Currently, at many colleges the primary route for difficult conversations exists at only two ends of a spectrum. Either the process is so casual as to invite a lack of commitment, or so extreme that it may involve supervisors, human resources and/or a union representative. Data demonstrates that most disputes can be resolved without formal action or litigation, if only a process in place that is solution-oriented, and yet at the same time does not require a solution. Most so-called 'disputes' dissolve when a truly confidential arrangement, preferably with mediators who are unfamiliar to both parties, is created. If folks are willing to enter into a trust, agree to simply listen, and there is ample space to have a turn to be heard, creative solutions often emerge. Under stress, people comprehend information at four grade levels below normal, and fear can shut down the verbal brain. It is imperative that the process build in time to reflect, self-regulate, and find the words for expression. Well-evidenced mediation techniques with innovative options will be covered in a fast-moving, highly interactive discussion, with opportunities for mini-mindfulness as well as to practice scenarios with breakout groups.
