standards must be labeled as compliant with TSCA Title VI or CARB ATCM Phase II emission standards (which are set at identical levels).After March 22, 2019, regulated products manufactured in or imported into the U.S. may not rely on CARB reciprocity (40 CFR 770.15(e)) and must be certified and labeled as TSCA Title VI compliant.
Non-exempt laminated products made with formaldehyde-based resins (other than phenol-formaldehyde (PF)) to attach a veneer to composite wood products must be tested and certified to meet the HWPW emission standard beginning March 22, 2024.

Under TSCA Title VI, importers, distributors, and retailers are responsible for recordkeeping and labeling requirements, including:• Ensuring they purchase only compliant composite wood products, whether unfinished panels or
incorporated into component parts or finished goods;• Ensuring labels stay intact on individual items or on file if items were purchased by the bundle and
sold separately (label information must be made available to potential customers upon request);• Using a method sufficient to identify the supplier of the panel or finished good, and linking the
information on the label to the product; and• Importers must also provide an import certification for all imports beginning March 22, 2019.

Q: Se un mobile è stato prodotto in Italia prima del 1° giugno 2018
utilizzando pannelli prodotti prima del 1° giugno 2018 (e quindi non
certificati CARB/TSCA title VI) e viene spedito prima del 1° giugno ma arriva
dopo questa data deve già essere etichettato conforme a CARB/EPA TSCA
Title VI?
A: All composite wood products and finished goods arriving in the U.S. after June
1, 2018 must be compliant with TSCA Title VI or the CARB ATCM Phase II
regulations – and labeled as such. Beginning March 22, 2019 all composite wood
products and finished goods must be fully compliant with TSCA Title VI and
labeled as such.

Q: Se un prodotto spedito prima del 1° giugno 2018 arriva in dogana prima del 1°
giugno 2018 ma viene sdoganato dopo quella data il prodotto deve già essere
etichettato come conforma a CARB/EPA TSCA Title VI?
A: Under TSCA, import means products coming into the customs territory of the United
States (as defined in general note 2 of the Harmonized Tariff Schedule of the US).
Nel TSCA, per importazione si intendono i prodotti che entrano nel territorio doganale degli Stati
Uniti (come definito nella nota generale 2 del programma tariffario armonizzato degli Stati Uniti).

FAQ - Recordkeeping
Q: Quali sono i documenti che i trasformatori e i fabbricanti devono mantenere per 3 anni?
Importers, fabricators, distributors and retailers must maintain the following records for three (3) years and be able to make them available to EPA upon request within 30 days:
Records identifying the panel manufacturer and date panels were manufactured; Records identifying the supplier, if different, and date of purchase; Bills of lading, invoices or comparable documents that include a written statement from supplier
that the panels, components or finished goods are TSCA Title VI compliant or were produced prior to June 1, 2018.

Se per la produzione di un componente (ad es. di ante) si utilizza pannello NAF (noadded Formaldehyde), cosa occorre inserire nei documenti che accompagnano ilprodotto finito?Ad es. nell'ordine al fornitore quale dicitura si deve utilizzare?
• Se si acquistano pannelli NAF occorre inserire nell'ordine d' acquisto la dicitura "pannelliNAF" e richiedere l'executive order del produttore di pannelli che attesta laconformità di quel prodotto NAF. (Att!! Gli executive order hanno validità 2 anni)
N.B. Ai fini dell’etichettatura i prodotti totalmente NAF e ULEF sono considerati esenti dal regolamento.Per prodotti misti NAF e TSCA title VI l'etichetta va comunque fatta e in questo una dicitura correttapuò essere: "Product contains TSCA Title VI products and NAF/ULEF products«.

Labeling: CARB vs TSCA Title VI
CARB ATCM U.S. EPA TSCA title VI
Requires panels (or bundles of panels) and finished goods (or boxes that contain finished goods) to be labeled as compliant with CARB’s Phase 2 formaldehyde emission standards.
Note: Panels and finished goods that are labeled as TSCA Title VI compliant will be accepted as being compliant withCARB’s formaldehyde emission standards
CARB recommends labeling panels and finished goods as being compliant with both the EPA and CARB regulations,
Beginning June 1, 2018, panels (or bundles of panels) and finished goods (or boxes that contain finished goods) may be labeled as complying with TSCA Title VI, CARB Phase 2, or both, whichever is true for the product.
• Until March 22, 2019, composite wood panels and finished goods labeled as being compliant with CARB Phase 2 will be considered as TSCA Title VI compliant.
• After March 22, 2019, all manufactured (including imported) regulated composite wood panels and finished goods must be labeled as TSCA Title VI compliant.

From 22 March 2024…Non-Exempt Laminated Panel Producers must maintain the following records for three (3) years:
Quarterly emissions test results; Ongoing quality control testing; Production records; Records of changes in production; Records demonstrating initial and continued eligibility for reduced testing of NAF and ULEF products; Purchaser information for each composite wood product; Transporter contact information and shipping invoice number; Representative copies of labels; and Disposition of any non-complying lots, if applicable Records demonstrating initial and continued eligibility for reduced testing or NAF/ULEF exemption must be
kept for as long as the panel manufacturer is producing panels under the reduced testing or NAF/ULEF exemption.
Although testing and certification is not required for NAF/ULEF exempt panels, records must be kept of tests that are conducted.
Records of quarterly chamber results must be made available to direct purchasers upon request.

CARB ATCM U.S. EPA TSCA title VI
Not required. More stringent than CARB - Beginning March 22, 2019, import certification through the U.S. Customs and Border Protection’s Automated Commercial Environment will be required for all non-domestic composite wood products being imported into the U.S.

(b) Failure or refusal to establish and maintain records or to make available or permit access to or copying of records, as required by this part, is a violation of TSCA section 15 (15 U.S.C. 2614).
(c) Making false or misleading statements in any statement, certification, or record required by this part is a violation of TSCA section 15 (15 U.S.C. 2614).
(d) Violators may be subject to civil and criminal sanctions pursuant to TSCA section 16 (15 U.S.C. 2615) for each violation.

1. In case of violation of the TSCA Title VI rule, is it available the penalties for any different
kind of violation?
2. If a finished furniture is made without panels affected under TSCA TITLE VI rule, it is
allowed to label it? If yes, it is correct to use the following sentence "This furniture
contains only exempt products to the TSCA TITLE VI rule"? or in alternative could you
suggest us a correct sentence?
