Federal Motor Carrier Safety Administration (FMCSA) Electronic Logging Device (ELD) mandate

ELD regulation mandates all drivers of Commercial Motor Vehicles (CMVs) who are currently required to fill out Record of Duty Status (RODS) paper logs to convert over to Electronic Logging Devices (ELDs)

ELD solution must:• Automatically capture movement of the CMV

• Connect to the vehicle’s engine and collect engine data

• Device must change to drive duty status when motion is detected

• Must not allow any deletion of the drive time

• Be tamperproof

• Data must be encrypted to ensure security

• Edits/Annotations must identify who made them

• All persons accessing the system must have accounts to identify them

• ELD must be mounted (secured fixed position), visible while driver is operating the vehicle but be easily removed to hand to inspectors as needed.

Impacts of non-compliance with Hours of Service

Drivers and carriers who violate Hours of Service and/or Electronic Logging Device regulations may face the following impacts:

Out of Service (OOS)Drivers may be placed out of service (shut down) at roadside until the driver has accumulated enough off-duty time to be in compliance and continue operating the Commercial Motor Vehicle (CMV).

State finesState and local enforcement officials may assess fines.

FMCSA civil penaltiesThe Federal Motor Carrier Safety Administration may levy civil penalties on the driver and/or carrier, ranging from $1,000 to $11,000 per violation depending on the severity.

CSA ScoringThe driver's and/or carrier's scores under the Compliance, Safety, Accountability (CSA) enforcement program may be downgraded if there is a pattern of violations. A driver/motor carrier rated unsatisfactory may be prohibited from operating a commercial motor vehicle.

In 2015, there were 934 civil penalty cases focused on the violation of Hours of Service logs and compliance, resulting in $9,579,330 in fines (averaging US$10,256 per fine).
