    As a condition to, and in consideration for the undersigned trainer (“Trainer”) being permitted to race, work, or train any horse at Turfway Park, the Trainer and the undersigned Trainer’s attending veterinarian (“Attending Veterinarian”) hereby agree to be bound by the following Conditions:

    1. At all times, a horse must be in serviceable, sound racing condition in order to race, work or train at Turfway Park. The Trainer acknowledges that it is his/her obligation to confirm the horse is in serviceable, sound racing condition in order to race, work or train Turfway Park Grounds.

    2. Trainer will not enter a horse in any race at Turfway Park UNLESS the horse has: (a) been examined by Trainer’s Attending Veterinarian during the three (3) days immediately preceding the entry to race for the express purpose of evaluating the horse’s fitness to race; and (b) been found fit to race by the Attending Veterinarian. This evaluation shall include, at a minimum, watching the horse jog. The Attending Veterinarian and Trainer are obligated to inform the CDI Equine Medical Director and the Kentucky Horse Racing Commission (“KHRC”) official veterinarian (or his or her designee) of any changes in the horse’s fitness after entry through race day. Extenuating Circumstances to the examination requirement of this rule will be handled by the Racing Office in conjunction with the CDI Equine Medical Director on a case-by-case basis.

    3. Trainer will not permit a horse stabled at Turfway Park to work UNLESS the horse has: (a) been examined by the Trainer’s Attending Veterinarian during the five (5) days immediately preceding the work for the express purpose of evaluating the horse’s fitness to work; and (b) been found fit to work by the Attending Veterinarian (this evaluation shall include, at a minimum, watching the horse jog). The Attending Veterinarian and Trainer are obligated to inform the CDI Equine Medical Director (or his or her designee) of any changes in the horse’s fitness after the examination set forth above and before the horse works.

    4. Trainer will not enter in any race at Turfway Park a horse that is an unstarted four year- old or older or any horse that has not raced within 365 days of its previous race UNLESS, in addition to the criteria set forth in Section 2, above, the horse has worked 5 furlongs in 1:03 or better for the CDI Equine Medical Director (or his or her designee) in the previous thirty (30) days. Horses that have not raced within 120 days but have raced within 365 days must have an examination performed by the CDI Equine Medical Director (or his or her designee) prior to entry. Based upon that examination, the CDI Equine Medical Director may require the horse to work prior to being allowed to enter. If the horse is required to work it must meet the same requirements as a horse that is working off of the KHRC’s Official Veterinarian’s list.

    5. Under no circumstances shall an examination conducted by a veterinarian who has NOT been identified as the Trainer’s Attending Veterinarian in compliance with these Conditions constitute a valid examination for purposes of determining a horse’s to fitness race, work or train.

    TURFWAY PARK RULES & CONDITIONS FOR RACING & TRAINING

    PLEASE NOTE: The following agreement must be read and signed by both the trainer and the attending veterinarian and the signature portion returned to the CDI medical director ([email protected]) before the trainer will be permitted to enter horses. See page 5.

    6. Turfway Park and the CDI Equine Medical Director are entitled (but not obligated) to contact, without prior notice, Trainer’s Attending Veterinarian to confirm that examinations have been conducted pursuant to these Conditions and that any such examination meets Turfway Park’s requirements. Turfway Park and the CDI Equine Medical Director shall have the right (but not the obligation) to examine and review all records of examinations performed in accordance with these Conditions.

    7. All horses entered to race at Turfway Park, or on Turfway Park grounds, are subject to: (a) veterinary inspections by the CDI Equine Medical Director, or his/her designee and (b) veterinary monitoring. Trainer and Trainer’s staff will cooperate fully with all requests made by CDI veterinarians and outriders.

    8. All horses at any Kentucky Training Facility are subject to (a) veterinary inspections by the staff or contractor of the Kentucky Training Facility and (b) veterinary monitoring. Trainer and Trainer’s staff will fully cooperate with all requests made by the Kentucky Training Facility, veterinarians and outriders. Both Trainer and Attending Veterinarian consent to sharing all information as a result of such inspections and monitoring with Turfway Park.

    9. As used herein, the term “Attending Veterinarian” shall include the undersigned veterinarian and any veterinarian who is a member of his/her veterinary practice.

    10. As used herein, the term “Kentucky Training Facility” shall mean a horse training center or facility in the Commonwealth that records official timed workouts for publication and that is affiliated with a racing association. Kentucky Training Facility shall include Turfway Park.

    11. If stabled on Turfway Park, both Trainer and the Attending Veterinarian will abide by all rules and regulations of Turfway Park, including, without limitation, House Rules (including those relating to TCO2 or “Milkshake” testing and all medication, Medical and integrity rules), or other rules (including, without limitation, all rules set forth in Turfway Park’s Condition Book, Turfway Park’s Stall Application, the Rules of the Barn Area, and the Rules of the Track), all of which are hereby expressly incorporated by reference herein. Trainer and Attending Veterinarian shall be responsible for obtaining and becoming familiar with such rules and regulations.

    12. Both Trainer and Attending Veterinarian will abide by all rules and regulations of the KHRC, at any time expressly incorporated by reference herein, and the rules and regulations of the KHRC, at any time adopted or as they may be amended (collectively, “KHRC Regulations”). Trainer and Attending Veterinarian shall be responsible for obtaining and becoming familiar with such rules and regulations.

    13. Any failure by Turfway Park to enforce any terms or conditions of this Agreement shall not constitute a waiver by Turfway Park, and shall not affect or impair this Agreement in any way, or the right of Turfway Park at any time to enforce this Agreement.

    Turfway Park’s approval or consent to any action proposed by Trainer or Attending Veterinarian shall not affect Trainer or Attending Veterinarian’s obligation to strictly comply with this Agreement.

    14. Both Trainer and the Attending Veterinarian understand and acknowledge that these Conditions shall be in effect from the earliest date noted below through the end of the 2021 Turfway Park Winter/Spring Meet, and for Trainers that have horse(s) on Turfway Park, these Conditions shall be in effect from earliest date noted below and for so long as Trainer has horse(s) on Turfway Park grounds.

    15. By signing below, Trainer acknowledges and agrees that Trainer (a) has read and fully understands the Conditions and agrees to be bound by them, (b) will consult with Trainer’s Attending Veterinarian and the CDI Equine Medical Director if Trainer has any questions regarding such Conditions, and (c) will fully comply with the Conditions.

    16. By signing below, the Attending Veterinarian acknowledges and agrees that he/she (a) is the Attending Veterinarian for the undersigned Trainer, (b) has read and fully understands the above Conditions and agrees to be bound by them, (b) will consult with the CDI Equine Medical Director if he/she has any questions regarding such Conditions, and (c) will comply fully with the Conditions.

    17. Any change in the party that will be acting as the Trainer’s Attending Veterinarian requires Trainer and the new Attending Veterinarian to submit a fully executed copy of these Conditions to Turfway Park’s Racing Office.

    EQUINE SAFETY INITIATIVESSeveral equine safety initiatives have been implemented for Turfway Park. Below are the changes and how they affect you.

    1. HORSEMEN-VETERINARIAN AGREEMENT: This must be signed and submitted to the Stable Office upon arrival. This document will cover the 2020 Holiday Meet and the 2021 Winter/Spring Meet. Please make sure you and your veterinarian sign prior to turning it in.

    2. MEDICATION-RESTRICTED RACES: Pursuant to KHRC regulation 810 KAR 8:010 all two (2) year-old races will be conducted Lasix-free. Please consult with your veterinarian, Churchill Downs Equine Medical Director (Dr. Farmer), or the KHRC if you have any questions regarding this regulation.

    3. PRE-ENTRY EXAM: Pursuant to KHRC regulation, all horses must have an exam performed by your veterinarian within the three (3) days preceding a race entry This exam is to be documented by your veterinarian and he/she will include their findings on their daily treatment records submitted to the KHRC

    4. PRE-WORK EXAM: All horses stabled at Turfway Park must have an exam performed by your veterinarian within the five (5) days preceding a timed workout, per Horsemen-Veterinarian Agreement. This exam is to be documented by your veterinarian and he/she will include their findings on their daily treatment records submitted to the KHRC

    5. IN-TODAY SIGNAGE: All horses entered to race must be clearly identified starting at 7:30am on race day with an “In-Today” sign. Trainers should hang these signs on the stall door or adjacent to the stall. This is separate from the KHRC Lasix tag hung following lasix administration. Extra signs are available in the Stable Office.

    6. ENTRY RESTRICTIONS: All first time starters 4yrs old and older or 3 years old and older with no race within 365 days are required to have an exam and published 5 furlong work in 103 or faster approved by the CD Equine Medical Director PRIOR to entry. In addition, horses that have not raced within 120 days but less than 365 days must notify the CD Equine Medical Director PRIOR to entry to schedule an exam.

    7. WAIVER CLAIMING RULE: Allows a trainer to enter a claiming race, but be ineligible to be claimed providing the horse has been laid off and has not started for a minimum of 180 days since its last race, and the horse is entered for a claiming price equal to or greater than the price at which it last started. Please see condition book for more details.

    The Jockey Club registry shall issue digital foal certificates for foals of 2018 and later. Digital certificates are stored on the Registry’s website at registry.jockeyclub.com. If you are planning on running at Turfway Park ask your owners to assign their 2-year-olds’ digital certificates to Turfway Park as the Certificate Manager. All digital foal papers will be treated the same as paper foal papers and must be on file by the first day of racing for a zero date. For horses 3-year-old and up, continue to deliver paper certificates to the Turfway Park Racing Office Attention Horse I.D. If you have questions about digital foal certificates, see the digital certificates FAQs at registry.jockeyclub.com or contact the Registry office via email at inquiries@ jockeyclub.com or by phone at (800) 444-8521.

    DIGITAL FOAL CERTIFICATES

    2020 DIGITAL TATTOO TRANSITIONOn January 1, 2020, Race Horse Identification transitioned from lip tattooing to utilizing the Digital Tattoo (Picture Horse ID), which is accessible through scanning of the Jockey Club-issued microchip that has been implanted in the horse’s neck by the breeder. The process will be as follows:

    • All foals of 2017 and forward must be microchipped before the Jockey Club will register the horse.

    • Foals of 2016 and older who are not tattooed and who currently do not have a microchip (by January 1, 2020) will need to contact the Jockey Club (800-444-8521) to obtain a microchip.

    • The Jockey Club issued microchip must be inserted into the horse and listed on the foal pa-pers before the horse is digitally tattooed prior to its first race.

    • Like the current tattoo system, TRPB Identifiers will come to your barn, scan the microchip to pull up the digital copy of the foal papers and verify the markings prior to you being allowed to race. Additionally, the TRPB Identifiers will take a series of photographs of your horse.

    • The TRPB identification fee will remain the same ($80) and must be paid when the horse is identified.

    PLEASE NOTE: If you have an older horse (2016 or older) that is not tattooed and does not have a Jockey Club-issued microchip inserted in the horse, please make arrangements prior to the end of the year to be either tattooed or microchipped. If not, your horse will not be able to be identified nor will it be allowed to race until a Jockey Club-issued microchip has been inserted and the horse has been identified by a TRPB Identifier.

    At the time of entry into a claiming race, the owner may opt to declare a horse ineligible to be claimed provided: (1) The horse has been laid off and has not started for a minimum of 180 days since its last race, and (2) The horse is entered for a claiming price equal to or greater than the price at which it last started. (b) Failure to declare the horse ineligible at the time of entry may not be remedied. (c) Ineligibility shall apply only to the first start following each such layoff. (d) Waiver claiming races shall be considered as a starter allowance, in regard to eligibility and weight allowances.

    OWNERSHIP

    The stewards may at any time require presentation of a horse’s registration certificate, virtual certificate, or racing permit or other proof of ownership.

    Upon claim, sale or any other transfer of ownership, the horse’s registration certificate or racing permit shall be given to the new owner and any virtual certificate shall be transferred to the new owner electronically. The new owner shall report the change in ownership to the stewards.

    SEX ALTERATION: SECTION 12

    Any alteration in the sex of a horse shall be reported by the horse’s trainer to the racing secretary and to the breed registry. The alteration shall be noted on the horse’s registration certificate, racing permit, virtual certificate, or entry in the electronic system.

    EQUIPMENT: RIDING CROP: SECTION 11

    (9)(a) Any riding crop shall be subject to inspection and approval by the stewards or the clerk of the scales to ensure conformity with the specifications of paragraphs (c) through (e) of this subsection.

    (b) Only riding crops meeting the specifications of this subsection, including the mandatory shock absorbing characteristics, may be used in thoroughbred racing and training.

    (c) A riding crop shall have a: 1. Maximum weight of eight (8) ounces; Legislative Research Commission PDF Version Page: 4 2. Maximum length, including flap, of thirty (30) inches; and 3. Minimum diameter of the shaft of three-eighths (3/8) inch.

    (d)1. The only additional feature that may be attached to the riding crop is a flap that shall have a: a. Maximum length from the end of the shaft of one-half (1/2) inch; and b. Maximum width of one and six-tenths (1.6) inches, with a minimum width of eight-tenths (0.8) inch; 2. The flap from the end of the shaft shall not contain any reinforcements or additions; 3. There shall not be binding within seven (7) inches of the end of the flap; 4. The contact area of the shaft shall be smooth, with no protrusion or raised surface, and covered by shock absorbing material throughout its circumference; and 5. The flap shall have similar shock absorbing characteristics to that of the contact area.

    (e) A riding crop shall not have: 1. Stingers or projections extending through the hole of a popper; and 2. Any metal parts.

    (11) Indiscriminate or brutal use on a horse of a riding crop or any other equipment, as determined by the stewards, at any time on the grounds of a licensed racing association or training center under the jurisdiction of the commission shall be prohibited.

    SAFETY EQUIPMENT: 810 KAR 2:070: SECTION 29

    SAFETY HELMET

    A person mounted on a horse or stable pony at a location under the jurisdiction of the commission shall wear a properly secured safety helmet at all times. If requested by a commission official, the person shall provide sufficient evidence that his helmet has a tag, stamp, or similar identifying marker indicating that it meets one of the following safety standards: (a) ASTM International Standard, ASTM F1163-04a; (b) British Standards, BS EN 1384:1997 or PAS 015:1999; or (c) Australian/New Zealand Standard, AS/NZS 3838:2006.

    SAFETY VEST

    A person mounted on a horse or stable pony on a location under the jurisdiction of the commission, assistant starters, and a person handling a horse in a starting gate shall wear a safety vest at all times. If requested by a commission official, the person shall provide sufficient evidence that his safety vest has a tag, stamp, or similar identifying marker indicating that it meets or exceeds one (1) of the following safety standards: (a) British Equestrian Trade Association (BETA):2000 Level 1; (b) Euro Norm (EN) 13158:2000 Level 1; (c) ASTM International Standard, ASTM F2681-08; (d) Shoe and Allied Trade Research Association (SATRA) Jockey Vest Document M6 Issue 3; or (e) Australian Racing Board (ARB) Standard 1.1998.

    ENTRIES, SUBSCRIPTIONS & DECLARATIONS: 810 KAR 4:030

    WORKOUT RULE: SECTION 3

    (8)(a) A horse that has not started in the past forty-five (45) days shall not be permitted to start unless it has at least one (1) published workout within twenty (20) days of entry at a distance satisfactory to the stewards. If a horse has performed the requisite workout, but the workout does not appear in the past performances, the horse shall be permitted to start if the stewards determine that the workout failed to be published through no fault of the trainer.

    (b) A horse starting for the first time shall not be permitted to start unless it has three (3) workouts, one (1) of which is from the starting gate, one (1) of which is within twenty (20) days of entry, and at least one (1) of which is published.

    (c) A workout not appearing in the official program shall be publicly displayed on television monitors, the tote board, and, if available, the bulletin boards where photo finishes are shown at the time when mutuel windows are opened and shall be displayed until the conclusion of the race in which the horse is entered.

    EXAMINATION BY ATTENDING VETERINARIAN: SECTION 17(1) Subject to the exception in subsection (4), a horse shall only be entered if: (a) The horse has been examined by an attending veterinarian licensed by the veterinary regulatory body in the jurisdiction where the examination occurs no more than three (3) days prior to entry; (b) The attending veterinarian certifies in writing that the horse is in

    serviceable, sound racing condition; and (c) The written certification is provided to the KHRC Veterinarians office no later than the time of entry. (2) The examination required by paragraph (a) of subsection (1) of this section shall include watching the horse jog in hand.

    (3) If the attending veterinarian who examines the horse prescribes a diagnostic test as part of the evaluation of the horse’s soundness, the results of the test shall be provided to the commission’s veterinarian no later than one (1) day before the horse is set to start.

    (4) If a racing secretary contacts a trainer to fill a race, the trainer may enter a horse prior to obtaining the examination and written certification required in this section, if the cer-tification required in this section is provided to the KHRC Veterinarian’s Office: (a) on the same day that the horse is entered; and (b) prior to the race in which the horse is entered.

    USE OF RIDING CROPS: 810 KAR 4:040: SECTION 15(1) Although the use of a riding crop is not required, a jockey who uses a riding crop during a race shall do so only in a manner consistent with exerting his or her best efforts to win.

    (2) In any race in which a jockey will ride without a riding crop, an announcement of that fact shall be made over the public address system.

    (3) An electrical or mechanical device or other expedient designed to increase or retard the speed of a horse, other than a riding crop approved by the stewards pursuant to 810 KAR 4:010, Section 11 shall not be possessed by anyone, or applied by anyone to a horse at any time at a location under the jurisdiction of the racing commission.

    (4) A riding crop shall not be used on a two (2) year-old horse in races before April 1 of each year.

    (5) A riding crop shall only be used for safety, correction, and encouragement.

    (6) A rider who uses a riding crop shall: (a) Show the horse the riding crop and give the horse time to respond before striking the horse; (b) Having used the riding crop, give the horse a chance to respond before using it again; and (c) Use the riding crop in rhythm with the horse’s stride.

    (7) A riding crop shall not be used to strike a horse: (a) On the head, flanks, or on any other part of its body other than the shoulders or hind quarters except if necessary to control a horse; (b) During the post parade or after the finish of the race except if necessary to control the horse; (c) Excessively or brutally; (d) Causing welts or breaks in the skin; (e) If the horse is clearly out of the race or has obtained its maximum placing; and (f) Persistently even though the horse is showing no response under the riding crop.

    (8) A riding crop shall not be used to strike another person.

    (9) After the race, a horse may be subject to inspection by a racing official or official veterinarian looking for cuts, welts, or bruises in the skin. Any adverse findings shall be reported to the stewards.

    (10) The giving of instructions by any licensee that, if obeyed, would lead to a violation of this section may result in disciplinary action also being taken against the licensee who gave the instructions.

    FUROSEMIDE USE ON RACE DAY: SECTION 6(1) Furosemide may be administered, in accordance with this section, to a horse that is entered to compete in a race.

    (2)(a) The commission veterinarian; or (b) A licensed veterinarian approved by the commission to perform the administration if the commission veterinarian is unavailable. If the furosemide is administered by an approved licensed veterinarian, the administering veterinarian shall provide a written report to the commission veterinarian no later than two (2) hours prior to post time of the race in which the horse receiving the furosemide is competing.

    (3) Except as provided in subsection (6) of this section, furosemide may be used if administered: (a) At a location under the jurisdiction of the commission where the horse is scheduled to race; (b) By a single intravenous injection, not less than four (4) hours prior to post time for the race, qualifying race, or time trial in which the horse is entered; and (c) In a dosage not less than 150 milligrams and not more than 500 milligrams.

    (5) The initial cost of administering the furosemide shall be twenty (20) dollars per administration. The commission shall monitor the costs associated with administering furosemide and consult with industry representatives to determine if the cost should be lowered based on prevailing veterinarian services and supplies. The commission shall maintain records documenting the basis for its determination, and if the cost is determined to be less than twenty (20) dollars per administration, then the commission shall lower the cost accordingly. The cost shall be prominently posted in the racing office.

    (6)(a) A two (2) year old or stakes horse shall not be administered any drug, medication or other substance, including furosemide, within twenty-four (24) hours of the post time of the race in which the horse is entered. Participation by the horse shall not affect the status of the participating horse on the official authorized bleeder medication list. (b) The implementation and enforcement of the prohibition in paragraph (a) of this subsection shall begin on: 1. January 1, 2020 for all two (2) year olds; and 2. January 1, 2021 for all horses entered to run in a stakes race; including the races comprising the Breeders’ Cup World Championships and the races designated as graded stakes by the American Graded Stakes Committee of the Thoroughbred Owners and Breeders Association.

    FUROSEMIDE ELIGIBILITY: SECTION 7

    (1)(a) Except as provided in Section 6(6) of this administrative regulation, a horse shall be eligible to race with furosemide if the licensed trainer or a licensed veterinarian determines that it would be in the horse’s best interests to race with furosemide. Notice that a horse eligible to receive furosemide will race with or without furosemide shall be made at the time of entry to ensure public notification, including publication in the official racing program.

    (1) Any horse eligible to race in Kentucky shall be subject to testing without advance notice for the substances specified in Section 2 of this administrative regulation. A horse shall be presumed eligible to race in Kentucky if: (a) It is under the care, custody, or control of a trainer licensed by the commission; (b) It is owned by an owner licensed by the commission; (c) It is nominated to a race at an association licensed pursuant to KRS 230.300; (d) It has raced at an association licensed pursuant to KRS 230.300 within the previous twelve (12) calendar months; (e) It is stabled on the grounds of an association licensed pursuant to KRS 230.300 or a training facility subject to the jurisdiction of the commission; or (f) It is nominated to participate in the Kentucky Thoroughbred Development Fund, the Kentucky Standardbred Development Fund, or the Kentucky quarter horse, paint horse, Appaloosa and Arabian Development Fund.

    (2) A horse subject to testing under subsection (1) of this section may be designated for testing by the executive director, the chief state steward, chief judge, or their respective designee.

    (3) An owner, trainer, or any authorized designee shall fully cooperate with the commission veterinarian, or his or her designee, by: (a) Locating and identifying any horse designated for out-of-competition testing; (b) Making the horse available for the collection of the specimen at a place designated by the commission veterinarian, or his or her designee; and (c) Observing the collection of the specimen. 1. If the owner, trainer or their authorized designee, is not available to observe the collection of the specimen, the collection shall be deferred until the trainer, owner, or their authorized designee, becomes reasonably available, but the collection shall occur no later than six (6) hours after notice of intent to collect a specimen from a horse is issued by the commission veterinarian or his or her designee. 2. If the collection does not occur within the time provided for in this subsection, any horse that is designated for testing may be barred from racing in Kentucky and placed on the veterinarian’s list, pursuant to 810 KAR 8:010, Section 17, and the steward’s list or judges’ list, for a period of 180 days and the owner and trainer of the horse may be subject to the penalties de- Legislative Research Commission PDF Version Page: 6 scribed in Section 8 of this administrative regulation.

    (4) Responsible persons. (a) The trainer of the horse shall be responsible for the condition of a horse sampled for an out-of-competition test while on the grounds of a licensed training facility or racetrack. (b) If the horse is sampled while not on the grounds of a licensed training facility or racetrack, the owner shall be presumed to be the responsible person unless the owner can establish, by substantial evidence, that another licensed person had accepted the responsibility for the care, custody, and control of the horse, making that person the responsible person. (c) If a horse sampled for an out-of-competition test was claimed, sold, or otherwise transferred during the time the substance giving rise to the positive test may have been administered, then the commission shall investigate to determine, by a preponderance of the evidence, the identity of the responsible person at the time the substance may have been administered. (d) If the commission cannot determine a responsible person, then the commission may deem the owner responsible and may place the horse on the veterinarian’s list for as long as is necessary to protect the integrity

    of racing. (e) If a horse designated for testing is sampled at a location not under the jurisdiction of the commission, the trainer or his designee may declare at the time of sampling any reportable substances that have been administered to the horse but have not previously been disclosed to the commission.

    EQUINE INJURY DATABASEIn consideration of the acceptance of a nomination of any horse to any race described in the condition book, the owner(s) and trainer of such horse consent to the collection of information related to any equine injury occurring at the Turfway Park facility to such horse and entry of said information into a database maintained by The Jockey Club (the “Equine Injury Database”).

    Said owner(s) and trainer further agree to indemnify, release, hold harmless and covenant not to sue Turfway Park LLC or its owners, any state or track appointed veterinarian collecting such information, and The Jockey Club (collectively, the “Indemnified Parties”) from and against any liability, cost, loss, or expense of any kind or nature (including, without limitation, reasonable attorneys’ fees) arising from any claim, demand, or action (a) alleging that the data entered into the Equine Injury Database (either directly or indirectly) violates the rights of the owner(s), trainer, or any third party, or (b) relating to any equine injury report run, published or otherwise created by any of the Indemnified Parties, including the owners, stewards, directors, officers, employees, and agents of any of them (either directly or indirectly).

    BAN ON HORSE SLAUGHTERAny owner or trainer based at Turfway Park who sells for slaughter a horse that was previously stabled at Turfway Park may have his/her stalls permanently revoked.

    TAP supports the Thoroughbred Aftercare Alliance, which distributes funds to accredited agencies. 1. The horsemen’s bookkeeper will assess $1 per starter from the owner’s account, to be held in

    the TAP account. Owners may contact the horsemen’s bookkeeper to opt out. 2. Turfway Park will contribute $1 per starter to the TAP account. 3. Turfway will accept independent donations to the TAP fund. 4. Each year the balance of the fund will be sent to the Thoroughbred Aftercare Alliance for

    distribution to accredited Thoroughbred aftercare agencies.

    Horsemen with Kentucky-sired Kentucky-breds have more purse money to run for in allowance, non-claiming maiden and stakes races less than $50,000 added in Kentucky through the Kentucky Thoroughbred Development Fund program.

    In Allowance Optional Claiming races, horses entered for less than $25,000 are not eligible for KTDF distribution.

    Eligible races can be readily recognized in the stakes and condition books by the Kentucky Thoroughbred Development Fund seal, which will appear next to each race in the stakes and condition books.

    In accordance with KRS 230.400(5) (d), it is mandatory for a horse to be registered prior to time of entry to be eligible to participate in the distribution of Kentucky Thoroughbred Development Fund monies. Registration is only complete once the application is approved and payment has been received.

    All horses of racing age that are both Kentucky-bred and sired by a Kentucky stallion which stood in Kentucky the entire breeding season the year the horse was conceived are eligible to be registered. Owners of horses of racing age are responsible for registering their horses. Stallion owners are responsible for registering their stallions.

    RACING AT TURFWAY PARK

    NOTICE FOR HORSES SHIPPING TO TURFWAY: ARRIVAL

    All horses shipping in to run at Turfway Park shall be on the grounds and in their proper receiving barn and assigned stall a minimum of four-and-one-half (4-1/2) hours prior to their race time.

    All shipped-in horses will be assigned to a certain barn and stall by the stall superintendent or his personnel at the entrance gate.

    NOTICE FOR HORSES SHIPPING TO TURFWAY: VETERINARIAN EXAMINATION

    Trainers of shipped-in horses shall have a responsible person available to present the horse for ex-amination when the veterinarian comes to the barn. Horses will have bandages off and are not to be placed in ice, tubs, leg freeze or other such paraphernalia until after the pre-race exam.

    It should be further understood by all trainers that if an entered horse fails to receive a pre-race examination a late scratch may be necessary and the trainer shall be held responsible for this action.

    COGGINS TEST, HEALTH CERTIFICATE & INOCULATION

    All horses shipping to Turfway Park must be accompanied by a current Coggins, a health certificate dated within 72 hours of arrival, and an equine herpes inoculation dated 14 days prior to shipping and no older than 120 days.

    SHOE POLICY

    Prohibited – Front and HindThe following devices are prohibited both front and hind for racing and training at Turfway Park: turn-downs, bends, jar calks, stickers and any other traction device worn on the shoes of Thoroughbred horses.

    Acceptable – FrontThe following front shoes are acceptable for racing and training at Turfway Park: Queen’s Plate, Queen’s Plate XT, King’s Plate, King’s Plate XT, Fast Break, Speed Toe, and Outer Rim.

    Acceptable – HindHind shoes with a toe grab not exceeding one-quarter inch (1/4”) shall be permitted for racing and training at Turfway Park.

    EARLY CANCELLATIONS

    Trainers shipping to Turfway Park before 8:00 am during adverse weather/road conditions may con-tact the Stable Gate (859-647-4883) to confirm early cancellations. After 8:00 am, please contact the Racing Office.

    TURFWAY PARK DATE PREFERENCE SYSTEM

    Foal certificates are no longer required to be on file in the Racing Office to enter or start at Turfway Park; however, foal certificates must be on file to obtain a preference date or to have a horse tattooed.

    Each day’s overnight will list the dates of horses in and on the also-eligible list to enable trainers to see what dates are getting horses into over-filled races.

    1. In over-filled races, preference will be given to horses in order of their assigned preference dates, earliest date first. Horses having identical dates will be chosen by lot, however, where entry and running dates are the same, the horse with the entry date will have preference.

    2. All horses intended for racing at Turfway Park will be assigned a preference date. A horse can have only one date at any one time. Dates will be of two types:

    E-Date This date will correspond to (a) the date on which a horse’s foal papers/digital foal certificate and name card are submitted to the Identifier (their earliest date being the day when entries are first taken for the meet). The deadline to submit foal papers/digital foal certificates to receive a date on day of entry is 9:30 a.m. Eastern; (b) the day on which a horses is first entered if his papers are not on file with the Identifier. To qualify for the latter E-Date, a horse must have been excluded from a race that appears on the overnight or been entered in a condition book race which failed to fill through insufficient entries.

    R-DateThis date will correspond to the day of a horse’s most recent race at Turfway Park. An R-Date also will be assigned to a horse that scratches.

    3. A horse retains his R-Date until he receives a newer R-Date. No horse with an established R-Date may receive an E-Date. A horse whose papers are removed from the Identifier’s office will lose his date and must then re-establish a date to receive preference. A horse with an E-Date cannot receive a newer E-Date. Horses starting at another race track will forfeit any date they may have at Turfway Park. Additionally, horses racing at Turfway Park without foal papers/digital foal certificate on site will not retain their R-Date.

    4. Preference dates are good for any type of race or distance (other than maiden dates).

    5. Maiden dates will be kept separately and will not have preference in winners races.

    6. No E-Date will be assigned to the second choice of an un-split same-owner entry.

    7. A horse placed on a list (Veterinarian, Steward, Starter or Paddock Judge) will lose its date and be assigned an R-Date corresponding to the day removed from the list.

    8. Horses on the Also-Eligible List shall be permitted to draw into races and will be assigned post positions in the order of their dates, earliest dates first.

    9. A horse which is a scheduled starter in a canceled race will not receive an R-Date for that race but will retain his previous date.

    10. The draw of stake and handicap races is not subject to date preference.

    11. Preference dates are transferred through change in ownership and changes in trainer only after the proper transfer procedures have been completed through the Stewards office and delivered to the Racing Secretary’s office.

    GENERAL: Entries to the race are received only upon the condition that the Applicant will comply with the rules and regulations governing thoroughbred horse races adopted by the Kentucky Horse Racing Com-mission (KHRC) and the rules and regulations of Turfway Park L.L.C. (the *Association) and will comply with and abide by any decision of the state racing officials and/or the officers of the Association regarding the interpretation and application of such rules and regulations. Applicant consents and agrees to all provisions of the Association’s current application and/or agreement regarding the use of stall space, the terms of which are specifically incorporated herein by reference, and shall execute all such applications and/or agreements before bringing any horse upon the Association’s grounds. In making this applica-tion to participate in thoroughbred racing, Applicant agrees and consents to the Association and/or its agents making an investigation of Applicant where by information may be requested from third parties as to character, general reputation, personal characteristics, mode of living, or such other information as may be relevant to the Applicant’s integrity as a racing participant. The Association reserves the right to cancel any race, without notice, at any time prior to the actual running thereof, without liability except for the return of all fees as required by the rules of racing. The Association reserves the right to make all decisions regarding preferences and conditions and its decision shall be final. Nominations are received only with the understanding that the Association reserves the right, it is sole and absolute discretion to refuse, cancel or revoke any nomination, entry or stall application or the transfer thereof and reserves the right to deny the right to start in a race without notice to the Applicant and for any reason, including but not limited to the Applicant’s failure to fully perform or abide by all provisions and conditions thereof.

    Release, Waiver and Indemnification: All Kentucky Horse Racing Commission licensees, including but not limited to the host association, owners, trainers, jockeys, and grooms (*licensees*), participating in sta-bling, racing, training, and related activities at the Association recognize that hazards and risks inherent in such activities may cause the injury or death of horses. Therefore, in consideration of participating in stabling, racing, training and related activities at the Association, all licensees assume the risks of, and release, hold harmless and covenant not to sue all other licensees so participating for: (i) Ordinary negli-gence which uses or contributes to loss, loss of use, injury or damage to horses while on the premises of the Association; and (ii) Ordinary negligence which causes or contributes to personal injury or property damage including but not limited to loss, loss of use, injury or damage to horses arising from the use of grass fields or gallops owned or controlled by the Association, whether arising from alleged acts or omis-sions of a licensee and its agents or employees, the condition of the premises of the Association or any other cause. Except as provided above, all licensees participating in racing, training, and related activities at the Association shall be responsible for their own acts and omissions and those of their agents, em-ployees to the same extent as provided by law. The foregoing provisions shall be construed in a manner consistent with the limitations set forth herein to be as broad and inclusive as permitted by the laws of the Commonwealth of Kentucky and the KHRC regulations and shall be binding upon Applicant, as successors and/or assignees. The maintenance by Association of insurance shall not affect the terms or interpretation of this Agreement. For purposes of this agreement, Association shall mean and include Association and its officers, directors, agents, employees, contractors, servants, and licensees. In the event of any inconsistency between these provisions and KHRC regulations, the KHRC regulations shall control. Further, these provisions shall be deemed to be amended to the extent of, and to be in compliance with any amendment to the KHRC regulations.     mortality insurance to cover the risks outlined above vests with the applicant. Consultation with a com-petent insurance advisor is strongly recommended. Failure to maintain adequate insurance may subject the Applicant to the risks outlined above.

    Reservation of Rights: As the organizer, horse and sponsor of thoroughbred horse races, the Association hereby reserves unto itself, its agent, assigns and licensees, the sole and exclusive right to produce, exhibit, sell, license, transfer or transmit in any manner still or motion pictures, radio and television broadcasts, or any other media transmission, now known or hereafter developed, of all events which occur on the Associations property, including without limitation, all activities occurring before, during and after thoroughbred horse races; and the sole and exclusive right to utilize the race and the results thereof, all for any purpose or use as the Association shall determine (hereinafter referred to as the “Host Rights”). The acceptance of stall accommodations, the submission of a nomination or making of any entry in any race shall mean that the Applicant consents to the above reservation of the Host Rights and consents to be photographed or to otherwise be a subject of still or moving pictures, radio, or television programs, without remuneration. The Applicant agrees that he has not and will not execute any documents or take any other action which purports to assign or otherwise transfer any interest in the Host Rights or assert any claim, demand or cause of action against the Association which is inconsistent with the full and exclusive exercise by the Association of its Host Rights.

    Interstate Wagering: In consideration of the Associations agreement to provide a portion of revenues received from interstate wagering to purses for races run at the Associations facility during the 2021 racing season (the “Races”), the Applicant hereby joins with all other applicants to form a group consisting of all applicants participating in each of the races, which group is hereby authorized and directed to consent to, and the applicant hereby individually consents to, allow the association to contract with any domestic or foreign license wagering entity for the purpose of accepting wagers on the Races pursuant to the interstate Horseracing Act of 1978, 15 U.S.C.301 et seq. The Racing Secretary of the Association is authorized to execute any documents necessary to evidence such individual and group consents. The applicant warrants that no third party organization has or will be given the right or authority to assert any claim, demand or cause of action inconsistent with such consent.

    Definition of Applicant: As used herein, the “Applicant” shall mean and include the nominating owner(s) and the owners agents, trainers, jockeys, employees, invitees, and their agents, employees and invitees and the heirs, administrators, representatives, next of kin and assigns of each of them. The nominating owner covenants that his agents, trainers, jockeys, employees and invitees have agreed for themselves and their agents, employees, and invitees to the foregoing conditions and further agrees that he will deliver their written consent and agreement to such conditions upon request of the Association. The owner and trainer shall, jointly and severally, indemnify and hold the Association harmless from and against any claim or cause of action (including any expense incurred in connection therewith, including reasonable attorney’s and other fees) that may be asserted by or on behalf of any of the foregoing persons which is inconsistent with the release, waiver and indemnification provisions set forth in the foregoing paragraph.
