THIS MATTER is before the Court upon the Report and

Recommendation (DE 5) filed herein by United States Magistrate

Judge Patrick M. Hunt, and Plaintiffs Objections (DE 9) to the

Magistrates Report and Recommendation. The Court has conducted a

de novo review of the entire record herein and is otherwise fully

advised in the premises.

Accordingly, after due consideration, it is

ORDERED AND ADJUDGED as follows:

1. Plaintiffs Objections (DE 9) to the Magistrates Report

and Recommendation be and the same are hereby OVERRULED;

2. The Report and Recommendation (DE 5) filed herein by United

States Magistrate Judge Patrick M. Hunt be and the same is hereby

approved, adopted, and ratified by the Court;

3. Consistent with the terms set forth in Magistrate Judge

Hunts Report and Recommendation (DE 5), the above-styled cause be

and the same is hereby DISMISSED with prejudice; and

4. To the extent not otherwise disposed of herein, all pending

motions are hereby DENIED as moot.
