EP401 DRAFT ENVIRONMENTAL PROTECTION POLICY FOR THE SWAN AND

CANNING RIVERS 1995 The Environmental Protection Authority in association with the Swan River Trust has prepared a Draft Environmental Protection Policy for the Swan and Canning Rivers. In accordance with Section 26 of the Environmental Protection Act (1986), the draft policy is now available ibr public inspection. Copies of the draft policy are available free of charge from-

The draft policy is also available from the Department of Environmental Protection by telephoning MS Noelene Edwards on 222 7127. The public will be provided with two opportunities to make submissions on the draR policy. The first opportunity is offered with this document, the Draft Environmental Protection Policy. The second opportunity will be with the release of the Revised Draft EPP in early 1996, which will be a product of public comments received on the draft policy and further consideration by the Environmental Protection Authority and Swan River Trust. Interested people and organisations likely to be affected are invited to submit written comments on the draft policy by January 12 1996.

3. HOMESTEADS, BUILDINGS, HAYSTACKS, BULK FUEL, DRUMS AND LIQUID PETROLEUM

From the 1st December 1995, to and including the 22nd May 1996, you shall install a 4 metre firebreak clear of inflammable material around the whole of any or all the above items. 3.1 (a) All private access tracks to be of sufficient width and condition to allow entry and

exit of a heavy duty fire unit. (b) Sufficient room to be provided to turn a heavy duty fire unit a t the end of all access

tracks; i.e. a cul-de-sac or ring road to be provided. 4. STRATEGIC FIRE ACCESS TRACKS-RURAL LAND

4.1 Strategic Fire Access Tracks apply to all rural land. 4.2 All Strategic Fire AccessTracks are to be a minimum of 4 metres wide, variations shall be

carried out in conjunction with the Local Fire Brigade. 4.3 Access Tracks are to be maintained in a trafficable condition. 4.4 If a n AccessTrack is located on your property you will be required to install and maintain

it in conjunction with your Local Fire Brigade by the 1st December 1994 to the 22nd May 1995.

4.5 All Strategic Fire Access Tracks must be maintained by the landowner where a Strategic Access Track is located on that property.

NB: Contact your Local Brigade or Shire for locations of Strategic Fire Access Tracks. 5. HARDWOOD/SOFTWOOD PLANTATIONS LESS THAN 3 HA's

(a) 6 metre wide firebreak clear of inflammable material around all boundaries of the plan- tations.

(h) All firebreaks to be maintained in a trafficable condition and trees to be progressively pruned to maintain an unrestricted access of 4 metres.

(C) Where SEC power lines pass over plantation areas, firebreak to be in accordance with SEC specifications and are to be complied with whole.

(d) Where 3 or more plantations of less than 3 ha's are in one fire brigade area, they will be required to purchase adequate fire units for that area's brigades.

6. FIRE PROTECTION OF HARDWOOD/SOFTWOOD PLANTATIONS (a) Plantation: Any area of planted pines or eucalyptus species 3 ha or more. (h) Firebreak for Plantations: 15 metre boundary break: i.e. The first row of trees must be 15

metres from the outside edge of the firebreak. The outer 10 metres must be clear of any flammable material on the ground and will have a 10 metre vertical clearance. The re- maining 5 metres must be maintained with only low fuel.

6.1 Minimum Firebreak Standards 15 metre firebreak (as defined in 6(b)) on all boundaries of plantations that adjoin first class public road i.e. road subject to heavy traffic. 10 metre wide firebreak clear of inflammable material should adjoin secondary road i.e. roads subject to low traffic. 6 metre wide firebreak clear of inflammable material should surround compartments of approximately 30 hectares. Shire of Albany FIREUREAK NOTICE

Notice to all owners andor occupiers of land in the Shire of Albany Pursuant to the powers contained in Section 33 of the Uushfires Act, 1954, you are required to have ploughed, scarified, cultivated, burned, chemically sprayed or otherwise cleared and maintained clear on inflammable matter all firebreaks as are required and specified by this notice. North East Sector: (See plan). A minimum of three (3) metre wide firebreak (*) to be installed on or by the 15th day of November, 1995 and maintained clear of all inflammable matter to and including the 30th day of March 1996 (or as otherwise gazetted). South & South West Sector: (See plan). A minimum of two (2) metre wide firebreak (*) to be installed on or by the 15th day of December, 1995 and maintained clear of all inflammable matter to and includ- ing thc 30th day of March, 1996 (or as othcrwisc gazcttcd).

l. Land having an area of 2100 square metres (112 acre) or less: A firebreak is not required-however-

(a) The land will be inspected by a Fire Control Officer appointed by the Shire of Albany and notice may be served if action is deemed necessary to reduce a fire hazard existing on the land;

2. All other land exceeding 2100 square metres (1/2 acre) in area: (a) Firebreaks shall be constructed as otherwise specified in this notice and-

(i) Immediately inside all external boundaries, or within 19.8 metres (1 chain) of those boundaries if so determined by the conditions; whether the land be cleared, partly cleared, bulldozed, chained, used for pasture or undeveloped;

(ii) Immediately surrounding all buildings that may be erected thereon.

(b) Firebreaks shall be constructed as otherwise specified in this notice on all land being under crop during the period 15th November, 1995 to 30th March, 1996 immediately inside the external boundary and a round the standing crop so that the crops are broken up into areas not exceeding approximately 200 hectares. Owners andor occupiers of land in the North Eastern Sector only have the option of providing a 6 metre width of crop cut and raked for hay as a firebreak around the standing crop.

(C) A suitable operational fire fighting unit comprising a minimum of a 400 litre tank with mo- torised pump shall be placed inside the boundary of any land where the harvesting of a crop is taking place. Such equipment is to be adjacent to the harvest and in place for the entire period of the harvest.

(*) Firebreak width is considered to include a vertical plane to a height of five (5) metres, i.e. all scrub must be cut back so as not to overhang a firebreak.

Applications to vary the above requirements: If it is considered to be impractical for any reason whatever to carry out works as required by this notice, you may apply through the Fire Control Officer of your Local Bush Fire Brigade no later than 21 days prior to the date by which the firebreaks are required by this notice for permission to provide firebreaks in an alternative position, to take alternative action to abate the fire hazards on the land or to alter or vary this notice in any other way.

Late applications or those not on the current form will not be accepted: Application forms for this purpose are available from all Bush Fire Control Officers or the Shire Office. It should be noted that residential and minimum equipment level requirements apply where total exemptions from firebreaks are sought for areas in excess of 2ha. Full details are available from the Shire Council or your local Fire Control Officer.

Note: Council, or its duly authorised officer will consider approval of other than firebreaks immediately inside the external boundaries where a more suitable alternative can be provided. Approval of such alternatives will only be considered if submitted with the endorsement of the Fire Control Officer for the area concerned and will be on a yearly basis. If permission to vary this order is not granted by the Council or its duly authorised officer, you must comply with the requirements of this notice.

Strategic Firebreaks: Landowners andor occupicrs or groups of landowncrs andor occupicrs may apply to thc Council of thc Shire of Albany for permission to install strategic firebreaks in a specific area, rather than breaks as othcrwisc spccificd in this notice. Such strategic fircbrcaks must bc maintained by the landowncrsl occupiers in accordance with the specifications of this notice.

Optional Perimeter Firebreaks-Kalgan, Kojaneerup, Wellstead, South Stirling and Gnowellen Bri- gade Areas: Owners andlor occupiers of land in the Kalgan (previously Lower Kalgan section only), Kojaneerup, Wellstead, South Stirling and Gnowellen brigade areas only, have the option of installing perimeter firebreaks on their land for a 3 year period expiring on 30th June, 1996.

Fire Protection of Private Hardwood/Softwood Plantations Definitions and specifications Plantations: Any area of planted hardwood or softwood species exceeding 3ha within a townsite or lOha outside a townsite, with a depth greater than 50 metres.

Windbreaks: Will be defined as planted areas not exceeding 50 metres in depth with a n unrestricted length.

Firebreaks-15 metres Boundary Break: The first row of trees shall be at least 15 metres from the outside edge of the break. The outer 10 metres of the firebreak shall be cleared of all flammable material on the ground, and have a 10 metre vertical clearance, i.e. with no overhanging branches. The remaining 5 metres shall be maintained in a low fuel condition, i.e. short grass may be considered low fuel.

Minimum Firebreak Standards: The following firebreak standards apply for plantations:

a Firebreaks constructed 15 metres wide (as per definition) on the boundaries of plantations or on such other locations as may be agreed between Council and the plantation owner.

a Firebreaks (as per definition) 15 metres wide shall adjoin first class public roads, i.e. roads subject to heavy traffic density.

a Firebreaks clear of all flammable material 10 metres wide shall adjoin secondary public roads, i.e. roads subject to low traffic density.

In this regard, the 40m buffer can comprise all or a combination of public open space reserve, road reserve and land forming the separation between the front boundary of lots and the building line.

2.2.9 Reflect the need to ensure that no trees or substantial vegetation shall be felled or removed from the site except where-

1. required for approved development works; 2. the establishment of a firebreak as required by regulation or by-law 3. trees are dead diseased or dangerous.

2.3 Notwithstanding clauses 2.1,2.2 and sub-clauses 2.2.1 to 2.2.5, changes to the Subdi- vision Guide Plan may be made at the discretion of Council and approval by the Western Australian Planning Commission provided that such changes do not involve an adjustment to the R Code designations generally outlined in clauses 2.2.2 and 2.2.3 above.

3.0 DEVELOPMENT 3.1 Not more than one dwelling house may be constructed on any allotment unless such

lot is specifically identified on the Subdivision Guide Plan as a group housing site. The provision shall not exclude the approval by the Council of additional ancillary accommodation, or a "Granny Flat: for the exclusive use of family members, provid- ing such is integral to the house, contains not more than one bedroom, has shared laundry facilities and does not exceed 40m2 in area.

3.2 No clearing or felling of any vegetation shall occur within any allotment except for the following:

(a) Clearing to comply with the requirements of the Bush Fires Act 1954. (b) Clearing within a prescribed Building Envelope, or, within a 30 metre radius

of the centre of the main dwelling where no building envelope is specified, as may be reasonably required to construct an approved building and curtilage thereto.

(C) Clearing to gain vehicular access to the curtilage of an approved dwelling. 3.3 On any lot which has been denuded of natural vegetation by previous agricultural

clearing, Council may require as a condition of building approval, the planting and maintenance of 20 native trees or shrubs or approved species. The planting shall be concentrated around the proposed buildings and between the road reserve boundary and the buildings.

3.4 No live stock is to be kept on any lot other than for domestic purposes on a lot greater than 2 000m2.

3.5 Dwelling houscs and all ancillary buildings shall bc constructcd of non-rcflcctivc material (with the exception of glazed areas) and shall comprise either timber, stone, rammed earth, brick or steel construction and shall be to the satisfaction of the Council and shall be of colour(s) and textures which are essentially natural and earthy. All such materials shall be to the satisfaction of the Council and shall be compatible with thc rural character of thc locality

3.6 Notwithstanding the provisions of the Residential Planning Codes for all lots, a mini- mum rcar setback for rcsidcnccs of 40m shall apply to those lots abutting rural zoncd land to thc south of Lot 43 unlcss otherwise approved a t thc discrction of Council. Outbuildings will be permitted within the 40 in rear setback subject to appropriate R Codc rcquircmcnts.

3.7 All lots within the Zone south of the By-pass shall be fenced using split jarrah and wire materials only, and lots to the north of the By-pass shdl be fencedusing timberlap materials unless otherwise approved by Council. Perimeter fencing will be under- taken as an element of the subdivision of the land.

3.8 Provision of all necessary fire protection arrangements as specified by and to the satisfaction of the Local Authority, are to be made by individual land owners.

"Fremantle Regional Strategy" File: 809-2-5-3 Amendment No.: 970133 The Metropolitan Region Scheme (the Scheme) is proposed to be amended for various portions of land in the Fremantle, North Fremantle, South Fremantle and Mosman Park localities of the Perth metro- politan region. The proposals are intended to implement recommendations contained in the "Freman- tle Regional Strategy" released in December 1994. The "Fremantle Regional Strategy" provides the basis for coordinating planning and Government investment in regional infrastructure and is a reflec- tion of the identification of Fremantle as a strategic regional centre in the "Metropolitan Centres Policyn. That Strategy, which provides a guide for future planning of integrated transport, land use and port facilities, is being implemented by way of this Metropolitan Region Scheme amendment proposal. The procedure for amending the Scheme, as set out in section 33 of the Metropolitan Region Town Planning Scheme Act, is to be used to advertise this proposal. Public submissions are invited and the amendment will eventually be put to Parliament for final approval. In accordance with the procedure in section 33, the Hon Minister for Planning has approved the amendment for public display and for the calling of submissions. Copies of the maps showing the proposed changes to the zones and reservations of the Scheme and the Commission's Technical Report on the amendment proposals will be available for the public inspec- tion a t each of the places listed hereunder.
