Our work program sets out the programs and projects that the National Transport Commission (NTC) will undertake to achieve the direction, goals and priorities set out in our strategic plan.

Strategic plan Our strategic plan sets out our directions, goals and priorities.

Corporate planOur corporate plan is a high-level operational planning document. It sets out the objectives and strategy that we will pursue to achieved the priorities in our strategic plan over the next four years. This plan states our purpose, including explaining the environment and context in which we operate, planned performance, capabilities and risk oversight and management.

Annual reportOur annual report details our actual performance over the past financial year. It includes our financial statements and the results achieved against the planned performance in our corporate plan.

NTC strategic planning and work program development processWe continue to implement a best practice approach to developing our strategic plan and work program, as summarised in Figure 1.

September–November • Review the reform pipeline

The process continues to provide:

• a repeatable, transparent and inclusive process that provides a clear line of sight from strategic objectives and goals to outcomes and better coordination with other national transport bodies

• a longer term view of candidate reforms, maintenance, planning, reform evaluation and performance reporting activities. This is done so that reforms and key activities can be planned, sequenced and resourced to ensure a high-quality pipeline of priority national reforms. The reform pipeline guides the annual development of the more detailed four-year published work program (which is summarised below)

• increased opportunity for stakeholders to provide input to the NTC’s strategic direction, nomination and prioritisation of proposed candidate reforms, and development of the detailed work program

• using a more comprehensive performance-based framework for considering and monitoring programs against the NTC’s strategic plan, work program and budget each year.

The work program has been developed with extensive consultation. Consultation undertaken to date includes the following.

The indicative four-year program has been developed based on:• continuing projects on the current NTC work program

(2014–15 to 2016–17), which was endorsed by Ministerial Council in May 2014

• incorporating business cases presented and endorsed for project commencement by the Ministerial Council in November 2014

• feedback received to date from the project prioritisation process on high-value proposals to proceed to the business case stage in the future.

With the introduction of the new Public Governance, Performance and Accountability Act 2013, we are now required to extend the work program to cover four years (previously three years). The following program reflects this requirement.

If endorsed by the Council, business cases will proceed to projects on the work program. The NTC may begin the projects after ministerial endorsement if there is available resources and support.

Compliance and technology

Electronic work diaries

In May 2014 the Transport and Infrastructure Council considered recommendations relating to the use of electronic work diaries. A draft Bill incorporating these recommendations was endorsed by the Council in November 2014. The NTC will continue to support the NHVR on implementing electronic work diaries.

Legislative chain-of-responsibility issues

The NTC is currently conducting a review of chain-of-responsibility duties within the Heavy Vehicle National Law to assess whether any changes are required in order to improve safety and compliance.

The NTC is also completing a review of the executive officer liability provisions in the Heavy Vehicle National Law to ensure alignment with the Personal Liability for Corporate Fault: Guidelines for Applying the COAG Principles.

Development of the Data Collection Framework for Heavy Vehicle Driver Fatigue

In November 2014 the Transport and Infrastructure Council endorsed the business case for the NTC to develop a framework for collecting heavy vehicle driver fatigue data. The NTC will work with industry and governments to develop the data framework in order to support future fatigue policy.

Cooperative intelligent transport systems

Following on from the Transport and Infrastructure Council endorsing the Cooperative Intelligent Transport Systems Policy Paper in 2013, the NTC will continue its involvement with partners to develop a robust technical, operational and legal framework for developing and implementing cooperative intelligent transport systems (C-ITS) technology in Australia, in conjunction with the ongoing work of Austroads in this area.

Enforcement approaches for speeding heavy vehicles

This project explores two proposals for improved heavy vehicle speed enforcement, including the options for enforcement officers to ground a heavy vehicle for excessive speeding and, separately, deeming any heavy vehicle identified as travelling at a speed of 115 km/h or more to have a defective speed limiter.

The compliance and technology program focuses on policy changes designed to improve the safety and productivity of land transport.

Heavy Vehicle Charges Review and Determination (including Annual Adjustment)

As set out in the NTC’s governing legislation and Intergovernmental Agreement, the NTC is responsible for performing an annual adjustment to the heavy vehicle charges each year. The NTC will continue to provide advice to the Transport and Infrastructure Council on heavy vehicle charges including:

• exploring options for improving the current heavy vehicle charging framework with the aim of enhancing productivity in the transport sector

• incorporating new knowledge and data and addressing new requirements such as recovering the costs associated with the NHVR.

Within this program, the NTC will work with all jurisdictions to implement ministerial decisions on heavy vehicle charges.

Ongoing work on road infrastructure funding and charging arrangements

There is a need to continue to develop options for improved and sustainable ways of funding road infrastructure. This work will include developing options to improve the mechanisms and processes for setting and collecting road user charges.

Heavy Vehicle Roadworthiness

The NTC is undertaking a program of work jointly with the NHVR to examine ways to improve the safety and roadworthiness of Australia’s heavy vehicle fleet. This program incorporates the review of the maintenance management component of the NHVAS being undertaken by the NHVR.

This collaborative approach allows informed consideration of all relevant matters including periodic inspections, government and industry accreditation schemes and intelligence-targeted auditing to ensure that the most effective and efficient approaches are identified and recommended to the Transport and Infrastructure Council for implementation.

Productivity sub-program

The NTC will commence a series of projects aimed at increasing the productivity of Australia’s freight and passenger networks. The first phase of this work will examine current practices and develop case studies of access management decisions to support road managers. This will be followed and complemented by work to identify opportunities and support road managers in increasing access for vehicles that are constrained by the size and not mass of their load. Complementary work will be undertaken to review the effectiveness of the PBS marketplace and to identify any potential barriers to innovative vehicle design and utilisation.

This program focuses on policy changes to improve land transport safety, productivity and environmental outcomes.

Detailed business cases or project proposals will be developed for the following proposals that have been jointly prioritised with stakeholders in 2015–16:

Technology sub-program: assessing the potential regulatory and operational barriers to using transport technology for safety, commercial and regulatory purposes

This project will examine potential policy, legal and regulatory issues relating to the use of vehicle technologies for commercial and safety purposes such as platooning, C-ITS, E-call, in-vehicle cameras, sensors and pedestrian detection. In addition, the project will examine the future use of technology for regulatory purposes such as speed compliance or vehicle maintenance, consistent with the Council-approved framework for telematics.

Technology sub-program: facilitating the release and sharing of electronic information for the following areas: network access maps; locations of heavy vehicle rest areas or parking; locations of bridges and the height restrictions or load restrictions; rail level crossings; diversions; and speed limits

This project aims to identify issues and facilitate increased release and sharing of data and information that would to support improved commercial and government network and service planning and investment. It will highlight innovative activities and approaches already underway in a number of jurisdictions.

Candidate project Description/scope

National transport productivity framework This project involves developing a framework (metrics and indicators) to enable better and more granular measurement and benchmarking of transport productivity in Australia. This framework could be used to underpin the development of a national strategy (with targets) and rolling action plans. This candidate project was considered for business case development by transport CEOs at their meeting on 2 December 2014.

Written-off register/s for heavy vehicles Chapter 2 of the Heavy Vehicle National Law has provisions for a national written-off and wrecked heavy vehicle register. These provisions are scheduled to commence on 1 July 2018. At their meeting on 27 March 2015, transport CEOs requested that the NTC and Transport for NSW develop a business case in consultation with all jurisdictions and industry with options for written-off register/s for heavy vehicles. Currently, all states and territories have written-off registers for light vehicles to ensure crashed vehicles that are structurally unsafe are not re-registered and driven on public roads. This project will examine options for developing and implementing written-off register/s for heavy vehicles.

Consistent with the directions of the 2012 Review of NTC and other bodies, the NTC will continue to undertake its strategic planning process in collaboration with government and industry stakeholders. The NTC will prepare business cases for TISOC and the Transport and Infrastructure Council on proposed future reform work to form part of the NTC work program.

Supporting other national work

In addition to delivering the NTC work program, the NTC is involved with national work that is led by others. This work includes Austroads projects as well as being involved in the Austroads taskforces.

Reform monitoring and reporting

Routine maintenance

Under our Intergovernmental Agreement, the NTC leads the monitoring and maintenance of national laws, model laws and administrative guidelines to ensure they remain contemporary and consistent with their policy intent.

The NTC works closely with maintenance advisory groups and other interested stakeholders to identify, develop and recommend agreed, simple changes to existing national applied and model laws. Maintenance advisory groups also assist with finalising legislation and other legal instruments for policy projects approved by the Transport and Infrastructure Council.

The NHVR and the Office of the National Rail Safety Regulator (ONRSR) have a particularly important role in identifying desirable changes to the Heavy Vehicle National Law and Rail Safety National Law.

Current maintenance projects

The NTC will progress the following maintenance activities throughout 2015–16 including amendments to the:

• Heavy Vehicle National Law

• Rail Safety National Law

• Australian Dangerous Goods Code

• Australian Road Rules

• Australian Vehicle Standards Rules

• medical standards

• review and update the Load Restraint Guide.

Preliminary work on other model law maintenance items will continue in 2015–16 as required. Some activities will continue into the following years of the work program.

The NTC produces the National Transport Reform Implementation Monitoring Report for the Transport and Infrastructure Council’s meeting in November each year. The report monitors and reports on the progress of national reforms that are agreed by governments through the Council of Australian Governments or the Transport and Infrastructure Council.

The NTC also produces an annual information paper on carbon dioxide emissions from new Australian light vehicles. The Federal Chamber of Automotive Industries has provided the data needed for past reports and the NTC hopes to continue this partnership into the future.

The Review of the National Transport Commission and Other Relevant Transport Bodies recommended the NTC commence work with the regulators and others (including the Bureau of Infrastructure, Transport and Regional Economics) to identify and collect the data and undertake analysis that will be needed to assist the Productivity Commission in the review of the national transport regulation reforms in 2016. The NTC has written to the Productivity Commission regarding the specific methodology that will be used in the review. When the Productivity Commission confirms the methodology that will be used, the NTC will start collecting data in partnership with the regulators.
