Classical Patent rating Methods
• Rating means Ranking by quality but not Valuation
• Classical approach : – Multidisciplinary team
– Time consuming
– Costly, subjective
– Not always suitable (M&A)
Has led to simplified, less reliable, but easily manageable
scoring methods
Could be improved by calculating predictive indices extracted from « worldwide » patent data bases

Patent rating metrics
• A lot of parameters could have an impact on patent quality (about 100 econometrics studies) – Number of independent claims – Number of dependent claims – Average length of independent claims – Shortest independent claim – Type of claims – Patent class/subclass – Patent pendency period – Scope and content of cited prior art – Relative earliness of priority date – Forward citation rate – File history details – Number of related patents
And Generality index, Originality index….. Even if Ocean has failed.

-Patent value is still frequently underestimated
-Combining Statistical and Classical approaches is mandatory
-IP experts must be trained to calculate and use statistical patent metrics
Different angles are needed to assess the quality of a patent
A threat or an opportunity ?
• Innovations have never been easier to be located anywhere in the world
• I.P. portfolios and the way they are managed are becoming transparent to any party using the right tools.
• Freedom to Operate must be carefully checked prior to any investment .
• Patent aggregation is a very trendy and lucrative business for the first movers
• The new IP analytics tools are providing a dramatic competitive advantage to the first movers .
• Identification of innovative companies having a high quality patent portfolios has never been easier . It must impact their value
