“Association” shall mean and refer to the Wedgewood Homeowners Association, Inc.organized pursuant to the Georgia Non-Profit Corporation Code.

“Board of Directors” or “WHOA” shall mean and refer to the Board of Directors of theAssociation, which is the governing body of the Association.

“Common Area” shall mean and refer to all Real Property owned by the Association forthe common use and enjoyment of the Owners, and includes all roadways, parkingareas, lawns, etc. To be more precise, it includes all property not occupied by aresidential dwelling and its lot.

“Development” shall mean and refer to the Property and all improvements thereonknown as Wedgewood.

“Lease” shall mean and refer to any lease, sublease or rental contract, whether oral orwritten.

“Lot” shall mean and refer to any numbered plot of land on the Property comprising asingle dwelling site, together with all improvements located thereon.

“Occupant” shall mean and refer to any person, including without limitation all Ownersor lessee of a lot, or any guest, invitee, agent, servant or other family member of anOwner or such Lessee, occupying or otherwise using a Lot.

“Owner” or “Lot Owner” shall mean and refer to one or more persons who or whichowns all interest of any Lot, excluding, however, the holder of a mortgage or otherholder of an interest merely as security for the performance of an obligation.

“Property” shall mean and refer to that tract or parcel of land known as Wedgewoodand all improvements thereon.

1. The Property is restricted exclusively to residential use and the use andoccupancy thereof shall be subject to such reasonable restrictions as the Boardof Directors may establish.

2. The use and enjoyment of the Common Area by lot Owners and Occupants shallbe subject to the Rules and Regulations of the Association as may be made andamended from time to time. There shall be no obstruction of the Common Areanor shall anything be kept, parked or stored on any part of the Common Area.Parking in the Common Area shall be short term. The pursuit of hobbies or otheractivities, including the assembly and disassembly of motor vehicles shall not bepursued or undertaken on any portion of the Common Area.

3. Homeowner Association dues are due on January 15 and July 15 of every year.Homeowners may pay the full amount in January.

4. No construction of any nature whatsoever shall be commenced or maintained byany Owner or Occupant with respect to the exterior of any building on the Lot,nor shall any exterior addition to or change or alteration therein be made, unlessand until the plans and specifications shall have been submitted and approved inwriting by the Board. Please see Section G “Modifications” for more detail.

5. Toys or other personal items shall not be allowed to stand unattended on anypart of the Common Area.

6. Children playing outside of their own yard should be supervised by an adult andshould not play in the street.

7. Occupants shall not make or permit any noises that will unreasonably disturb orannoy the occupants of any other home or do or permit to be done anything thatwill unreasonably interfere with the rights, comfort or convenience of occupantsof other homes.

8. Except as may be otherwise specifically provided, the responsibility of theAssociation with respect to maintenance, repair and replacement shall be tomaintain, repair and replace all portions of the Common Area. The Associationshall not be liable for injury or damage to a person or property caused by theelements or by any Owner, or by any other person, or resulting from any utility,rain, snow or ice which may leak or flow from any portion of the Common Area orfrom any pipe, conduit, appliance or equipment, the responsibility for themaintenance of which is that of the Association, nor shall the Association beliable to any Owner or Occupant for loss or damage, by theft or otherwise, whichmay be stored in or on the Common Areas.

9. The responsibility of each Owner of a Lot with respect to maintenance, repair andreplacement shall be to repair and/or replace all portions of his Lot and dwellingand to maintain same in a good and neat condition. Please see specificArchitectural Control Guidelines.

1. The speed limit within the development is 25 MPH and is posted accordingly.

2. The following vehicles are NOT Permitted in the common parking area at theClubhouse: commercial vehicles and trucks as well as vehicles deemed by theBoard to pose a hazard to the health and safety of the homeowners or detractingfrom the overall appearance of the Property. With prior approval from a boardmember, and at the board’s discretion, other vehicles may be parked for up to 48hours. Vehicles parked longer than 48 hours will be subject to towing at theowner’s expense and the homeowners may be subject to fines.

3. At the board’s discretion, Commercial Vehicles shall not be parked anywhere inthe neighborhood except in the homeowner’s garages.

4. All vehicles shall be parked in driveways only and shall not be parked in thestreet overnight.

5. No vehicle shall be parked in such a manner as to impede or prevent readyaccess to any community street.

6. Repairs to vehicles in the streets shall he limited to (a) minor repairs only, (b)repairs which can be accomplished in 6 hours or less.

7. A repair that may damage any portion of the common parking area or streets oris in violation of the Georgia Hazardous Chemicals Act (e.g. draining radiators orpouring waste oil into storm drains or landscape drains) is strictly prohibited. Anydamage to the Common Area or streets resulting from the repair of vehiclesbecomes the financial liability of the vehicle or Lot Owner.

8. There shall be no parking of cars or trucks in driveways that are not in workingcondition (i.e. flat tires, on blocks, broken down, etc)

9. Parking spaces at the pool shall only be used by residents/guest while they areat the pool.

10. No cars may be parked in the grass and/or landscaping anywhere in theCommunity.

1. The Lot Owner shall indemnify the Association and hold it harmless against anyloss or liability of any kind from having an animal on the property.

2. In accordance with Fulton County and City of Alpharetta Code, Pets are notpermitted to run free, except within a fenced back yard. Any Pet not in a fencedarea must be on a leash.

3. Pets may be tied outside a house with the following restrictions

a. The leash must be of sufficient length to allow the animal freedom.

b. The pet must be tied in the backyards of houses only.

c. The pet owner or a family member who can control the pet must be athome whenever the pet is tied outside.

4. The pet must not in any way annoy other residents.

5. Pets must not be allowed to defecate/urinate on Common Areas or in the right ofways of streets. The pet owner shall perform any clean up required.

6. All problems or complaints concerning pets should be referred to the AlpharettaPolice Department or the Fulton County, SPCA, Animal Control Division (404-794-0358).

NOTE: The City of Alpharetta is responsible for the pickup of refuse as well as thepickup schedule. These Rules and Regulations are for your guidance.

1. Recyclable items must fit in the recycling bins.

2. Containers shall not be placed out for pickup until the night before the day ofpickup.

3. Empty containers and garbage receptacles shall not be left curbside, on walks orlawns after collection. All containers and garbage receptacles shall be returned tothe house by the end of the collection day.

4. Trash Containers must be kept out of sight when not set out for trash pick up.

5. Trash must be in an approved container and/or outdoor trash bags (contractortype)

6. Trash, garbage, debris or other waste matter of any kind may not be burnedwithin the Community

1. Pool use is a privilege based on being current with Homeowner’s Associationdues.

2. Pool hours are 7:00am to 10:00pm.

3. Adult supervision is required for children under 16 years of age.

4. Residents under 18 years of age are restricted to TWO (2) guests.

5. Pets are not allowed.

6. No diving or running.

7. Glassware or glass bottles are not allowed in the pool area.

8. The emergency phone number is 911. The pool address is 12180 Blue JayTerrace.

9. Cleanup all of your trash. Do not litter.

10. Roll down all umbrellas at the end of the day.

11. Appropriate swimwear is required.

12. Inappropriate behavior will result in the loss of pool privileges.

13. Pool capacity is 80.

14. The Wedgewood Homeowners Association and the Alpharetta PoliceDepartment enforce pool rules.

15. The pool gate key also provides access to clubhouse bathrooms.

16. There is a $5 replacement fee for lost keys.

1. Clubhouse is available to be reserved by any Wedgewood home owner in goodstanding as to current dues on a first come first serve basis.

2. Usage of the clubhouse is free of charge to home owners.

3. A deposit of $50.00 is required. Deposits are returned if no damage hasoccurred. The home owner reserving the clubhouse is responsible for alldamages.

4. Pool access does not include exclusive access to pool.

5. No wet bathing suits or feet in clubhouse.

6. Clubhouse amenities include:

a. Refrigerator

b. Microwave Oven

c. Sink

d. Bathrooms and showers

The following modifications to property require Architectural Committee/WHOA writtenapproval (ACC approval request documents can be downloaded from our web site) priorto commencement of any work. A modification is defined as an alteration, addition ordeletion to the following and any other exterior change:

a. Structures

b. Exterior color

c. Fences, decks, terraces, walls, drives, turn around and walk.

d. Exterior lighting

e. Play equipment

f. Landscaping

g. Mailboxes

h. Decorative pools or fountains

i. Swimming pools

j. Landscape structures, furniture and accessories

k. Vegetable gardens

l. Sports equipment

m. Birdhouses, feeders and baths

n. Animal houses

Modification without prior approval from the WHOA could result in a fine and subsequentremoval or replacement at owners expense. It is the Home owner’s responsibility toacquire approval for any modifications that also require approval from the city ofAlpharetta such as tree removal, building permits, etc. For your convenience ACCapproval request documents can be downloaded from our web site.

ARCHITECTURAL CONTROL COMMITTEE

APPROVAL OF ANY STRUCTURE BY ARCHITECTURAL CONTROL COMMITTEE(ACC) IS LIMITED TO THE AESTHETICS OF STYLE, COLORS, MATERIALS,TEXTURE, AND GENERAL STREETSCAPE APPEARANCE. THEREFORE, AN ACCAPPROVAL IS NOT A CERTIFICATION THAT THE STRUCTURE HAS BEEN BUILT INACCORDANCE WITH ANY GOVERNMENTAL RULE OR REGULATION OR THATTHE STRUCTURE COMPLIES WITH SOUND BUILDING PRACTICE OR DESIGN.PROPER LOCATION OF A STRUCTURE OR ANY APPURTENANCES (FENCES,ETC.) WITH REGARD TO PROPERTY LINES, SETBACKS, EASEMENTS, OR ANYOTHER RESTRICTION, IS THE SOLE RESPONSIBILITY OF THE PROPERTYOWNER. Furthermore, neither the Association, the ACC, nor any member, employee oragent shall be liable to anyone submitting plans for approval or to any owner, includingwithout limitation, mistakes in judgment, negligence or misfeasance. Any personsubmitting plans to the Wedgewood Homeowners Association agrees, merely bysubmission of such plans, that no action or suit will be brought against the Association orthe ACC or any member, employee or agent thereof in connection with such submission.Items that appear in this document are for reference only. This document is intended toserve as a guideline. The Governing Documents take precedence over these standardsin any case of conflict. A more comprehensive understanding may be obtained byreferring to the Declarations of Protective Covenants for Wedgewood and by contactinga member of the ACC.

General Considerations

1. It is the intention of the ARCHITECTURAL CONTROL COMMITTEE to maintain ahigh standard of exterior architectural appearance throughout the Wedgewoodcommunity. The guidelines within this document have been established to protectthe integrity of the development, and the purchasers’ investment in the community.Your adherence to these guidelines will enhance the marketability of Wedgewood.

2. The Declaration of Protective Covenants for Wedgewood (“Covenants”) has createda standing committee called the ARCHITECTURAL CONTROL COMMITTEE(“ACC”) whose functions is to review and approve or disapprove plans for anyproposed new construction or for alteration of any existing structure or lot withinWedgewood. The covenants have granted the ACC powers regarding the aestheticimpact of design, construction and development, including architectural style, colors,textures, materials, landscaping, overall impact on surrounding property, and otheraesthetic matters. Its intent is to promote and ensure that all improvements (a) areaesthetically compatible with each other, (b) incorporate a unique yet pleasing anddiscriminating character, (c) are constructed to reflect the quality and permanence ofan outstanding community, and (d) comply with the Covenants.

3. Approval of any structure by the ACC is limited to the aesthetics of style, colors,materials, texture, and general streetscape appearance. Therefore, an ACCapproval is not a certification that the structure has been built in accordance with anygovernmental rule or regulation or that the structure complies with sound buildingpractice or design. Proper location of a structure or any appurtenances (fences,

etc.), with regard to property lines, setbacks, easements, or any other restriction, isthe sole responsibility of the property owner.

4. This document is intended to serve as a guideline. The Covenants shall takeprecedence over these standards in any case of conflict.

Review and Approval Process

Home owners must submit an application in duplicate along with plans indicating extentof proposed improvements in sufficient detail to allow review. This must includedrawings of exterior building elevation changes, material, finish and color schedules andconstruction details. Specific and detail measurements of the proposed project arerequired. Any modification other than a color change requires a site plan showing thefollowing:

(1) Property Lines

(2) Setbacks and easements

(3) Footprint of house and driveway, sidewalks, decks, patio, retaining walls, etc.

(4) All proposed improvements dimensioned to properly locate them from thehouse or property.

After the improvements are complete, the ACC should be contacted to conduct an on-site review to verify conformity with the approved submittals. Notifying the ACC as tocompletion and scheduling the time of review will be the responsibility of the Applicant.

Regulatory Compliance

Plans submitted for ACC review must comply with all applicable building codes, zoningregulations and the requirements of all agencies having jurisdiction over the project. It isthe responsibility of the Applicant to obtain all necessary permits, inspections and finalCertificate of Occupancy. Regulatory approvals do not preclude the authority andresponsibility of the ACC for design review and vice versa.

Final Review

The Committee’s final approval constitutes a binding agreement between the Applicantand the Association. Any deviation from the approved plans must be submitted o theCommittee for approval.

A Committee decision is based on simple majority and shall not be arbitrary orcapricious. Any denial deferral or exception shall be substantiated by the Committee withdue reason. The Committee may, at its discretion, assist the Applicant by suggestionalternative design solutions.

Appeals

Any decision reached by the ACC may be appealed to the Committee forreconsideration within 14 days after ACC decision. Technical design informationsupporting the appeal request must be included with the request. All appeals will bereviewed on a case-by-case basis. Each case will be reviewed on its own design, merits,and in keeping with the overall objectives of the Design Guidelines.

Enforcement

The provisions for enforcement of the Declaration of Covenants shall apply to theenforcement of these Design Review Procedures and Guidelines in addition to any otheravailable remedies.

Waiver, Amendment and Third Party Benefit

The ACC maintains the rights from time to time at their sole discretion, to waive, amendor modify these Procedures and Guidelines. Neither the ACC nor its agents,representatives, or employees shall be liable for failure to follow these Procedures andGuidelines as herein defined. These Procedures and Guidelines confer no third partybenefit or rights upon any Entity, Person or Applicant.

An Application for ACC (Exhibit “A”) has been designed to facilitate the request processand can be secured either from the Wedgewood web site(www.wedgewoodcommunty.com) or from the chairperson of the ACC. No constructionof a building or other structural improvement, no landscaping or other site improvement,and no alteration or addition to any existing structure or site improvement shall be madeon any property until the plans and specifications showing the proposed design, nature,kind, shape, size, color, materials, and location of the same shall have been submitted tothe ACC and it has issued final approval. Homeowners requesting final approval of animprovement shall submit sufficient exhibit to demonstrate compliance with thesestandards and requirements (expected turn-around time by ACC is 5 - 20 daysaccording to complexity of design purpose). Work should be completed within three (3)months from date of final approval unless otherwise approved.

Plans submitted for ACC review must comply with all applicable building codes, zoningregulations and the requirements of all agencies having jurisdiction over the project. It isthe responsibility of the Applicant to obtain all necessary permits, inspections and finalCertificate of Occupancy. Regulatory approvals do not preclude the authority andresponsibility of the ACC for design review and vice versa.

Remedies

Homeowners are forewarned that the Covenants have granted to the ACC (Board of

Directors) broad discretionary powers regarding the remedy or removal of any non-complying improvement constructed within Wedgewood. In this regard, if the ACC findsthat any improvement was not performed or constructed in substantial compliance asapproved, the Association may remedy or remove the non-complying improvement, andcharge the cost of the action to the homeowner as outlined in the Covenants. The Boardof Directors (ACC) also has the right to assess reasonable fines (up to $25.00 per day)in accordance with the Bylaws to homeowners and other involved parties in the case ofviolations of these rules and all other standards as outlined in this ARCHITECTURALCONTROL COMMITTEE Guidelines.

The following are general standards and guidelines for design issues related to improvedproperty in Wedgewood. Please note that this list contains guidelines only; it is not all-inclusive. Items listed here are not automatically approved. All requested changes toany property in Wedgewood must be first submitted and approved by the ACC.

1. Driveways, Garage, & Garage Doors

a. Driveways must be concrete. All landscaped areas should make a smoothtransition to the street with no abrupt elevation change.

b. Driveways should remain clear of oil spots and/or any discolorations.

c. Driveways cannot be enlarged nor can additional driveways be constructed.

d. Garage door must be maintained in good working condition and remain freeof noticeable damage.

e. Garage door must be painted to match the house trim (white is theapproved color).

f. Garage door should remain fully closed except for removal/insertion ofvehicles or other items.

g. No vehicles parked in driveway shall obstruct sidewalk.

2. Windows

a. Window treatments visible from the street must be a light neutral color. Anyexceptions must be approved by the ACC. Please note that temporaryblinds are not acceptable for permanent use. No sheets, towels, etc.

b. Paint must be maintained in good condition – chipped or flaking paint mustbe repaired immediately

c. Replacement windows must be the same size and design.

d. No air conditioning units or fans may be installed in windows.

3. Retaining Walls

a. Retaining walls shall not exceed 3.0 feet in height without the expressapproval of the ACC. Location, elevation and material selection must beapproved by the ACC. All retaining walls visible from the street must betreated in an architecturally pleasing manner (i.e. no railroad ties shall beplaced in the front yard). Exposed concrete block or poured concretefoundations and site retaining walls must be covered with paint, stone, brickor stucco to complement the house materials. ACC approval is required fornew walls or modifications to existing walls.

4. Housing Exterior (Siding and Color Schemes)

a. Siding must be maintained in good condition.

b. Replacement siding must be approved by the ACC.

c. All color schemes must be submitted to the ACC for approval.

5. Fences

a. Chain Link, wire (or other metal) fencing or Stockade fencing are notallowed. Split rail fences are not allowed. Fencing of front yards isprohibited. No other materials may be affixed to the fence in an effort tofurther enclose it. Privacy fences for rear yards must be a minimum of 4’ inheight and are not to exceed 6’ in height. Fences allowed must be ofnatural wood with natural wood stain applied or composite wood likematerial with natural color. Fencing is restricted to the following styles:

6. Fireplaces and Chimneys

a. The exterior of all chimneys must be compatible with exterior sidingmasonry/stucco material. All chimneys must have a detailed top. Paintedmetal caps are required to conceal circular prefabricated flue top.

a. All exterior lighting shall be consistent with the character established inWedgewood and be limited to the minimum necessary for safety, identificationand decoration. Colored lights shall not be used except those decorativeholiday lights and ornamentation used during the holiday season fromThanksgiving through New Years.

9. Patio/Decks

a. Additions to decks or enlargements of patios must be approved by ACC.

b. Hoses may be stored on the back patio or deck provided they are neatly coiledor stored on a device specifically designed to store a hose.

c. Patio/deck must be maintained in good condition and remain free from trashand hazardous or combustible materials.

d. Rear patios may be tiled with a natural toned stone or bricked with brick thatadheres to the community standards and must be approved by ACC.

e. Approved deck materials are cedar and pressure treated wood and must be ofnatural wood material and may have a clear or natural wood stain applied.Composite wood material with a natural color is allowed.

10. Landscaping Requirements

a. Lawns will be cut on a regular basis during the growing season to maintain ahealthy look.

b. Lawns must be edged along driveways, sidewalks & beds on a regular basis toprevent excess grass from growing. Weeds should be removed from whereconcrete and asphalt meet.

c. Any beds used for landscaping designs (flowers or pine islands) must beproperly maintained (i.e. free of weeds, dead plants, yard rubbish, etc).

d. All landscape beds must be mulched with pine straw or other mulch typeapproved by the ACC. Pine straw and mulch must be replaced when it startsto decay and bare ground is showing.

e. ACC must approve any changes or extensions to the existing beds that arevisible from the street - front, side or rear.

f. Front beds are to contain shrubbery and may be accented with seasonalflowers.

g. Front beds are not to be used as a vegetable or cutting garden.

h. All shrubs/flowers must be kept pruned or removed when dead

j. Trees: Planting of trees by residents is allowed, but make sure you call theutility companies prior to digging and insure that root growth will not damageyour underground utilities. The home owner is responsible for any damagecaused to underground utilities.

k. Sod: All areas along the street front (and side street for corner lots) of eachhome site not covered with pavement, buildings, shrubs or ground cover shallbe completely sodded with Bermuda, Zoysia or other approved ground cover.Street frontage is defined as the area from the back of the curb to the frontedge (and side edge for a corner lot) of the house foundation.

l. Mulch: All areas within each home site not covered with pavement, buildings,shrubs or ground cover or sod shall be covered with pine straw, wood mulch,or decorative rock.

m. In order that the natural beauty of the home site may be preserved, no livingtree having a diameter of six (6) inches or more, as measured from a point two(2) feet from the natural grade, shall be destroyed or removed from theproperty unless approved by the ACC in connection with its approval of theplans and specifications for the construction of improvements on the property.All modifications to existing trees should also be done in accordance withgovernment ordinances.

11. Compost

a. No compost bins or compost piles are allowed in Wedgewood. All solid wastesmust be disposed of through the City of Alpharetta.

12. Playground Equipment

a. Recreational and playground equipment shall be placed or installed only uponthe rear of the lot, not to be viewed from the street as much as possible, andonly as approved by the ACC. No portable basketball goals in street or in plainview when not in use. Permanent basketball goals are not allowed.

b. Above ground pools are not allowed.

c. Tree houses or similar platforms are not allowed.

d. Only temporary play structures are acceptable.

13. Hot Tubs

a. The composition of the material must be thoroughly tested and accepted;

b. Hot tubs shall not be visible from the street in front of the residence;

c. Home owners are responsible for compliance with all ordinances and lawsconcerning discharge of water and chemicals.

a. No storage buildings of any sort are allowed.

b. All animal houses must be approved by the ACC.

15. Antenna, Satellite Dishes

a. Notification: Installation of satellite dishes is permitted, however theAssociation must be notified in writing using the attached form. As long as theinstallation is in accordance with the regulations, no further action is requiredby the owner.

16. Lawn Furnishings

a. No ponds, flagpoles, lawn sculptures, fountains, artificial plants, large rockgardens, statues, or similar types of accessories and lawn furnishings arepermitted on any lot without prior approval of ACC.

17. House Maintenance

a. No material or debris shall be stored or disposed of on any Wedgewoodproperty. Non-compliance with these guidelines will result in action beingtaken against the home owner as deemed appropriate by the ACC.

b. Cables and wires running along the property must be properly and neatlymaintained. Home owners should run exterior wiring as inconspicuously alongthe home as possible (e.g. underneath siding seams or trim). No overheadutilities (including those for cable television) shall be permitted in thecommunity.

18. SignsNo signs (including, but not limited to, commercial, political, for rent, and similarsigns) shall be erected or maintained on home sites, common areas, andentranceways except such signs as may be required by law and such signs asmay be approved by the ACC. Generally allowed signs include:

a. Signs required by legal proceedings;

b. Not more than one “For Sale” sign, with maximum area of 4 square feet anddisplayed in front yard of lot;

c. Directional signs for safety, if approved by ACC;

d. “Garage Sale” signs will be allowed only in the front yard of the lot, and only onsale days.

e. Security Company signs not extending more than 18 inches above the ground.

f. Temporary business signs, such as those display by contractors, may bedisplayed a maximum of five (5) days after the job is complete.

g. No signs are allowed for permanent business.

Introduction

An FCC Rule went into effect in October 1996 which preempts community Associationrestrictions on certain Satellite Dishes used to receive video programming services;specifically over the air reception of direct broadcast satellite (DBS) service, multi-channel multipoint distribution service (MMDS) and television broadcast service. Not allSatellite Dishes are protected by the FCC Rule. The Rule applies only to DBS satellitedishes less than one meter in diameter, MMDS satellite dishes (wireless cable) less thanone meter in size and standard TV antennas. So long as the Association does not installa centralized antenna in accordance with the FCC rule, the FCC Rule permits theAssociation to adopt restrictions on installation as long as they do not unreasonablyincrease the cost of installation or maintenance or impair reception. These restrictionsare adopted pursuant to that authority and are further promulgated to provide for thehealth, safety and welfare of the residents of Wedgewood.

1. Notification.

Installation of Satellite Dishes is permitted; however, the Association must be notified inwriting using the attached form. As long as the installation is in accordance with theseRegulations, no further action is required by the Owner.

ANY INSTALLATION WITHOUT PROPER NOTIFICATION, OR NOT IN COMPLIANCEWITH THESE REGULATIONS, MAY BE REMOVED BY THE ASSOCIATION, AT THEEXPENSE OF THE OWNER.

2. Definitions.

(a) Reception Satellite Dish means an antenna, satellite dish, or other structure used toreceive video programming services intended for reception in the viewing area.Examples of video programming services include direct broadcast satellite services,multipoint distribution services, and television broadcast signals. The mast supportingthe Reception Satellite Dish, cabling, supports, guy wires, or other accessories for theReception Satellite Dish or similar structure is part of the Reception Satellite Dish. AReception Satellite Dish that has limited transmission capability designed for the viewerto select or use video programming is a Reception Satellite Dish provided that it meetsFederal Communications Commission standards for radio frequency radiation.Structures similar to Reception Satellite Dish or any structure, device, or equipment thatis similar in size, weight, and appearance to Reception Satellite Dishes.

(b) Transmission Satellite Dish means any antenna, satellite dish, or structure used totransmit radio, television, cellular, or other signals other than Reception Satellite Dishes.

Transmission Satellite Dishes are prohibited unless approved in writing by the Board ofDirectors. All Transmission Satellite Dishes must meet Federal CommunicationsCommission standards for radio frequency radiation.

4. Size Limits for Reception Satellite Dishes.

Direct Broadcast satellite dishes or antenna and MMDS satellite dishes or antenna shallbe no larger than One Meter.

5. Masts Limited to 12 Feet.

Due to safety concerns relating to wind loads and the risk of falling structures, masts,supports, and other structures more than twelve feet above the roof must receive theprior written approval of the Board. The owner must submit an application includingdetailed drawings of the structure and methods of anchorage. The Board shall handlesuch permit application expeditiously.

6. Location.

General Note: If there are multiple locations where substantially the same acceptablequality signal can be received, the Reception Satellite Dish must be placed in thelocation that is least visible to public view.

(a) In order of priority, the primary locations for installation of the Satellite Dish shouldbe:

(i) On the rear of the roof of a dwelling; or

(ii) On the rear of the chimney of a dwelling; or

(iii) On the ground in the rear of a lot.

(b) If it is determined that the Reception Satellite Dish cannot be located in one of theprimary locations, the alternate location for installation for the Satellite Dish shall besubmitted to the Board of Directors, along with specific, written documentation as to whyone of the primary locations is not acceptable.

7. Satellite Dish Installation.

(a) Installation shall be by a qualified person knowledgeable about the proper installationof antennas.

(b) Installation shall be in accordance with all applicable building, fire, electrical andrelated codes and a building permit shall be obtained, if required by ordinance.

(c) Installation shall be in accordance with the manufacturer’s installation specifications.The installer shall have a copy of such specifications on site at all times during theinstallation.

(d) All penetrations to any building surface shall be properly waterproofed or sealed inaccordance with acceptable industry standards and applicable codes.

(e) Wiring or cabling shall be installed so as to be minimally visible and blend into thematerial to which it is attached.

(f) The Satellite Dish shall be painted so as to blend into the background to which it ismounted or placed, so long as painting can be done at a reasonable cost and does notinterfere with the quality of the signal.

8. Mast Installation.

(a) Satellite Dishes mounted on masts are prohibited except where necessary forreception of an acceptable quality signal.

(i) A mast satellite dish structure, which extends twelve feet or less above the rooflinemust be anchored to withstand a minimum of 12 mph winds.

(ii) Installation of a mast satellite dish structure, which extends more than twelve feetabout the roofline, must be approved in writing by the Board of Directors prior toinstallation. The owner must submit an application including detailed drawings of themast structure and methods of anchorage.

(iii) Installation of a mast, which extends more than twelve feet above the roofline,must comply with all local ordinances.

(b) Masts must measure no more than 2 inches in diameter.

(c) Masts must be painted to match the Satellite Dish mounted on it and to blend with thesurroundings, so long as painting can be done at a reasonable cost.

(d) In addition to the above, masts must be installed in accordance with the BOCA Code.

9. Maintenance and Repair.

(a) The Owner shall be responsible for the maintenance of any Satellite Dish and mast.Maintenance and repair shall include, but not be limited to:

(i) Reattachment. If the Satellite Dish is dislodged from its original point of installationand owner intends to retain the Satellite Dish, then reattachment must be performedwithin seventy-two (72) hours of dislodgment.

(ii) Repainting. If for any reason the exterior surface of the Satellite Dish or mastbecomes worn, disfigured or deteriorated, so long as painting can be done at areasonable cost and does not interfere with the quality of the signal.

(iii) Repair or replacement to prevent the Satellite Dish or mast from becoming a safetyhazard.

(b) Should the Owner fail to properly maintain the Satellite Dish or mast, the Associationmay impose sanctions as permitted by Declaration or Bylaws and not otherwiseprohibited by the FCC Rule.

(i) Except in an emergency situation, the Board of Directors shall notify the Owner, inwriting, that the Satellite Dish and/or mast requires maintenance, repair or replacement,and that such maintenance, repair or replacement must be completed within thirty (30)days of such notification.

(ii) The Owner may request a meeting with the Board of Directors to be held within thirty(30) days of such notification, to review the reasons for the required maintenance, repairor replacement. Within thirty (30) days of such meeting, the Board of Directors shallnotify the Owner, in writing, of its final decision.

(i) Should the Owner fail to remove the Satellite Dish and mast in a timely fashion, theAssociation may remove it at the expense of the Owner.

(ii) In such case, the Association shall not be responsible for any damage to the SatelliteDish or mast.

(iii) The Board shall notify the Owner when the Satellite Dish or mast may be claimed. Inthe event the Owner does not reclaim the Satellite Dish or mast within ten (10) days, theAssociation may destroy it or otherwise dispose of it.

10. Responsibility.

(a) The Owner of the Satellite Dish (including the mast) shall be responsible for anydamage to any and all personal property, or for any injury resulting from the installationof the Satellite Dish (including mast) and/or its use, including but not limited to:

(i) Damage to any real or personal property caused by, related to, or arising from theinstallation, dislodgment, use, or maintenance of any Satellite Dish or mast.

(ii) Injury to any person resulting from the installation of the Satellite Dish or mast or theiruse.

11. Removal of Satellite Dish or Mast.

(a) In the event the Owner removes a Satellite Dish or mast that is not free standing, forwhatever reason, the Owner shall properly restore the property to its original condition.

(b) In the event of a transfer of the dwelling that does not include the Satellite Dish, theOwner shall be responsible for the permanent removal of the Satellite Dish and mast, ifany, prior to the transfer.

(c) Permanent removal of the Satellite Dish (including the mast) shall be performed tothe satisfaction of the Association.

(d) In the event of a transfer of a dwelling which includes the Satellite Dish, the newowner shall be required to comply with these Regulations and shall assume allresponsibility for the Satellite Dish (including the mast) as provided herein and in theDeclaration and Bylaw

This will reduce electrical cost expenses. If you use the air conditioner, please turn it off when you leave the clubhouse. Ensure all trash is placed securely in the trash bin located on the outside of the

clubhouse near the pool entrance. Please remember to secure the trash bin lid. Remove items from refrigerator and freezer. Clean the microwave. Wipe all counter areas and sink with a cleaning solution. This will reduce the

chance of ants. Ensure all doors are locked before you leave. If you use items from the storage area, please return them to their appropriate

place before leaving. Ensure restrooms are left neat and tidy. Return the clubhouse key to Key Custodian. She will inspect the clubhouse and,

if the clubhouse is left neat, return your deposit of $50.00.

I understand that under the Modification Rules and Regulations, the ACC committee willact on this request and provide me with a written response of their decision. I furtherunderstand and agree to the following provisions:

I will make no commitment for work nor start work until I have received writtenapproval from the ACC committee.

All work will be done at my expense and all future upkeep will remain at myexpense.

All work will be done expeditiously once commenced and will be done in a qualityworkman-like manner by a contractor or myself.

All work will be performed at a time and in a manner to minimize interference andinconvenience to neighboring homes/lots.

I assume all liability and will be responsible for all damage and/or injury that mayresult from performance of this work.

I will be responsible for the conduct of all persons, agents, contractors, andemployees who are connected with this work.

I will be responsible for complying with, and will comply with, all applicablefederal, state, and local laws, codes, regulations, and requirements in connectionwith this work, and I will obtain any necessary governmental permits andapprovals for the work. I understand and agree that the Wedgewood HOA, itsBoard of Directors, its agent and Committees have no responsibility with respectto such compliance and that the Board of Directors or its designated committee’sapproval of this request shall not be understood as the making of anyrepresentation or warranty that the plans, specifications or work comply with anylaw, code, regulation or governmental requirement.

I understand that decisions by the ACC Committee are not final and that theWHOA Board of Directors may reverse or modify a decision by the ACCCommittee upon the written application of any home owner made to the WHOABoard of Directors within 30-60 days after the ACC Committee makes itsdecision.
