Introduction, Oxford Univer-sity Press, Hardback, £50.00, ISBN: 9780199533114 This book provides the most comprehensive description of the German law of un-justified enrichment in the English language. It explains to common law readers how German law generally al-lows restitution for transfers made without legal ground (rather than on the basis of individual unjust factors), an approach which the late Peter Birks proposed for English law to adopt, and which the House of Lords was careful not to rule out for the future in Deutsche Morgan Grenfell v Inland Revenue.

namic and complex field which can be properly un-derstood only in its broader international and historical context. Deakin and Morris: Labour Law, a work increas-ingly cited as authoritative in the higher appellate courts, provides a comprehensive analysis of current British labour law which explains the role of different legal sources, as well as social and economic policy, in its devel-opment. It thus enables read-ers to obtain a deeper insight into likely future, as well as past, changes in the law. The fifth edition of Deakin and Morris: Labour Law is an essential text for students of law and of disciplines related to management and industrial relations, for barristers and solicitors working in the field of labour law, and for all those with a serious interest in the subject.

Deakin, Simon; Supiot, Alain, Capacitas: Contract Law and the Institutional Preconditions of a Mar-ket Economy, Hart Pub-lishing, Hardback, £40.00, ISBN: 9781841139975 One of the principal tasks for legal research at the be-ginning of the 21st century is to reconstruct the under-standing of the relationship

between the legal system and the market order. After almost three decades of de-regulation driven by a be-lief in the self-equilibrating properties of the market, the financial crisis of 2008 has reminded everyone of the fundamental truth that markets have legal and insti-tutional foundations, without which they cannot effectively function. The chapters in the present volume are the result of work by a group of legal scholars which began in the mid-2000s, at a time when the shortcomings of deregulatory policies were becoming clear in a number of contexts. The chapters address the question of how the language of contract law describes or conceptualises the market order and the relationship of the law to it. The perspectives taken are,

in turn, historical, compara-tive, and context-specific. The focus of the book is on a foundational idea, the concept of capacitas, which signifies a status conferred upon citizens for the purpose of enabling them to partici-pate in the economic life of the polity. In modern legal systems, ‘capacity’ is the principal juridical mecha-nism by which individuals and entities are empowered to enter into legally bind-ing agreements and, more generally, to arrange their affairs using the instruments of private law. Legal capacity is thereby the gateway to in-volvement in the operations of a market economy.

Challenges, Routledge-Cav-endish, Hardback, £70.00, ISBN: 9780415446136 The topics addressed in this book have traditionally been covered in separate publica-tions on private and com-mercial law. This dualism of regimes has made it dif-ficult for students and profes-sionals alike to comprehend Spanish private law as a whole. In the past this has led to inefficient duplica-tion of explanations, gaps in key areas and an altogether fragmented picture. This book presents a consolidated, modern, and realistic image of today’s Spanish private legal system. It combines both private and commer-cial law and integrates them in the same book, making the overall subject far more accessible to readers. This united approach results in a more logical and efficient process of learning.

Roy Heywood

After many years of service Roy is retiring from the company. Roy joined the com-pany in 1967 working mainly in the bookshop. In 1970 he left to join Butterworths in their legal bookshop. In 1975, Roy returned to Wildy & Sons to take over as manager of the New Books Department. He has been with the company ever since.

Recently Roy’s principal responsibilities were running our Antiquarian Department along with our Sets and Multi-volume Reports Department. Roy has a vast biblio-graphic knowledge of English law books from the latest student textbooks, right back to fine antiquarian volumes (the company has records of books and documents going back to the year 1500). Roy’s quiet and thoughtful manner, coupled with a sharp sense of humour, has endeared him to customers from all over the world, some of whom have known him for more than thirty years.

Roy’s colleague John Pethick will be stepping up to take responsibility for Sets and Multi-volume Reports while the Antiquarian Department will be looked after by Graham Norfolk.

FACES OF LAW

Photographs by James F. Hunkin

£45 ISBN: 9780854900275 Hardback

‘Faces of Law’ is a unique photographic chronicle of 100 people working in the legal pro-fession at the turn of the twenty-first century. It forms part of an on-going chronicle - ‘Faces of Britain’.

The collection covers a broad spectrum of activities including some of the country’s most respected judges, solicitors and barristers as well as support staff and others.

Each portrait is accompanied by a personal testimony providing a fascinating insight into the working lives and ideas of the men and women who help shape our society. Alongside this, there is a short factual piece about some aspect of each person’s work.

‘Hunkin’s quiet yet powerful portraits provide an honest document of individuals working within the legal sector’.

Clare Freestone, Assistant Curator of Photographs, National Portrait Gallery

‘This remarkable collection of photographs shows the faces of lawyers from all over the legal landscape. It shows the variety of what lawyers do and the variety of lawyers who do it. The words they have chosen, tell us something of how they think or feel about what they do but the photographs tell us even more about them. It all adds up to an intriguing picture of the British legal system as it is today’.

POWERS OF DISTRESSA Guide to Remedies Unreformed by the Tribunals,

Courts and Enforcement Act 2007

ISBN: 9780854900459256 pp Hardback £49

JOHN KRUSE

The Tribunals Courts & Enforcement Act 2007 will, for many debts, sweep away the old procedures and principles of enforcement and introduce a new code of law. However, some debts have been deliberately excluded from these changes. Among the liabilities in question are a wide range of shipping liabilities including harbour dues and fines, market tolls and stallages, distress damage feasant for trespassing chattels and powers of seizure of trespassing animals under the Animals Act 1971, arrests of aircraft and ecclesiastical executions. For them, the old common law procedures and principles will continue to oper-ate unaltered.

In a single volume this timely book offers a detailed examination of arrears which have in many respects been neglected and which thereby have been allowed to become obscure and poorly understood. The new Act may cause further difficulties by creating two parallel systems of enforcement- one for the most common debts and one for the remainder. This text aims to restore some balance to this dichotomy by, for the first time, uniting these less common forms of recovery in a clear and structured work. It provides a thorough analysis of the case law developed over the centuries along with discussion of the relevant statutory provisions.

BAILIFFS’ LAW

Volume 1 ‘A Lawful Trespass’: The Development of the Common Law to the Present DayISBN: 9780854900312 £45.00

Volume 2 ‘Persons of No Value?’: The Growth of Statute from 1500 until the PresentISBN: 9780854900329 £45.00

JOHN KRUSE

The law relating to distress and execution is a much neglected area of study, despite the fact that bailiffs regularly appear in literary works and their activities are a constant feature of court rolls. This two-volume work aims to provide a detailed and comprehensive history of both the development of the law and the profession of bailiff. The work chronicles the growth of enforcement law from Anglo-Saxon times, tracing the continuity in the com-mon law and examining the intervention of statute. The seizure of goods by bailiffs was a familiar aspect of life in earlier times and this work sets their legal powers into their legal, social and economic context. Key themes are explored throughout both volumes: the pro-tection given to certain essential goods, the efforts to regulate the conduct of bailiffs and the gradual shift of emphasis from promoting the rights of creditors to enhancing the protection of debtors.

Working within the field of social welfare, John Kruse has specialised in the law of enforce-ment for the last twenty years, and has written numerous books and articles on the subject. He has also acted as a consultant inter alia to the Ministry of Justice and the Council of Europe.

52 WILDY’S BOOK NEWS

State-owned enterprise (SOE) reform has been at the heart of China’s post-Mao economic reforms. Since early 1990s, a large number of Chinese SOEs have been transformed into joint stock companies, and many of them are now listed on China’s domestic stock exchanges. The corporatisation and listing of the SOEs did not, however, bring about significant improvement in their performance or in the manner in which they are governed.

This book examines the effectiveness of the key legal reforms that have been put in place for addressing the governance issues facing Chinese listed companies. The focus is on three important – but understudied – aspects of corporate govern-ance reform in China: regulation of the private sales of corporate control, institu-tional shareholder activism, and board level monitoring and control. In addition, this book attempts to explore a political economy understanding of formal legal changes in China with particular reference to China’s corporate board reform.
