As a condition of your entry onto and use of these lands, you agree to assume all risk of personal injury, death or property loss resulting from any cause whatsoever including but not limited to: the risks, dangers and hazards of mountain biking, backcountry travel, hiking, and other activities; collision or impact with natural or manmade objects, vehicles or other persons; slips and falls; traversing manmade and natural structures; encounters with animals; tree falls; negligence of other persons; and negligence, breach of contract, or breach of statutory duty of care on the part of Timberwest Forest Company, Mosaic Forest Man- agement, the Regional District of Nanaimo, and the Nanaimo Mountain Bike Club and their directors, officers, employees, agents, volunteers, independent contractors, subcontractors, representatives, sponsors, successors and assign (“the Releasees”). You acknowledge the risk of injury, death or property loss by entering upon and using these lands and you agree to release the Releasees and waive all claims you may have against the Releasees with respect thereto. Any litigation involving the Releasees shall be brought solely within the Province of British Columbia and shall be within the exclusive jurisdiction of the Courts of the Province of British Columbia. These conditions and any rights, duties and obligations involving the Releasees and you shall be governed by and interpreted solely in accordance with the laws of the Province of British Columbia and no other jurisdiction.
