Standard of Care for Agents

The National Association of Insurance Commissioners (NAIC) hasrecently adopted a new model regulation that establishes a “bestinterest” standard of care for agents who sell annuity products. It alsoincludes a series of new compensation and disclosure requirementsfor such agents. Although NAIC models do not have the force of law on their own andoperate only as recommendations to state policymakers, there is aconcern that similar proposals could be adopted in individual statesand even extended to other lines of insurance and ultimately to every

agent and every insurance transaction.
