Made by the Governor in Executive Council under section 9(1)(a) of

the Act.

1. Citation

This order is the Yerecoin Water Reserve Order 2013.

2. Commencement

This order comes into operation as follows —

(a) clauses 1 and 2 — on the day on which this order is

published in the Gazette;

(b) the rest of the order — on the day after that day.

3. Yerecoin Water Reserve constituted and boundaries defined

(1) In this clause —

coordinates means Map Grid of Australia 1994 grid coordinates

in Zone 50 of the Universal Transverse Mercator Grid System

based on the Geocentric Datum of Australia.

(2) There is constituted a water reserve called the Yerecoin Water

Reserve.

(3) The boundaries of the Yerecoin Water Reserve are —

(a) defined by reference to the coordinates annexed to the

Department of Water plan WT 10734; and

(b) shown outlined in bold on that plan.

4. Information plan of Yerecoin Water Reserve

The boundaries of the Yerecoin Water Reserve are shown, for

information purposes, on the plan in Schedule 1.

Notice to All Owners and/or Occupiers of Land in East Fremantle and Fremantle.

Pursuant to the powers contained in section 33 of the above Act, you are hereby required on or before 30th day of November, 2013 or within fourteen days of the date of you becoming owner or occupier should this be after the 30th day of November 2013 to clear flammable matter from the land in accordance with the following requirements—

(a) Land having an area of fifteen hundred (1,500) square metres or less—

The owner or occupier is to remove all the flammable matter from the whole of the property, except living trees, shrubs, plants under cultivation and lawns, by slashing or mowing to a height of not more than 100 millimetres, or otherwise to the satisfaction of council or an authorised officer.

(b) Land having an area of fifteen hundred (1,500) square metres or more—

(i) Clear firebreaks of a minimum width of three (3) metres inside all external boundaries of the land and all buildings situated on the land, by ploughing, cultivating or scarifying; or

(ii) Mow/Slash the whole of the land. The height of vegetation thereafter must not exceed, one hundred (100) millimetres over the entire area of the land, as far as reasonably practicable as determined by the authorised officer.

Once installed the firebreak must be maintained up to and including the 31st day of March 2014.

If it is considered to be impractical for any reason to clear firebreaks as required by this notice, you may apply to the Council or its duly authorised officer not later than the 15th day of November 2013 for permission to provide firebreaks in alternative positions on the land. If the Council or its duly authorised officer does not grant permission, you shall comply with the requirements of this notice.

The penalty for failing to comply with this notice is a fine of not more than $5000 and a person in default is also liable, whether prosecuted or not, to pay the cost of performing the work directed in this notice if it is not carried out by the owner or occupier by the date required by this notice.

Note: Burning is prohibited. No permits will be issued.

Acting pursuant to the powers conferred by Regulation 10A.(b) of the Navigable Waters Regulations 1958, I hereby declare the following areas to be swimming prohibited areas between 7:30 pm and 15 minutes after the completion of the pyrotechnics display, on Sunday 27 October 2013—

SUCCESS BOAT HARBOUR

All the waters within a 200 metre radius of two (2) firing points on the Southern Breakwater Groyne, Success Boat Harbour, Fremantle. One position is at the end of the groyne and the other will be approximately 230 metres from the end of the groyne.

These areas are set aside for safety measures during the set up and display of pyrotechnics associated with the Fremantle Blessing of the Fleet.

Pursuant to regulation 19H(2)(c) each of the vessels listed in Schedule 1 is permitted to use a lamp displaying intermittent blue flashes only in the following circumstances—

while the vessel is deployed in relation to sea search and rescue or other emergency situations where the potential for serious injury and or loss of life has been reported and or can be reasonably expected; and

the use of the blue light has been authorised by an officer of the Western Australia Police. Exceptions to this condition are only ever permitted when extraordinary circumstances inhibit the gaining of the authorisation in a timely manner. In these circumstances authorisation must still be gained as soon as is practicable.

Pursuant to regulation 19H(2)(b), the person driving a vessel listed in Schedule 1 is exempt from the following provisions of the regulations—

Regulation 19A, Speed limit in Swan and Canning Rivers

Regulation 48, Limitation of speed

Pursuant to section 115A of the Western Australian Marine Act 1982 (“the Act”) the person driving a vessel listed in Schedule 1 is also exempt from the provisions of the following sections of the Act—

Section 66, Closure of navigable waters

Section 67, Limiting speed of vessels

The above exemptions from provisions of the Act and the Regulations only apply whilst the vessel is deployed in relation to sea search and rescue or other emergency situations where the potential for serious injury and or loss of life has been reported and or can be reasonably expected, and are subject to the following conditions—

1. The driver of the vessel must be suitably experienced with high speed emergency response and hold a minimum Recreational Skippers Ticket or higher commercial marine master’s qualification.

2. The vessel masters and crew must comply with all directions issued by officers of the Western Australia Police and / or the Department of Transport Marine Inspectors appointed pursuant to section 117 of the Act, including providing timely and accurate information and situation reports as requested.

3. The person driving the vessel is only exempt from compliance with the above provisions whilst acting in the course of their duties in an actual emergency situation, only in circumstances that warrant such action for reasons of safety, and where they reasonably believe that it is expedient and safe to do so.

4. Authorisation to exceed speed limits and enter closed waters must be obtained from officers of the Western Australia Police. Exceptions to this condition are only ever permitted when extraordinary circumstances inhibit the gaining of the authorisation in a timely manner. In these circumstances authorisation must still be gained as soon as is practicable.

5. All other applicable legislation including the WA Prevention of Collisions at Sea Regulations 1983, must be complied with.

The Western Australian Planning Commission proposes to amend the Peel Region Scheme and is seeking public comment.

The purpose of the amendment is to transfer approximately 6,380 square metres of land from the Urban zone to the Primary Regional Roads and Regional Open Space reservations in the Peel Region Scheme. The site is currently undeveloped and contains remnant vegetation.

The Western Australian Planning Commission (WAPC) hereby certifies that, in its opinion, the amendment does not constitute a substantial alteration to the Peel Region Scheme.

The plan showing the proposed amendment and the WAPC amendment report (which explains the proposal) will be available for public inspection from 25 October 2013 to 10 January 2014 at the following locations—
