Requested Action:Dredge and fill 1,774 square feet, 187 linear feet, of the bed and bank of Moose Brook to stabilize bank of Moose Brook byextending an existing j-hook into a full channel cross-vane, creating a floodplain shelf, and installing rip-rap and boulders. With Conditions:1. All work shall be in accordance with plans by Loureiro Engineering Associates, Inc. entitled Pike Industries, Inc.: Moose BrookBank Stabilization Phase 11 (Sheets 1-8 of8) dated August 24, 2015 as received by DES on September 10, 2015.2. A qualified professional shall monitor the project during construction to verifr that all work is done in accordance with theapproved plans and narratives, adequate siltation and erosion controls are properly implemented, and no water quality violationsoccur. A follow-up report including photographs of all stages of construction shall be submitted to the DES Wetlands Programwithin 60 days of final site stabilization.3. Work shall be done during annual low flow conditions and during the months of July through September. No in-stream workshall occur after October 1 unless a waiver of this condition is issued in writing by DES in consultation with NH fish & Game.4. Appropriate siltation and erosion controls shall be in place prior to construction, shall be maintained during construction, andshall remain until the area is stabilized. Temporary controls shall be removed once the area has been stabilized.5. Appropriate turbidity controls shall be installed prior to construction, shall be maintained during construction such that noturbidity escapes the immediate dredge area, and shall remain until suspended particles have settled and water at the work site hasreturned to normal clarity.6. Construction equipment shall be inspected daily for leaking fuel, oil, and hydraulic fluid prior to entering surface waters orwetlands or operating in an area where such fluids could reach groundwater, surface waters, or wetlands.7. The pennitte&s contractor shall maintain appropriate oil/diesel fuel spill kits on site that are readily accessible at all times duringconstruction, and shall train each operator in the use of the kits.8. All refueling of equipment shall occur outside of surface waters or wetlands during construction. Machinery shall be staged andrefueled in upland areas only.9. Faulty equipment shall be repaired immediately prior to entering areas that are subject to RSA 482-A jurisdiction.10. All equipment shall work from adjacent banks or uplands and shall not enter flotving water.11. Extreme precautions shall be taken within riparian areas to prevent unnecessary removal of vegetation during construction.12. Area of temporary impact shall be regraded to original contours following completion of work.13. Within three days of final grading or temporary suspension of work in an area that is in or adjacent to wetlands or surface waters,all exposed soil areas shall be stabilized by seeding and mulching during the growing season, or if not within the growing season, bymulching with tackifiers on slopes less than 3:1 or netting and pinning on slopes steeper than 3:1.14. Where construction activities occur between November30 and May 1, all exposed soil areas shall be stabilized within 1 day ofestablishing the grade that is final or that otherwise will exist for more than 5 days. Stabilization shall include placing 3-inches ofbase course gravels, or loaming and mulching with tack or netting and pinning on slopes steeper than 3:1.15. The contractor responsible for completion of the work shall use techniques described in the New Hampshire Stonnwater Manual,Volume 3, Erosion and Sediment Controls During Construction (December 2008).16. Any further alteration of areas on this property that are subject to RSA 482-A jurisdiction will require a new application andfurther permitting.

With Findings:1. This is a major project per Administrative Rule Env-Wt 303.02 (1) Projects which, when taken in the aggregate with previouswork on the property within the last 5 years, would be considered major.2. The proposed project is Phase II of previously completed stabilization and repairs (Wetlands Permit 2013-00319).3. The need for the proposed impacts has been demonstrated by the applicant per Env-Wt 302.01.4. The applicant has demonstrated by plan and example that each factor listed in Env-Wt 302.04 Requirements for ApplicationEvaluation, has been considered in the design of the project.5. The proposed project is a response to historical chairnelization of Moose Brook that has resulted in a highly incised stream,increased sheer stress at high flows, and bank instability. The stream channel lacks access to floodplain and cannot dissipate energyduring high flow events6. The project is needed to restore access to the floodplain shelf and increase width of the channel; reducing the depth of flow andshear stress at the current channels most constricted point.7. Downstream of the project area the brook appears to widen and exhibit more normal characteristics.8. Moose Brook has been identified as having both Eastern Brook Trout and Rainbow Trout. The permit is conditioned on workoccurring between July 1 and September 30.9. The applicant provided written pennission from the property owner of Gorham Tax Map U-8, lot 15 for work to occur on theirproperty.10. The applicant provided a written permission from the owner of property located at Town of Gorham tax map Map U-8, Lot 18waiving the Nil Wetlands Bureau requirement of maintaining a 20 foot setback.11. No comments were submitted from the Conservation Commission or the Natural Heritage Bureau.12. The project is for bank stabilization and to protect existing infrastructure and therefore does not require compensatory mitigationper Administrative Rule Env-Wt 302.03(c)(2)c.13. In accordance with RSA 482-A:8, DES finds that the requirements for a public hearing do not apply as the permitted project isnot of substantial public interest, and will not have a significant impact on or adversely affect the values of the riverine resources, asidentified under RSA 482-A: 1.

substructure work area from the surface waters.6. Temporary cofferdams shall be entirely removed immediately following construction.

7. Construction equipment shall not be located within surface waters.

8. Discharge from dewatering of work areas shall be to sediment basins that are: a) located in uplands; b) lined with hay bales or

other acceptable sediment trapping liners; and c) set back as far as possible from wetlands and surface waters, in all cases with a

minimum of 20 feet of undisturbed vegetated buffer.9. Appropriate turbidity controls shall be installed prior to construction, shall be maintained during construction such that no

turbidity escapes the immediate dredge area, and shall remain until suspended particles have settled and the water at the work site

has returned to normal clarity.10. Within three days of the last activity in an area, all exposed soil areas, where construction activities are complete, shall be

stabilized by seeding and mulching during the growing season, or if not within the growing season, by mulching with tack on slopes

steeper than 3:1 or netting/matting and pinning on slopes steeper than 2:1.

11. ‘here construction activities have been temporarily suspended within the growing season, all exposed soil areas shall be

stabilized within 14 days by seeding and mulching or if temporarily suspended outside the growing season, all exposed areas shall be

13. Extreme precautions to be taken within riparian areas to limit utmecessary removal of vegetation during road construction and

areas cleared of vegetation to be revegetated as quickly as possible.14. There shall be no further alteration to wetlands or surface waters without amendment of this permit.

15. Standard precautions shall be taken to prevent import or transport of soil or seed stock from nuisance, invading species such as

purple loosestrife or Phragrnites.16. The impacts associated with the temporary work shall be restored immediately following construction.

With Findings:1. This is a major impact project per Administrative Rule Env-Wt 303.02(p), a replacement of a stream crossing structure in a tier 3

stream.2. The need for the proposed impacts has been demonstrated by the applicant per Env-Wt 302.01.

3. The applicant has provided evidence which demonstrates that this proposal is the alternative with the least adverse impact to areas

and environments under the department’s jurisdiction per Env-Wt 302.03.

4. The applicant has demonstrated by plan and example that each factor listed in Env-Wt 302.04(a) Requirements for Application

Evaluation, has been considered in the design of the project.

5. The project does not require mitigation as this meets rule Env-Wt 302 .03(c)(2)(c), protection of existing infrastructure.

6. In accordance with RSA 482-A:8, DES finds that the requirements for a public hearing do not apply as the permitted project is

not of substantial public interest, and will not have a significant impact on or adversely affect the values of the riverine resource, as

crossings (twin 15” culvert: 30” culvert) each with 4 foot wide box culvert, sediment removal, and stream channel restoration.************************************

3. Work shall be done during non-flow or in the dry.

4. Materials used to emulate a natural stream channel surface must be rounded, smooth stones similar to the natural stream substrate

and shall not include angular rip-rap.5. Appropriate siltation and erosion controls shall be in place prior to construction, shall be maintained during construction, and

shall remain until the area is stabilized. Temporary controls shall be removed once the area has been stabilized.

6. Appropriate turbidity controls shall be installed prior to construction, shall be maintained during construction such that no

turbidity escapes the immediate dredge area, and shall remain until suspended particles have settled and water at the work site has

returned to normal clarity.7. All dredged and excavated material and construction-related debris shall be placed outside of the areas subject to RSA 482-A.

Proper headwalls shall be constructed within seven days of culvert installation.15. The contractor responsible for completion of the work shall use techniques described in the New Hampshire Stormwater Manual,Volume 3, Erosion and Sediment Controls During Construction (December 2008).16. Any further alteration of areas on this property that are subject to RSA 482-A jurisdiction will require a new application andfurther permitting.

With Findings:1. This is a Minor Project per Administrative Rule Env-Wt 303.03 (h) Projects involving less than 20,000 square feet of alterationin the aggregate in nontidal wetlands, nontidal surface waters, or banks adjacent to nontidal surface waters which exceed the criteriaof Env-Wt 303.04(0.2. The need for the proposed impacts has been demonstrated by the applicant per Rule Env-Wt 302.01.3. The proposed project is needed because the site is unsafe and the pavement has reached the end of useful life.4. The applicant has provided evidence which demonstrates that this proposal is the alternative with the least adverse impact toareas and environments under the department’s jurisdiction per Rule Env-Wt 302.03.5. The applicant has demonstrated by plan and example that each factor listed in Rule Env-Wt 302.04 Requirements forApplication Evaluation, has been considered in the design of the project.6. The proposed site improvements are intended to improve overall surface water quality entering the wetlands. The project seeksto make improvements during roadway reconstruction to reduce sedimentation and erosion, and control storrnwater runoff into thewetlands to provide improvement to hydrology and water quality. The project proposes to install pervious pavement in areas that arecurrently imnpervious.7. The agent stated that the two existing 15” culverts appear to have been installed at the incorrect location (off-set from thecenterline of the drainage). The project intends to improve connectivity between the east and west side of the driveway.8. The proposed replacement stream crossings meet the criteria of Env-Wt 904.07 for the replacement of a Tier One or Tier 2stream crossing as the proposed crossings meet the general criteria specified in Env-Wt 904.01; will not diminish the hydrauliccapacity of the crossing; and will not diminish the capacity of the crossing to accommodate aquatic life passage.9. In a letter dated received October 30, 2015 the Hanover Conservation Commission provided suggestions for the project and planset.10. On January 25, 2016 the agent submitted a response and revised plans following the suggestions of the Hanover ConservationCommission.11. The NFl Natural Heritage Bureau commented that although there was a NHB record present in the vicinity, they do not expectthat it will be impacted by the proposed project.

2015-02724 TROOP, CYNTHIA/ROBERTMEREDITH Lake Winnipesaukee

Requested Action:Remove an existing permanent “U” shaped docking structure, and construct a 6 ft. x 36 ft. crib pier connected to a 6 ft. x 40 ft. cribpier by a 6 ft. x 12 ft. walkway, drive two 3-pile ice clusters, install a permanent boatlift and a 14 ft. x 30 ft. seasonal canopy in thecenter slip, a seasonal boatlift and 2 seasonal personal watercraft lifts in the outer slips, and construct a 478 sq. ft. perched beach onan average of 156 feet of shoreline frontage along Lake Winnipesaukee, in Meredith.* * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * *

Conservation Commission/Staff Comments:11/09/2015 Con. Com. has a number of concerns with the plans for both the docking structure and for the perched beach. Analternative type of docking structure was suggested by the Con. Com. They also do not believe the perched beach should beauthorized in the location proposed in the plan.

Remove an existing permanent “U’ shaped docking structure, and construct a 6 ft. x 36 ft. crib pier connected to a 6 ft. x 40 ft. crib

pier by a 6 ft. x 12 ft. walkway, drive two 3-pile ice clusters, install a permanent boatlift and a 14 ft. x 30 ft. seasonal canopy in the

center slip, a seasonal boatlift and 2 seasonal personal watercraft lifts in the outer slips, and construct a 478 sq. ft. perched beach on

an average of 156 feet of shoreline frontage along Lake Winnipesaukee, in Meredith.

With Conditions:1. All work shall be in accordance with plans by New Hampshire Environmental Consultants dated September 13, 2015, and revised

through February 1, 2016, as received by DES on February 3, 2016.2. This permit is not valid and effective until it has been recorded with the appropriate county Registry of Deeds by the applicant.

Prior to starting work under this permit, the permitted shall submit a copy of the recorded permit to the DES Wetlands Program by

certified mail, return receipt requested.3. All development activities associated with this project shall be conducted in compliance with applicable requirements of RSA

483-B and N.H. Code of Administrative Rules Env-Wq 1400 during and after construction.

4. This permit does not authorize the removal of trees or saplings within the waterfront buffer that would result in a tree and sapling

point score below the minimum required per RSA 483-B:9, V, (a)(2)(D)(iv).

5. Work authorized shall be carried out such that there are no discharges in or to spawning or nursery areas during spawning

seasons. Impacts to such areas shall be avoided or minimized to the maximum extent practicable during all other times of the year.

6. Work shall be carried out in a time and manner to avoid disturbances to migratory waterfowl breeding and nesting areas.

7. Appropriate siltation and erosion controls shall be in place prior to construction, shall be maintained during construction, and

shall remain until the area is stabilized. Temporary controls shall be removed once the area has been stabilized.

8. Appropriate turbidity controls shall be installed prior to construction, shall be maintained during construction such that no

turbidity escapes the immediate dredge area and shall retnain until suspended particles have settled and water at the work site has

returned to normal clarity.9. All dredged and excavated material and construction-related debris shall be placed outside of the areas subject to RSA 482-A.

Any spoil material deposited within 250 feet of any surface water shall comply with RSA-483-B.

10. The contractor responsible for completion of the work shall use techniques described in the New Hampshire Stormwater

Manual, Volume 3, Erosion and Sediment Controls During Construction (December 2008).11. Any subdivision of the property frontage will require removal of a sufficient portion of the docking structures to comply with the

dock size and density requirements in effect at the time of the subdivision.12. Only those structures shown on the approved plans shall be installed or constructed along this frontage. All portions of the

structures shall be at least 20 ft. from the abutting property lines or the imaginary extension of those lines into the water.

13. Cribs shall not exceed 6 feet long x 6 feet wide, and shall be of sufficient height to support the docking structure above normal

full lake level (Elev. 504.32).14. Crib material shall be timber, concrete, or other non-toxic material, and of such size and spacing as necessary to completely

contain the ballast.15. The minimum clear spacing between cribs shall be 12 feet.

16. No portion of the docking structures shall extend more than 40 feet from the shoreline at full lake elevation (Elev. 504.32).

17. All seasonal structures, including watercraft lifts, shall be removed for the non-boating season.

18. The canopy, including the support frame and cover, shall be designed and constructed to be readily removed at the end of the

boating season and the flexible canopy shall be removed for the non-boating season.

19. Stone placed along the beach front for the purpose of retaining sand shall be placed above and landward of those rocks currently

located along the normal high water line (Elevation 504.32). The rocks existing at the normal high water line shall remain

undisturbed such that the natural shoreline remains visible and intact.20. The steps installed for access to the water shall be located completely landward of the normal high water line.

21. No more than 10 cu. yd. of sand shall be used and all sand shall be located above the normal high water line.

22. The permittee shall provide appropriate diversion of surface water runoff to prevent erosion of beach area.

23. Within three days of final grading or temporary suspension of work in an area that is in or adjacent to wetlands or surface

waters, all exposed soil areas shall be stabilized by seeding and mulching during the growing season, or if not within the growing

season, by mulching with tackifiers on slopes less than 3: 1 or netting and pinning on slopes steeper than 3:1.

24. A combination of trees, shrubs and ground covers representing the density and species diversity of the vegetation present prior

to construction shall be replanted beginning at a distance no greater than 5 feet landward from the beach area.

5. The NH Natural Heritage Bureau (“NHB”) has record of a sensitive species present within the vicinity of the project area, butNHB does not expect impacts to the species by the proposed project.6. On September 4,2015, DES conducted an inspection of the property and found recent excavation and filling on the propertywithin the jurisdiction of RSA 482-A, the Nfl Wetlands statute, and within the jurisdiction of RSA 483-B, Shoreland Water QualityProtection Act. DES found no record of permits being issued for the work.7. On September 16, 2015, DES issued a letter to the owner, Kenneth Scarpetti, requesting that he voluntarily refrain fromconducting additional work within jurisdiction and provide an explanation for the unauthorized work.8. On January 15, 2016, DES received a Shoreland application to retain 522 sq. ft. of impact to construct a driveway.9. On January 15, 2016, DES issued Shoreland permit 2016-00172 to retain shoreland impacts described in item #8 above.10. On January 19, 2016, DES received a Wetlands application to retain 430 sq. ft. of impact to previously developed upland tidalbuffer zone to install a 500 gallon residential underground propane tank. The application, DES file #2016-00185, is currently underreview.11. The Portsmouth Conservation Commission recommends approval of the project with stipulations that the owner not mow thelawn or cut vegetation in the area below the 1:1 slope and that fill must be certified as clean fill.
