DECREE CUSTOMS LAW

• President Pena Nieto presented the modification on September 8th to Congress

• Congress approved modification on October 24th

• Expected to be published in the Official Gazette January 1st

REFORM MOTIVES

• Pretends to facilitate international trade

• Modernize customs, invest in infrastructure, establish best practices and procedures in customs

• Adapt law to new technological implementations

• Relates to National Development Plan 2013-2018

CUSTOMS CLEARANCE

• Possibility to clear customs in different locations other than Customs

• Customs clearance optional to use Customs Broker

• Administrator, General Manager, Partners, etc. are liable

CUSTOMS CLEARANCE

• Elimination of Customs Broker substitute

• Possibility to request new licenses

• Cancelation of licenses– Clear customs for a Company not authorized as an

importer– Permit a third party to use the license – Declare a different value declared by the importer

CUSTOMS CLEARANCE

• Elimination of Customs Agent (Apoderado Aduanal)

• Companies can design a Customs Representative that complies with terms and condition in the regulation

RAIL TRANSPORT

• Construction of new rail systems

• In order to promote this type of transportation Article 11 is modified to include this specifically

ELECTRONIC PREVALIDATION

• SAT can authorize prevalidacion services

• This can not be authorized to importers, exporters or Brokers

• All pedimentos must be prevalidated

CUSTOMS ELECTRONIC SYSTEM

• VU It’s included in our law• Customs clearance with electronic &

digital documents• Use of electronic signature• Elimination of paper in customs

procedures• This where in Customs Rules• Option to create an electronic file

instead of paper, except value declaration

SECONDARY INSPECTION

• This second inspection is eliminated from the law

• This will optimize and speed customs clearance

• Recommendation from World Customs Organization

CUSTOMS INSPECTIONS

• Implement new tools and technologies to inspect cargo efficiently

• Analyze images and transportation equipment

• Sample testing equipment

OTHERS

• Option to correct the pedimentos before and after customs clearance (R1)

• Option to change the regimen, not only IMMEX (F4. F5)

• Option to regularize even the term is expired (A3)

• Option to pay fiscal credits with a reduction in fines (50%)
