Why have I received a Notice of Driver’s Licence Suspension?Ifyouhavenotmadeyoursupportpayments,theFamilyResponsibilityOfficemaybegintheprocessofsuspendingyourdriver’slicencebymailingyouadocumentcalledaFirstNoticeofDriver’s Licence Suspension.

When will my driver’s licence be suspended?Yourdriver’slicencewillbesuspended30daysafterthedateofyourFirstNoticeofDriver’sLicenceSuspension.The deadline date is set out in your notice.

EffectiveDecember2010,driverswhoselicenceshavebeensuspendedfornon-paymentofchildsupportmayhavethevehicletheyaredrivingimpoundedbypolice for seven days if caught driving with a suspended licence(RoadSafetyAct,2009).

How can I keep my driver’s licence? Ifyoudonotwanttoloseyourdriver’slicence,youmusttakeactionbeforethedeadlinedatesetoutinyourFirstNoticeofDriver’sLicenceSuspension.Therearethreewaysyoucankeepyour driver’s licence: • Immediately pay all the arrears owing. • EnterintoavoluntaryarrearspaymentplanwiththeFamilyResponsibilityOffice. • Ask the court for a Refraining Order.

Note: ARefrainingOrderisacourtorderthatpreventstheFamilyResponsibilityOfficefromsuspending your driver’s licence for a temporary period of time. You cannot get a Refraining OrderafterthedeadlineprovidedintheFirstNoticehasexpired.

What is a Refraining Order?ARefrainingOrderisanordermadebythejudgethatwillrequireyoutostartaMotiontoChangeyourcurrentsupportorder.ARefrainingOrdermayalsorequireyouto:

• ProvideyourfinancialinformationtotheFamilyResponsibilityOffice.

• Makeongoingpayments.

• Makepaymentsonthearrears.

IfthecourtissuesaRefrainingOrder,thejudgewillordertheFamilyResponsibilityOfficenotto suspend your driver’s licence.

Why would I decide to get a Refraining Order?Usually,youwoulddecidetogetaRefrainingOrderbecause:

• YoucannotreachapaymentagreementwiththeFamilyResponsibilityOffice.

• Youbelievethattheamountofsupportyoupayshouldbechanged.

• You have already applied to change the amount of support you must pay.

How do I make a motion to the court for a Refraining Order?

There are nine steps you must take to make a motion to the court for a Refraining Order. Every stepisimportant.Youcanusethissimplechecklisttobesureyouhavecompletedeachstep.

Important Date!TheFirstNoticeofDriver’sLicenceSuspensionthatwassenttoyouinthemailincludesadeadline.Ifyoudonottakeaction(optionsonpage5in“WhatchoicesdoIhavenow?”)beforethisdeadline,yourdriver’slicencewillbesuspended.IfyouhavereceivedaFinalNoticeofDriver’sLicenceSuspension,youmustbringyourpaymentsuptodatewithin15daysoryourdriver’slicencewillbesuspended.MakingamotionforaRefrainingOrderisnotanoptionafteryoureceiveaFinalNotice.YoucancheckyournoticetoseeifitisaFirstNoticeoraFinalNotice.

Step 1 Find out in which court you should be making a motion toFamilylawmatters,likechildsupportandspousalsupport,canbeheardinoneofthesecourts:

• TheOntarioCourtofJustice–formerlyknownastheOntarioCourt(ProvincialDivision)

• TheSuperiorCourtofJustice–formerlyknownastheOntarioCourt(GeneralDivision)

• TheFamilyCourtbranchoftheSuperiorCourtofJustice–formerlyknownasthe

UnifiedFamilyCourt

Normally,youwillbringyourmotiontothesamelevelofcourtthatmadeyoursupportorder.Youcanfindthenameofthecourtonyoursupportorderdocument.Youcanbringyourmotion to that court, either where you live, or where the person receiving the support lives.

If you do not have a copy of your support order: youcangetacopyfromthecourtoffice.Ifyoudonotrememberthecourtwhereyourorderwasmade,youcancalltheFamilyResponsibilityOfficeandaskforthatinformation.

Important to know. YoucanfindalistofOntariocourtaddressesandphonenumbersonlineat www.attorneygeneral.jus.gov.on.ca.

Step 2 Gather the information and forms you will needBeforeyoubeginyouwillneed:

• acopyofyourFirstNoticeofDriver’sLicenceSuspension

• a copy of your support order

• yourFamilyResponsibilityOfficecasenumber(foundontheFirstNotice)

• yourcourtfilenumber(foundonthesupportorder)

• two pieces of valid identification, including valid photo identification such as a driver’s licence, passport or photo health card

Where to get helpIf you need help filling out these forms, you may want to get advice from a lawyer. You can alsovisittheFamilyLawInformationCentre(FLIC)atyourlocalfamilycourt.

If you do not have a copy of your support order, contact the court at which the order was made for a copy.

Step 3 Fill out the formsNotice of Motion Form (FLR Form 14)This form allows you to tell the judge that you are seeking a Refraining Order to prevent the suspension of your driver’s licence. It also shows the day and time you will go to court. You will getthisdayandtimebyvisitingthefamilycourtofficelaterintheprocess(seeStep4).

Affidavit (FLR Form 14A)This form allows you to provide your side of the facts, which the judge will use to make a decisionaboutyourmotion.Itisyourchancetotellyourstorytothejudgeinaclearandconvincingway.EverythingyouneedtotellthejudgemustbewrittendownintheAffidavit.Youmaynotbeallowedtotellthejudgeanythingelsewhenyougotocourt.Forthatreason,itisextremelyimportantthattheinformationyouprovideis:

• accurate and complete

• clear and specific

• detailed enough to provide all the information the judge will need

AnAffidavitmustbeswornoraffirmed.Whenyouswearanoathoraffirmadocument,itmeansyouarepromisingthattheinformationinthedocumentistrue.YoucanbechargedforcommittingacrimeifyoudonottellthetruthwhenyouswearoraffirmyourAffidavit.

Where can you swear or affirm the Affidavit?YoucanswearanoathoraffirmyourAffidavitinfrontofalawyer,ajusticeofthepeace,anotarypublicoracommissionerfortakingaffidavits.Youshouldbeabletogetthisdoneatafamilycourt.Besuretobringtwovalidpiecesofidentificationwithyou,includingvalidphotoidentification such as a driver’s licence, passport or photo health card.

Financial Statement (FRO Form 4) or Financial Statement (FLR Form 13)YoumustalsofilloutandswearoraffirmaFinancialStatement.Thisprovidesthecourtwithimportantinformationaboutyourfinances including:

• the amount and sources of your income

• theamountofyourlivingexpenses

• theamountofyourassetsanddebts

TolearnmoreabouthowtofilloutaFinancialStatement,visitthewebsiteoftheMinistryoftheAttorneyGeneraltogetthepublication“AGuidetoProceduresinFamilyCourt”.Youwillfind this guide at: www.attorneygeneral.jus.gov.on.ca/english/family/guides.

Step 4 Get a hearing dateYoumustservetheFamilyResponsibilityOfficeatleastfourdaysbeforeyourhearingdate.Ifyouhavelessthanfourdays,besuretoservetheFamilyResponsibilityOfficeassoonaspossible.

Youcancallorvisitthefamilycourtofficetogetahearingdateforyourmotion.ThehearingdatemustbefilledinonyourNoticeofMotion.Youmaybeaskedtocometothefamilycourtofficeinpersontogetahearingdate.Ifso,youshouldbringatleastonecopyofallyourdocuments plus the originals.

Step 5 Give copies of your forms to the Family Responsibility Office.Onceyouhaveahearingdateforyourmotion,youwillneedtoprovidetheFamilyResponsibilityOfficewithacopyofyourdocuments.Thisisanimportantpartoftheprocess.Inlegalterms,itiscalledservice.Whenyouserveyourforms,youaretellingtheFamilyResponsibilityOfficewhatyouintendtoshowincourt.

You can serve your forms in two ways:

1. byfaxto416-240-2402

2. bymailordeliverytothe: LegalServicesBranch

ReminderYourmotionmustbeheardincourtbeforethedeadlinedateonyourFirstNoticeofDriver’sLicenceSuspension.Yourhearingdatecannotbeafterthedeadlinedate.

Step 6 File your forms with the courtYou must take your original documents to the court and give them to the family court clerk. In legal terms, this is called filing. These are the documents you will need to file:

• NoticeofMotion

• Affidavitandattachedexhibits(seeSampleAffidavitintheappendixforinstructions)

• FinancialStatement

• AffidavitofService

The court clerk keeps a file on your case called a Continuing Record. It contains all of the documentsthathavebeenfiledonyourcase,andatableofcontentslistingthesedocuments.The court clerk will ask you to add your documentstothisfile,andtoupdatethetableofcontents.IfnoContinuingRecordexistsyoumaybeaskedbythecourtclerktocreateone.

Step 7 Confirm that you will attend court.You need to tell the court that you will attend on your hearing date, and that you are ready to goahead.YoucandothisbyfillingouttheConfirmationform(FLRForm14C).Youcanfaxthisformtothecourt,orbringtheformtothecourtinperson.Youmustdeliverthisformtothecourtnolaterthan2:00intheafternoon,twodaysbeforeyourhearingdate.Ifyoumissthisdeadline, the court may refuse to hear your motion.

Important DateYoumustfileyourdocumentswiththecourtatleastfourdaysbeforeyourcourtdate.Ifyounolongerhavefourdays,besuretofileyourdocumentsassoonaspossible.

Step 8 Go to court on your hearing dateYoushouldarriveatthecourtatleast30minutesbeforethetimeofyourhearing.Besuretobringcopiesofallofthedocumentsyouhavefiledwiththecourt.

Beforeyourcourtappearance,youshouldmeetwiththeFamilyResponsibilityOfficelawyer,who will call your name in the waiting room. The purpose of this meeting is to attempt to makepaymentarrangementswiththeFamilyResponsibilityOffice.

IfyouandtheFamilyResponsibilityOfficelawyeragreeonpaymentterms,thenyouwillbeabletogetaRefrainingOrderonconsentincourt.IfyoudonotreachanagreementwiththeFamilyResponsibilityOfficelawyer,thenthejudgewillmakethedecision.

IfyouaregivenaRefrainingOrderincourt,thejudgewillrequireyoutostartaMotiontoChangeyoursupportorder.Thejudgemayalsoimposeconditionsthatyoumustmeet.Forexample,thejudgemaydecidethatyoumust:

• providefinancialinformationtotheFamilyResponsibilityOffice

• make ongoing payments

• make payments on the arrears

How can I start a Motion to Change?YoucanlearnmoreaboutstartingaMotiontoChangeontheFamilyResponsibilityOfficewebsite,under“InformationforPeoplePayingSupport,HowdoIchangemysupportorder,endsupportorlowermypayment?”

If you do not have a lawyer, you may want to speak with duty counsel upon your arrival. DutycounselarelawyerspaidbyLegalAidOntariowhoworkinfamilycourts.Ifyouarenotrepresentedbyalawyer,dutycounselcanhelpyouby:

• givingyoubasiclegalinformationandadvice

• helping you prepare documents

• assisting you in the courtroom, in some cases

• helpingyounegotiatesettlementtermswiththeFamilyResponsibilityOfficelawyerwho willalsobeattendingcourtthatday

Step 9 Take the steps ordered by the court.IfthejudgehasorderedyoutostartaMotiontoChangeyoursupportorder,youmustdo this within 20 days of receiving the Refraining Order. You will also need to provide the FamilyResponsibilityOfficewithacopyofyourMotiontoChange.

Besuretodoeverythingthejudgemayhaveorderedyoutodo.Forexample,thejudgemay order that you pay a certain amount of money, or take other steps.

IfyoudonotstartaMotiontoChange,ortaketheotherstepsorderedbythejudge,yourRefrainingOrderwillterminate.ThismeanstheFamilyResponsibilityOfficecansuspendyour driver’s licence.

Herearesometipsthatwillhelpyouavoidproblemswithyourchildsupportorspousalsupport:

• Pay your support in full and on time to avoid enforcement action.

• MakeyoursupportpaymentsthroughtheFamilyResponsibilityOffice.Donotpay the support recipient directly.

• Alwaysincludeyourseven-digitcasenumberandyourfirstandlastnameonyour paymentandinallcommunicationwiththeFamilyResponsibilityOffice.

• If your financial situation changes, you may wish to contact a lawyer to find out what youroptionsare.TheFamilyResponsibilityOfficecannotchangetheamountof support you pay. If you want the amount of support to change, you must commence a MotiontoChange.

• Ifyoufallbehindonyourpayments,youshouldcontacttheFamilyResponsibility Officetomakepaymentarrangementswithyourcasecontact.Youwillbeaskedtofill outaFinancialStatementandadocumentcalledaVoluntaryArrearsPaymentSchedule (VAPS).

• TelltheFamilyResponsibilityOfficeaboutanychangestoyourname,addressor incomesourcewithin10daystoavoidfileerrorsandpossibleenforcementaction.

• Keepyourownrecords(paystubs,copiesofcancelledcheques,receipts).TheFamily ResponsibilityOfficedoesnotprovideayear-endstatementforincometaxpurposes.

Support Order: An order for the payment of money toward the support or maintenance of a child or spouse. Alsoincludesadomesticcontractrequiringsupportpaymentsthathasbeenfiledwiththecourt.

Voluntary Arrears Payment Schedule: Aplantorepaysupportarrears(debt)owingtoarecipient.Thepayorproposestheplan.TheFamilyResponsibilityOfficereviewsitand,ifacceptable,agreestoit.Theplanisproposedbythepayorand,ifacceptable,agreedtobytheFamilyResponsibilityOffice.
