Writ of Mandamus

DESCRIPTION

I had such a successful outcome yesterday in court due to the fact the Writ of Mandamus was filed a couple of days prior to pre-trial. Oral enforcement was easy as my line was " ....and then I filed the Writ of Mandamus which is the superior court order compelling you to perform your public duty to uphold the statutory authority of this court. As a matter of fact I have the order right here ready to sign, There is no further controversy and you are ready to move on to you next case." Needless to say he tried to dismiss my claim against the state for 10k, and was livid but because it was tied into T.R.C.P. Rule 18.01 Joinder of claims, as long as i did not plea, my claim along with states complaint must be heard at same time. This claim was brought in under Rule 13.04 Claims against the State. The Judge was also notified of a potential law suite since without establish jurisdiction he would have no judicial immunity and I could sue him in a small claims court for up to 35k. This made him think twice. You can view these other documents. Anyway, I got tiered of going back and forth so I just took the initiative to give them a choice to pay or play. Guess we will see.
