  • JUNE 13, 2015

    Texas Governor Gregg Abbott signed SB 11 “Campus Carry” into law on June 13, 2015 at Red’s Indoor Gun Range in

    Pflugerville, Texas.

  • SENATE BILL 11- SUMMARY

    The Bill authorizes a license holder to carry a concealed handgun on or about the license holder's person while the license holder is on the campus of an institution of higher education or private or independent institution of higher education in this state.

  • SENATE BILL 11

    Open carrying of handguns is still prohibited.

  • SENATE BILL 11

    Authorizes an institution of higher education or private or independent institution of higher education to establish rules, regulation, or other provisions concerning the storage of handguns in dormitories or other residential facilities that are owned or leased and operated by the institution and located on the campus of the institution.

    The bill allows a private or independent institution to choose not to allow handguns on campus, but only after consulting with students, staff, and faculty of the institution.

    Allows private universities to prohibit concealed handguns on their campus all together.

    The president of an institution of higher education shallestablish reasonable rules, regulations, or other provisions regarding the carrying of concealed handguns by license holders on the campus or on specific premises located on the campus.

    • Requires universities to submit a report by September 2 in even numbered years to legislative oversight committees describing its rules under this section

    • Prevents universities or its officers from being held liable for damages caused by a person authorized to carry a concealed handgun

    • Prohibits a university from restricting the carrying of a handgun in a persons car if that person holds a concealed handgun license

    • Requires that prohibited areas are designated by “30.06 signs” which indicated that carrying of a handgun within the area that is prohibited

  • SENATE BILL 11

    • Takes effect Aug. 1, 2016, but universities can take action to establish rules prior to that effective date

    • The effective date of this law for a public junior college is August 1, 2017

  • STILL PLACES CANNOT CARRY

    • There are significant exceptions.

    • For example, Texas PC 46.035 (UNLAWFUL CARRYING OF HANDGUN BY LICENSE HOLDER)prohibits carrying of handguns and other weapons in the following places:

    Still prohibited in places that serve alcohol which derive 51% or more of their income form the sale of alcohol for consumption on the premises, such premises are required to post notices under Texas GC 411.204

  • STILL PLACES CANNOT CARRY

    • On the premises where a high school, collegiate*, or professional sporting or interscholastic event is taking place

    • On the premises of a correctional facility

    *Collegiate Sporting Events require notice that meets Penal Code Chapter 30.06

  • STILL PLACES CANNOT CARRY

    On the premises of a hospital or nursing home if effective notice of prohibition is given per Penal Code Chapter 30 (unless the licensee has written authorization); such premises also are required to post notices under Texas GC §411.204

  • STILL PLACES CANNOT CARRY

    • In an amusement park*

    • On the premises of a church, synagogue, or other place of worship*

    *if effective notice of prohibition is given per Penal Code Chapter 30

  • STILL PLACES CANNOT CARRY

    • At any meeting of a governmental entity

    • (if the meeting is subject to the Texas Open Meetings Act per Government Code Chapter 551, and effective notice of prohibition is given per Penal Code Chapter 30)

    Sec. 30.06. TRESPASS BY LICENSE HOLDER WITH A

    CONCEALED HANDGUN.

    a) A license holder commits an offense if the license holder:(1) carries a concealed handgun under the authority of Subchapter H,

    Chapter 411, Government Code, on property of another without effective consent; and

    (2) received notice that entry on the property by a license holder with a concealed handgun was forbidden.

    (b) For purposes of this section, a person receives notice if the owner of the property or someone with apparent authority to act for the owner provides notice to the person by oral or written communication.

    (c) In this section:

    (1) "Entry" has the meaning assigned by Section 30.05(b).

    (2) "License holder" has the meaning assigned by Section 46.035(f).

    (3) "Written communication" means:

    (A) a card or other document on which is written language identical to the following:

    "Pursuant to Section 30.06, Penal Code (trespass by license holder with a concealed handgun), a person licensed under Subchapter H, Chapter 411, Government Code (handgun licensing law), may not enter this property with a concealed handgun"; or

    Examples: Language printed on back of ticket, an informational pamphlet, etc..

    (B) a sign posted on the property that:

    (i) includes the language described by Paragraph (A) in both English and Spanish;

    (ii) appears in contrasting colors with block letters at least one inch in height; and

    (iii) is displayed in a conspicuous manner clearly visible to the public.

    d) An offense under this section is a Class C misdemeanor punishable by a fine not to exceed $200, except that the offense is a Class A misdemeanor if it is shown on the trial of the offense that, after entering the property, the license holder was personally given the notice by oral communication described by Subsection (b) and subsequently failed to depart.

    (e) It is an exception to the application of this section that the property on which the license holder carries a handgun is owned or leased by a governmental entity and is not a premises or other place on which the license holder is prohibited from carrying the handgun under Section 46.03 or 46.035.

    • UH takes issues surrounding campus safety and guns on campus very seriously.

    • UH will strive to create policies that: o comply with the new Campus Carry law,

    oprotect the rights of citizens, and

    oaddress the safety and security of the entire campus

  • CAMPUS CARRY WORK GROUP

    The University has charged a 15-member Campus Carry Work Group comprised of representatives throughout various University departments and groups with the responsibility to develop a campus carry policy that is compliant with the new campus carry law.

  • WORK GROUP TIMELINE

    • March 2016: 1st draft distributed;

    • April 2016: 2nd draft distributed;

    • May 2016: Final drafts of the campus carry policies are presented to the

    Board of Regents.

    While the President may not generally prohibit license holders from carrying concealed weapons on the campus, the University can prohibit license holders from carrying weapons in certain portions of the campus after conducting the above-referenced review.

    Requires the Board of Regents (BOR) to approve these restrictions within 90 days of being established.

  • TEXAS SENATE BILL NO. 273

    Prohibits a state agency or political subdivision from posting a sign or similar notice forbidding a concealed handgun license holder from carrying a handgun on a premises owned or leased by the governmental entity unless the license holder was prohibited from carrying a weapon on the premises under Penal Code, secs. 46.03 or 46.035.

    • The Texas legislation has teeth, but fair notice must be given to the government entities that break the law.

    • Once a government entity is placed on notice that they are in violation of the law, they have 15 days to remove the offending sign.

    • The bill would make state agencies and political subdivisions that violated this section liable for civil penalties ranging from:

    • $1,000 up to $1,500 for the first violation; and

    • $10,000 up to $10,500 for a second or subsequent violation.• Each additional day is a separate offense.

    • It is likely that many gun free zones will be eliminated around the state.

    • The significance of this law is that the default position has become that permit holders are expected to be able to carry most places, with some specific exceptions.
