West New York Board of Education Work Session/Business Meeting Minutes
May 24, 2012, 5:40 p.m.
The Work Session/Business Meeting of the West New York Board of Education was held in the Auditorium of PS #4, 6300 Palisade Avenue, West New York, New Jersey. The order of business and agenda for the meeting was: I. CALL TO ORDER At 5:40 P.M. President Sires called the meeting to order. II. FLAG SALUTE
The Pledge of Allegiance to the Flag of the United States of America was recited.
III. OPEN PUBLIC MEETING STATEMENT – Mr. Franchetta read the following statement:
The New Jersey Open Public Meetings Law was enacted to ensure the right of the Public to have advance notice of and to attend the meetings of any public bodies at which any business affecting their interest is discussed and acted upon. In accordance with the provisions of the act, the School Business Administrator Board Secretary has caused notice of this meeting to be sent to the following, announcing time and place thereof, agenda, etc.:

And the Administration Bulletin Board. V. COMMUNICATIONS (Board Secretary) None VI. SUPERINTENDENT’S REPORT – John Fauta
A. Hudson County Student Recognition Dinner – Mr. Fauta mentioned that the Hudson County student recognition dinner was held last evening.
B. NFL “Fuel Up to Play 60” Rethink Pizza Contest
Mr. Fauta discussed the $1,000 contest prize presented by Giants’ former wide receiver Amani Toomer to the Harry L. Bain Elementary School on May 17, 2012. The American Dairy Association and the National Football League created the contest as a way to help reverse the growing trend of childhood obesity and the associated serious diseases that result from obesity.
C. School Development Authority Update
-Mr. Fauta stated that Public School #3 will open in September to the students of the district. Today the staff of the Old Public School #3 were permitted to tour the building of the New Public School #3. Last week Mr. Fauta met with representatives of the School Development Authority (SDA). The SDA is negotiating with the local diocese and Vatican for the purchase of St. Joseph’s High School. Hopefully the sale will be completed soon with the district receiving ownership of the building this summer. SDA also discussed the undertaking of emergent projects at PS #1, PS #3, PS #5 and the Harry L. Bain schools.
-Mr. Sanchez mentioned that the SDA commended the district for maintenance program in district. The SDA will fund the repairs for water filtration projects at PS #1 in the amount of $500,000 and PS #5 in the amount of $1,000,000. Additionally façade repairs will be performed by SDA to the Harry L. Bain School.

VII. PUBLIC COMMENTS In accordance with West New York Board of Education Bylaw #0167 (Public participation in board meeting – Adopted April 22, 2009) each participant shall be limited to three minutes duration.
Elsa Maldonado-Lara: A parent of children attending Public School #3 unsatisfied with the school administration. The Board will meet with Ms. Maldonando-Lara in executive session at the June 11, 2012 Board Meeting to hear her concerns.
Kerry Culhane: A teacher of the Alternative Program at Public School #5 expressing her displeasure with central administration’s decision to relocate the program to the Middle School effective September 2012. She asked the Board to have the program remain at PS #5.
Executive Session Notice: VII. OPEN PUBLIC MEETING STATEMENT - Mr. Franchetta read the following statement:
The public portion of the meeting is now concluded. The Board will now recess into Executive Session to discuss items which fall within an exception of our open meetings policy and permits the board to have private discussion since it deals with specific exceptions contained in N.J.S.A. 10:4-12b:

The Board Secretary provides the Board members the opportunity to remove any Resolution(s) from the Consent Agenda. R2 RESOLVED, that this Board of Education approves a curriculum for all grades from
Pre-Kindergarten through Grade 12 for all subjects including all State mandated programs and services, said curriculum having been determined to contain appropriate scope and sequence from course to course and grade to grade allowing for curriculum articulation, and BE IT FURTHER RESOLVED that, the Board of Education directs the Superintendent of Schools to implement the curriculum as adopted by this Board of Education for the 2012-2013 school year:

R3 BE IT RESOLVED that, the West New York Board of Education hereby approves the
following textbooks as attached and as recommended by the Superintendent of Schools, based upon the recommendations of Committees which review, analyze and evaluate textbooks and make recommendations for those that best meet the Curriculum requirements of the School District and that are correlated with the Core Curriculum Content Standards: Elementary (as attached) Middle School (as attached) High School (as attached) And BE IT FURTHER RESOLVED that, the West New York Board of Education may also adopt additional and/or different courses or texts offered on an as-needed basis to expand educational services to its pupils in keeping with the Board’s Goals and Objectives for the 2012-2013 school year.

R4 BE IT RESOLVED that, the West New York Board of Education hereby approves the following
textbooks as attached and as recommended by the Superintendent of Schools, based upon the recommendation of Committees which review, analyze and evaluate textbooks and make recommendations for those that best meet the Curriculum requirements of the School District and that are correlated with the Core Curriculum Content Standards:

the designated official newspapers for compliance with N.J.S.A. 10:4 et.seq., and
BE IT FURTHER RESOLVED that, the following newspapers of general circulation be used as required in the best interest of the West New York School District for the publication of legal notices for the 2012-2013 school year: Cambio El Especialito The Star Ledger
R6 RESOLVED, this Board of Education move that as provided by N.J.S.A. 18A:22-8.1 amended
and by Policy #6422, the Superintendent of Schools or his designee, be designated to approve such line item budget transfers as are necessary between Board of Education meetings, and that such transfers shall be reported to the Board of Education, ratified and duly recorded in the minutes of the next regular meeting of the 2012-2013 school year.
R7 RESOLVED that, the following Financial Institutions be designated as approved depositories
for the West New York School District funds for the 2012-2013 school year and that the Financial Institution be required to be insured by either the SLIC or the FDIC and/or as required by both Federal and State statutes:

R10 RESOLVED, this Board of Education, upon the recommendation of the Superintendent of
Schools, does hereby approve the NJ DOE Chart of Accounts Revised 2008 Edition, effective July 1, 2012.
R11 BE IT RESOLVED that, this Board guarantees non-discrimination practices and equal
access to all persons in all categories of employment, retention and advancement in this district, regardless of race, creed, color, national origin, ancestry, age, gender, affectional or sexual orientation, marital status, liability for service in the Armed Forces of the United States, atypical hereditary cellular or blood trait of any individual or non-applicable disability.
An affirmative action program shall be a part of every aspect of employment not limited to but including upgrading; demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation including fringe benefits; employment selection or selection for training and apprenticeships; promotion; or tenure. The board-designated affirmative action officer shall identify and recommend correction of any existing inequities, and any that occur in the future, and BE IT FURTHER RESOLVED that, this Board of Education is an affirmative action employer and holds all its employees responsible for maintaining a working environment that is free from all discriminatory practices, harassment or favoritism on any basis included in the Board’s statement of equal access to employment, retention and advancement is prohibited, and

NOW, THEREFORE BE IT RESOLVED that, this Board of Education shall maintain a working environment that is free from sexual harassment. Administrators and Supervisors will make it clear to all staff that sexual harassment is prohibited. No supervisory employee shall threaten or insinuate, either directly or indirectly, that an employee’s submission to sexual advances will result in any improvement in any term or condition of employment to an employee. Sexually harassing conduct committed by non-supervisory personnel is also prohibited, and finally The Chief School Administrator and Board have established a grievance procedure to implement this policy to inform staff annually of the identity and location of the Affirmative Action Officer and the implementing procedures as per N.J.A.C. 6:4-1.1 et.seq for the 2012-2013 school year.
R12 BE IT RESOLVED that this Board of Education shall provide an equal opportunity for all
enrolled children to achieve their maximum potential through the programs offered in these schools regardless of race, creed, color, national origin, ancestry, age, gender, affectional or sexual orientation, marital status, liability for service in the Armed Forces of the United States, atypical hereditary cellular or blood trait of any individual or non-applicable disability, nationality, place of residence with the district, social or economic condition, or disability. Enforcement of other district affirmative action polices (1523, 2260, & 5750) contribute to this legally required equality of educational opportunity.
Staff members shall maintain professional relationships with pupils at all times and develop wholesome and constructive relationships with pupils. Staff members shall be expected to regard each pupil as an individual and to accord pupil the rights and respect that is his/her due. Staff members shall promote a learning environment that encourages fulfillment of each pupil’s potential in regard to his/her program, consistent with district goals and with optional opportunities for pupils, and, BE IT FURTHER RESOLVED, and the district’s affirmative action program is part of each academic program regarding all pupils. No one--including pupils, staff members, vendors volunteers, or visitors--shall commit an act of harassment/discrimination of any kind against any member of the school community on any of the grounds prohibited by law, and the Board of Education shall maintain an academic environment that is free from sexual harassment. The Chief School Administrator also ensures that staff and pupils participate in educational programs relating to this policy and the maintenance of an educational environment for the 2012-2013 school year.
R13 RESOLVED that, this Board authorizes the publication of the annual notice affirming this
Board’s policy to ensure equal education opportunities for all students and equal opportunities for all persons and by said policy affirms not to discriminate in its education programs, activities, employment policy or admission policies and practices on the basis of race, color, creed, religion, sexual orientation, national origin, social or economic status, gender, handicap or lack of English language skills, and BE IT FURTHER RESOLVED that, this Board also authorizes the publication of this Board’s affirmation of the designation of Allan C. to adopt policy and approve travel expenditures by district employees and board members using local, State, or Federal funds to ensure that travel is educationally necessary and fiscally prudent; and WHEREAS, the Board of Education has determined that the training and informational programs sponsored by NJSBA and Hudson County School Boards Association and set forth below are directly related to and within the scope of board members’ duties; and WHEREAS, the Board of Education has determined that the training and informational programs sponsored by NJSBA and Hudson County School Boards Association and set forth below are directly related to and within the scope of the listed job title’s current responsibilities and the board’s professional development plan; and WHEREAS, the Board of Education has determined that participation in the NJSBA and Hudson County School Boards Association training and informational programs requires school district travel expenditures and that this travel is critical to the instructional needs of the district and/or furthers the efficient operation of the district; and WHEREAS, the Board of Education has determined that the school district travel expenditures to NJSBA and Hudson County School Boards Association programs are in compliance with State travel guidelines as established by the Department of the Treasury and within the guidelines established by the federal Office of Management and Budget; except as superseded by conflicting provisions of Title 18A of the New Jersey Statutes; and WHEREAS, the Board of Education finds that a mileage reimbursement rate of $.31 per mile is a reasonable rate; and WHEREAS, the Board of Education has determined that participation in the NJSBA and Hudson County School Boards Association training and informational programs is in compliance with the district policy on travel; therefore be it RESOLVED, that the Board of Education hereby approves the attendance of the listed number of school board members and district employees at the listed NJSBA and Hudson County School Boards Association training and informational programs, and the costs of attendance including all registration fees, and statutorily authorized travel expenditures, provided that such expenditures are within the annual maximum travel expenditure amount; and, be it further RESOLVED, that the Board of Education authorizes in advance, as required by statute, attendance at the following NJSBA and Hudson County School Boards Association training programs and informational events: Travel Limitation for regular business travel up to $1,500.00 per person for the 2012-2013 School Year.

R37 The Board of Education of the West New York School District, County of Hudson, State of New Jersey, as provided for in Chapter 172 Laws 1979 (N.J.S.A. 18A:11-3, et seq.) herewith enrolls Memorial High School as a member of the New Jersey State Interscholastic Athletic Association to participate in the approved interschool athletic program sponsored by the NJSIAA.
This resolution to continue in effect until or unless rescinded by the Board of Education and shall be included among those policies adopted annually by the Board. BE IT FURTHER RESOLVED that, this Board approves contracting with the Hudson County Schools of Technology School for the assignment of a bus aide, where necessary, at a cost to be determined based upon student enrollment and need. NOW THEREFORE BE IT RESOLVED that, this Board acknowledges the Federal Omnibus Transportation Employee Training Act of 1990, 49 C.F.R. Park 382 et seq., requirements as submitted by the County Consortium and hereby approves same.
R39 WHEREAS, the State of New Jersey has adopted The Educational Stability Act A-2137/S1333 which requires this Board to appoint a Coordinator for securing transportation for students removed from the home so that they may remain in the school he/she attended prior to placement in foster care.

1.6 BE IT RESOLVED, by this Board of Education of the Town of West New York, renew the EASTERN
contract with Eastern Oil Company (Eastern Finch, Inc.) of Kearny, NJ based upon the bid OIL CO. received Tuesday, April 13, 2010 for #2 Fuel Oil (Bid #03-11) for the 2011-2012 school year in RWNL #03-11 accordance with N.J.S.A. 18A:18A:42a(1) at no increase. The price is based upon the New York Harbor Tank Car Consumer Low price with a fixed upcharge per gallon of $0.0810 based on the date of delivery.
FURTHERMORE, BE IT RESOLVED, that this Board of Education in accordance with N.J.S.A. 18A:18A-9 authorize the School Business Administrator/Board Secretary to advertise and receive competitive bids or utilize New Jersey State Contract, which ever method is more advantageous, for the furnishing and delivery of #2 Fuel Oil for the various schools of the Town of West New York for the 2012-2013 school year.
1.7 Approve the Third Renewal of contract for food service management services for the FOOD S.C.R.
2012-2013 school year with Nu-Way Concessionaires at a 3% Increase as follows:
2012-2013 AWARD The Food Service Management Company shall receive in addition to the costs of operation, a fee of $0.0840 (Eight Point Four Zero Cents) per reimbursable meal and meal equivalent to compensate the Food Service Management Company for administrative and management costs. This fee shall be billed monthly as a cost of operation. The Local Education Agency guarantees the payment of such costs and fee to the Food Service Management Company. Total meals are calculated by adding reimbursable meal pattern meals (breakfast, lunch and after school snack meals) served and meal equivalents. The number of School Breakfast Program, After School Snack Program, and National School Lunch program meals served to the children shall be determined by actual count. Cash receipts, other than from Sales of National Lunch Program and School Breakfast Program meals and After School Snack Program meals served to the children, shall be divided by $1.00 (One Dollar) to arrive at an equivalent meal count. The per meal management fee of $0.0840 (Eight Point Four Zero Cents) will be multiplied by total meals. The projected Management fee for the school year 2012-2013 is based on a projected total of 1,525,070 total meals. The Food Service Management Company guarantees the Local Education Agency a profit of at least $42,628.00 up to 100% of their management fee for school year 2012-2013. This guarantee is contingent upon the guarantee requirements as stated below.
a) That the reimbursement levels are equal to or greater than those from the base year contract and reimbursement does not decrease due to lack of funds.
b) Attendance levels remain within 5% of reported levels from the previous school year. c) The number of Free and Reduced priced eligible students does not decrease by more than 5% of
reported levels from the previous school year. d) Market fluctuations do not cause a substantial (+5%) increase in product costs.

e) Ala Carte sales shall be permitted at all locations for the term of the contract. f) No change in school policy that significantly affects operating costs. g) No change in federal or state regulations that impacts cafeteria operating revenue or expense. h) A decrease in sales due to food recall that is beyond the control of the Food Service Management
Company may affect the guarantee. i) The state or federal minimum wage rate and taxes in effect as of January 1, 2012, shall remain
consistent throughout the year. 1.8 BE IT RESOLVED, that the West New York Board of Education, upon the ANTI
recommendation of the Superintendent of Schools, authorizes the submission of the BULLYING application for funds to support the implementation of the Anti-Bullying Bill of Rights R.C.F.SUB. Act to the NJDOE for the project period 7/1/2011 to 6/30/2012 in the amount of $2,470.

BE IT RESOLVED, this Board approves the adoption of the District Comprehensive Maintenance Plan/M-1 with corrective and preventive measures for the interior and exterior of each building and the major systems of HVAC, Mechanical Plumbing, Electrical, Structural and Grounds for the 2012-2013 School Year, and BE IT FURTHER RESOLVED, the M-1 shall be submitted to the Hudson County Executive County Superintendent of Schools.

New Jersey Department of Education will defer the June, 2012, school aid payments until FUNDS July, 2012, and WHEREAS, under the authority of Title 18A, Education, of the New Jersey Statutes, N.J.S.A. 18A:22-44.1, 18A:22-44.2 or 18A:22-25, school districts are herby authorized to borrow funds for this purpose, and WHEREAS, the payoff of the approved short-term borrowing will be made by the state to the district’s regular state aid account from the district’s state aid payment no later than July 9, 2012, and WHEREAS, the state will also pay the interest cost approved by the department directly to the district’s regular state aid account, and WHEREAS, in order to ensure the continuing effective operation of the district, BE IT RESOLVED, this resolution permitting the borrowing of funds and submission of an Application for Approval of Loan to the Hudson County Executive Superintendent of Schools is herewith submitted, and NOW, THEREFORE, BE IT RESOLVED, the West New York Board of Education hereby resolves to borrow $5,207,502.00 from Capital One Bank N.A., at 3.25% interest, total a mount of $5,220,655.41 to be paid on July 6, 2012.
1.11 BE IT RESOLVED, the West New York Board of Education hereby accepts the NJSBAIG NJSBAIG/ and NJEIF Subfund 2012 Safety Grant in the amount of $23,322.01 for the 2012-2013 NJEIF S.G.P.A school year.
1.12 WHEREAS, the West New York Board of Education publicly solicited Requests for Proposal INCREASE
conflict legal counsel on November 9, 2011, and C.LEGAL C. WHEREAS, this Board of Education authorized the award of a Professional Service Contract to the firm of La Corte, Bundy, Varady & Kinsella, 989 Bonnel Court, Union Township,, New Jersey, to provide Legal Services, to the Board for the matter of Roque v. Passante and Locatelli in an amount not to exceed $5,000 on February 15, 2011, and NOW, THEREFORE BE IT RESOLVED that, this Board authorize the award of the Professional Service Contract awarded to La Corte, Bundy, Varady & Kinsella to provide Legal Services for the 2011-2012 School Year be increased to an amount not to exceed $7,000.
1.13 WHEREAS, N.J.A.C. 6A:23A-5.6 requires a school district to discuss the findings of an OFAC
OFAC audit at a public meeting of the district board of education no later than 30 days after AUDIT L.A. receipt of the findings, and
WHEREAS, the West New York Board of Education Early Childhood Education Provider, Little Angels of New Jersey LLC underwent such an audit for the 2010-2011 school year, and WHEREAS, the New Jersey Department of Education Office of Fiscal Accountability and Compliance letter of Report of Examination dated March 9, 2012 was received by the District on March 19, 2012, and WHEREAS, the Office of Fiscal Accountability and Compliance, based upon their limited review, revealed several areas of concern requiring additional monitoring and follow-up in order to enhance compliance with the contractual requirements of the educational components in the Early Childhood Preschool Education Program, and

WHEREAS, the District, in collaboration with the Provider, is submitting to the New Jersey Department of Education Office of Fiscal Accountability and Compliance the attached Corrective Action Plan which addresses the issues raised in the findings. 2.6 BE IT RESOLVED, that the West New York Board of Education, upon the recommendation STATE FARM of the Superintendent of Schools, approves the submission of the State Farm Insurance INS. G.S. Grant in the amount of $82,346 for the 2012-2013 school year. This grant will prepare high school students for entering college to study education, and will assist struggling students at the elementary and high school levels. The Tomorrow’s Teacher students will provide training of volunteer tutors who will work one-to-one with children and youth. As a result of the additional assistance, there will be an increase in students’ academic skills.
2.7 BE IT RESOLVED, that the West New York Board of Education, upon the recommendation MCCARTHEY
of the Superintendent of Schools, approves the submission of the McCarthey-Dressman Grant DRESSMAN in the amount of $28,206 for the 2012-2013 school year. This grant will provide an after GRANT. SUB. school program for music and dance in the context of social studies and language arts, African and Caribbean artwork, a play for elementary students, and a video document of the project. The funds will also support lighting for the stage, portable lighting for travel shows and camera equipment.
2.8 BE IT RESOLVED, that the West New York Board of Education, upon the recommendation ING. U.H.G.S.
of the Superintendent of Schools, approves the submission of the ING Unsung Heroes Grant in the amount of $25,000 for the 2012-2013 school year. This grant will support tutoring materials for School 2, e-readers for the TTs and School 2, and computers for a TT lab.
2.9 BE IT RESOLVED, that the West New York Board of Education, upon the recommendation FARM TO
of the Superintendent of Schools, approves the submission of the Farm to School Grant in SCHOOL the amount of $100,000 for the 2012-2013 school year. This grant will bring in more fruits GRANT SUB. and vegetables to the district’s menu on a consistent basis. Project will involve working in concert with local farmers, vendors, processors, as well as nutritional education in the curriculum.
2.10 BE IT RESOLVED, that the West New York Board of Education, upon the recommendation GTECH
of the Superintendent of Schools, approves the submission of the GTECH Computer Lab Grant Program Grant in the amount of $15,000 for the 2012-2013 school year. This grant will help develop an application for equipment to support the creation of a new computer lab at PS # 1 to be used in conjunction with the before and after school program.
2.11 BE IT RESOLVED, that the West New York Board of Education, upon the recommendation WHOLE KIDS
of the Superintendent of Schools, approves the acceptance of the Whole Kids Foundation and F./F.CROP. Food Corps Grant in the amount of $2,000 for PS # 4 for the 2011-2012 school year. This grant GRANT will be used toward gardening supplies and materials for the Wellness Garden at PS # 4.
2.12 BE IT RESOLVED, that the West New York Board of Education, upon the recommendation TOSHIBA
of the Superintendent of Schools, hereby approves the acceptance of the Toshiba America A.F.A.F.G.A. Foundation grant in the amount of $9,336 for the 2011-2012 school year. This grant will transport our innovative and exemplary Alternative Fuels Education program to an advanced level. The money will be used to purchase two (2) dynamometers that will allow students to scientifically evaluate the efficiency of alternative fuels in car engines.
2.13 BE IT RESOLVED, that the West New York Board of Education, upon the recommendation THOMAS
of the Superintendent of Schools, approves the display of Memorial High School’s Alternative ED.IN.L.D. Fuel Lotus Electric Car as part of Edison Day on June 2, 2012 at the Glenmont Garage in West Orange, NJ, honoring inventors and their innovative programs.

No.: 17E-2009-00255; and WHEREAS, the parties and the New Jersey Division on Civil Rights have agreed to amicably resolve the matter pursuant to the attached settlement agreement in the amount of $90,000.00 which includes back pay. NOW THEREFORE BE IT RESOLVED that this Board of Education hereby agrees to resolve this matter in the amount of $90,000.00 and authorizes the Superintendent of Schools and this Board’s President to execute the attached settlement agreement.

NOW, THERFORE, BE IT RESOLVED, this Board upon the recommendation of the Superintendent of Schools, in keeping with Article 10 of the Agreement between the West New York Board of Education and the West New York Education Association and having considered the request of said employee and having reviewed the supporting documentation and by reason of the special circumstances which exist and for good cause shown, hereby grants additional sick leave to Ms. Romelia Loynas commencing May 1, 2012 for a period not to exceed 40 days subject to the following limitations as enumerated below and pursuant to Article 10 of the Agreement:
A. Said employee shall have sustained a complete loss of pay for five (5) school days (first week) of sick leave time granted.
B. For each school day of the second week of said period said employee shall be paid a sick day’s salary (defined as 1/200th of the annual salary) less the pay of a substitute or the estimated cost of the employment of a substitute if none is employed.
C. After the expiration of the above 2 week period and with the concurrence of the Medical Director of the Board of Education on the recommendation from the attending physician of said employee that further absence from service is essential, the Board (having in mind the length of employment of such employee) shall grant further leave to such ill employee.
D. Upon the exhaustion of the extended sick leave period as herein set forth Ms. Romelia Loynas shall suffer full and complete loss of pay until such time that she is able to return to employment.
6.28 WHEREAS, this Board has determined to grant Nohora Cuellar, a Secretary at PS#5, BONUS SICK FMLA leave beginning May 8, 2012; and DAYS N.C.
