WHEREAS by section 109 of the Land Act, 1933- 1960, the Governor may resume, for any purpose as in the public interest he may think fit, any portion of land held as a Pastoral Lease; and whereas it is deemed expedient that the portion of Pastoral Lease 392/477 described in the schedule hereto should be resumed for the purpose of "Agri- cultural Settlement and Conservation of Fauna": Now, therefore I, Sir Charles Henry Gairdner, Gov- ernor as aforesaid, with the advice and consent of the Executive Council, do by this my Proclama- tion, resume portion of Pastoral Lease 392/477 for the purpose aforesaid. Child Welfare Act, 1947-1959.

ORDER IN COUNCIL.WHEREAS by section 19 of the Child Welfare Act,1947-1959, it is provided (inter alia) that the Gov-ernor may, by Order in Council

(a)•

establish special courts to be called Chil-dren's Courts and determine the area inand for which each court shall exercisejurisdiction, by reference to magisterialdistricts;

Corres. 351/97.WHEREAS by section 33 of the Land Act, 1933-1960, it is, inter alia, made lawful for the Gov-ernor, by Order in Council, to direct that anyland reserved pursuant to the provisions of thisAct shall be granted in fee simple to any person(as defined in the said section), subject to thecondition that the person shall not lease or mort-gage the whole or any part of the land withoutthe consent of the Governor and subject to suchother conditions and limitations as the Governorshall deem necessary to ensure that the land isused for the purpose for which the land is re-served as aforesaid; and whereas it is deemed ex-pedient that Reserve No. 7986 (Katanning Lot404) should, subject as aforesaid, be granted infee simple to the Baptist Union of Western Aus-tralia Incorporated to be held in trust for "ChurchPurposes": Now, therefore, His Excellency theGovernor, by and with the advice and consent ofthe Executvie Council, doth hereby direct that theabovementioned reserve shall be granted in feesimple to the aforesaid body to be held in trustfor the aforesaid purpose, subject to the conditionthat the land shall not be leased or mortgaged inwhole or in part without the consent of theGovernor.

Land Act, 1933-1960.ORDERS IN COUNCIL.

WHEREAS by section 33 of the Land Act, 1933-1960, it is made lawful for the Governor to directthat any reserve shall vest in and be held by anymunicipality, road board, or other person or per-sons to be named in the order in trust for thelike or other public purposes to be specified insuch order; and whereas it is deemed expedient asfollows:-

Corres. No. 2840/59.—That Reserve No. 26260(Korrelocking Lot 177) should vest in and be heldby the Shire of Wyalkatchem in trust for the pur-pose of Recreation.

Corres. No. 169/62.—That Reserve No. 26261(Williams Location 15367) should vest in and beheld by the Shire of Wagin in trust for the pur-pose of Gravel.

Corres. No. 3787/18.—That Reserve No. 26262(Williams Location 15366) should vest in and beheld by the Minister for Water Supply, Sewerageand Drainage in trust for the purpose of Water.

Now, therefore, His Excellency the Governor,by and with the advice and consent of the Execu-tive Council, doth hereby direct that the before-mentioned reserves shall vest in and be held bythe abovementioned bodies in trust for the pur-poses aforesaid, subject nevertheless to the powersreserved to him by section 37 of the said Act.

Land Drainage Act, 1925-1954.Extension of the Wilson-Torbay Drainage District.

WHEREAS by section 12 of the Land DrainageAct, 1925-1954, it is provided that the Governormay at any time by Order in Council extend anydistrict by the addition thereto of any land thathas not theretofore formed part of a district: Now,therefore, His Excellency the Governor, by andwith the advice of the Executive Council, dothhereby vary and amend the Wilson-Torbay Drain-age District by extension of the boundaries thereofto include the whole of the land described in theschedule hereto.

Rights in Water and Irrigation Act, 1914-1951.Collie Irrigation District—Various Channel

Extensions.ORDER IN COUNCIL.

P.W.W.S. 736/58.WHEREAS by the Rights in Water and IrrigationAct, 1914-1951, it is provided that before under-taking the construction of irrigation works, theMinister shall submit plans, descriptions, books ofreference, and estimates of the proposed worksto the Governor for approval; and that if theyare approved, the Governor may forthwith, byOrder in Council, empower the Minister to under-take the construction of the proposed works: Now,therefore, His Excellency the Governor, with theadvice of the Executive Council, hereby approvesof the plans, descriptions, books of reference andestimates marked P.W.D., W.A. 39324, for theconstruction of irrigation works within the CollieIrrigation District—Various Channel Extensions,which were duly submitted for approval, andhereby empowers the Minister to undertake theconstruction of the said works.

Country Towns Sewerage Act, 1948-1954.Mount Barker Sewerage Area.

ORDER IN COUNCIL.P.W.W.S. 63/61.

WHEREAS by section 4 of the Country TownsSewerage Act, 1943-1954, the Governor may, byOrder in Council, constitute any part or parts ofthe State outside the boundaries of the Metro-politan Water, Sewerage and Drainage Area asconstituted and defined by the Act No. 43 of1909 as a sewerage area; and whereas by section4 (b) of the Country Town Sewerage Act, 1948-1954, the Governor may, by Order in Council,constitute sewerage districts by dividing any sewer-age area into sewerage districts under such namesas may be directed: Now, therefore, His Excellencythe Governor, with the advice and consent of theExecutive Council, doth hereby constitute that partof the State defined in Schedule "A" hereundera sewerage area and assign the name of "MountBarker Sewerage Area" thereto and also dothhereby divide the Mount Barker Sewerage Areainto two sewerage districts, namely:

(a) No. 1 Mount Barker Sewerage District;(b) No. 2 Mount Barker Sewerage District;

defined in Schedule "B" hereunder.

Mode of Electing President andAlteration of Membership.

ORDER IN COUNCIL.L.G. 1350/52.

WHEREAS it is provided by section 10 of theLocal Government Act, 1960, that the mode ofelection of the President of a Shire may be changedfrom that of election by the members of the Coun-cil to that of election by the electors of the Muni-cipality, provided that a poll of the ratepayershas been held and has resulted in the approvalof the proposed change of mode of election; andwhereas the Council of the Shire of Canning hassubmitted a petition stating that a poll of electorshas been held and has resulted in a majority ofthe persons voting casting their votes in favourof the mode of election of the president being bythe electors; and whereas the Council has by apetition prayed that the mode of election maybe altered; and whereas the Council has furtherpetitioned that in consequence of the change ofmode of election of the president the number ofoffices of councillor assigned to the Municipalitybe continued at nine (9) and the total membershipof the Council be increased to ten (10) the addi-tional member being the president: Now, therefore,His Excellency the Governor, acting by and withthe advice and consent of the Executive Council,doth hereby

(a) declare that the mode of election of presi-dent of the Council of the Municipalityof the Shire of Canning shall be alteredto that of election by the electors of theMunicipality as from the date of the elec-tion to be held on the 26th day of May,1962;

(b) increase the number of members of theCouncil from nine (9) to ten (10), beingnine councillors and a president;

(c) direct that an election be held on the 26thday of May, 1962, to elect a president andsuch number of councillors as are neces-sary to fill vacancies existing or occur-ring on that day.

L.G. 566/61, "A."WHEREAS it is provided by paragraph (j) ofsubsection (2) of section 12 of the Local Govern-ment Act, 1960, that on presentation of a petitionunder the seal of a Municipality the Governormay alter the number of offices of councillorassigned to a Municipality; and whereas it is fur-ther provided by paragraph (d) of subsection (4)of the said section, that the Governor may givesuch directions as he thinks necessary in order togive effect to an alteration in the number of themembers of a Council; and whereas it is furtherprovided by section 20 that on the exercise of apower conferred by section 12, the Governor maydirect the holding on a day appointed by the orderof an election of members affected; and whereasthe Council of the Shire of Carnamah has sub-mitted a petition praying that the number of mem-bers should be increased to eight (8) and that theadditional member be allocated to the WinchesterWard: Now, therefore, His Excellency the Governor,acting by and with the advice and consent of theExecutive Council, doth hereby order that

(a) the number of offices of councillor as-signed to the Municipality of the Shire ofCarnamah be altered to eight (8);

(b) the additional councillor be allocated tothe Winchester Ward;

(c) an election shall be held on the 26th dayof May, 1962, to elect an additional mem-ber for the Winchester Ward.

Companies Act, 1943-1961.ORDER IN COUNCIL.

WHEREAS it is enacted by subsection (2) ofsection 28 of the Companies Act, 1943-1961, thatexcept with the consent of the Governor, signifiedby order published in the Government Gazette,no company shall be registered by a name which,inter alia, contains the word "Commonwealth";and whereas it is provided, inter alia, in proviso(a) to subsection (7) of that section that wherein the opinion of the Governor (on being satisfiedthat it would be inequitable or unreasonable torequire a company incorporated outside WesternAustralia to which Part XI of that Act appliesto change its name before complying with therequirements of that Part), it is in the circum-stances of the particular case expedient, the Gov-ernor may authorise the Registrar to accept forfiling the documents and particulars specified insubsection (1) of section 329 of that Act; andwhereas registration under Part XI of the Actof a company incorporated in the State of SouthAustralia by the name of Commonwealth HillProprietors Limited was refused by the Registraron the ground that that name included the word"Commonwealth"; and whereas His Excellency theGovernor is satisfied that it would be inequitableor unreasonable to require Commonwealth HillProprietors Limited to change its name beforecomplying with the requirements of Part XI ofthat Act and is of the opinion that the circum-stances of the case render it expedient: Now, there-fore, His Excellency the Governor, acting with theadvice and consent of the Executive Council andin exercise of the powers conferred by proviso (a)to subsection (7) of section 28 of the CompaniesAct, 1943-1961, and being satisfied that it would beinequitable or unreasonable to require that com-pany to change its name before complying withthe requirements of Part XI of that Act, andbeing of the opinion that the circumstances of thecase render it expedient, doth hereby authorisethe Registrar of Companies to accept for filingfrom Commonwealth Hill Proprietors Limited thedocuments and particulars specified in subsection(1) of section 329 of the Act..
