(a) any vehicle operator present on the Site or who has cause to enter upon the Site is in possession of a full and current valid Goods Vehicle Operator Licence as issued under the Goods Vehicles (Licensing of Operators) Act 1995 and that is in compliance with all statutory requirements in force at that time or

(b) where, on rare occasions, an operator appears to be using a vehicle legitimately but is unable to present a valid Goods Vehicle Operator Licence, evidence will be required to be produced that an application to the Central Licensing Office has been made.

We shall not permit any Vehicle Operator who does not have or reasonably expects to have possession of a currently valid Goods Vehicle Operator Licence access to the Site.

2) We shall ensure that any Vehicle Operator present on Site for the purposes of carrying out the Works who’s Goods Vehicle Operator License is revoked for whatever reason will be immediately required by us to remove his personnel and vehicles from Site or act as otherwise directed by the appropriate enforcement authorities.

3) We understand that failure by us to comply with sections 1) and 2) above and /or failure to act in accordance with the provisions herein and the Conditions of Contract will be taken into account when considering future tendering opportunities for our Company or any future Company which may be formed by us.

The Contractor submits revised programmes no longer than; 3 weeks before start date.

4 Testing and Defects The defects date is; 52 weeks after Completion of the whole of the works.

The defects correction period is; 4 weeks after the defects date.

5 Payment The currency of this contract is; pound sterling.

The assessment interval is; one calendar month.

The interest rate is; 2.5% per annum above the Bank of England base rate.

6 Compensation events The place where weather is to be recorded is; Clacton-on-Sea

The weather measurements to be recorded for each calendar month are;Cumulative rainfall (mm)Number of days with rainfall more than 10 mmNumber of days with minimum ground temperature less than 0ºc Number of days with snow lying for any period between 9am and 4pm

Weather measurements are to be provided by the Met Office Building Consultancy or Essex Weather Centre.

The weather data are the records of past weather measurements for each calendar month at Clacton-on Sea and which are available from the Met Office or Essex Weather Centre.

8 Risks and Insurance

The minimum limit of indemnity for insurance in respect of loss or damage to property (except the works, Plant and Materials and Equipment) and liability for bodily injury to or death of a person (not an employee of the Contractor) caused by activity in connection with this contract for any one event is; £10,000,000 ( ten million pounds).

The minimum limit of indemnity for insurance in respect of death or bodily injury to employees of the Contractor arising out of and in the course of their employment in connection with this contract for any one occurrence is:£5.000,000 (5 million pounds).

The arbitration procedure is the latest version of the Institution of Civil Engineers Arbitration Procedure in force when the Arbitrator is appointed.

The person or organisation who will chose an arbitrator if the parties cannot agree a choice or the arbitration procedure does not state who selects an arbitrator is; the Institution of Civil Engineers.

The completion date for the whole of the works is four weeks from start date

The following Key dates and conditions are to be met;

Delay damages for Completion of any part of the works by the date for completion of the whole of the works will be calculated as set out in the Instructions to Tenderers and inserted by the Employer before award of the contract.

The amount of the performance bond is 25% of the contractor’s tender value.

The retention free amount is; nil

The retention percentage is 5% with an upper limit of 3% of the contract sum.

The additional conditions of contract are set out below in Z1 to Z4;

Z1 Data Protection

1.1 In relation to all Personal Data, the Contractor and Tendring District Council (the Council), the Employer, shall at all times comply with the requirements of the Data Protection Act 1998 (as amended) (DPA).

1.2 The Contractor shall and shall procure that each Sub-contractor shall:

1.2.1 process Personal Data belonging to the Council only on the instructions of the Council;

1.2.2 only undertake processing of Personal Data reasonably required in connection with the Agreement and shall not transfer any Personal Data to any country or territory outside the European Economic Area.

1.3 The Contractor shall not disclose Personal Data to any third parties other than:

1.3.1 to employees and Sub-contractors to whom such disclosure is reasonably necessary in order for the Contractor to carry out the Agreement; or

1.3.2 to the extent required under a court order;

1.3.3 provided that disclosure under Clause 1.3.1 is made subject to written terms substantially the same as, and no less stringent than, the terms contained in this Clause 1 (Data Protection) and that the Contractor shall give notice in writing to the Council of any disclosure of Personal Data which it or a Sub-contractor is required to make under Clause

1.3.2 as soon as reasonably practicable.

1.4 The Contractor shall bring into effect and maintain and procure that all relevant Sub-Contractors have in effect and maintain all technical and organisational measures to prevent unauthorised or unlawful processing of Personal Data and accidental loss or destruction of, or damage to, Personal Data.

1.5 The Council may, at reasonable intervals, request a written description of the technical and organisational methods employed by the Contractor and the Sub-contractors referred to in Clause

1.6 Within 10 working days of such a request the Contractor shall supply written particulars of all such measures detailed to a reasonable level such that the Council can determine (at all times acting reasonably) whether or not, in connection with the Personal Data, it is compliant with the DPA. Where the Council makes repeated requests under this clause for the same information the Contractor may raise, and the Council will pay, a reasonable charge for such request if compliance with such request would cause the Contractor to incur the expenditure of material time or cost.

1.7 Both parties shall ensure that any Personal Data they obtain and provide to the other party has been fairly and lawfully obtained and complies with the DPA and that the use thereof in accordance with the Agreement by the other party shall not breach any provisions of the DPA

1.8 If:

1.8.1 under the DPA, the Council is required to provide information to a data subject in relation to Personal Data when it is in the possession or under the control of the Contractor; and

1.8.2 the Council informs the Contractor in writing that this is the case;

1.8.3 then the Contractor shall procure reasonable and prompt co-operation to the Council in meeting its obligations under the DPA including making copies of the relevant Personal Data.

1.9 The Council shall provide the Contractor and the Contractor shall provide the Council as soon as practicable, with such information in relation to Personal Data and their processing as the second party may reasonably request in writing and the first such party may reasonably be able to provide in order for the second party to:-

1.9.1 comply with its obligations under this clause and the DPA, and

1.9.2 assess whether the processing of Personal Data in connection with the Agreement is breaching or may breach the DPA in a manner which is material and not effectively sanctioned by any guidance statement issued by the Information Commissioner.

1.10 Each party shall indemnify and keep indemnified the other against all losses, liabilities, costs, claims, demands and expenses incurred by the indemnified

party in respect of any breach of this Clause 1 (Data Protection) by the indemnifying party, including in the case of the Contractor any breach of this clause by a Sub-contractor. The obligations of indemnity accepted by each party in this Clause 1 are conditional upon the indemnifying party being allowed the exclusive right to control the investigation, defence and settlement of each such claim and the reasonable assistance of the indemnified party in the defence (including the obligation that the indemnified party makes no admission in relation to any claim arising by breach of this Clause 1 (Data Protection) of the claim.

Z2 The Equality Act 2010

2.1 The Contractor shall, in so much as this condition is allowed by the Local Government Act 1988, comply with The Equality Act 2010, together with:

2.1.1 Any act, rule, statement, code of practice, manual or other instrument or document amending or replacing the foregoing enactment; and

2.1.2 Any other statute, statutory instrument, rules, regulations, order, directions, byelaws or other instrument having force of law, any rule of law, and any contractual obligation other than obligations arising from contracts between the Contractor and his employees (whether owed to the Council under this or any other Contract or to any other person other than his employees), for preventing unlawful discrimination (including victimisation) on grounds of race, creed, gender.

2.2The Contract shall give to the Council such information, such access to documents and such copies of documents as the Council may require in order to satisfy himself as to the Contractor’s compliance with the foregoing sub-clauses.

Z3 CorruptionThe Employer shall be entitled by notice to the Contractor to terminate the Contractor’s employment, under this or any other contract with the Employer if, in relation to this or any other such contract, the Contractor or any person employed by him or acting on his behalf shall have committed an offence under the Prevention of Corruption Acts 1889 to 1916, or where the Employer is a Local Authority, shall have given any fee or reward the receipt of which is an offence under sub-section (2) of section 117 of the Local Government Act 1972.

Z4 Freedom of Information Act 2000

4.1 The Contractor acknowledges the Council's obligations under the Freedom of Information Act 2000 (referred to as "FOIA") and which may require the Council to provide to a third party information relating to this Agreement or to the Contractor

4.2 The Contractor will facilitate the Council's compliance with FOIA and will comply with any reasonable request from the Council to that end within 10 working days of receipt of that request.

4.3 For the purposes of this Agreement confidential information shall exclude any information that the Council is obliged to disclose to a person under the provisions of the FOIA and any codes of practice and guidance issued by the Government and the Information Commissioner.

W100 Description of the works

W105 The works are the resurfacing of car parking areas to the rear of Weeley Crematorium. The surfacing is to be stone mastic asphalt. The works may be carried out to areas only as defined on the contract drawings, or any combination of those areas.

W110 The Crematorium is used by staff and public attending funeral services and visiting memorials.

W115 The site is operated by Tendring District Council.

W120 The works are required due to the existing surface requiring continual maintenance to fill potholes etc.

W125 The contractor shall be deemed to have visited the site and fully familiarised himself with the conditions of the site and the surrounding area before submitting his tender and before carrying out any works.

W200 General Constraints

W205 Works shall be undertaken between the hours of 8am-6pm Saturday and Sunday only. No works shall be carried outside of these times or machinery, materials or site facilities shall be obviously visible to funeral processions.

W210 There is no information available relating to the location of existing services providing supplies to Weeley Crematorium. The contractor shall undertake all necessary investigation works before any excavation commences to ensure the area of the works is unaffected by the presence of such services / supplies to this facility.

W215 The contractor shall also ensure that any power supply to the Crematorium is located and so that its operation is unaffected by the works.

W220 The contractor will be allocated a site compound area of 10m x 10m within the general car park area for location of welfare / office and materials storage facilities. Parking of contractors vehicles shall be contained within a reasonable area immediately adjacent to the compound.

W225 The Contractor shall be responsible for providing adequate signage warning the public of the works being carried out. The routes for delivery vehicles shall also be clearly signed.

W230 Contractors working hours shall be between 8am-6pm Saturday and Sunday. Works shall not be carried out outside these hours without prior agreement of the employer.

W235 Prior to the commencement of any works the Contractor shall undertake a condition survey of the area of the works, and any area that may potentially be affected by the works, including the access and egress to the Crematorium, and any areas of the car park not within the area of the works. This condition

survey shall consist of, as a minimum, a full digital photographic record accompanied by a written description of any areas which the Contractor considers falls below an acceptable condition for its, current, intended usage before the works are carried out. A full copy of the condition survey shall be provided in electronic format to the Employer before works on site commence.

W240 The Contractor is responsible for the security of the site and any area on which its welfare/ office / materials /plant or vehicles are located, and maintaining that security at all times for the duration of the works.

W300 Completion

W305 The Defects Correction period will not be considered to have commenced until all works have been completed, which includes the full reinstatement of areas used / occupied / disturbed in the carrying out of the works to their pre-works commencement condition or a condition accepted and agreed with the Employer.

W310 Sectional completion will not be considered to have been completed, and Defects Correction commenced for that section until that as described above under W305 applies to the area for which sectional completion is being considered.

W315 Sectional completion will also not be considered if the area for which sectional completion is being applied for is required to be used as a temporary pedestrian or vehicular route to other areas as a result of the carrying out of other parts of the works.

W310 The contractors attention is drawn to the dates as identified in the Optional statements forming part of the contract data - part one.

W400 Management of the Works

W405 Site meetings are to be held at a minimum of daily intervals.

W410 The Contractor shall submit daily progress and planned work reports to the Employer in sufficient detail to allow the Employer to advise any party affected by the works and prepare press releases to the public on intended work activities, especially those involving actions that may impact on the publics use / access to the area of the car park in general.

W415 The contractor shall liaise with all stakeholders affected by the works, including the Crematorium Manager as is necessary to ensure that their requirements for access and deliveries are considered and included in the short term and long term programing and carrying out of the works.

W420 The contractor shall identify a person at senior site management level who shall be responsible for acting as the point of contact for the stakeholders, and provide their contact details to the stakeholders.

W415 All communication between the parties to the Contract, and their representatives, shall be by electronic means.

W500 Services and other things to be provided

W505 The contractor shall make available for use by the Employer, if and when requested, surveying equipment equivalent to that as used by his own engineering / site staff.

W510 The contractor shall also provide adequate and appropriate PPE to allow 2 persons, visitors to attend site. This shall include as minimum appropriatefootwear, waterproof high visibility jacket, hard hat and gloves.

W515 The Contractor shall afford reasonable facilities for the inspection and testing of the works by the Employer or any representative of the Employer or person

authorised by the Employer.

W520 The contractor shall allow for providing information signage identifying the project title, the Employer, the contractor, and the duration of the works. The signage shall be mounted at the perimeter of the works, location to be agreed with the Employer. The sign shall be a minimum of 2m x 2m with white

lettering on a solid colour background.

W600 Health and Safety

W605 The Works are not considered “notifiable” under the Construction Design and Management Regulations, however, should the contractor consider that the requirements for notification will be met they should notify the Employer immediately.

W610 Although not “notifiable”, see above, the full requirements of all Health and Safety Regulations, and recommendations, shall be met.

W615 The Contractor shall provide all the information as identified in the Pre-Construction Information, as attached, within the timescales set out therein, and provide the full “As Constructed” information required upon completion.

W620 Method Statements and Risk Assessments shall be provided for all construction activities. All method statements shall be provided to the Employer a minimum of 24hrs before the work activity is implemented.

W625 The ongoing developed construction phase health and safety plan shall be available on site for inspection by the Employer, Project manager, Supervisor, or any person as deemed appropriate by the Employer as and when requested.

W630 The working methods of the Contractor may involve the use of heat (flame gun) to remove some of the current surface. If so the Contractor shall make certain that adequate fire fighting measures, fire extinguishers, are appropriately located immediately adjacent to the works being carried out, and

INTRODUCTION

It is a requirement under the Construction (Design and Management) Regulations 2015 for all construction projects that fall within the categories stated in the Regulations that all Clients/Employers provide Pre-Construction Information in their possession or which is reasonable to obtain by enquiry to each designer and contractor who is bidding for the work.

It is the responsibility of the prospective Principal Contractor to implement and develop a Construction Phase Plan having regard to the Pre-Construction Information. The Plan shall be submitted to the Employers prior to the commencement of the Contract.

This document should be read in conjunction with the Employers Requirement and the documentation which accompanies such, which together, can be considered the full extent of Pre-Construction Information available from the Employer.

1. EXISTING ENVIRONMENT1.1. Project and description of Site

1.3 Key construction dates

Works are to commence: Wednesday 25 March 2020

All works are to be complete by 4pm Sunday 29 March 2020

1.5 Existing Services

There will be services feeding the Crematorium

The contractor attention is drawn to the need to ensure that all services are located and protected if required or their effect on the works reviewed and necessary changes made before any works commence, particularly the carrying out of excavations.

1.6 Hazard Assessments

The Designers risk assessment as included in the contract documentation notes conflict with public users of the car park, vehicles and pedestrians and the presence of services as potential risks.

1.7 HSE Notification

Notification to the HSE via the use of an F10 notice is not considered to be required because the work will not last longer than 30 working days having more than 20 workers working simultaneously at any point in the project; or exceed 500 person days.

Should the Contractor consider the assessment in elation any of the above to be incorrect they are to notify the Employer immediately.

The fact that the project is not notifiable under the Construction Design and Management Regulations does not preclude the regulations from applying and tits requirements from being met.

2 CLIENTS CONSIDERATIONS AND MANAGEMENT REQUIREMENTSPlanning and Management of Construction

2.1 Health and Safety is treated as a high priority by the Employers. Good safety performance is achieved through the integrated development of safe

methods of work across the design, procurement and construction processes.

2.2 Health & Safety is to be managed to ensure a successful project. The overall project aim is to minimise the risk of harm to those visiting, or working on site or those who may be affected by the site activities, and achievement is measured via accidents, incidents and inspection/audit findings.

2.3 Regular health and safety inspections shall take place, be recorded and actioned to a satisfactory conclusion should defects be identified. Regular Health and Safety meetings shall be held at site to ensure good communications and feedback is maintained and the workforce consulted over safety solutions and proposals.

Communication and Liaison between Client and Others

2.4 Prior to any works commencing a meeting shall be held between the Principal Contractor, all Stakeholders and the Employer to discuss access, safety, security and agree a common approach acceptable to all.

2.5 It is of critical importance that all health and safety issues are openly discussed between all parties working within the works area, public, nearby residents and nearby commercial businesses that may be affected by the works, and where necessary safe systems of works agreed and put in place.

2.6 The Principal Contractor shall display on the site, in a prominent and clearly visible location, contact / emergency telephone numbers should the information be required by the general public.

2.7 Regular site meetings whether or not set out in the contract will be held with the Employer and their representatives and any other contractors on site. The agenda for these meetings will include specifically an item dealing with health, safety and welfare. The frequency of these meetings will be confirmed by the Employer prior to the commencement of works. Minutes of meetings will be taken and action points recorded. Any action points will be dealt with promptly.

2.8 The Principal Contractor shall ensure that any Sub-Contractors employed by them on site are competent and have made adequate provision for health and safety. The Principal Contractor shall check Sub-Contractors Risk Assessments and Method Statements and shall ensure the details are communicated to all others on site, and included in the Construction Phase Plan.

2.9 Should unforeseen circumstances result in significant changes to working methods and programme then these shall be agreed with the Employer and the details shall be conveyed to the whole workforce as appropriate.

2.10 Any visit by any Enforcement Authority (HSE, Local Authority, EA, etc.) to the project, for whatever reason shall be notified to the Employers forthwith

with details of any actions required or implemented.

2.11 The Principal Contractor shall perform a programme of regular recorded Health and Safety inspections. These shall be annotated to demonstrate actions completed and copied to the Employers for his information.

2.12 Welfare Provision A Site Compound shall be provided and welfare facilities for the workforce. All facilities must address the provision of adequate sanitary conveniences, washing facilities, drinking water, changing rooms and facilities for rest. Details of proposed welfare arrangements are to be reviewed and accepted by the Employer prior to the Principal Contractor being permitted to commence works.

3 CLIENT SPECIFIED HEALTH AND SAFETY REQUIREMENTS3.1 Site Strategy & Traffic Management Plans The Principal Contractor shall

produce prior to the commencement of works Site Strategy & Traffic Management Plans which are acceptable to the Employer and shall identify:

a) Site compound and welfare areas including employee's car parking arrangements

b) Waste storage areas

c) Loading and unloading areas

d) Contractors access routes along with signage

e) Site access / egress points/turning areas

f) Material storage area

g) Temporary fencing requirements

h) Fire/emergency assembly area

i) First Aid point

j) Emergency telephone location

k) Pedestrian and vehicular routes for public along with signage

l) The presence of services and how these are to be dealt with / maintained during the works.

These plans will need to be developed/revised as work progresses.

3.2 Site Security The Principal Contractor will be responsible for site security and will take all necessary precautions to prevent uninvited visitors etc. by

vehicles and pedestrians onto the site. No unauthorised traffic or pedestrians will be allowed access on or through the site. The site area shall be fenced as deemed necessary using 2.0m high 'Heras' type fencing panels securely fixed using two clips per panel (one being anti-tamper) and steel banding, with every third panel being braced. Heras fence foot blocks are to be positioned at right angles. Ensure foot blocks do not become a tripping hazard. Particular consideration is required to be given to when vehicle and pedestrian access is gained to completed areas of the works and works to other areas are ongoing. The contractor will be required to clearly identify the areas of the car park open for use and the pedestrian access routes, along with delivery routes, during that time.

3.3 Any adjacent areas of the car park outside the works area shall be maintained in a suitable condition to permit safe passage by the general public, this is in addition to any temporary routes, pedestrian or vehicular that form part of the works. Particular attention will be needed to ensure the public are protected from the work areas and appropriate precautions (signs, fencing etc.) provided, including ensuring the safety of visually impaired and disabled members of public.

3.4 Particular attention also needs to be given during the school holiday periods warning children, and making parents aware, of the dangers a construction site can present. Extra vigilance is required during these holiday periods.

3.5 Noise & Dust Unless advised otherwise by the Employer the following restrictions shall apply during the construction phase in addition to those stated elsewhere in the contract documentation.

a. Noise and Vibration

i) Noise from the works and any ancillary operations associated with the works shall not exceed a level of 70db (A) at the nearest residential boundary during the following hours:

0800 – 1800 hours Wednesday to Sunday

ii) No works will be permitted outside of these hours without prior consent of the Local Authority and the Employer.

b. Suppression of Dust and Dirt

i) No works shall commence on site until there has been submitted and approved in writing by the Employers a scheme employing the best practicable means for the suppression of dust during the works.

3.6 Parking, Loading and Unloading

Details are to be provided for the loading and unloading of materials on site. No materials shall be stored outside the area of the works or areas

specifically identified for the storage of materials.

3.7 Access / Egress to Site

a) Access on the site is through the general entrance of the crematorium which will be shared with the public. Adequate warning of the fact that construction works are being undertaken, and shared access routes exist, shall be provided at the entrance to the car park, along with clear directional signage for those involved in the carrying out of the works of the access route through the car park and for delivery drivers.

b) Access to any adjoining premises or facilities shall be maintained during working times. 0800 – 17.30 Monday to Sunday

c) The Principal Contractor is to ensure that measures are taken for the removal of any snow and ice that may accumulate to allow safe access for the workforce and safe use of the area of the car park adjacent to the works by the public.

3.9 Risk Assessments

a) The Principal Contractor shall carry out their own risk assessments for the works involved (including COSHH) and provide copies of all to the Employers prior to commencing works. These are to be included as part of the Construction Phase Plan.

b) A copy of the Employers Risk Assessment is attached for the Contractors use and this should be developed by the contractor as appropriate.

3.10 Method Statements. The Principal Contractor shall provide a detailed Method Statement for each of the various operations within the works to be undertaken. Which as a minimum shall include all the items set out in the Activity Schedule. These shall be agreed with the Employer prior to commencing works and are to be included as part of the Construction Phase Plan.

3.11 Should temporary works access be required the Principal Contractor is to ensure that whatever system is used it is legally compliant.

3.12 Client permit to work systems The Employers operates and/or requires the Principal Contractor to operate permit to work systems in respect of the following Health and Safety Hazards, and would expect the Principal Contractor to implement such systems where deemed necessary as follows:

3.13 Safety Checks & Inspect i ons

a) The Principal Contractor shall conduct a health and safety inspection of the site and checks on all plant to be used before doing so on all working days, and record the findings / actions in the Site Diary.

b) All Statutory Inspection Records are to be completed and held in the Site Manager's office. These records are to be completed at the required intervals and made available for inspection by the enforcing authorities if necessary.

c) Any test certification for the commissioning of the works is to be completed and held in the Site Manager's office. Copies of all test certification are to be included in the Health & Safety Files.

3.14 Accident Procedure and Medical Details of emergency procedures, telephone numbers etc. shall be prominently displayed and explained to all operatives. All accidents / incidents will be recorded in the Site Accident Book, HS Form 1 and Site Diary. First aid facilities and medical First Aiders will be on site at all times during working hours.

3.15 Control Measures and Safe Working Systems

a) All personnel including visitors will wear the appropriate PPE and be given induction training. All induction training will be given by the Principal Contractor and recorded in the Health & Safety Plan.

b) Particular attention to be given to the requirements of the Employer at all times.

c) Manufacturer's/Supplier's to provide information on product weights with delivery to site (preferably marked on packaging) to assist the lifting operators when considering maximum lift capability and also manual handling.

d) Machinery and tools will only be used by competent personnel who have been fully trained and received site induction training. All standard operating procedures and operating manuals will be complied with at all times.

e) Only 110 Volt electricity supplies and equipment will be used on site. Unauthorised electrical appliances and connections will not be permitted.

f) The site will be kept tidy GOOD HOUSEKEEPING IS AN AID TO SAFETY i.e. excavations clearly marked and fenced etc. A high standard of cleanliness shall be maintained.

3.16 Construction Skills Certification Scheme (CSCS) All site operatives shall be registered under this scheme and hold the appropriate level of CSCS card. Any operative not in possession of a CSCS card will be asked to leave site.

3.17 Plant may only be operated by operatives who hold a CPCS Certificate of Competence, or similar approved, and must be over the age of 18 years.

3.18 Fire Precautions

a) Effective fire precautions shall be put in place and agreed with the Employer as required especially if the contractor uses a method of heat to remove the void formers to the concrete paving. No open fires for the burning of waste material will be permitted on site.

b) Fire risk assessments shall be prepared for site offices/compound areas and construction areas as deemed appropriate. The control measures identified within fire risk assessments will be implemented and reviewed with tests performed on a periodic basis.

c) The Principal Contractor shall establish appropriate emergency arrangements and liaise with the Emergency Services to ensure appropriate access arrangements are maintained during construction, and to ensure access is available to all occupied premises.

3.19 Waste Management

a) The Principal Contractor shall include in their Construction Phase Plan details of their site waste management system.

b) The Principal Contractor shall provide, maintain and update a Site Waste Management Plan in accordance with the current guidance, taking into account also the Employers targets in reducing waste where advised.

3.20 Fuel Spillage Fuel spillage kits are to be provided and made accessible at all times. Appointed site staff needs to be trained in its use.

3.21 Mobile Phones Mobile Phones, mobile phone ear pieces, or any other device are not to be used whilst working onsite.

4 CO-ORDINATION OF ONGOING DESIGN AND HANDLING DESIGN CHANGES

4.1 On - going Design

a) Subsequent design changes following site start requires the Principal Contractor to be advised as soon as possible to ensure control

measures and changes to any current working methods are revised accordingly. Any such changes shall be recorded in the Construction Phase Plan and the workforce advised where necessary. Subsequent design changes should be avoided where possible.

b) Any contractor undertaking design work inclusive of temporary works shall produce Designer's Risk Assessments for review. This information shall be included in the Construction Phase Plan.

4.2 Buildability The Principle Contractors staff may make an input to on-going design to improve buildability of a project (or future projects). They shall be reviewed and assessed before implementation. The Principal Contractor must be advised of any site specific changes as soon as possible to ensure control measures and changes to working methods are implemented without delay. These changes shall be recorded in the Construction Phase Plan.

5 HEALTH & SAFETY FILE / MAINTENANCE GUIDE

5.1 The Principal Contractor shall provide all relevant information to ensure compilation of the Health & Safety File on practical completion, which shall be undertaken by the Contractor. The contents of the Health and Safety File shall be agreed with the Employer. Guidance on Health & Safety Files can be obtained from the HSE website.

Introduction

The following risk assessment is prepared under the requirements of the Construction Design and Management Regulations.

It is intended for use by Designers / Contractors in the preparation of their designs, and the Client (Employer) in terms of identifying Health and Safety risks during the preparation of the tender and as may influence the construction, operation, maintenance and dismantling of the works, the Principle Designer in the carrying out of their duties, and the Principle Contractor in implementation of the designs and carrying out of construction works by themselves and other contractors / sub-contractors.

The risks that have been considered and that may influence Health and Safety matters are as set out on the attached sheet(s).

Each risk identified is considered in terms of its likely hood of occurring and severity of impact. The assessment being carried out on a scale of 1-5, 1 being less likely, or less severe, and 5 being more likely and more severe. The severity being a consideration of the consequences.

Against each risk a mitigation action is identified, when such action is possible, and the likely hood of risk occurring reassessed based on the mitigating action being undertaken.

Each item is assigned a score, severity x mitigated risk (likely hood). This score should be targeted to be as low as possible. The higher scores should be given specific consideration, and constant review, including is the risk acceptable.

The preparation of assessment shall not be taken to remove the responsibility of minimising risk from any party, and shall not be taken as exhaustive or prescriptive. Assessment of risk is a continuous ongoing process by all parties at all times. And all risks should be subject to regular review.

101 DOCUMENTS The drawings and specification are intended to convey an accurate description of the nature, extent and standard of the work to be performed by the Contractor along with any other documentation provided in connection with the carrying out of the works. Should the Contractor be in any doubt regarding the true meaning and intent of any clauses in the Conditions of Contract, specification, or details or information shown on the drawings or in any documentation, he is to have these fully resolved before providing his tender for carrying out the works, as no additional monies will be paid for any loss or expense involved through any misunderstanding arising from his failure to comply with this requirement. The Contractor must include for carrying out the works strictly in accordance with the true intent of the meaning of the drawings and Specification. Minor works not specifically mentioned but necessary and required to undertake the works will be deemed to be allowed for in the Contractor's tender.

The standard of works and the manner in which the works shall be carried out shall be in accordance with the Manual of Contract Documents for Highway Works: Volume 1 Specification for Highway Works which shall form part of the specification for the undertaking of the works. Where the specification below does not make specific reference to elements of the work to be undertaken they shall be undertaken in accordance with the Manual of Contract Documents for Highway Works: Volume 1 Specification for Highway Works.

Weeley Crematorium EssexScope document for the maintenance of the Rear Car Park

Following a recent site survey, we have investigated the extent of surface defects to the carpark to the rear of the Crematorium and identify the following remedial works that arerequired. These works will bring the condition of the areas denoted with a red rectangleabove up to the standard for typical car park use and is further described below.Trial holes have been excavated in the central parking island. The following construction hasbeen identified:

The general layout of the two outside areas of granular fill with the Bodpave overlay iscontained between HB2 255 x 125 kerbs to the periphery of the car park. The inside edgeswhere the parking spaces adjoin the running lanes of the car park are contained by 150 x 50PCC edgings. Installation of a new road gully and soakaway trench to the bottom of the existingcar park, depth not exceeding 1m and average depth to invert 0.5m – 25mThe Contractor is required to consider the impact of signage for the closure of the car parkwhilst work is being undertaken and to allow for all necessary, labour, plant, materials andon‐cost for providing the works described together with all necessary measures for thesafety and welfare of their workforce in accordance with CDM Regulations.The Contractor is required to liaise with the Crematorium Manager to agree a suitableprogramme to minimise disruption to the proper operation of the Crematorium.Please note that water is available from the rear of the Crematorium via an outside tap and hose.

103 SEQUENCE OF OPERATIONS / INSPECTION

The Contractor shall not proceed with work which is likely to conceal any previous operations until the Employer or his appointed representative has been given the opportunity to inspect and approved such work.

The Contractor shall give adequate notice, a minimum of 12 hours, to the Employer, or his representative of the completion of any item which is likely to be concealed by subsequent operations so that arrangements for inspection can be made as required.

104 PRECAUTION AGAINST DISEASE

All plant to be used within the works and on the site is to be cleaned and disinfected before being brought to site and before being removed from site to prevent the spread of disease.

105 ACCESS TO SITE FOR CONTRACTOR

Vehicular access to the site shall be via Cemetery entrance only.

The contractor shall give due consideration to the route taken by delivery vehicles and the fact that the only route to the site requires vehicles to pass through the Cemetery grounds which has memorial plots in place. The contractor shall endeavour to arrange deliveries such that Funeral service times are avoided, and load / vehicle size is appropriate for the route to be taken.

ACCESS FOR OTHERS

SIGNAGE

The contractors attention is drawn to the requirements for access during office hours of 08:00 – 17:30 Monday to Friday.

Directional signage to provide the information as identified elsewhere in the Works Information shall be in accordance with the Traffic Signs Manual Chapter 8 (part 2). The wording for all signs and their location shall be submitted to and agreed with the Employer before implementation and any works are undertaken.

108 ELECTRICITY SUPPLY

The Contractor shall make his own provision for an electricity supply. The use of temporary generators is acceptable. Arrangements may be made with the Crematorium Manager for electrical services from the Crematorium

109 WATER SUPPLY The Contractor shall make his own provision for a supply of fresh clean water. Arrangements may be made with the Crematorium Manager for water services from the Crematorium.

110 PRECAUTION AGAINST TRESPASS

The Contractor shall take every precaution to ensure that his employees or people connected with the works are prevented from trespassing on land which does not form part of the construction area.

111 TIDINESS AND SITE CLEARANCE

At all times the site and surrounds shall be kept in a tidy condition. No rubbish shall be allowed to accumulate on the site, and the works area shall be kept clear of rubbish at all times

The Contractor shall clear away all surplus materials on completion and leave the site in a clean and tidy condition.

112 MAINTENANCE OF SURROUNDINGS

The Contractor shall exercise care to preserve the surrounding landscape and shall conduct his construction operations so as to prevent any unnecessary destruction of the natural surroundings and memorials in the vicinity of the work. Where unnecessary destruction, damage or defacing occurs as a result of the Contractor's operations, the same shall be repaired, replanted, reseeded or otherwise corrected at the Contractor's expense.

The Contractor shall take all necessary measures to secure the protection of all areas of and surrounding the works from pollution of any form as a result of the works being carried out or the actions of the Contractor. Such protective measures shall include, but not be limited to, the following:-

All fuel lubricating oil and/or other liquid chemicals stored on the site shall be located as far as reasonably possible and in any case NOT LESS THAN 10.0M from any Watercourse, building or drain and such stores shall be sited on impervious bases and surrounded by an effective impervious bund capable of containing the full contents of the store plus 10% and with a sealed drainage system with no discharge to any Watercourse, land or groundwater. All such stores shall be kept locked or otherwise secured when not in use and all containers therein must bear clear labels giving full descriptions of the contents. A stock of absorbent material suitable for use on the contents of the store MUST be maintained on the Site.

Any leaking and/or empty oil/fuel/chemical containers shall be removed from the Site immediately.

All static equipment using fuel/oil shall be located as far as reasonably possible from any Watercourse, building or drain and shall be surrounded with oil absorbent material to contain spills and leaks.

The refuelling of machines shall be strictly controlled and confined to a location as far as reasonably possible from any Watercourse, Building or drain.

Ensuring that the use of any concrete mixing plant or ready mix vehicle together with the placing of any wet concrete is strictly controlled in such a manner that contamination does not occur.

Ensuring that only material free from polluting toxic substances is used at locations where drainage from new material can directly or indirectly enter any Watercourse or drain.

Preventing the spread of the following plant species:

Japanese Knotweed

Giant Hogweed.

In particular any spoil or other such arising’s contaminated with or suspected of being contaminated with the rhizomes and/or roots of these species SHALL NOT be spread to areas currently free of these plants but shall be disposed of as directed by the Employer.

The Contractor shall provide adequate means of cleaning the wheels of all vehicles. Also all vehicles shall also be cleaned such that any debris cannot drop from the vehicle, and all material being removed from site shall be adequately covered / secured. This shall take place before entering onto any paved surface within the area of the car park, or onto the Public Highway

Ensure that surface water drains are not contaminated by any debris or other arising’s from the Works.

Failure to comply with the above shall be rectified by the Contractor to the satisfaction of the Employer or their representative, or any other managing body / agent at the Contractors cost.

114 EXCAVATION: GENERAL

All necessary precautions shall be taken to preserve the material below and beyond the established lines of all excavation in the soundest possible condition. All excess excavation for the convenience of the Contractor or over excavation performed by the Contractor for any purpose or reason, except as may be ordered in writing by the Employer or his representative, shall be at the expense of the Contractor. Where required to complete the work all such excess excavation and over-excavation shall be refilled with suitable material, placed and compacted in accordance with this specification at the expense of the Contractor.

Areas beneath the proposed construction and beyond the established line of excavation which are considered by the Employer or his representative to be unsound shall be excavated to a depth to be agreed with the Employer or his representative and backfilled in accordance with the instructions given.

113 REMOVAL AND PROTECTION OF THE WORKS FROM WATER AND RAINFALL

The Contractor shall construct and maintain all necessary channels, drains, sumps, and/or other temporary protective works, including covers, for the removal of surplus water from the works and protecting against rainfall, during construction. The Contractor shall provide all materials required and shall provide, install, maintain and operate all necessary pumping and other equipment for the removal of water from any part of the work and for maintaining the works free from water from whatever source.

The cost of furnishing all labour, equipment and materials for constructing channels and other protective works /covers to allow the works to be undertaken; maintaining the work free from water and effects of rainfall as required; and all other work required shall be assumed to have been included in the Contractor's tender.

115 PREPRATION PRIOR TO PLACING OF FILL / SUBBASE

The finished formation surfaces against which any material is to be placed within the construction shall be cleaned of all loose, soft, and disintegrated materials including the removal of such materials from pockets, irregularities, fissures, and depressions in the foundation.

116 DISPOSAL OF EXCAVATED MATERIAL

All excavated material that is unsuitable, not to be used in the construction, or surplus, shall be disposed of to an appropriate tip, or, if so directed by the Employer or his representative, disposed of at a location as defined by the Employer or his representative.

117 CONSTRUCTION: GENERAL

All works shall be carried out in accordance with the latest edition of the "Specification for Highway Works" produced by the Department of Transport.

REINSTATEMENT

MAINTENANCE

The Contractor shall include for reinstating any temporary access, areas disturbed by the Contractor during the carrying out of the works to its original condition by excavation, filling, resurfacing as necessary using materials at least equivalent, and of the same physical properties / characteristics to those disturbed, with the surface finish being to the same line and level as existed prior to the works being carried out. This shall include reseeding of any grassed area.

The Contractor shall undertake maintenance of he works completed under the contract for a period of 12 months from the issuing of the final completion certificate (i.e. the issuing of the last completion certificate / commencement of defects correction period should areas be handed over to the Employer under partial completion certificates). For the avoidance of doubt this shall include for splits and cracks in surface, slumps or movement in block paving and faults in drainage changes.

120 PERMIT TO WORK It is expected the Contractor will operate a permit to work system for the following work types as a minimum;

Excavation works Entry into confined spaces Lifting operations Hot working

121 CONSTRUCTION, DESIGN AND MANAGEMENT REGULATIONS

The Contractor shall be responsible for, and include in his tender, the cost of meeting all of his legal obligations under the Construction Design and Management Regulations. The successful Contractor will be the "Principal Contractor" under these Regulations and shall carry out the necessary duties. In addition‚ the Contractor shall provide all of the necessary information to allow preparation of the Post Construction information as required by the Regulations. The information being provided electronically and within two weeks of the issuing of any certificate of practical completion for the works.

The Contractor shall‚ in accordance with the Regulations‚ develop the Pre Construction information contained within the tender documents to the satisfaction of the Employer. He shall ensure that the plan is sufficiently developed and approved before starting work on site and liaise as required and requested with the Employer his representative, or any other person designated by the Employer throughout the implementation of the works.
