Post Oak Neighborhood Watch Program The Neighborhood Watch program is a joint effort between the Kyle Police Department and our community. The goal of the program is to enhance neighborhood security, heighten the community’s power of observation and to encourage mutual assistance and concern among the neighborhood.

We need your help! Be part of the information gathering team and agree to be proactive in our goal to keep our neighborhood safe. Be suspicious of unfamiliar vehicles. Let another trusted neighbor know if you will be away. Look after someone else’s home while they are away. Above all, be concerned. It is the most effective way to reduce or prevent crime and make our neighborhood safe. Often times, spending a few extra seconds watching strangers walking or driving through your neighborhood is enough to prevent many crimes. Did you know that the City of Kyle has a curfew? Any minors, under 17 years of age may not linger or stay in public places between the hours of 11:00p.m. – 6:00a.m. Sunday – Thursday and 12:01a.m. -6:00a.m on Friday and Saturday. Offense can be punishable by fine of up to $500 per conviction of violation. POST OAK ONE DIRECTORY

What is a homeowners' association and how does it function? A homeowner association is corporation formed by a real estate developer for the purpose of marketing, managing, and selling of homes and lots in a residential subdivision. The by-laws and declarations of covenants, conditions and restrictions were created and filed as legal documents by the developer as a basis for the function of the homeowners association. The HOA grants the developer privileged voting rights in governing the association, while allowing the developer to exit financial and legal responsibility of the organization, by transferring ownership of the association to the homeowners after selling off a predetermined number of lots. It allows a civil municipality to increase its tax base, but without requiring it to provide equal services to all of its citizens. Membership in the homeowners association by a residential buyer is a condition of purchase; a buyer isn't given an option to reject it. Post Oak One HOA retains a community management company. The management company is hired to handled Post Oak One Homeowners Association statements for annual assessments, violations to deed restrictions, collection notices, manage vendors, file taxes, maintain required insurance and manage the day to day business needs of the community. Our management company has a secure online portal for residents and homeowners to manage their affairs. It is also in charge of making sure our amenities and common areas are maintained and kept in order. The board of directors is responsible for the retention of this company. Our board of directors is comprised of 3 individuals; our developer, a sales representative and a community representative. The board of directors make decisions based on the by-laws and declarations of covenants, conditions and restrictions regarding maintenance, upkeep and other issues pertinent to the development. Board meetings are held typically in May and October. Post Oak One HOA also has board officers who volunteer to serve a 1-year term. These individuals express an interest to volunteer as leader of the community at the annual meeting and are inducted at the board meeting following the annual meeting. The board officers provide a voice for the community by expressing the community's concerns and providing proactive solutions brought up at HOA meetings to the board of directors at board meetings.

RECREATION AREA RULES AND REGULATIONS

INTRODUCTION The Post Oak One Homeowners Association (Association) provides attractive and desirable amenities for the benefit of its members and authorized guests. These rules are written to provide for the safety and enjoyment of its recreational areas by authorized members and guests and to protect the assets of the Association. All members are responsible for understanding and enforcing these rules with the members of their household, their authorized guests, and wherever they see rule violations occur.

ADMINISTRATION OF THE FACILITIES 1. Control of Recreation Areas Control of the recreation area will be exercised by ALL POST OAK ONE HOA members to aid and assist in the enforcement of these rules and regulations. If necessary, the Sheriff’s Department shall be called to assist. 2. Amended Rules The Association Board of Directors reserves the right, by a majority vote among the board members, to amend or change these rules at the time and in the manner it deems necessary. 3. Disputes and Appeal Process Disputes and Appeals should be submitted in writing to the Board of Directors to be considered within a reasonable period of time but no later than the next regularly scheduled board meeting. All parties involved in the dispute or appeal are encouraged to attend the meeting and discuss the situation with the Board of Directors. Final interpretation and enforcement of these rules, however, is the responsibility and authority of the Association Board of Directors.

PROVISIONAL USE OF FACILITIES 1. Authorized Users All members in good standing and all tenants who have paid recreation use fees for the current season are welcome to use the facilities during normal operating hours. A ‘member in good standing’ is:

a. Any member of the Association physically residing or owning property in any Section of Post Oak, whose outstanding

dues balance is current, and who owes no outstanding fees or charges assessed in addition to regular dues;

b. The unmarried child of a member in good standing who is a student living away for school and resides in Post Oak during school breaks.

Additional age requirements apply to the use of the pool and are documented below. 2. Revocation of Privileges It is a privilege to use the Association recreational facilities. Violation of these rules or unlawful or unsafe behavior is just cause for revoking this privilege. The Association Board of Directors, in its discretion and with cause, may revoke the privileges of any member or members for any period of time as designated by the Board. 3. Trespassing / Restricted Use The recreational facilities are on private property and are not open to the general public. Only Authorized Users, as defined above, may use the Recreational Areas. All other persons using the facilities may be reported to local authorities as trespassers. 4. Liability Use of any of the recreational facilities shall be at the risk of the user. The Association cannot be held liable for any accidents incurred during any authorized or unauthorized use of the recreational areas. All Authorized Users Are Required To Sign A Waiver And Indemnity Agreement Prior To Using Any POST OAK ONE HOA Facility. This form may be obtained from RealManage. 5. Gate Access Cards are numbered and registered to each authorized user household. Cards may not be loaned or otherwise provided to any one for any reason. Additional or replacement cards must be registered to the member and may be ordered from the RealManage for an additional charge. Lost or stolen cards must be reported immediately. Authorized users are responsible for the use of their card at all times. Violation of this rule is just cause for the revoking of privileges.

RULES COMMON TO ALL FACILITIES 1. Damage to POST OAK ONE HOA Property Members of the Association or tenants paying annual fees for recreation use will be billed and responsible for all replacement or repair costs for POST OAK ONE HOA property damaged by members of their household or their guests. 2. Noise Control All of the facilities are close to homes. Loud music and yelling is strictly prohibited. 3. Profanity / Explicit Behavior This is a family-friendly neighborhood. The use of profanity in the Recreation Areas is strictly prohibited. Explicit or suggestive conversations or actions, even in the absence of profanity are also strictly prohibited. Explicit or suggestive attire is strictly prohibited. Nudity is not allowed at any time. 4. Alcoholic Beverages No alcoholic beverages shall be permitted at any of the facilities. 5. Animals Please leave all pets at home. Pets are not allowed inside any of the fences and may not be left tied outside the fence. Service Animals are allowed inside the fences but may not enter the water at any time.

BASKETBALL COURT RULES 1. Basketball Court Access The basketball courts are for POST OAK ONE HOA residents and their guests only. 2. No Horseplay No horseplay or other dangerous activity shall occur on either court. Hanging from the basketball rim is prohibited. 3. Damage Prevention No activity shall be permitted which will damage the courts and/or equipment, or render either unfit for use. Only basketball playing is allowed on the courts. Appropriate footwear shall be worn for all court activity to prevent damage to the court surface. Property that is damaged as a result of recurrent use should be reported to a RealManage so that it can be repaired or replaced. 4. Equipment The Association provides the basketball goals with nets. The users of the courts must provide all other equipment needed for play. 5. Excluded Items No bicycles, skateboards, skates or etc. are allowed on the court. These items should be left in the parking area adjacent to the courts. 6. No Animals No animals are allowed on either court. Animals are not to be left tied up outside the court or otherwise unattended while owners are using the basketball court. 7. Order of Use The basketball court cannot be reserved. Use is strictly on a first come, first use basis, but users should be considerate of other members and their guests who wish to use the courts. Users are expected to release the court they are using to those who wish to use it next within one hour of the next user’s arrival. 8. Hours of Operation Basketball courts may be used from sunrise to sunset only. Play during darkness is prohibited in order to prevent injury. 9. Parking Users of the basketball court shall park their vehicles in the paved parking area adjacent to the courts. Parking of vehicles on public streets or in the recreation property driveways is prohibited.

WARNING: NO LIFEGUARD ON DUTY, SWIM AT YOUR OWN RISK

The gates are to remain locked at all times. The pool can be accessed with a pool card and under no circumstances should the gates be propped open. DO NOT OPEN THE POOL GATE FOR ANYONE OTHER THAN YOUR FAMILY OR YOUR GUESTS. The fence and gate that surround the pool area are for resident protection. PLEASE NOTE: cards will ONLY be distributed to members in good standing with the Association. To be in good standing, you must: 1) Be current on homeowner assessments as outlined in the Collections Procedures approved by the Board of Directors; 2) You must have a current card waiver form on file with RealManage; 3) You may have no unresolved Deed Restriction Violation fines. Lost cards will be replaced for a fee of $40.

IDENTIFICATION • Swimmers must have a pool card with them to enter pool area. The pool is for the use of Post Oak

One Homeowners Association, Inc. members and their invited guest(s)/appointed guardian(s) only. It is recommended that you write your name on your card so it does not get confused with others at the pool.

• Parents must provide authorization naming a specific guardian to attend to their children 16 years of age and under while at the pool. An authorized guardian must be 18 years of age or older.

COMMUNITY REQUIREMENTS & CONDUCT

1. Children under the age of 16 and under must be accompanied by an adult age 18 or older that is a Post Oak One Homeowners Association, Inc. member or an authorized guardian.

2. The gates are to remain locked at all times. The pool can be accessed with a pool card and under no circumstances should the gates be propped open. The fence and gate that surround the pool area are for resident protection.

UNDER NO CIRCUMSTANCES WILL ALCOHOL, TOBACCO, FIREARMS, DRUGS OR GRILLS BE PERMITTED IN ANY AMENITY CENTER FACILITIES OR SURROUNDING AREAS. ANYONE SEEN ENGAGING IN THE USE WILL BE SUBJECT TO LOSS OF PRIVLEGES FOR A PERIOD OF TIME TO BE DETERMINED BY THE ASSOCIATION BOARD, AND OTHER LEGAL ACTIONS MAY BE TAKEN IN CONJUNCTION WITH THE LOCAL LAW ENFORCEMENT AGENCY.

GENERAL REQUIREMENTS & CONDUCT

Any individual(s) who are reported to be/or found to be in violation of any of these following pool rules will be reported to the Post Oak One Homeowners Association, Inc. Board and possibly the local law enforcement agency (as applicable). The nature of the situation will be considered and action(s) toward resolution will be at the Board’s discretion.

3. USE OF ANY EQUIPMENT PROVIDED IN THE AMENITY CENTER FACILITIES IS AT YOUR DISCRETION. PLEASE USE CAUTION. SWIM AT YOUR OWN RISK

4. When lifeguards or monitors are on duty, they are the authority at all times. No person shall distract a lifeguard

or monitor who is on the lifeguard stand except in cases of an emergency. Only lifeguards or monitors are allowed on the lifeguard stand.

5. Children under age 12 must demonstrate the ability to swim the length of the pool in order to be allowed in the water without an adult at hand. A parent must supervise all children under the age of 16 listed on the pool waiver form for their household.

6. Parents must check swim diapers AT LEAST 3 times per hour. Children under the age of 3 are not allowed in the pools without a swim diaper. Disposable diapers are not allowed, swimsuits are required.

7. The baby pool is reserved for children ages five (5) and under. Adult supervision is required at all times for

children in the baby pool.

8. Proper swim attire is required. No “cut-offs” are allowed. Please respect all cultural differences with family friendly attire. Cover-ups are only allowed over proper swim attire.

9. Conduct by any person deemed to be dangerous, unreasonable, or offensive (including "horseplay") is not

allowed and should be reported to RealManage at (512) 219-1927 OR 1-866-4-RealService (1-866-473-2573). Any individual disciplined repeatedly, or for serious infractions, will lose all pool privileges for the rest of the season.

10. Running, hopping, skipping or speed walking within the pool area is prohibited.

11. Under no circumstances shall grills, pets, bicycles, skateboards, scooters or motorized cycles be permitted within

the fenced pool area. Roller-skates and/or Rollerblades may be carried into the pool area and stored with personal belongings but may not be worn within the fenced pool area.

12. Diving from the side of the pool is not permitted.

13. Climbing or sliding on any hand railing is not permitted.

14. Playing with lifesaving equipment is not permitted. The use of the lifesaving ring, life hook or any other safety

equipment is for emergency use only. Do NOT play with these items.

15. No glass containers of any type are allowed in the pool area.

16. Food shall only be consumed in areas at least six feet away from the pool. No chewing gum is allowed within the pool area.

17. All trash generated by anyone in the fenced pool area must be placed in garbage containers or otherwise properly disposed of.

18. Swimmers are encouraged to shower before entering the pool. While we encourage protection from the harmful

rays of the sun, the use of oils and other heavy suntan lotions cause filter damage, use these lotions sparingly.

19. Persons with open sores, wounds and bandages or communicable diseases are encouraged to refrain from swimming in the pool. DO NOT USE THE POOL IF YOU OR YOUR CHILD HAS HAD DIARRHEA IN THE PREVIOUS TWO WEEKS. IF A FECAL ACCIDENT OCCURS: All swimmers must exit the pool immediately, and the pool will be closed for a minimum of two (2) hours from the time the pool has been chemically treated. The pool will be cleaned, disinfected and tested, and proven to be free from contamination before the pool will be reopened. If your child is found to be responsible for a closure due to fecal matter, all costs to clean and reopen the pool may be assigned to your family. Incidents should be reported to RealManage at (512) 219-1927 OR 1-866-4-RealService (1-866-473-2573), immediately.

20. Floatation devices are permitted as long as there are less than 15 people in the pool. All air-inflatable crafts

used must be a maximum 2-person carrier. Exceptions are arm-floaties and toddler carriers/life preservers.

21. Any items lost will be your responsibility. If the loss or find is of great value, please contact RealManage at (512) 219-1927 OR 1-866-4-RealService (1-866-473-2573).

22. Swim safely and treat others, as you would like to be treated. Do not throw items when others are nearby.

Parents are responsible for the behavior of their children.

23. Swimmers in the water have the right of way. Those entering the water must make certain that the area that they are entering is free of other swimmers.

24. In the event of inclement weather, swimmers are to clear the pool during the storm and for at least thirty (30)

LOSS OF POOL PRIVILEGES

Again, PLEASE NOTE: cards will ONLY be distributed to residents in good standing with the Association. To be in good standing, you must:

Be current on homeowner assessments as outlined in the Collections

Procedures approved by the Board of Directors; You must have a current card waiver form on file with RealManage; You may have no unresolved Deed Restriction Violation fines.

Any individual(s) using the pool after hours (see pool rules), could lose all pool privileges for the season. The Board will consider individual events. Any individual(s) committing acts of vandalism to the pool, pool house, equipment and/or surrounding area will lose all pool privileges for a period of time to be determined by the Association Board, and be held responsible for cleaning and/or repair of damaged items. In the event the individual(s) are juveniles, the parents shall assume full responsibility for their child’s actions. The Board will consider individual events.

MISCELLANEOUS

Guest Policies A Post Oak One Homeowners Association, Inc. member must accompany a guest. Guests are limited to four per family. If you need to entertain more than four guests, please call RealManage at (512) 219-1927 OR 1-866-4-RealService (1-866-473-2573) to make arrangements. Members are allowed to authorize a guardian for their needs as applicable. (baby-sitters, relatives, family friends and neighbors are allowable.) Parents must provide authorization naming a specific guardian to attend to their children under the age of 16 while at the pool. Authorized guardians must be 18 years of age or older. Individuals who may have been involved in misconduct or vandalism to the pool area who are found on the premises may be asked to leave immediately regardless of guest status if the Board has given previous approval of such action. Individual(s) who are on the premises without permission or who are under the appointed age should be/can be asked to leave by any Post Oak One Homeowners Association, Inc. member or authorized guardian who is an adult and on the premises. If the individual(s) will not leave please contact the police from the pay phone located at the pool, then contact RealManage. Restrooms The restroom fixtures are sanitized and cleaned by a private janitorial service on a weekly basis. The designated maintenance person(s) are responsible for cleaning mirrors, counters, stocking hand towels, emptying trash and hosing down the floors. But please be mindful of the other Association members by cleaning up after yourself when using the restrooms. Emergency Phone This phone has the capability of connecting to emergency services by dialing 911. Pool cards Pool cards will be issued to adults (age 18 years and older), only after an Acknowledgment & Waiver form is signed. A total of one (1) pool card will initially be issued per household. If your card is lost or stolen, you will be provided with a second replacement card AT A COST OF $40.00 TO YOU. To obtain cards, please sign (execute) a current Acknowledgment & Waiver form and send it to RealManage. Upon receipt of the signed card waiver, and pending assessment evaluation that the residence is in good standing, the card will then be mailed. By signing the Acknowledgment and Waiver Form, members are agreeing not to distribute cards to anyone outside their immediate family. Pool Parties Please contact the management company, RealManage, to schedule your party at (512) 219-1927 OR 1- 866-4-RealService (1-866-473-2573). All pool parties must be scheduled through RealManage so that parties are not double-booked and all necessary paperwork can be completed. Informal/Non Private parties at the pool may be held Monday, Tuesday, Thursday or Friday between the hours of 11:00 a.m. and 6:00 p.m. (holidays excluded). There shall be not more than fifteen (15) guests per party and parties are limited to no longer than two and one-half hours. Informal meaning, you may not turn away other member and their guests, so long as they meet the “guest policy”, from entering the pool area during a scheduled party. Parties may only be scheduled by a Post Oak One Homeowners Association, Inc. member over the age of eighteen (18). The party must be scheduled at least two weeks in advance. There must be a one to three adult to child ratio for children ages three (3) and under; a one (1) to five (5) adult to child ratio for children ages seven (7) to twelve (12). In all events, one adult, age 18 or older must be present at all times. The sponsoring member will be responsible for any damages caused by party patrons and a Recreational Use Agreement may be requested at the discretion of the Board, RealManage or Pool Committee member(s).

Post Oak Pool Rules Enforcement Policy

Authority to invoke suspensions to fit violations of the rules has been delegated to the Pool Monitor on duty by the Post Oak Board of Directors. Anyone who does not agree with suspensions invoked by the monitor may appeal to the Board of Directors. The Board of Directors may suspend all rights and privileges of any homeowner.

Enforcement of rules: • First offense- rule is explained and warning issued • Second offense- rule is explained and 1 hour “time out” enforced • Third offense- person must leave for the day

Pool monitor may eject persons from pool area for cause. In serious cases of misconduct, the City of Kyle Police should be called. In cases involving minor children, the parents will be informed.

No abusive or objectionable language will be tolerated on pool grounds. Any verbally abusive, threatening or dangerous behavior will result in loss of pool privileges. Entry card will be deactivate without further warning. If the infraction is serious enough, swimming rights may be terminated for the remainder of the year.

POST OAK ONE HOMEOWNERS ASSOCIATION, INC.

Pool Party Reservation and Deposit Agreement 1. The Post Oak One Homeowners Association, Inc. (the “Association”), a non-profit corporation, hereby approves the use of the “Common Areas” according to that one certain Post Oak One Homeowners Association Declaration of Covenants, Conditions and Restrictions dated September 29, 2003, recorded in Document Number 03031641 of the Real Property Records of Hays County, Texas (the “Declaration”), which Declaration is incorporated here in by this reference, and locally known as the Post Oak Community Pool, located at 271 Stennis Drive, Kyle, Texas to, ___________________________________(resident name); ____________________________________________(resident address), (the “User”) on this ___day of ________________, 20____, from __________ until ___________ (time). Maximum 2.5 hours between 1:00 p.m. and 6:00 p.m. Monday, Tuesday, Thursday or Friday ONLY. 2. User must be a Member of the Association not delinquent in the payment of any duly established assessments. This Agreement is subject to the Association's Swimming Pool Rules and Regulations. A pool party reservation DOES include use of the pool by guests of the member. The reservation DOES NOT provide for exclusive use of the pool during paid event. It is understood that the premises are to be used "as is" without warranty and without representations by the Association as to the suitability of the premises for the user's intended use. All renters must be 18 years of age or older. 3. A deposit of $75.00, made payable to the Post Oak One Homeowners Association, Inc. and forwarded to 12335 Hymeadow Drive, Suite 300, Austin, Texas 78750, ATTN: Assistant Community Association Manager, is required with this executed Pool Party Reservation and Deposit Agreement. The deposit will be refunded ONLY after the appointed representative of the Association makes an inspection of the premises. The Association reserves the right to withhold cleaning charges and/or charges for damages from the deposit as deemed necessary by the representative of the Association. If cleaning charges and or charges for damages exceed the deposit amount, User will be billed for such charges.

4. Use of the Common Areas is permitted between 1:00 p.m. and 6:00 p.m. only, no overnight use is allowed. Pool party reservations are taken for Monday, Tuesday, Thursday or Friday ONLY (holidays excluded).

5. User shall use the premises in an orderly and proper manner and so as not to annoy, disturb, or be offensive to others within the Swimming Pool area or immediate vicinity. User must be present at all times during pool party.

6. User shall REMOVE FROM THE PREMISE all garbage, debris, or other waste material immediately upon completion of the party.

7. User shall indemnify and hold harmless the Association, RealManage, and the Association or RealManage’s officers, agents, directors, and employees from all claims, demands, loss, damage or expense including, but not limited to, those for death, for personal or bodily injuries, or for property damages arising out of or in connection with the use of the premises by lessee or arising out of any acts or omissions of lessee, his employees, agents, representatives, customers, guests or invitees.

8. User shall, upon demand, immediately reimburse the Association for any damages to the premises above and beyond the deposit amount, and all privileges will be denied until balance is paid in full. 9. User is prohibited from assigning or transferring this agreement.

10. Pool parties must be scheduled at least two weeks in advance.

11. There shall be no more than fifteen (15) guests per party and parties are limited to no longer than to two and one-half hours. There must be a one to three adult to child ratio for children ages three (3) and under; a one to five adult to child ration for children seven (7) to twelve (12).

PLEASE NOTE: This listing does NOT replace the Declarations of Covenants, Conditions and Restrictions (CC&R's) given to each Post Oak One Homeowner upon the purchase of their home. It is simply a convenient OUTLINE to help each homeowner better understand many of the provisions contained in the CC&R's in a more simplistic manner and is being presented here in a condensed version to simply make you aware of some of the Post Oak One HOA Provisions. ANIMALS AND PETS BREEDING, QUANTITY Article VIII, Section 5 "…dogs, cats or other household pets may be kept on a Lot, provided they are not kept, bred or maintained for any commercial purposes and further provided, no more than three (3) such pets shall be kept on a Lot…. NON-DOMESTIC The raising, breeding or keeping of animals, livestock or poultry of any kind on any Lot in the Subdivision is strictly prohibited… UNLEASHED/LOOSE All pets must be properly tagged for identification and penned in an approved enclosure. No pet may be chained or leashed outside an enclosure unless being walked on a leash.
