with a clear plan of action• A determination of a violation must be made within

a 30 day timeline• A report to PPS must be submitted, with all

supporting evidence, within 30 days of the day the district became aware of the violation.

• Reports to PPS are made only on certified educators

Employment vs. Certification

Employer must determine employment actionBurden of proof = preponderance of evidence

Department determines if disciplinary action against a certificate should be pursued

Burden of proof = clear and convincing

Education Practices Commission (EPC) issues disciplinary actions against a certificate

Page 76: Www.FLDOE.org © 2015, Florida Department of Education. All Rights Reserved. K-12 Student Assessment Administration 1

www.FLDOE.org

Final Orders of the EPC• May… • Result in revocation or suspension of a

certificate

• Require restriction of scope of practice so the educator can not administer or proctor exams

• Issue other penalties including probation, coursework, fines and fees

Page 77: Www.FLDOE.org © 2015, Florida Department of Education. All Rights Reserved. K-12 Student Assessment Administration 1

Consider the Impact of Testing Violations• Substantiated

violations often result in serious discipline against an educator’s certificate

• Educators may lose their employment due to the violation

• Children are negatively impacted when violations occur

• Employers must make very clear the expectations of professional and academic integrity

• Respond quickly and effectively to potential violations

• Ensure assessment protocols are upheld

Special Programs• If possible, schedule special program students during the

regular window instead of the make-up window.• Please remember not to schedule special program

students on the last day of a testing window for two-session assessments because they will not have the opportunity to complete Session 2 or 3 of the test.

• Special program students should be aware of any additional school policies that may impact their ability to test at that school. If a student is not able to meet these policies (e.g., students required to wear a uniform), the district should try to identify a different testing location.
