RE: CRIMINAL REFERRAL RE: NICK J. MOSBY & MARILYN J. MOSBY

Dear Mr. Davitt, Mr. McDonough, Mr. Dunty, & Ms. Anthony:

I write you today to inform you of the following so that you may investigate the matter further under your sua sponte powers.

My name is Bill Bond. I am a Baltimore City resident. I also own “Baltimore Corruption Wire,” a Maryland public policy initiative with many followers. My focus is on Maryland federal court corruption and Maryland attorney & judicial ethical misconduct.

On August 19, 2015, I noticed a news story in The Baltimore Brew alleging that Baltimore City State’s Attorney Marilyn J. Mosby and her husband, Nick J. Mosby, a Baltimore City Council member who is also a presumptive mayoral candidate, had circumvented Baltimore City Public Schools’ regulations for an out-of-zone school transfer regarding their daughter.1

The story offered the following facts that, in part, would appear to offer circumstantial evidence of grave wrongdoing:

“But how did their daughter, Nylyn, get a coveted spot in Mount Washington, which is 118% over capacity and has a waiting list that stretches to seven pages.

“We waited on the waiting list, and she got in,” Nick Mosby said, speaking to The Brew.

According to the rules as described by City Schools spokeswoman Edie House-Foster, such a transfer shouldn’t happen.

“If a school is over capacity, we will not approve a transfer there regardless of the reason for the request,” House-Foster said, when asked to explain the policy for K-5 schools listed on City Schools’ website.

That policy appears to contradict the process that the Mount Washington School follows for kindergarten admission – a class waiting list process Mosby said the family simply followed. School administrators at Mount Washington said they could not comment.”2

I ask that your office do two things:

First, it is obvious, because of who the subjects are that this is a matter the Office of the Maryland State Prosecutor must investigate, as the local jurisdiction is under the subject’s direct prosecutorial authority and it is hard to see how the matter would be a federal violation.

Therefore, I ask the State Prosecutor’s Office to investigate who authorized the illegal transfer of the Mosbys' child to the out-of-zone school, including any conspiracy and/or thing of value offered for the obvious favor that was granted.

Second, I ask that, if it is proved that Marilyn J. Mosby was involved in the alleged fraudulent scheme to circumvent the Baltimore City Public Schools’ rules, then the State Prosecutor should also refer this matter to the Maryland Attorney Grievance Commission as such conduct would be a violation of the Maryland Lawyer’s Rules of Professional Conduct.
