Determining patent terms
• In the United States
• The rest of the world– The patent term is 20 years from the date of
filing

Extensions and adjustments in the U.S.
• Patent Term Extension (PTE)– Applications filed between June 8, 1995 and
May 28, 2000 can be extended up to five years• Delayed from secrecy orders, appellate review, or
interference proceedings
• Patent Term Adjustment (PTA)– Applications filed on or after May 29, 2000
• Issued for the USPTO not complying with administrative time frames and situations mentioned above

Patent terms can be shortened in the U.S.
• A patent is abandoned if maintenance fees are not paid at 4, 8, and 12 years– May be reinstated for unavoidable or
unintentional delay• Terminal disclaimers shorten or negate the
patent term• Interferences or withdrawals can also
