THE GOVERNMENT RAILWAYS ACT .AMEND-1\ !ENT ACT, 1907.

IT is hereby notified, for general information, that theOrder in Council issued on the 18th June, 1929, andpublished in the Government Gazette. of 25th idem, re-lating to the Denmark-Frankland River, has been can-celled and the following Order in Council, dated the13th August, 1029, has been issued in lieu thereof :

Whereas by "The G ovenunent Railways ActAmendment Act, 1907," it is provided that theGovernor may from time to time by Order in, Coun-cil published in the GOICI7111Clu (7a : -%'e declarethat any Branch, Spur, or other P.:milw:1;- shall be aDistrict Railway; and whereas it is desirable thatthe undermentioned section of railway should bedeclared a District Railway: Now, therefore, HisExcellency the Governor of Western Australia, byand with the advice and consent of the ExecutiveCouncil, does hereby declare that the Railway knownas the Denmark-Frankland River line, extendingfrom Denmark to Prankland River, a distance of34 miles 17 chains or thereabouts, shall be a Dis-trict Railway.

The above Reserve will be available for leasing underSection 41a of "The Land Act, 1898," and its amend-ments, for a term of one year, renewable at the will ofthe Hon. the Minister for Lands, and terminable at threemonths' notice, rent being apportioned accordingly, andno compensation will be paid for improvements effectedat the expiration of the !ease or the sooner determina-tion thereof. IT is hereby notified, for general information, that it isthe intention of His Excellency the Governor, under theprovisions of "The Road Districts Act, 1919," to-

(1) sever that porthin of the West Ward of theGnowangerup Road District, described in Scife-dule "A" hereto, and a.inex it to the TownWard of the Gnowangerup Road District;

(2) sever that portion of the West Ward of theGnowangerup Road District, described in Sche-dule "B" hereto, and annex it to the CentralWard of the Gnowangerup Road District.

IT is hereby notified for general information, that, pur-suant to an Order in Council whereby the Kent RoadDistrict was redivided into Wards, the Hon. Ministercontrolling Local Government has been pleased, underthe provisions of "The Road Districts Act, 1919," toorder and direct that all matters in connection with thepreparation of the Electoral List and Roll of the saidDistrict as divided into Wards shall be prepared, re-vised, and completed in accordance with the said Act.

The works and undertakings for which this Loan isproposed to be raised will, in the opinion of the Board,he of special benefit to portion of the Carnamah RoadDistrict, i.e., Coorow Ward, and any Loan Rate applic-able to such Loan will be levied only on the rateableland within the Coorow Ward of the Como:mob RoadBoard District.

No. 17 of 1929.THIS Agreement, ma.d.e in pursuance of "The Indus-trial Arbitration Act, 1912-1925," this 7th day ofAugust, 1929, between the Federated Clerks' Unionof Australia industrial Union of Workers, W.A.Branch, of the one part, and the Perth Hospital Boardof Management, of the other part; whereby it ismutually agreed as follows:

Area and Scope.This Agreement shall apply to all members of the

clerical staff, including telephonists, of the Perth Hos-pital Board of Management, with the exception of thesecretary and assistant secretary.

Definitions."Officer," "worker," shall mean any member of

the clerical staff of the Perth Hospital, male orfemale, covered by this Agreement.

"Board" shall mean the Board of Management ofthe Perth Hospital in office.

" Union" shall mean the W.A. Branch of the Fed-erated Clerks' Union of Australia IndustrialUnion of Workers.

"Secretary" shall mean the secretary for the timebeing of the Union.

"Temporary clerk" shall mean a clerk who is en-gaged for a lesser period than three calendarmonths.

"Casual clerk" shall mean a clerk who is engagedfor a lesser period than four weeks.

Hours of Duty.The ordinary hours of duty shall be thirty-eight per

week, and shall be worked from 9 a.m., to 5 p.m., onMondays to Fridays inclusive, with one hour off forI set, and from 9 a.m. to 12 noon on Saturdays.

0 vertime.Overtime shall mean all time worked outside the

ordinary hours of duty and shall be paid for as fol-lows:All time worked on the first five days of theweek, at the rate of time and half for the first twohours and double time thereafter. All time worked onSaturdays, and all time worked on Sundays and holi-days, at the rate of double time: Provided that, whenat officer is required to work on a holiday, he shallreceive at least four hours' pay at the penalty rate:Provided that overtime will not be paid for unlesssame is authorised by the secretary of the Perth Hos-pital Board.

Meal Money.If an officer is required to resume duty after the

ordinary hours of duty, he or she shall, in addition tothe overtime above referred to, be paid 2s. as the priceof one meal on each such occasion, or shall be pro-vided with a suitable meal by the Board.

Rates of Pay.The rates of pay from January 1st, 1929, to June

30th, 1929, are based on a basic wage of £4 5s. perweek for males and £2 5s. 11d. per week for females.

11 olidays.(ss) The following days shall be observed as holi-

days and, paid for:New Year's Day, AnniversaryDay, Good Friday, Easter Saturday, Easter Monday,Labour Day, Foundation Day, Christmas Day, BoxingDay, Anza.c, Day, and all gisszetted holidays.

(b) Annual Holidays.All officers shall receive a.fortnight's holiday per annum, in accordance withthe Rules and Regulations of the Perth Hospital Board,dated. June 16th,- 1926.

(c) Sick leave.Sick leave shall he granted to allofficers in accordance with the Regulations of thePerth Hospital Board dated June 16th, 1920.

Engage men tOtlic ors.The employment of any officer shall be terminated

by one month's notice on either side. Such notice toexpire oil the usual pay day.

Temporary Clerks.The employment of temporary clerks shall be ter-

minated by one week's notice on either side, suchnotice to expire on the usual pay day.

Preservation of Accrued Rights.Nothing herein contained shall affect any rights or

privileges accrued prior to this Agreement.Recognition of Union.

All officers shall be members of the'Federated Clerks'Union of Australia: Provided that any officer ap-pointed who at the time of engagement is not a mem-ber of the Union shall become a member of the Unionwithin fourteen days.

Record Book.A Record Book shall be kept showing the name of

each worker under this Agreement, showing the natureof the work performed, the hours worked each day,and the amount of wages received each pay, the saidRecord to be open to the inspection of an accreditedrepresentative of the Union during working hours.

Reference.A reference shall be given to any officer of not less

than three months' service, containing all necessaryinformation in regard to service and duties performed.

Term.The term of this Agreement shall be for a period of

three years from 1st January, 1929, provided that, atany time after the expiration of twelve months fromthe commencement of this Agreement, any term orterms thereof may be reviewed by either party givingone month's notice of their desire so to do.

HIS Excellency the Governor in Council has approved of the followingRegulations governing the procedure of the Teachers' Appeal Board.

REGULATIONS MA DE UNDER SUBSECTION (El OFSECTION 37 OF THE EDUCATION' ACT, 1928.

(1) The Director may appoint a member of the Clerical Staff ofhis Department to act in the capacity of Clerk to the Appeal Board,and such Clerk shall have the custody of the records and proceedingsof the Board.

(2) Notice of appeal to the Board shall be given by an appellantto the Director within one month after the receipt by the appellant. ofthe notification of the decision appealed against..

(3) The notice shall be in writing signed by the appellant, andshall contain a short statement of the grounds of appeal. Providedthat the Board may at any stage of the proceedings allow an appellantto amend the statement of the grounds of appeal on such terms (ifany) as the Board may deem just.

(4) The appellant shall deposit with the Director with his noticeof appeal the sum of two pounds as security for costs.

(5) The Director, as soon as practicable after the receipt by himof the notice of appeal, shall notify the Clerk to the Boa rd, who shallforthwith arrange for a sitting of the Board to deal with the appeal.

(0) The Chairman of the Board shall appoint a time and place forhearing the appeal.

(7) The Clerk to the Board shall give notice in writing by postor otherwise to the appellant, and to all other persons interested inthe appeal of the time mid place appointed for the hearing of theappeal. Where the party to be notified resides at a place' within aradius of 300 miles from the place of sitting of the Board, seven days'notice at least shall be given; if he resides outside such a radius, 21days' notice at least must be given.

(3) The Clerk of the Board, if requested so to do by the Directoror an appellant, shall send notice to any person whose attendance asa witness is desired at the hearing of the appeal. Should the witnessbe required to produce any document or other thing at the hearing, theClerk shall notify the witness accordingly and specify in hi: notice theparticular document or thing required to be produced.

(9) The party requiring the attendance of a witness at the hearingof an appeal shall, if the witness resides or carries on a business at a,place more than two miles from the place of sitting of the Board, payor tender the witness a reasonable sum of money for travelling ex-penses.

(10) Any person who, having been notified by the Clerk to theBoard to attend as a. witness, and/or to produce any document or otherthing at the hearing of the appeal, and having been paid or tenderedreasonable conduct, money, if resident more than two miles from theplace of sitting of the Board, fails without reasonable cause to attendbefore the Board and give evidence, or produce any such document orother thing, shall he liable to a, penalty not exceeding ten pounds.

(11) The evidence of witnesses who reside more than 20 milesfrom the place of sitting of the Board may be taken on affidavit swornbefore a Justice of the Peace; but the Board may require the attend-ance of any such witness if it deems it desirable so to do.

(12) The appellant may at any time before the date appointedfor the hearing of the appeal, give notice to the Clerk to the Boardof his intention to abandon his appeal. In such event the Board may,on the application of the Director, order the appellant to pay the costs(if any) reasonably incurred by the Department in connection withthe appeal.

(13) The order of procedure at the hearing of the appeal beforethe Board shall be as follows:

(a) The appellant may attend in person or by his agent;(b) The appellant. or Ids agent shall open his case to the Board

and may adduce evidence in support of his appeal;(c) At the close of the ease for the appellant, the Director's

representative may adduce evidence in support of thedecision appealed against.;

(d) When all the evidence for both parties has been adduced,each party shall he entitled to address the Board on thewhole of the evidence. If evidence is called by bothparties, the Director's representative may address theBoard immediately at the conclusion of the evidence calledby him, and the appellant or his agent may then addressthe Board. If evidence is called by the appellant, andthe Director's representative before the conclusion of theappellant's case intimates to the Board that he does notintend to adduce any evidence, the appellant or his agentshall address the Board immediately on the conclusion ofthe evidence, and the Director's representative shall havethe right to reply. If no evidence is called by either partyto the appeal, the appellant may address the Board Firstand will be entitled to a further address in reply to theDirector's representative, if he addresses the Board; andthe seine procedure will he followed where the only evi-dence adduced is on behalf of the Director.

(14) The Board shall conduct the inquiry without regard to legalforms and precedents, and shall direct itself by the best. evidence it canprocure, and may regulate its own procedure.

(15) The Clerk shall keep a record of the proceedings of theBoard. Any member of the Board, the Director or his representative,shall have access to such record. An appellant shall be entitled to applyfor and obtain from the Clerk a copy of the proceedings relating tohis appeal. No other person shall be entitled to inspect or obtain copiesof proceedings in custody of the Clerk.
