as part of the DBQ contract.

The Agglomeration has one pumping station at Manna South, Templemore also called the Ma Teine Pumping station, built in 2006. This is currently used by a private housing developer (DB Homes Ltd.) to serve the Ma Teine Housing development and future development on adjoining lands. It is currently owned and run by DB Homes Ltd. It is envisaged that in time it will ultimately be taken in charge by the local authority . The pumping station, as constructed, is fitted with two pumps (one duty, one standby) each with a design flow rate of 35m3/hr. The capacity of the pumping station can be increased by installing larger pumps when the need arises. Emergency 24 Hour Storage is provided in the form of 2 No. 36m3 precast concrete tanks. The pumping station is currently operating at a minority percentage of its potential capacity. Electrical switchgear is provided in the storehouse adjacent to the control panel to allow for the connection of a standby generator. A visible alarm (beacon) is fitted to the exterior of the storehouse to alert a pump/power failure. A Gardtee Speech Dialler is installed in the control panel, which can be programmed to provide an automatic dial out to maintenance personnel once the telephone line is installed. It has no emergency overflow facility to surface or ground waters.

The new plant is expected to cost €4m. Priority work also includes a service land initiative of foul and stormwater sewers at Kiltillane, Templemore to facilitate Housing Development. This is expected to cost CO.806M. This proposal has been approved by the DEHLG and a design has been prepared. Funding is expected to be split with 40% coming from DEHLG funds and 60% coming from Local Authority/Developer funds.

Attachment B.10 should contain the most recent development programme, including a copy of any approved funding for the project and a timeframe for the completion of the necessary works to take place.

It is currently owned and run by DB Homes Ltd. It is envisaged that in time it will ultimately be taken in charge by the local authority. The pumping station, as constructed, is fitted with two pumps (one duty, one standby) each with a design flow rate of 35m3/hr. The capacity of the pumping station can be increased by installing larger pumps when the need arises.

C . l Operational Information Requirements Provide a description of the plant, process and design capacity for the areas of the waste water works where discharges occur, to include a copy of such plans, drawings or maps, (site plans and location maps, process flow diagrams), and such other particulars, reports and supporting documentation as are necessary to describe all aspects of the area of the waste water works discharging to the aquatic environment. C. 1.1 Storm Water Overflows

For each storm water overflow within the waste water works the following information shall be submitted:

0 An assessment to determine compliance with the criteria for storm water overflows, as set out in the DoEHLG 'Procedures and Criteria in Relation to Storm Water Overflows', 1995 and any other guidance as may be specified by the Agency, and Identify whether any of the storm water overflows are to be decommissioned, and identify a date by which these overflows will cease, if applicable.

It is expected that the overflow at Regents Bridge, Church Avenue will be assessed in the coming years. The present SWO at the current WWTP's inlet works will be decommissioned once the current plant is decommissioned in Mid 2009.

Emergency 24 Hour Storage is provided in the form of 2 No. 36m3 precast concrete tanks. The pumping station is currently operating at a minority percentage of its potential capacity. Electrical switchgear is provided in the storehouse adjacent to the control panel to allow for the connection of a standby generator. A visible alarm (beacon) is fitted to the exterior of the storehouse to alert a pump/power failure. A Gardtee Speech Dialler is installed in the control panel, which can be programmed to provide an automatic dial out to maintenance personnel once the telephone line is installed. At present it has no emergency overflow to ground or surface waters.

The Primary Discharge Pipe is an open concrete pipe of diameter 525mm and has no flap valve at its discharge point to The River Suir. The Stormwater Overflow at Church Avenue has a concrete outfall structure of diameter 800mm with a flap valve at its discharge point to The Mall River. The potential storm water overflow at the new WWTP will have a flap valve at its discharge point to The River Suir.

Attachment C.2 should contain any supporting documentation on the design and construction of any and all discharge outfalls, including stormwater overflows, from the waste water works.

Monitoring of the characteristics of the storm water overflow emissions has not been done, but it is expected that they would not differ from the Primary Discharge Point emissions in any significant way.

E. l Waste Water Discharge Frequency and Quantities - Existing 8t Proposed

Provide an estimation of the quantity of waste water likely to be emitted in relation to all primary and secondary discharge points applied for. This information should be included in Table E. l ( i ) of the Annex. The primary discharge shall be annotated with a (P).

New flow meters are being installed as part of the new WWTP. An estimation of 1,623m3/day of inflow has been made recently. The new plant is designed for 6000p.e. with a hydraulic capacity of 3 times the dry weather flow. Using an estimate of 230 Litres of water per person per day, this amounts to 4,140m3 per day hydraulic capacity. This means that the new plant will have plenty of capacity for future development.

Provide an estimation of the quantity of waste water likely to be emitted in relation to all storm water overflows within the agglomeration applied for. This information should be included in Table E.l( i i ) of the Annex.

At present North Tipperary County Council has no clear estimation of the quantity of waste water likely to be emitted in relation to all storm water overflows within the Templemore agglomeration. There are no flowmeters on the Regents Bridge Overflow. The new plant will however have a larger hydraulic capacity and a better inlet screen than the existing plant and will eliminate that particular overflow at the inlet works. The current inlet screen is manually raked once a day, rather than an automatically raked screen and so can be easily blocked which can prevents inflow into the plant and instead it floods into the storm water overflow)

Indicate if composite sampling or continuous flow monitoring is in place on t h e primary or any other discharge points. Detail any plans and timescales for the provision of composite sampling and continuous flow meters.

Continuous flow monitoring is not in place on the primary or any other discharge points in the Templemore Agglomeration. However when the new Templemore Plant is in operation in Mid 2009, there will be flow composite sampling coupled with refrigeration facilities and continuous flow monitoring on both the influent and effluent streams. Currently a portable composite sampler is used by North Tipperary County Council's Central Water Laboratory, Coolbawn, Nenagh, Co. Tipperary to take influent and effluent wastewater samples. It has no refrigeration capacity.

This laboratory determines if the Templemore wastewater Treatment Plant final effluent is complying with the Urban Waste water Treatment Regulations. Results of said sampling are available to Water Services

staff through the €PA approved LabInfo Database Software System provided by the Local Government Computer Services Board. In the future this information will be available on the PMS Database Software System. This data will ultimately be available to the public and other stakeholders via an internet website. When any effluent samples fail any Urban Waste Water Treatment Regulations criteria, the Engineer and Caretaker responsible for the plant are notified normally by telephone and/or e-mail. An investigation into the non-conformance will take place and corrective action taken if needed.

E.2. Monitoring and Sampling Points

Programmes for environmental monitoring should be submitted as part of the application. These programmes should be provided as Attachment E.2.

All the larger wastewater plants (>lo00 P.E.) in North Tipperary including Templemore WWTP are monitored on a monthly basis. Influent, effluent, upstream and downstream samples are taken.

See the Annual Waste Water Monitoring Plan in Attachment E.2

Reference should be made to, provision of sampling points and safe means of access, sampling methods, analytical and quality control procedures, including equipment calibration, equipment maintenance and data recording/reporting procedures to be carried out in order to ensure accurate and reliable monitoring.

Four sampling points currently exist within the Templemore Agglomeration. They are:

The upstream and downstream sample points are located along The Bank of the River Suir. These sample points are safe, with easy ease of access. These are grab sampling points only and a telescopic grab sampler is used to collect samples. Portable composite samplers are not used for upstream & downstream sample points as the area is quite rural and there is a risk of vandalism and/or theft or damage by wild animals or domestic livestock. The influent and effluent points are located in the plant and are safe with easy ease of access. These sampling points are part of North Tipperary County Council's Annual Wastewater Monitoring Plan.

Due to their irregular nature, there have been no samples taken from the Regents Bridge SWO, but it is expected to be the same characteristics as the WWTP influent. The SWO at the WWTP has not been sampled, but it is expected to be the same characteristics as the WWTP influent All sampling staff and the WWTP plant staff hold the Safe Pass Certificate.

In determining the sampling programme to be carried out, the variability of the emission and its effect on the receiving environment should be considered.

Presently samples at Templemore Wastewater Plant are routinely taken once a month. Samples are taken more often if plant staff require it, if there is an issue with plant effluent quality or for research purposes. E.4 Sampling Data Regulation 16( l)(h) of the Waste Water Discharge (Authorisation) Regulations 2007 requires all applicants in the case of an existing waste water treatment plant to specify the sampling data pertaining to the discharge based on the samples taken in the 12 months preceding the making of the application.

North Tipperary County Council's Water Laboratory monitors, takes and analyses samples from Templemore WWTP as part of this Annual Wastewater Sampling Plan. It records all of the aforementioned analyses on Database Software Programme called "LabInfo". An Excel Spreadsheet for Templemore Upstream (aSWlu), Downstream (aSWld), Influent (SW2 +SW3) and Effluent (SWl) has been extracted from LabInfo and is included in Attachment E.4.

The routine sampling of the above sampling points usually analyses and records for the following parameters:

Detailed information is required to enable the Agency to assess the existing receiving environment. This section requires the provision of information on the ambient environmental conditions within the receiving water(s) upstream and downstream of any discharge(s).

Where development is proposed to be carried out, being development which is of a class for the time being specified under Article 24 (First Schedule) of the Environmental Impact Assessment Regulations, the information on the state of the existing environment should be addressed in the EIS. In such cases, it will suffice for the purposes of this section to provide adequate cross- references to the relevant sections in the EIS.

When Templemore WWTP was built in the 1950s, EIS regulations did not exist. For the new WWTP currently under construction an EIS was not required. Therefore no cross reference will be made to any relevant EIS.

F.l. Assessment of Impact on Receiving Surface or Ground Water

o Give summary details and an assessment of the impacts of any existing or proposed emissions on the environment, including environmental media other than those into which the emissions are to be made.

The existing WWTP does not include phosphate reduction facilities. However, these facilities are under construction as part of the new WWTP. Templemore Agglomeration does not discharge to groundwater. Noise and odour emissions are regarded as being very minor. Mitigation measures to reduce odour and noise are part of the design of the new WWTP.

Templemore Agglomeration does not impinge on any bathing areas on the Mall River or River Suir as neither river has any designated bathing, marina, slipway or pier facilities on its course through North Tipperary. Some angling takes place on the River Suir, but it is not suitable for most types of pleasurecraft.

In 2006, A Report was commissioned on the River Water Quality in the Suir Catchment, 2006 by the County Councils of Kilkenny, Waterford, North and South Tipperary County Council and by Waterford City Council. This report was carried out by the EPA Regional Water Laboratory, Kilkenny and was published in June! 2007.

The main findings of this report in relation to the impact that Templemore Agglomeration has on the River Suir is as follows:

0 The Suir continues to be seriously polluted downstream of Templemore WWTP. Issues include high ammonia, phosphate and nitrite along with low D.O. levels especially in summer.

This report is one of many that have been published in relation to water quality of the River Suir and of North Tipperary's various rivers over the recent past. An annual report is published by North Tipperary County Council on River Water Quality in North Tipperary. The most recent was published in April 2008, containing 2007 results. Biological ratings of North Tipperary's rivers in conducted once every 3 years. The most recent survey took place in 2005. The biological rating for the Suir, is the EPA approved Q-Rating scheme. This quality standards for rivers ranges from 1-5, with 5 being pristine unpolluted river and 1 being grossly polluted river.(Ql is badly polluted, Q5 pristine waters, etc) Penane Bridge was 43, whereas the upstream Knocknageragh Bridge monitoring point had a higher rating of 43-4. This suggests that Templemore Agglomeration may have an adverse effect on the River Suir. At Knocknageragh Bridge the water quality could be described as slightly polluted, while at Penane Bridge the water quality could be described as moderately polluted. The provision of the new WWTP should result in a substantial improvement in this regard.

The Local Government (Water Pollution) Act, 1977, (Water Quality Standards for Phosphorus) Regulations, 1988, Third Schedule Part 1 identifies the quality standards for rivers, and their target ratings as outlined in the Table No.4 below:

Using the above Table, for Templemore Agglomeration, the minimum target rating to be achieved for Penane Bridge is 43-4. It is expected that the new WWTP will achieve this goal in the medium term, due to reduced ammonia and BOD levels in the fina! effluent and phosphate removal facilities. It is also hoped that the River Suir at Templemore would reach the standards for Salmonid Waters. Assimilative capacity is available in terms of BOD, Ammonia and phosphate but relatively limited to achieve Q status of 43-4. However it is hoped that the upstream water quality of the Suir may improve in the medium term due to changes in agricultural activities and lead to more assimilative capacity. This appears to be taking place due to

0 changes in agricultural subsidies (decoupling) leading to less intensive livestock rates on land.

0 less use of artificial fertiliser containing phosphates and nitrogen compounds due to high prices.

0 additional slurry capacity in farmyards due to lower stock numbers and farm waste management grants for new agricultural sheds and slurry storage units.

0 Increased number of farmers in REPS, which encourages environmentally friendly farming and the need for Nutrient Management Plans.

0 Increased cross-compliance checks by the Department of Agriculture and Food.

Flow data and assimilative caDacitv of the River Suir

The Suir rises in the Devil's Bit Mountain to the North of Templemore and flows through Templemore, Thurles and Holycross. The River north of Thurles is a relatively small river. As part of the PR (preliminary report for the new plant at Templemore) RPS carried out a study into the assimilative capacity of the river Suir at Templemore. Here are some of the information gathered and RPS conclusions.

The dry weather flow in the River Suir at Templemore is less than 0.05m3/sec. (Knocknageragh Bridge) The Meanflow/ Long Term Runoff is l.63m3/sec. (Knocknageragh Bridge) The average annual flow in the river is 1.74m3/s. (Knocknageragh Bridge) The 95 percentile flow is 0. 13m3/sec. (Knocknageragh Bridge)

Knocknagerragh Bridge (Grid Reference N213100 E172518) is located approximately 1.7km upstream of the existing outfall point from Templemore WWTP. Penane Bridge (Grid Reference N212426 E169259) is located approximately 1.75km downstream of the existing outfall point from Templemore WWTP.

As part of the regulations enforcing certain aspects of the Dangerous Substances Directive, the Local Authorities of the Southeast Region (including North Tipperary County Council) commissioned the EPA Regional Water Laboratory, Kilkenny to undertake a programme of sampling and analysis of surface waters at 22 locations in the region. This included the River Suir. This report was published in November 2004. The samples were analysed for a range of parameters (volatile organic compounds, heavy metals, etc) that included many of the substances required under the Dangerous Substances Regulations. Atrazine, simazine, tributyltin and cyanide were not analysed. Two stations on the River Suir were sampled, one downstream of Thurles, the other downstream of Clonmel at twomilebridge. In both cases no substance was present in any environmentally significant concentration in the River Suir.

o Tables F.l(i)(a) & (b) should be completed for the primary discharge point. Surface water monitoring locations upstream and downstream of the discharge point shall be screened for those substances listed in Tables F.l(i)(a) & (b). Monitoring of surface water shall be carried out a t not less than two points, one upstream from the discharge location and one downstream.

Currently one upstream monitoring point and one downstream monitoring point of the discharge point are used by North Tipperary County Council.

o For discharges from secondary discharge points Tables F.l(ii)(a) & (b) should be completed. Furthermore, provide summary details and an assessment of the impacts of any existing or proposed emissions on the surface water or ground (aquifers, soils, sub-soils and rock

environment), including any impact on environmental media ,other than those into which the emissions are t o be made.

Templemore has no secondary discharge points.

o Provide details of the extent and type of ground emissions at the works. For larger discharges to groundwaters, e.g., from Integrated Constructed Wetlands, large scale percolation areas, etc., a comprehensive report must be completed which should include, inter alia, topography, meteorological data, water quality, geology, hydrology, and hydrogeology. The latter must in particular present the aquifer classification and vulnerability. The Geological Survey of Ireland Groundwater Protection Scheme Dept of the Environment and Local Government, Geological Survey of Ireland, EPA (1999) methodology should be used for any such classification. This report should also identify all surface water bodies and water wells that may be at risk as a result of the ground discharge.

Templemore Agglomeration does not have any groundwater discharges, its discharges only to surface water i.e. the River Suir and the Mall River.

o Describe the existing environment in terms of water quality with particular reference to environmental quality standards or other legislative standards. Submit a copy of the most recent water quality management plan or catchment management plan in place for the receiving water body. Give details of any designation under any Council Directive or Regulations that apply in relation to the receiving water.

The River Suir at Templemore is not designated as a Sensitive or Salmonid river. The Mall River is not designated as a Sensitive or Salmonid river.

o Provide a statement as to whether or not emissions of main polluting substances (as defined in the Dangerous Substances Regulations S.I. No. 12 of 2001) to water are likely to impair the environment.

The main polluting substances from Templemore Waste Water Treatment Plant are the normal urban wastewater parameters of Ammonia, nitrates, phosphates, suspended solids, Biological Oxygen Demand and Chemical Oxygen Demand that one would expect from a residential town like Templemore which has no heavy or chemical industries. Test results from samples taken at the primary discharge point have shown no significant levels of Dangerous Substances as defined in the Regulations.

o I n circumstances where water abstraction points exist downstream of any discharge describe measures to be undertaken to ensure that discharges from the waste water works will not have a significant effect on faecal coliform, salmonella and protozoan pathogen numbers, e.g., Cryptosporidium and Giardia, in the receiving water environment.

Templemore discharges to the River Suir which ultimately flows into Waterford Harbour. North Tipperary County Council, South Tipperary County Council and Waterford County Council do not abstract water from the Suir for the

purposes of drinking water. No group water scheme abstracts water from the River Suir. It is extremely unlikely that Templemore Agglomeration has or will have a significant effect on faecal coliform, salmonella or cryptosporidium in the receiving water environment due to the dilution factors of The River Suir. At present Templemore WWTP or the new WWTP under construction does not facilities such as chlorination or membrane filtration of the final effluent to reduce or kill coliforms, salmonella or protozoan pathogens. However the increased performance of the new plant is likely to reduce the number of pathogenic microorganisms entering the receiving water environment.

o Indicate whether or not emissions from the agglomeration or any plant, methods, processes, operating procedures or other factors which affect such emissions are likely to have a significant effect on -

(a) a site (until the adoption, in respect of the site, of a decision by the European Commission under Article 21 of Council Directive 92/43/EEC for the purposes of the third paragraph of Article 4(2) of that Directive) -

(i) notified for the purposes of Regulation 4 of the Natural Habitats Regulations, subject to any amendments made to it by virtue of Regulation 5 of those Regulations,

(ii) details of which have been transmitted to the Commission in accordance with Regulation 5(4) of the Natural Habitats Regulations, or

(iii) added by virtue of Regulation 6 of the Natural Habitats Regulations to the list transmitted to the Commission in accordance with Regulation 5(4) of those Regulations,

(b) a site adopted by the European Commission as a site of Community importance for the purposes of Article 4(2) of Council Directive 92/43/EEC1 in accordance with the procedures laid down in Article 21 of that Directive,

The river quality of the Suir improves before Thurles Town (downstream of Templemore) as the River Suir ecosystem assimilates the constituents of the discharges from Templemore Agglomeration. Templemore Agglomeration is located near the source of the Suir and is the first major point contributor of phosphates and organic loading to the river. The new plant through better wastewater treatment and ferric salt dosing to precipitate phosphate compounds will help minimise organic loading and phosphate loading into the River Suir. This will have a beneficial knock on effect on the entire River Suir as it will result in improved water along its river course which flows through 3 counties before discharging into the sea at Waterford Harbour.

North Tipperary County Council intends to operate the Templemore Agglomeration in a way so that it does not contravene the above EU Directives. North Tipperary County Council is aware that its current plant is insufficient for the purposes of the Urban Waste Water Treatment Directive 91/271/EEC. To rectify this issue a new plant is under construction and is hoped to be commissioned by mid to late 2009.

North Tipperary County Council's Capital Investment Programme has made a priority of the scheme and a sum of €4.OM has been made available for this project. This new plant may cater for population expansion in Templemore for the next 20 years. In this way Templemore WWTP will not be overloaded in the medium to long term. Funding of this project is expected to split between the Local Authority and the DEHLG at 25% and 75% respectively. The running costs of the plant will be borne by Local Authority.

6.2 Compliance with Water Quality Standards for Phosphorus Regulations (S.I. No. 258 of 1998).

Provide details on a programme of improvements, including any water quality management plans or catchment management plans in place, to ensure that improvements of water quality required under the Water Quality Standards for Phosphorous Regulations (S.I. No. 258 of 1998) are being achieved. Provide details of any specific measures adopted for waste water works specified in Phosphorus Measures Implementation reports and the progress to date of those measures. Provide details highlighting any waste water works that have been identified as the principal sources of pollution under the P regulations.

Under the Phosphorus Fourth implementation Report 2006 produced by North Tipperary County Council - Under Measure 1, North Tipperary County Council has undertaken Phosphate Removal in the new Templemore Plant. Another recommendation was that all new or upgraded plants would have the appropriate composite samplers and flowmeters. This has been taken into account in the new plant and appropriate samplers will be in operation.

Under Measure 4 - Catchment Manasement GrowPs.

North Tipperary County Council is currently involved on the operational Management committee of the Shannon River Basin District and the South Eastern River Basin District. These two catchments cover the entire county. The establishment of local river management/stakeholder teams for each river in the Agricultural Bye-law area is under consideration. The success of achieving good water quality in the Agricultural Bye-law area of North Tipperary relies on close co-operation and coherent action at local level.

Future plans/new directions under Measure 4:

1. The council will continue to work closely with other authorities and RBD management committees to achieve good water quality.

2. The recommendations of the catchment projects in regard to all municipal, agricultural and industrial discharges will be implemented in accordance with the final report received.

3. A rationalisation of river monitoring stations is to be carried out.

Under Measure 7 - Environmental Awareness.

North Tipperary County Council appointed an Environmental Awareness Officer in May 2000. The Environment awareness officer informs and advises the public and local authority staff on issues relating to protection of the Environment including water quality and promoting the use of phosphate-free detergent.

The Councils Environment Section prepares a quarterly report for presentation to the Council. The Council's Planning Environment and Corporate Affairs SPC considers current environmental issues at its meetings.

Future Dlans/new directions under Measure 7::

North Tipperary County Council will fully cooperate with the publicity campaigns of the River Basin District Management Systems. The Environmental Awareness Officer will also actively promote water quality as part of the education programmes for schools. North Tipperary County Council will continue to sponsor water quality awareness projects through the Environmental Partnership Fund, and also continue assisting with REPS courses for farmers.

The current treatment plant has no chemical phosphate removal facilities and the biological removal of phosphates is quits poor. This situation has led to high levels of phosphate in the River Suir. As a result a new plant is being built under a 20 year DBO contract which will have a dramatic reduction in phosphate levels due to chemical and biological removal of phosphates from the final effluent.

The Suir is not a designated Salmonid River under the EU Freshwater Fish Directive.

For many years North Tipperary County Council has commissioned the EPA Regional Water Laboratory in Kilkenny to carry out physio-chemical monitoring of North Tipperary's rivers including The River Suir. The sampling programme is designed so that stations such as the River Suir are sampled on a monthly basis and tributaries or smaller rivers are sampled 6 times per annum.

Biological monitoring is carried out on the River Suir as part of the EPA National River Monitoring Programme on a 3-yearly cycle.

Templemore Agglomeration discharges to the Suir. The Suir and its tributaries are part of the South Eastern River Basin District (SERBD). The SERBD has established a management structure with the objective of achieving "Good Status" for waters in the catchment by 2015. North Tipperary County Council is an active participant in the Suir Working Group. The SERBD is based in Carlow and have a laboratory in Kilkenny.

A new Plant with a 6,000 P.E. is currently being built via a 20 year DBO contract. This is expected to be completed by Mid-2009. This plant will have Phosphorus removal, preliminary treatment, primary treatment and secondary treatment. There will be a storm water holding tank to help prevent excess preliminary treated water entering the River Suir. The sewer network has been recently improved. Work such as Closed Circuit Television Vision (CCTV) surveys of the sewers is ongoing. CCTV surveys will assess the integrity of the new sewers and the integrity of older sewers so ascertain if they need to be replaced in the near future. This work is due to begin in the short term.

Attachment 6.3 should contain the most recent programme of improvements, including a copy of any approved funding for the project and a timeframe for the completion of the necessary works to take place.

6.4 Storm Water Overflow Provide details on a programme of improvements to ensure that discharges other than the primary and secondary discharges comply with the definition of 'storm water overflow' as per Regulation 3 of the Waste Water Discharge (Authorisation) Regulations, 2007.

The Templemore Agglomeration has quite a high watertable due to the low-lying nature of the area and as a result groundwater infiltration to the sewers is to be expected.

It is the goal of North Tipperary County Council to eliminate all storm water overflows in the medium to long term. North Tipperary County Council requires developers to separate foul and storm waters and is enforcing the requirements of sustainable urban drainage design to control storm water discharges for many years.

North Tipperary County Council are currently implementing a major investment programme, approved by the Department of the Environment, Heritage and Local Government and co-financed under the EU Cohesion Fund and the National Development Plan, which will upgrade the sewer networks and Wastewater Treatment plants in the main population centres and smaller towns of North Tipperary, including Templemore Agglomeration.
