Terms and Conditions Entire Agreement: This agreement contains the entire understanding between Joseph Cote and the above named bride and groom. It supersedes all prior and simultaneous agreements between the parties in both verbal and written communication. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties wish to waive or alter one provision of this agreement, that does not mean that any other provision is also waived.

Reservation / Retainer (non-refundable): A signed contract and retainer are required to reserve the specified coverage dates and times. The financial terms of this agreement are explained below. Failure to provide the retainer nulls and voids this contract.

Pre-Event Consultation: The parties agree to a pre-event consultation before the event date in order to finalize the actual shooting times and locations..

•  It is further recommended that a list of events with approximate times be given to all paid participants such as the Photographer, Videographers, DJs, Bands, any other entertainment providers, as well as any of the wedding party. This avoids misunderstandings during the wedding. All parties have their role and this is an opportunity to structure the best possible working environment and cooperative atmosphere.

•  The Bride and Groom will designate a point person to identify people of whom specific photographs are desired.

•  I, Joseph Cote, am not responsible for missing shots of those on the VIP list if there is no one to assist in identifying these people, if a list is not provided for any reason, if they didn't show up, if they are against being photographed, or they can't be located.

•  If applicable, the bride and groom agree to set aside enough time before the ceremony to allow Joseph Cote and/or one second shooter to complete any pre-wedding ceremony photographs. (Shoes, rings, cuff links, tying ties, makeup, et cetera)

Cooperative Agreement: Licensed by this contract, it is agreed I, Joseph Cote, and one second photographer, are the sole professional photographers for the time allocated. The bride, groom, and wedding planner are the sole decision makers at the wedding, regardless of who is writing the check, advisory boards, in-laws, passersby, or any other authority figures.

Designated Appointee: Since it commonly occurs, individuals failing to appear or cooperate during photography sessions or for missed images due to details not planned or due to unusual circumstance are not the responsibility of the photographer.  I recommend that a designated appointee be assigned the duties to assist the photographer with a schedule of events, as well as to point out important individuals for informal, or candid, photographs..

Churches and Reception Hall Rules:The photographer is limited by the guidelines of ceremony official or reception site management. The bride and groom agree to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation, changes, adjustments of certain guidelines is responsibility of the bride, groom, or wedding planner and the photographer, Joseph Cote, is to be notified of any changes. If the officiate rules "NO FLASH" it means there is to be NO flash.

Initial Site Visit:I, Joseph Cote, do not charge for pre-event consultations, rehearsals, or location planning and evaluation unless it is out of the local area. If desired, the photographer will take preliminary images that can be used to test lighting in the ceremony location as well as offer a chance to have a few engagement photos taken. This also allows for a moderate level of comfort to be achieved with the professional camera and lighting.

Model Release: The bride and groom grant Joseph Cote, and his legal representatives, the irrevocable and unrestricted right to use and publish photographs of the parties or in which the parties or their family may be included, for editorial, trade, advertising and any other purpose including use as sample for other bridal photographic opportunities and in any manner and medium; to alter the same without restriction; and to copyright the same.

Good Pictures: In order to ensure that the photographer gets good pictures he may use different cameras, stands, lighting, poses and may do several shots of the same thing due to a stressed or unusual lighting situation. Also, the photographer may choose to change equipment to produce a unique photo or artistry at the discretion of the photographer. As in the case when a side or backlit stained glass window might have a lot of green in it and the brides dress being white suddenly looks green. That's when the most common phrase in photography is used most often..."Just one more please!"

I do not guarantee a specified number of photos because every wedding is different, every couple has a different level of photogenia, in addition, the wedding’s length can affect the output of images. Instead I, Joseph Cote, guarantee my product. I promise to deliver quality images that the you will truly enjoy and cherish for the rest of your lives, these photos after all are going to be the one thing that remains in 100 years from now when memories are long gone.

Bad Pictures:  There are things that can cause bad or imperfect pictures, some are: blinking, not everyone’s attention in one direction, distractions in the background (such as lighting, two bridesmaids fighting, or perhaps kids messing with the cake). There will be unavoidable and not initially seen events such as waiters walking through, hair, clothes or props in the way, and unexpected equipment failures. At the last count there are 3,141,592 various things that can unwillingly occur under the combined rules of Mother Nature, Acts of God, and Murphy’s Law, none of which will be caused by the photographer.  

Limits Of Liability:  It is further understood that in the unlikely event that the photographer is injured or becomes too ill to photograph the event, I, Joseph Cote, photographer and owner of 207 Stills will personally find and pay a photographer of equal or better technical expertise to take my place on the day of the wedding. I take the highest of precautions when it comes to image data and backups. However, if memory cards fail, hard drives crash, computers are for other reason deemed not useable, images stolen or destroyed for reasons beyond that which I can control, liability is limited to the return of all payments received for the event package.

Photo Release:No photography may be reproduced in any manner for commercial purposes without the explicit written permission of Joseph Cote. Two versions of the final images will be given to the client: the full resolution photos, with which the wedding couple may produce prints for their personal use and for the purpose of dispersal to relatives and friends. The second set is rendered in a web resolution, these may be used on personal web sites such as Facebook, Flickr, and personal blogs. Joseph Cote retains the rights to all imagery after the wedding day and may use images for promotional purposes listed above under heading Model Release.

Fees:  One week prior to the wedding Joseph Cote will be paid any remaining balance (equalling Total minus Retainer listed below) unless prior agreements have been made and revised in writing.

Retainer:   This is a reservation fee, once it is paid a date will be held for you if available. In the event of cancellation due to wedding being called off for reasons beyond the control of the photographer for any reason, the retainer is non-refundable and non-transferrable.

6 Hour Coverage - The essentials, and then some - $1,999 This is a great package for those who want plenty of time for family photos, beautiful wedding portraits, plus lots of candid photos at the reception!

8 Hour Coverage - Don't miss a thing! - $2,499 Most people choose this package because it provides plenty of time to get shots of the bride and groom getting ready before their big day. Then the rest of the day falls into place nicely and no one feels like they’re looking at the clock. After the ceremony, formals, and bride & groom portraits this option allows for lots of dancing, cake cutting, bouquet/garter toss, wedding games, and more dancing at the reception!

10 Hour Coverage - The whole darn day - $2,999 This is the full package and it’s for those who want us to truly document their whole day. Many people want to do something extra fun with their bridesmaids or groomsmen on the morning of their wedding. Want to also remember the morning spa treatment or football game? Take us along!
