NEW DELHI, Apr 15: The National Investigation Agency (NIA) today argued in a court here that Delhi Police was trying to "frustrate" their ongo- ing probe against Indian Mujahideen (IM) operatives by seeking further custody of top IM men Tehsin Akhtar and Zia- ur-Rehman alias Waqas. The tug of war between the two probe agencies was seen in the court after the Special Cell of Delhi Police sought 25 days police custody of Tehsin and Waqas in connection with a case regarding the conspiracy of IM and Lashkar-e-Toiba (LeT) to carry out terror strikes in the national capital. The NIA told the court that the Special Cell was again seek- ing remand of these two accused to "frustrate the investigation so far done by the NIA with respect to accused in different FIRs." The NIA also said their probe into these cases were "held up" due to want of interro- gation of these accused. The Special Cell, however, countered the NIA's submis- sions saying their probe into the case regarding the conspiracy of IM and LeT to carry out terror strikes in Delhi was going on. It also argued the interroga- tion of these two accused was necessary to "verify the nexus between LeT and IM". The court, after hearing the arguments, remanded both the accused to custody of the Special Cell for 20 days while brushing aside the contentions of the NIA seeking its permission to formally arrest and interrogate these two accused in connection with the February last year Dilsukhnagar blasts in Hyderabad. "It was the Special Cell Delhi Police who arrested the accused first and they have completed the investigation with respect to case FIR no 54/11 (regarding illegal arms factory here). However, they are yet to complete investigation in respect of case FIR no 16/12 (the present case) dated July 7, 2012.....," Additional Sessions Judge Daya Prakash said. "If at this stage, accused (Tehsin and Waqas) are handed over to the NIA, the whole investigation so far conducted by the Special Cell in FIR no. 16/12 will be frustrated," the judge said and noted that per- mission of the Ministry of Home Affairs to conduct the probe into the case was also placed on record before it.(PTI) NEW DELHI, Apr 15: Over Rs 269 crore of cash has been seized so far by the Election Commission (EC)- appointed teams, with Andhra Pradesh topping the list. Acording to official data pre- pared till today, the EC-appointed Election Expenditure Observers have so far seized a total of Rs 129 crore in cash in Andhra Pradesh, Maharashtra Rs 33.46 crore, Rs. 19.87 crore in Tamil Nadu, Rs. 12.29 crore in Karnataka, over Rs 12 crore in Uttar Pradesh and over Rs 5 crore in Punjab including numerous other small seizures in other states. Also, the total liquor seized stands at 132 crore litres, heroin 104 kg while more than 12,000 FIRs have been registered against distribution of cash and illegal inducements in various states. A senior official, who is a part of the EC-appointed team, said surveillance teams drawn from IRS and other central services have been deputed to all Lok Sabha and Assembly constituen- cies and they are reporting cash seizure instances since the polls were declared on March 5. The Commission, as part of its measures to curb black money in the polls, has deployed the ‘expenditure observers’ drawn from central revenue services like the Income Tax and Customs and Excise departments. The EC, in order to keep a track of huge cash during the polls, has also asked the Central Board of Direct Taxes and the Financial Intelligence Unit (FIU), both agencies under the Union Finance Ministry, to keep a watch through their intelli- gence and investigative tools during the poll period. (PTI) NEW DELHI, Apr 15: The Supreme Court today held that a woman employee of Central Government can get uninterrupted leave for two years for child care, which also includes needs like examination and sickness. A bench of Justices S J Mukhopadhaya and V Gopala Gowda set aside the order of Calcutta High Court which had held that Central Civil Services (Leave) Rules do not permit uninterrupted CCL(Child Care Leave) for 730 days. “On perusal of circulars and Rule 43-C, it is apparent that a woman Government employee having minor children below 18 years can avail CCL for maxi- mum period of 730 days i.e. dur- ing the entire service period for taking care of upto two children. The care of children is not for rearing the smaller child but also to look after any of their needs like examination, sickness etc,” the bench said. It said that CCL even beyond 730 days can be granted by com- bining other leave if due and the finding of the High Court was based neither on Rule 43-C nor on guidelines issued by the Central Government. The court passed the order on a petition filed by a woman Government employee Kakali Ghosh challenging Government’s decision not to grant her leave of 730 for preparing her son for second- ary/senior examinations. She had first approached Central Administrative Tribunal Calcutta for getting leave. The tribunal had ordered in her favour but the High Court reversed the order after which she moved the apex court. The apex court set aside the High Court’s order. “We set aside the impugned judgement dated September 18, 2012 passed by the Division Bench of Calcutta High Court, Circuit Bench at Port Blair and affirm the judgement and order dated April 30, 2012 passed by the Tribunal with a direction to the respondents to comply with the directions issued by the Tribunal within three months from the date of receipt/ produc- tion of this judgement,” it said. NEW DELHI, Apr 15:

The National InvestigationAgency (NIA) today argued in acourt here that Delhi Police wastrying to "frustrate" their ongo-ing probe against IndianMujahideen (IM) operatives byseeking further custody of topIM men Tehsin Akhtar and Zia-ur-Rehman alias Waqas.

The tug of war between thetwo probe agencies was seen inthe court after the Special Cellof Delhi Police sought 25 dayspolice custody of Tehsin andWaqas in connection with a caseregarding the conspiracy of IMand Lashkar-e-Toiba (LeT) tocarry out terror strikes in thenational capital.

The NIA told the court thatthe Special Cell was again seek-ing remand of these two accusedto "frustrate the investigation sofar done by the NIA with respectto accused in different FIRs."

The NIA also said theirprobe into these cases were"held up" due to want of interro-gation of these accused.

The Special Cell, however,countered the NIA's submis-sions saying their probe into thecase regarding the conspiracy ofIM and LeT to carry out terror

strikes in Delhi was going on.It also argued the interroga-

tion of these two accused wasnecessary to "verify the nexusbetween LeT and IM".

The court, after hearing thearguments, remanded both theaccused to custody of the SpecialCell for 20 days while brushingaside the contentions of the NIAseeking its permission to formallyarrest and interrogate these twoaccused in connection with theFebruary last year Dilsukhnagarblasts in Hyderabad.

"It was the Special Cell DelhiPolice who arrested the accusedfirst and they have completed theinvestigation with respect to caseFIR no 54/11 (regarding illegalarms factory here). However, theyare yet to complete investigationin respect of case FIR no 16/12(the present case) dated July 7,2012.....," Additional SessionsJudge Daya Prakash said.

"If at this stage, accused (Tehsinand Waqas) are handed over to theNIA, the whole investigation so farconducted by the Special Cell inFIR no. 16/12 will be frustrated,"the judge said and noted that per-mission of the Ministry of HomeAffairs to conduct the probe into thecase was also placed on recordbefore it.(PTI)

Over Rs 269 crore of cashhas been seized so far by theElection Commission (EC)-appointed teams, with AndhraPradesh topping the list.

Acording to official data pre-pared till today, the EC-appointedElection Expenditure Observershave so far seized a total of Rs 129crore in cash in Andhra Pradesh,Maharashtra Rs 33.46 crore, Rs.19.87 crore in Tamil Nadu, Rs.12.29 crore in Karnataka, over Rs12 crore in Uttar Pradesh and overRs 5 crore in Punjab includingnumerous other small seizures inother states.

Also, the total liquor seizedstands at 132 crore litres, heroin104 kg while more than 12,000FIRs have been registered againstdistribution of cash and illegalinducements in various states.
