Crackdown: A matter of trust

F air Trading Minister Matthew Mason-Cox (pictured) has released the results of NSW Fair

Trading’s recent compliance audit targeting the trust accounts of real estate agents across the state.

Mr Mason-Cox said Fair Trading received 506 qualifi ed audits for the 2012/13 fi nancial year with 51 matters referred for further inves-tigation and 83 warnings issued to agents.

“Five penalty infringement notices have already been issued with a number of follow-up inspections to occur,” he said.

“87 audits required on-site inspections and 285 audits required no further action.”

Mr Mason-Cox said an addi-tional 1,702 random audits were undertaken with 170 real estate agents found to be in breach of the law for failing to submit an audit report or having discrepancies in the audit report submitted.

“Further on-site inspections are continuing with a view to taking disciplinary action against agents found to be in breach,” he said.

Mr Mason-Cox said Fair Trad-ing’s real estate compliance checks send a clear message to dishonest agents that they will be held to account if they fl out the law.

“In the 2013/14 fi nancial year, six real estate agents were convicted of off ences involving trust account fraud, with fi ve licensees receiving custodial sentences,” he said.

“Millions of home-owner and landlord dollars go through trust accounts every year.

“Do not be mistaken, to misap-propriate this money is fraud and agents can fi nd themselves in prison if they break the law.”

Licensees who held or received trust money during the fi nan-cial year must have their trust accounts audited by an auditor.

NSW Fair Trading is looking closely at the activities of trust accounts associated with real estate agents

Building a brand new home often puts people off , but a major developer says it’s all because of a range of mis-conceptions

Debunking myths about new homes

B usy families might fi nd the idea of building a new home, rather than buying and renovating a

second-hand home, overwhelm-ing, with underlying concerns about the level of control they will have in the process, expenses and whether the fi nal product will meet their expectations. But these concerns are based on common misconceptions, says a major developer.

Kim Clarke, Managing Director of Xcel Properties and Plantation Palms, a 2000-home master-planned community in Queens-

land’s Mackay, says there’s many myths out there.

Based on the most common questions asked, Kim debunks the most common misconcep-tions about new-build homes:

Buying a house and land pack-age is more expensive: On the contrary, building new means you’re less likely to need renova-tions down the track. Builders are required to off er a building guarantee and warranty to cover any structural repairs in the fi rst six years.

They require a bigger deposit: This isn’t always the case. While

most developers require a 10 per cent deposit to exchange on land, many off er a range of fi nancing options, such as longer settle-ment periods, to allow you more time to prepare your deposit and fi nances.

I don’t know what the neigh-bourhood will look like: Many who invest their time and resources into purchasing a house and land package tend to be fami-lies who are also looking to buy into the community aspect. Many master-planned communities comprise parks and recreational facilities, enabling the commu-

nity to get to know each other. When buying second hand in the suburbs, many of us often don’t know our neighbours across the street.

There’s no guarantee the property will grow in value: The area is a strong determining factor in capital growth. As when buying second hand, you need to research the areas in which properties sell well.

I don’t know if the fi nal product will meet my expectations: It’s important you have confi dence in the work of the developer and builder before your fi nal decision.

Data released by the Austral-ian Bureau of Statistics (ABS) revealed that home loan approv-als grew by 0.04 per cent in May after two consecutive months of negative growth. Loan Market director Mark De Martino said the numbers for May were 4.57 per cent higher than the same month last year and it demon-strated how competitive the market for home loans is.

The Housing Industry

Association (HIA) has welcomed the passage of legislation through the Senate to repeal the carbon tax. The dumping of the tax followed a promise by Prime Minister Tony Abbott leading into the 2013 election.

“HIA has advocated against the carbon tax since its inception, as it represents yet another impost on one of the most heavily taxed sectors in the economy,” said HIA Chief Executive Industry Policy and Media, Graham Wolfe.

“The repeal of the tax was a key part of HIA’s 2013 federal election platform to help revive the housing industry.

“The carbon tax has had a direct impact on energy produc-tion costs, which in turn flowed through the manufacturing and fabrication phases of building material, product and assembly production.

“It has impacted on domestic manufacturing, jobs and material input costs in building new homes.”

M inister for Planning Pru Goward and NSW Treasurer Andrew Constance

(pictured) said levels of new residential construction in NSW have hit a 10 year high according to latest Australian Bureau of Statistics fi gures.

Residential construction commencements for the last 12 months hit 46,035, the highest level since September 2003. Also, residential commencements from the March 2014 quarter have now reached levels not seen since 2002, in fact the latest March quarter commencement levels are 42 per cent higher than the 10 year average.

“This is yet another sign of confi dence in the NSW economy, stemming from smarter planning

and the strong economic leader-ship of the NSW Government,” Ms Goward said.

“With expert population projections released earlier this year showing NSW will need one million additional homes in the next 20 years we have a lot of work to do, but today’s fi gures show we are getting on with the job.

“If we want our children to be able to live and work in the areas we know and love we have to ensure we are bringing a steady supply of new housing to the market every year.”

Treasurer Andrew Constance said the NSW Liberals and Nationals Government is driving economic activity through hous-ing construction while supporting fi rst-time buyers to break into the property market.

He said it was all about looking forward, not backwards, when it came to the economy.

“We have taken the state’s economy out of the dark ages under Labor to become the coun-try’s powerhouse, and today’s fi gures are further proof NSW has its mojo back,” Mr Constance said.

“As we accelerate housing supply in NSW, we’re determined to ensure more young families get the appropriate support.”

The June 2014 REINSW Vacancy Rate Survey saw Sydney residen-tial vacancy rates remain mostly unchanged in the Sydney metro-politan market.

The number of properties for

rent across Sydney fell 0.1 per cent to 1.8 per cent.

“Rates above two per cent are considered neutral. We are comfortable with these vacancy rate levels and the opportuni-ties that are provided in the marketplace currently,” REINSW President Malcolm Gunning said.

“The biggest mover in the

market was in middle Sydney where availability fell 0.4 per cent to 2.1 per cent.

“Inner Sydney vacancy rates remained at 1.9 per cent, while the outer suburbs saw a decline of increase of 0.1 per cent to 1.5 per cent.”

Looking outside the metropoli-tan area, availability in the Hunter

remains solid at 3.3 per cent, despite a fall of 0.1 per cent. This was led by a decrease of 0.4 per cent in Newcastle at 3.5 per cent.

The Illawarra had a vacancy rate of 1.8 per cent, down 0.1 per cent, with Wollongong down 0.3 per cent at 2.1 per cent.

Vacancy rates in the Central West were at 4.4 per cent.

I t’s well and truly winter now, which means keeping warm and rugging up indoors. Unfortunately winter also

How to get a home loan

Three months of clean
