Accountability of People’s representatives

Democracy has been defined as a governing system of the people for the

people and by the people. It is thought that the elected representatives of the people right

from the Grampanchayat level to the parliament carry out procedure to provide legal shape

to the people’s issues. The laws enacted for the welfare of the citizens of the country,

nation at large and also the world at a larger scale is later formed as rules and regulations

for implementation. If these laws enacted by the Legislation assembly and according to the

constitutional provisions are violated the judiciary system steps in to take action on its face

this democratic system in the country is ideal but the political parties leave no table

unturned to exploit and misuse this system and it seems as if autocracy/monarchy is the

rule of the land.

No doubt, we in an attempt to raise aware citizens have lessons an democratic

systems included in the school text books at primary education level and also at the

secondary education level but the education system being examination-oriented these

lessons are carried no further than text-book material. The further citizens of the nation fail

to grasp and carry the lessons to their adulthood. Consequently, educated adult citizens too

have little knowledge or awareness regarding the role of Panchayat, legislative assembly

and parliament in a democratic regime. It is necessary that citizen has awareness regarding

how the democratic system works. Giving votes at the time of the elections is not the only

duty of an aware citizen. A citizen also needs to be aware that not only the elected

representative but a common citizen also can influence the procedure of the legislative

assembly/parliament.

Even if the state/nation is on a path of remarkable progress, it is necessary to

have discussion and deliberations on all the people-related issues (be they beneficial for the

state or otherwise) in the legislative assembly/parliament. It becomes duty of MLAs to fulfill

the purpose of their having been elected and sent to legislative assembly/parliament and it

is the duty of the citizens to see to it that their elected representatives fulfill their

expectations.

Does the legislative assembly/parliament fulfill the purpose for which it has

been formed? This needs to be examined. Do the elected representatives know or have

been trained to understand and participated in legislative assembly/parliament procedure?

How many MLAs and ministers have participated or at least have remained present at the

Legislative assembly /parliamentary sessions? These issues need to be verified. One needs

to verify if the in-house majority of the ruling party members have not been manipulated to

act as effectiveness also needs to be examined.

Legislative assembly is an efficient platform to discuss the people’s issues and

take decision regarding that. This study makes an attempt to examine the transparency and

efficiency of the legislative assembly procedure, participation of MLAs and other related

issues. This study shall be an attempt to generate awareness among people with a view to

make the democracy truly people oriented. We wish to present before people the study of

last year’s budget session so that people become third party capable to act as watch dogs of

the Legislative assembly activities and elected representatives and make the elected

representative answerable to the people.

Gujarat Legislative Assembly

• The State of Gujarat was formed by bifurcating the Greater Bombay State

into Gujarat and Maharashtra on 1st May 1960 by an Act of Parliament

called the Bombay Reorganisation Act, 1960. When the State of Gujarat

came into being on 1 May 1960, the number of members in the First

Gujarat Legislative Assembly was 132.

• Thus the initial strength of the Assembly was 132. It was further increased

to 154 in 1962, 168 in 1967 and 182 in 1975 with the gradual increase in

the population and territorial revision of the Constituencies of the State.

However, since 1975 the increase in the strength of the legislature has

been stayed by constitutional amendments till 2025.

• Out of the present 182 territorial constituencies, 13 constituencies are

reserved for Scheduled Castes and 26 constituencies for Scheduled

Tribes.

• The Gujarat Legislature is unicameral.

• Presently, the Twelfth Legislative Assembly consists of 182 members.

The term of the Assembly is five years unless dissolved sooner.

• There are 19 permanent Committees in the Assembly.

Session • The eighth session commenced on Thursday, the 24th February, 2011 and the

session concluded on 30th

March, 2011.

• During 8th

session, House sat for 24 days and total 30 sittings and transacted its

business for 112 hours and 47 Minutes.

Government Bills

During the session, 30 Government Bills were admitted in the house. (The Governor sent

back one bill for review of the house) 31 government bills were presented for first,

second and third reading and passed after discussion. During the session, 31 Government

Bills were passed by the House.19.74% time used for government bills.

Vote of Thanks on Governor's Address Time devoted: 7 hours 10 minutes: 6.35%

• The Session, being the first Session of the year (As per the provision under para

176(1) of the Indian constitution), Her Excellency, the Governor, Dr. Shrimati

Kamla Benival addressed the Assembly in Hindi at 12.00 A.M. on 24th

February,

2011.

• A Motion for vote of thanks for the Governor's Address was moved on the same

day by Shri Rajnikantbhai Patel, a member of the Gujarat Legislative Assembly

and seconded by another member Shrimati Vibhavariben dave.

• The motion was discussed in three sittings on 1st, 3

rd and 4

th March 2011.

• In all, 47 notices of amendments to the motion were received out of which 17

notices of amendments were admitted. Out of these 17 amendments, 15

amendments were moved in the House & remaining 2 amendments could not be

moved due to absence of the members in charge of the amendments.

• In all, 37 members participated in the debate. At the end of discussion, the motion

of thanks was passed by the House on 4th

March 2011 in its original form,

rejecting all the amendments tabled thereto.

Discussion on Budget Time devoted: 49 hours and 10 minutes: 43.59%

• 118 members were took part in the discussion on budget.

• General discussion on budget was discussed in 4 sittings.

Questions in the Legislative Assembly

Generally the first hour of every sitting of the House is the question hour. This is the most

interesting period of all the procedure of the House. During this hour, members, through questions

and supplementary questions try to get information from the Government and to activate the

Government machinery. With the help of the questions the day to day delays, omissions and corrupt

practices prevailing in the vast administration are pointed out to the Ministers, to the Legislative

Assembly and to the public and thus, the goals of removing the laxity of the Government machinery,

correcting the omissions, getting the undone work done and getting justice are accomplished.

Questions are of three types:

(1) Starred Questions.

(2) Unstarred Questions. and

(3) Short notice questions.

Starred Question

The question on which the Minister gives oral answer and supplementary questions can be

asked in respect thereof is called starred question. A member in the Legislative Assembly can ask

not more than three starred questions in a day to the Minister. Generally in the Gujarat Legislative

Assembly, not more than five minutes are allowed for supplementary questions on any starred

question. Generally, in the Gujarat Legislative Assembly supplementary questions are not allowed

for more than five minutes for each starred question.

Unstarred Questions

A question, the answer of which is presented before the House in written form only is called

an unstarred question. No supplementary questions can be asked on such questions. There is neither

any time limit for asking an unstarred question nor there is any ceiling on the number of unstarred

questions to be asked by a member. Whether the House is in session or not, any member can give

the notice of an unstarred question on any working day of the year. A printed list of such questions

and their answers is Laid on the Table of the House and copies thereof are circulated to the

Members when the House is in session.

Short Notice Questions

The time limit prescribed for giving the notice of a starred question is of 21 days. If a

member does not have enough time left to give such a notice and desires to have an immediate reply

to a question of an urgent nature and if the Minister concerned agrees to give reply to the short

notice question, the member is allowed to ask the short notice question in the House on the time of a

starred question. Such a question is called “a short notice question” and it is taken up on the

prescribed day before the question hour begins.

Half an Hour Discussion

If a member is not satisfied with the reply of the question he has asked in the House, he can

give a notice of a Half an Hour Discussion on a matter of sufficient public importance arising out of

the reply of that question. After the Speaker gives the approval, the discussion is held on a

prescribed day after the routine business of the House is over. In a week two day are allotted for

such a discussion. For such kind of discussion, no motion is moved or no voting takes place at the

end of the discussion.

Motions in the Legislative Assembly

Any proposal presented before the House for its consideration to seek the decision

of the Legislative Assembly on any matter or to criticize the Government or to know the

reflections of the Government is known as motion.

Looking to the importance, seriousness, the matter of public importance involved,

Calling Attention notice under Rule – 116

Under this Rule a Member may arise any matter of Urgent Public Importance in

which the State Government is responsible. For this notice is primarily to be given as

perthe rules. On the permission of the Speaker, the attention of the concerned minister

is drawn to such a matter of Urgent Public Importance and is requested to make
