Ridesharing companies like Lyft and Uber offer free applications, or “apps,” that customers download on their smartphones or tablets. Customers can download the Uber or Lyft app onto their smartphone and create a free account. Every customer needs to add his or her phone number and credit card information or Paypal account information before requesting a ride.

The use and awareness of ridesharing services more than doubled between 2015 and 2018. According to the most recent Pew Research Center survey on ridesharing, 36 percent of adults in the U.S. used a ridesharing service in 2018. As a comparison, in 2015, only 15 percent of Americans had used a ridesharing service. The number of people who had not heard of ridesharing services shrunk from 33 percent in 2015 to 3 percent in 2018.

Up to 25 percent of U.S. adults use a ridesharing service at least one time per month. Customers most commonly use ridesharing services for convenience, particularly as transportation from a party or dinner. Ridesharing services are most popular in urban areas, such as Cincinnati and Daytona. However, ridesharing services have attempted to expand into more remote and rural areas in the last few years.

Customers between the ages of 18 and 49 are the most likely to use ridesharing services every week. However, the Pew Research Survey noted that ridesharing had become more widely used in most demographic groups across the United States. In every category they surveyed, more people had used rideshares in 2018 than in 2015. In short, ridesharing is on the rise across the country.

When the customer is ready to be picked up, he or she can enter a pickup location and schedule the pickup. The customer will receive a notification when the Lyft or Uber driver accepts the customer’s request. Customers are even able to watch the driver move on the map within the app.

The Uber or Lyft driver will pick the customer up and drive him or her to the desired location. After the driver drops the customer off, the app will automatically charge the customer’s credit card. Drivers themselves do not carry or handle any cash or credit card information.

Ridesharing is a budget-friendly and convenient way to travel on short notice. Whether you are an Ohio local or you’re visiting Ohio from out-of-state, using a rideshare service can save you time and money. The use of ridesharing services has increased dramatically in the last few years. Over one-third of Americans use ridesharing services, and that number continues to climb.

Ridesharing sharing companies allow customers to book a one-way transportation service on short notice. Customers pull up their smartphones, book a driver, and wait for the driver to arrive. The ridesharing scheduling and payment process take place entirely online. Passengers pay their drivers through a mobile application, and can leave reviews based on the service they receive. The most popular ride-sharing services are Lyft and Uber.

The average Uber or Lyft driver travels 2.8 miles between dropping off one customer and picking up the next customer. The term “deadheading” refers to the process of looking around to pick up customers. Uber and Lyft drivers may spend up to 60 percent of their time in this manner.

Deadheading can be incredibly dangerous. Instead of focus- ing on the road and surroundings, drivers are focused on picking up their next passenger. This practice contributes to traffic congestion, which increases the likelihood of an injury. Deadheading also causes dangerous driver distractions.

Traffic Deaths in the U.S.Ridesharing Leads to an Increase in Traffic Deaths

Ridesharing services are incredibly popular and convenient in Southwest Ohio and across the United States. Un- fortunately, a recent study conducted by the University of Chicago and Rice University, has linked ridesharing to traffic fatalities. Research from the study concludes that ridesharing services have increased U.S. traffic deaths by 2 to 3 percent since 2011. As many as 1,100 people die every year in ridesharing accidents.

To conduct the study, researchers compared data released from Uber and Lyft with statistics from the National Highway Traffic Safety Administration in each city. They also checked the accident rates in cities relative to the number of miles each vehicle traveled. The researchers noticed that the accident rate in Chicago increased after Uber began offering ride services in that city. This phenomenon continued to happen in other cities when Uber or Lyft launched their services.

Stage 1: The Driver is Offline, or the App is Off

Stage 2: The Driver is Available and Waiting for a Ride Request

Stage 3: Drivers Are En Route to Pick Up Passengers and During Ridesharing Trips

In the first stage, the driver has turned off the application, or the driver is offline. During this stage, the driver’s personal insurance company and coverage will apply. Uber and Ly-ft’s insurance policies will not cover any accident that takes place when the driver is not online, meaning the Lyft or Uber application is not active.

During stage 2, drivers set their status as available on the app. Rideshare drivers will remain available on the app un-less they turn off the app or accept a ride request from a customer. During stage two, ridesharing companies offer the following third-party liability insurance if the driver's personal auto insurance coverage doesn't apply:

$50,000 PER PERSON in bodily injury coverage

$1,000,000in third-party liability

$100,000 PER ACCIDENT in bodily injury coverage

UNDERINSURED OR UNINSURED MOTORIST COVERAGE FOR BODILY INJURIES

$25,000 PER ACCIDENT in property damage

CONTINGENT COMPREHENSIVE AND COLLISION INSURANCE

When the driver does not have personal insurance coverage in the amounts listed above, the ridesharing company’s insurance policy will cover the accident.

Stage 3 begins when rideshare drivers accept a ride request and continue un-til drivers drop the customer off. Ride-sharing companies maintain the highest amount of auto insurance for drivers and passengers during stage 3, to include:

The contingent comprehensive and collision insurance applies to damage to the driver's vehicle. This coverage only applies if the driver had his or her own insurance that covers comprehensive and collision coverage for the car when not using the app.

When a ridesharing service's insurance does provide comprehensive and collision insurance, the driver is responsible for paying a $1,000 deductible.

The Three Stages of a Ridesharing TripRidesharing companies provide some motor vehicle insurance for their driver-partners. However, not all rideshare accidents are covered by Uber or Lyft’s insurance companies. Instead, Uber and Lyft divide up ridesharing trips into three separate stages. Each stage comes with different auto insurance protection. Understanding the three stages of a ridesharing trip can be incredibly helpful for both drivers and passengers.

What to Do If You Are a Rideshare Driver and You’re Injured on the Job

What to Do If You Are a Rideshare Driver and You’re Injured on the Job

The American economy has increasingly become a “gig economy” in recent years. More workers than ever are taking on part-time contract work outside of their regular employment to earn extra money. In 2017, the owner of Uber noted that over 2 million drivers worked part-time for Uber, providing over 15 million rides per day in over 500 cities.

Becoming a ridesharing driver allows individuals and families to earn extra money whenever they have an hour or more to spare. Rideshare drivers are independent contractors, not employees. They do not enjoy the same benefits and legal protections that employees enjoy. Nonetheless, rideshare drivers do enjoy the protection of Uber's or Lyft's insurance policies, depending on when the accident took place.

A Driver’s Insurance Coverage Depends on the Stage of the Trip

Are you an Ohio rideshare driver who's become injured on the job? If so, you may be worried about whether or not Uber's insurance policy will cover your injuries and property damage. Ridesharing companies provide their drivers with different amounts of insurance coverage, depending on the stage in which the accident took place.

Rideshare drivers and passengers receive coverage under a three-stage insurance plan offered by both Lyft and Uber. The amount of coverage to which drivers and passengers are entitled depends on the driver's activity at the time of the rideshare accident. Uber and Lyft require drivers to carry minimum amounts of personal auto insurance. When the driver's insurance doesn't cover the claims, Uber and Lyft insurance policies will step in and cover the remaining costs, up to their policy limits.

Uber Provides Limited Insurance Coverage for Drivers During Stage 2

During stage 1, the driver is offline, meaning the ridesharing app is off. When an accident happens during state 1, Uber and Lyft insurance policies will not cover your claim. Instead, your personal auto insurance policy will cover any accidents that take place during this stage.

The state of Ohio requires that all drivers purchase minimum amounts of personal auto insurance. It is illegal to drive any motor vehicle for any reason without insurance in Ohio. All drivers are legally required to purchase the following minimum insurance amounts:

● $25,000 for the injury or death of one person● $50,00 for the injury or death of two or more people● $25,000 for property damage in an accident

If you are at fault for the Uber or Lyft accident during stage 1, you and any other injured parties may file a claim on your insurance policy. What happens if you are not at fault for the accident during stage 1? You and any of your passengers will be able to file a claim with the at-fault driver’s insurance company. What happens when the at-fault driver does not have insurance?

Even though it is illegal to do so, many people continue to drive without minimum levels of insurance in Ohio. You may be able to file an underinsured or uninsured driver's claim with your own insurance company. Purchasing under-insured or uninsured driver's insurance is not mandatory in Ohio, but many drivers do pay for this optional coverage.

Rideshare companies do provide limited insurance coverage for drivers when an accident takes place during stage 2. In stage 2, the rideshare driver has turned the app on and is available and waiting to accept a ride request from a customer. Ride-share companies provide the following insurance coverage to drivers and passengers during stage 2:

The Driver’s Personal Insurance Will CoverAccidents in Stage 1

STAGE 2STAGE 1

$50,000 PER PERSON in bodily injury coverage

$100,000 PER ACCIDENT in bodily injury coverage

$25,000 PER ACCIDENT in property damage

When a driver accepts a customer's request for a ride, stage 3 begins. Stage 3 continues until the driver drops off the customer. During stage 3, Uber and Lyft offer the most in terms of insurance protection for drivers. Both the rideshare driver and passenger will receive coverage under the $1 million policy.

Rideshare Companies Provide $1 Million in Coverage for Drivers During Stage 3

PICK-UPAREA

STAGE 3Accidents Caused by Uninsured or Underinsured MotoristsRideshare companies also carry a $1 MILLION POLICY for uninsured or underinsured motorists during stage 3. When the at-fault driver does not have insurance or does not have enough insurance to cover the damages, the ridesharing company's insurance will kick in and cover the costs of the accident, up to $1 million.

Who Is Liable for Property Damage During a Rideshare Accident?Drivers may be entitled to collision and comprehensive coverage for their property damage when the accident happens during stage 3. When a rideshare driver's personal insurance policy includes coverage for collision and comprehensive coverage, Uber or Lyft's insurance coverage will take its place.

Uber or Lyft’s policy will cover the costs of repairing the driver’s vehicle due to an accident caused by Stage 3. Rideshare drivers must pay a $1,000 deductible to take advantage of this coverage, however.

What if the rideshare driver does not have collision and comprehensive coverage? In this instance, Uber and Lyft will not provide collision and comprehensive coverage. If another driver caused the motor vehicle accident, the Uber or Lyft driver could file a claim for property damage with the at-fault driver's insurance company. Or, the ridesharing driver may benefit from bringing a personal injury lawsuit for damages, from including property damage to his or her vehicle.

Make sure that you attend all follow-up appointments and take every step that your doctor recommends that you take. Keep records of all of your appointments and prescriptions, as these records could become significant evidence in seeking compensation for your injuries.

I’m a Rideshare Driver. What Should I Do After an Accident? All motor vehicle accidents come as a shock to those in-volved. Even experienced drivers can become uncertain as to how to respond after a car accident. If you are an Uber or Lyft driver and you're in an accident, you will likely be confused and stunned. You or your passengers may be injured and in pain.

As a rideshare driver, it is wise to keep a copy of the steps you should take after an accident in your vehicle. Should an accident happen while you're driving for Uber or Lyft, you will be able to quickly pull out the list. By going through the list step-by-step, you will make sure that you don't miss any crucial steps.

Stop Your Vehicle And Call the Police

Collect Important Information and Exchange Insurance Information

Take Pictures of the Scene

Report the Accident to the Ridesharing CompanyDo Not Admit Fault

If your vehicle is still moving after the accident, stop your vehicle and pull it over to the side of the road and bring your vehicle to a complete stop. If mov-ing your vehicle to the side of the road is not an option, turn your vehicle off and park on the side of the road. Call 911 if you or any of your passengers are injured and need medical treatment.

Next, call the police. You will need to request a police report after the accident takes place. Police reports offer important legal proof when filing an insurance claim or when bringing a personal injury lawsuit. These reports provide another record of the accident taking place and the positioning of the vehicles.

During the shock of the accident, it is easy to admit fault, even when you were not the at-fault driver. When police officers begin asking you questions, refrain from admitting that you caused the accident. Sometimes innocent drivers admit fault because of the stress of the situation.

As with any other car accident, you will need to collect important information from witnesses and other drivers.Write down the names, telephone numbers, and addresses of witnesses and drivers. Gather the contact information of your Uber or Lyft passengers as well before they leave the scene of the accident. Exchange insurance information with all drivers involved in the accident.

If you can do so, take pictures of the scene of the accident with your smart-phone. Take photos of your injuries as soon as possible after the accident. Also, take photos of any property damage to your vehicle.

Keep Records of Your Medical TreatmentWhen you visit the doctor after your ridesharing accident, describe your pain using a specific language. Many of us tend to downplay our illnesses and injuries as being "no big deal." After a car accident, downplaying injuries can have negative consequences. Describing your pain and symptoms in detail will benefit you when you make an insurance claim or file a personal injury lawsuit.

Rideshare company drivers are required to fill out an Uber or Lyft Accident Form. Drivers can select the help setting in their driver app to file the report. Next, confirm with the rideshare company that they received your accident report. Typically, someone from the ridesharing company will contact you soon after you file the report to begin the investigation. When they do, the other drivers involved

or the insurance company can use that admission against you. Keep your answers brief and to-the-point. Do not speak to the other driver except to gather the necessary information.

Speak with an Ohio Rideshare Accident AttorneyIn some cases, Uber and Lyft may deny a valid insurance claim against their policy. In rideshare accidents, drivers have a lot at stake, includ-ing their financial security. Speaking with a lawyer as soon as possible is an essential step to protect your right to compensation.

Ohio residents use rideshare services because they are an affordable and convenient way to get alone. Unfortunately, rideshare accidents do happen in Ohio. As the rideshare industry grows in Ohio, more Lyft and Uber drivers will be involved in motor vehicle accidents. If you become injured as a passenger in a Lyft or Uber accident, you may have several options to recover compensation.

Rideshare companies do provide insurance coverage, depending on the type of accidents. Uber and Lyft insurance policies do not always cover the extent of your injuries or property damage, however. In some cases, Uber and Lyft deny claims made on their insurance policy, and drivers will not receive compensation for injuries caused by the rideshare accident.

Rideshare drivers may benefit from filing an Ohio personal injury lawsuit. When another driver caused the rideshare driver's injuries, that driver may be liable for damages caused by accident. When the rideshare driver can successfully prove that the at-fault driver caused his or her injuries, the following types of compensation are available:

APPOINTMENT REMINDER FOR:

ANY FUTURE MEDICAL EXPENSES NEEDED TO TREAT A DISABILITYRELATED TO THE ACCIDENT

DRIVER’S LOSS OF EARNING POTENTIAL AFTER THE ACCIDENT

Without a car, many rideshare drivers can’t earn a living! This lost income

can be a huge problem!

Lost wages mean late payments, more debt, and possibly worse!

Finally, when the at-fault driver causes another person's death, the surviving family can file a wrongful death lawsuit. Wrongful death lawsuits are personal injury lawsuits that provide compensation for funeral expenses, burial costs, medical expenses prior to death, loss of earning capacity, and pain and suffering.

Determining Who Was at Fault for the Rideshare

Recovering Compensation When A Third Party Driver Was at Fault

The first step is to determine who was at fault or liable for the accident. Typically, either your rideshare driver or another third party driver was at fault for the accident. Rideshare passengers are rarely, if ever, at fault for rideshare accidents. Experienced rideshare accident attorneys will thoroughly investigate the accident using all available evidence to determine which driver is liable for your injuries.

Ohio is a fault-based state when it comes to filing insurance claims. The driver who is at-fault for the accident, or who causes the accident, is financially responsible for the losses of injured people. The driver who caused your injuries is financially responsible for your financial losses. Recovering compensation depends on whether or not the at-fault driver has adequate insurance coverage.

When the other driver is at fault, you will be able to file a claim with the at-fault driver's motor vehicle insurance policy. For example, if a random third party car hit your ridesharing vehicle, the third-party driver is at fault and liable for the accident. You will be able to file a claim with the third-party driver's insurance. What happens if the at-fault driver does not have insurance or is underinsured? Should an accident take place during stage 2, the Uber and Lyft's $1 million uninsured and under- insured motorist coverage will step in and cover the accident.

Recovering Compensation When Your Uber or Lyft Driver Was at FaultWas your rideshare driver texting while driving or distracted in another way when the accident happened? Did your driver drive through a yellow light and cause a collision at an intersection? When your Uber or Lyft driver was at fault for your accident while driving you to your destination, you will be able to file a claim under Uber or Lyft’s insurance policy.

Rideshare companies provide passengers who suffer injuries with $1 million in liability coverage. Many clients ask us if they can bring a lawsuit against Uber or Lyft directly when one of their drivers is at fault for the accident. Bringing a lawsuit directly against Uber or Lyft is typically not an option. Uber and Lyft drivers are not employees of those companies. Instead, they are independent contractors. The best option for recovering compensation for your injuries caused by a Lyft or Uber driver is to file a claim with Uber or Lyft's insurance policy.

What to Do As a Passenger After a Ridesharing AccidentWhat to Do As a Passenger After a Ridesharing AccidentHere are some steps you should take as a passenger who is involved in a rideshare accident in Ohio:

Call the Police and 911, If Necessary

Report the Car Accident to the Rideshare Company

Save Important Documents and Take Notes

Contact an Ohio Ridesharing Lawyer as Soon as Possible

Gather Information and Take Photos

Call the Police and 911, If Necessary

Report the Car Accident to the Rideshare Company

Save Important Documents and Take Notes

Contact an Ohio Ridesharing Lawyer as Soon as Possible

Gather Information and Take Photos

As with any auto accident, the first step after the vehicle stops is to call 911 if anyone is hurt. Next, call the police. You will need a police report when filing for insurance claims, or when pursuing a personal injury lawsuit against the at-fault driver. The police will also help you exchange relevant information with the other parties involved.

Be sure to get the phone number, address, and name of the rideshare driver and any other drivers involved in the accident. Also, be sure to get the rideshare driver's personal car insurance policy information. Should Uber or Lyft deny your insurance claim, you may need to file a claim with the driver's personal insurance company.

Write down the make, model, license plate, and registration of all cars involved in the accident. Also, write down the contact information of any witnesses to the accident. If you can take photos, such as with your cell phone's camera, do so. Be sure to take photos of the positions of the vehicles, any dangerous road conditions, and the damage to both cars. Take pictures of your injuries as well.

In some cases, rideshare drivers are reluctant to report the rideshare accident to Lyft or Uber. However, it is best to ensure that you or the driver report the accident as soon as possible. Keep in mind that rideshare companies do not always have the passenger's best interest in mind. They are for-profit companies who attempt to avoid paying insurance claims on behalf of passengers whenever possible.

The more information and documents you can save, the better. Keep all information related to your medical visits and specialist appointments. Keep a notebook and write down the dates and times of all important phone calls with insurance companies. Make a note of your daily pain levels. Write down any activities that you've struggled to do because of your injuries. This information will help you greatly should you pursue a personal injury lawsuit. The more information you have available, the better you can protect your claims to compensation.

Uber and Lyft will often begin the accident investigation process soon after the driver submits an accident report. Injured passengers are usually in a state of shock and may unintentionally admit fault or say something that could hurt their claim shortly after the accident. Hiring a skilled rideshare injury lawyer soon after the accident is essential.

An effective lawyer can help you make statements to insurance companies and negotiate with them to ensure you receive a fair amount of compensation for your injuries. When necessary, a skilled legal team can help you file a personal injury lawsuit against the at-fault driver or drivers.

What Damages are Passengers Entitled to After a Rideshare Accident?

Compensation for Property Damage

Damages for Bodily Injury from a Rideshare Accident

Under Ohio law, the at-fault driver in an auto accident is liable for the injuries caused by the accident. When a third-party driver is at-fault for the accident, you will be able to file a claim with his or her auto insurance compa-ny. When your rideshare driver caused the accident while transporting you, you will be able to file a claim with Uber or Lyft’s insurance provider. As a passenger, you will most likely recover compensation for your bodily injuries.

Bodily injury insurance coverage provides compensation for damages caused by accident, up to the limits of the insurance policy. Injured passengers can receive compensation for all of the following:

Depending on the insurance coverage, passengers may also be entitled to compensation for any property damage. In serious accidents, personal property such as laptops and cell phones can become damaged. Be sure to report any damaged property to the insurance adjuster so you can receive compensation for your property damage.

Every day, out-of-state passengers suffer injuries in Uber and Lyft accidents in Ohio. For example, what happens when an Uber or Lyft driver picks up a passenger at an Ohio airport and then gets into an accident? Out-of-state passengers involved in a car accident in Ohio have a legal right to file a personal injury claim. Ohio courts have personal jurisdiction to hear car accident cases in Ohio, even when the injured party is not a resident of Ohio.

Ohio is an at-fault insurance state. When a rideshare accident happens while a driver is transporting a passenger, Uber and Lyft's $1 million insurance cov-erage will cover the accident. When the rideshare driver was at-fault for the accident, the out-of-state passenger has a right to file a claim with Uber or Lyft directly.

If a third-party driver caused the accident, the out-of-state passenger would need to file a claim with the out-of-state driver's policy. Uber and Lyft provide uninsurance and underinsurance coverage for pas-sengers. This coverage becomes available when the at-fault driver does not have insurance or does not have enough insurance to cover the passenger's in-juries. Uber and Lyft's insurance policies also cover hit-and-run accidents.

Out-of-state passengers who become injured in a ridesharing accident face unique challenges. When passengers are injured away from home, in an unfa-miliar location, every task can seem more stressful and complicated. Passengers who become injured out-of-state have additional hotel and transporta-tion expenses. Hiring a local Ohio rideshare attorney is essential for out-of-state passengers who suffer injuries. Passengers can rest assured knowing that a local attorney is fighting to ensure they receive compensation for all of the expenses related to the rideshare accident.

What to Do if You are a Third Party Driver Hit by a Ridesharing Car

What happens when a ridesharing driver causes a car accident? Will the rideshare insurance policy cover your injuries as a third-party driver? The answer depends on the stage of the rideshare during which the accident occurred. Ohio is an at-fault insurance state, meaning injured parties must seek compensation from the at-fault driver’s insurance policy.

Page 14: WHEN SHARING THE ROADjklawoffices.com/wp-content/uploads/2020/06/Rideshare... · 2020. 7. 23. · Uber Provides Limited Insurance Coverage for Drivers During Stage 2 During stage

What happens when a rideshare driver causes an accident in stage 2?Stage 1 includes the period in which the rideshare application is

offline or turned off. If a rideshare driver injured you in stage 1, you’d need to file a claim through the driver’s own insurance company. Unfortunately, many personal insurance policies will not cover accidents that happen when the driver is engaged in commercial activity. What happens when the driver’s personal insurance is not enough, or the driver is uninsured? You may need to file an un- insurance or underinsurance claim with your own insurance company.

Stage two includes the period when the driver app is on, and the driver is waiting to accept a cus-tomer. In this situation, rideshare companies offer reduced compensation with no deductible. When a rideshare driver causes an accident during this stage, you may be entitled to the following:

When the accident happens during stage 1, the rideshare driver’s personal insurance coverage will apply.

STAGE 2STAGE 1

$50,000 PER PERSON in bodily injury coverage

$100,000 PER ACCIDENT in bodily injury coverage

Stage 3 begins when a rideshare driver accepts a rideshare request from a customer and ends when the driver drops the customer off. Uber and Lyft both carry a $1 million insurance policy for accidents that take place during stage 3. Was the rideshare driver transporting a customer when he or she collided with your vehicle? If so, you will likely be able to re-cover compensation through the rideshare company’s $1 million policy.

The rideshare company’s insurance should compensate you for your injuries when the accident happened during stage 3.

After the police arrive and investigate the scene, they will prepare an official police report that you can use to back up your claim.

One of the best steps you can take after being injured by a rideshare accident is to document your medical treatment. Many insurance companies will claim that you were not in-jured or that your injuries are not as extensive as you claim. Documenting your medical treatment will help you prove the severity of your injuries. The Benefits of Hiring an Attorney After a Rideshare Accident

How Jones Kahan Law Works with YouHow Jones Kahan Law Works with You

As hiring rideshare drivers become more common, more Uber and Lyft drivers are involved in rideshare collisions. Accidents involving an Uber or Lyft driver are often more complex than other car accidents. If you’ve suffered an injury in a rideshare accident, your amount of compensation depends on several different factors, including the stage in which the accident occurred.

One of the biggest mistakes that a rideshare accident lawyer can make is to assume that Uber and Lyft will automatically pay them the benefits to which they are entitled. Like other for-profit companies, Uber and Lyft prioritize their profits above all other claims. These companies will fight to find a way to deny coverage to victims of rideshare accidents. Without the right preparation, legal knowledge, and strategy, victims of ridesharing accidents cannot recover compensation.
