04. PROMOTION OF DIGITAL TRANSACTION IN MINISTRY OF DEFENCE
To consider copy of DGDE letter bearing No. 83/62/DGDE/IT/Digi Transaction/ 2017 dated 21.08.2017 wherein it has been instructed that the respective Boards should undertake public awareness campaigns and also sensitize shopkeepers on the benefits of digital transactions. Connected papers are placed on the table.Note : The Government of India is encouraging the use of digital mode of payments by Govt. Departments on account of various services, procurement of materials etc. DGDE has also instructed to initiate adequate steps towards adaptation of digital mode for Cantonment Boards. This office has started the online transaction of

receipts of property tax. The payments to employees is also in digital mode. DGDE has directed the Cantonment Boards to make payments by way of IMPS instead of NEFT / RTGS in consultation with the primary bank. Payments made by cheque is not to be treated as digital payment. RESOLUTION NO. 4 : Considered. Board noted the letter received from DG DE, New Delhi. CEO explained that the Government of India has initiated a very good action for payment to be done through digital mode. Matter discussed. Resolved that the Board will make all the receipts as well as expenditure through e-payment / online/ net banking in consultation with the Primary Bank. POS machines be installed for receipt payments digitally. Chief Accountant to initiate action.
05. UPGRADATION / IMPROVEMENT IN CLINICAL LABORATORY AT SVP CGH
Reference Office Note dated 1st August,2017 from RMO (Offg.).To consider the upgradation / improvement to clinical laboratory by introduction of histopathology, generation of reports through computers and purchase of software.a. The following rates are proposed for reporting of
Histopathology specimen :-Small Specimen Rs.600Medium Specimen Rs.900Large Specimen Rs.1200The rates are reasonable compared to rate of private Laboratories.
b. To purchase computer alongwith printer and software for clinical laboratory reports. The total cost of computer is Rs.49500/- & HP Laserjet 1005 All in one Printer @ Rs.17,950/- which has been quoted by M/s. Shree Balaji Computer Services. The software recommended by Dr.Sudhir Kamble, Pathologist is from M/s. Birlamedisoft Pvt. Ltd. for Rs.15000/- + 18% GST and Rs.3000/- as maintenance charges for software per year.

RMO explained that the clinical laboratory has to be upgraded and also the reporting of Histopathology special has to be carried out. SEMO stated that the rates are reasonable in comparison to the private labs. Matter discussed. Resolved to approve the charges for reporting of

Histopathology specimen as shown on the agenda side. RMO (Offg.) to initiate further necessary action.
RESOLUTION NO. 5 (b) : Considered. Resolved to purchase computer from M/s. Shree Balaji Computer Services @ Rs.49500/- & HP Laserjet 1005 All in one Printer @ Rs.17,950/- for the clinical laboratory. Further resolved to purchase software for the Clinical Laboratory from M/s. Birlamedisoft Pvt. Ltd. @ Rs.15000/- + 18% GST and Rs. 3000/- towards maintenance charges for software per year.
06. ENGAGEMENT OF AMO SPECIALISTS ON CONTRACTUAL BASIS FOR SVP CGH
Reference CBR No. 3 dated 23.12.2016.a. To consider the interview conducted on 9th August, 2017 for
engagement of various AMO Specialists and NUHM staff by the committee comprising of Civil Surgeon, Dy. Director Health Services, rep of CEO, Pune and RMO. The monthly remuneration approved by the Board is Rs. 65,000/- per AMO Specialist. The details of the AMO Specialists are as under :-i. Two candidates for the post of AMO-Pediatrician - Dr.
Atish Pagare (MD Pediatric) has been recommended. ii. Two candidates for the post of AMO-Orthopedic Surgeon
– Dr. Yogesh S Khandalkar (D-Ortho, DNB Ortho, M-Ch Ortho) has been recommended.
iii. One Candidate for the post of AMO Anesthetist – Dr. Akshada B Kenjale (MBBS DA) has been recommended.
b. To consider the issue of engaging a AMO Radiologist for SVP CGH. At present there is only one Radiologist, who is working part time roughly about two hours during the morning session i.e. from 7.30 to 9.30 am. The monthly charges being paid exceeds Rs. 1 lakh approx. Hence it is suggested that one full time AMO (Radiologist) may be engaged on monthly remuneration of Rs. 65,000/-.
Connected papers are placed on the table. RESOLUTION NO. 6 : Considered. SEMO stated that the Honorary Specialists are not working during peak hours and not available during emergency. The RMO (Offg) should justify the work load of each Specialists and thereafter action be initiated for their engagement. CEO inquired whether any representative of SEMO was present for the interview. SEMO stated that no information regarding the interview has been intimated to their office. President

stated that the RMO (Offg) has to initially justify the work load and thereafter in consultation with SEMO, action be initiated for conducting fresh interviews. After detailed discussion, resolved that the interview held on 9th August, 2017 be considered as null and void. Further resolved that after justifying the work load of each Specialists required in SVPCGH and in consultation with SEMO, fresh advertisement be published in the local newspapers. The interview will be conducted by the committee comprising of rep. of SEMO, Members of Health & Hygiene Committee & RMO (offg.) so that a fair and transparent interview is conducted for selection of appropriate and eligible Specialists on contractual basis.
07. ENGAGEMENT OF CONTRACTUAL ASST. MEDICAL OFFICER (AMO) IN SVP CGH
Reference office note dated 19th August, 2017 from RMO (Offg.). To consider the engagement of one contractual AMO on monthly remuneration of Rs. 45,000/-. An interview was conducted on 17.07.2017. Only two candidates appeared for the same. Dr. Neelesh Wadnap was selected for the post of AMO and Dr. Vishal Karale was in the waiting list. Appointment Memo dated 12th August, 2017 was issued to Dr. Neelesh Wadnap due to shortage of general duty medical officers and on the urgent requirement as per report of the RMO (Offg.). The individual did not join. Hence Dr. Vishal Karale is recommended to be engaged as AMO, SVP CGH. Connected papers are placed on the table.RESOLUTION NO. 7 : Considered. After detailed discussion, resolved that the interview held on 17.07.2017 be considered as null and void. Further resolved that after justifying the work load of General Duty Medical Officers in SVPCGH and in consultation with SEMO, fresh advertisement be published in the local newspapers. The interview will be conducted by the committee comprising of rep. of SEMO, Members of Health & Hygiene Committee & RMO (offg.) so that a fair and transparent interview is conducted for selection of appropriate and eligible AMO on contractual basis.
08. PROVISION OF DOCTORS FROM MEDICINE DEPARTMENT OF AFMC
To consider note dated 12th September, 2017 received from RMO (offg) informing that the Medicine Department of AFMC, Pune will be providing medical specialists / super specialists / post graduate trainees to SPV CGH in order to give coverage round the clock and also the required super specialists in case of need. A letter to this effect has already been forwarded to the Commandant, AFMC vide SVP CGH letter dated 11th September, 2017.

RESOLUTION NO. 8 : Considered. Shri. Atul V Gaikwad, Vice President stated that this is good effort being initiated by AFMC. SEMO explained that Trainees cannot be considered as Specialists, hence accountability of medico legal aspects of any patient should lie on the senior specialists instead of Trainees. RMO stated that AFMC will be providing whole unit of doctors round the clock and a letter to that effect will be issued by the Commandant, AFMC. SEMO further explained that proper terms and conditions should be specified while provision of doctors from Medicine Department of AFMC and the responsibility should be accountable and ethics of the Hospital should be maintained. Matter discussed and Board noted the same. RMO (Offg.) to initiate further necessary action.
09. PAYMENT OF OPERATION THEATRE CHARGES BY CHEQUE TO SURGEONS & ANESTHETISTS
To consider note dated 09.08.2017 from RMO (offg). informing that the Operation Theatre charges are being collected in the Stores Department of SVP CGH, which is thereafter deposited with the Board for onward payment through cheque / RTGS to the concerned Surgeons & Anesthetists on the basis of monthly surgeries conducted by them.Connected papers are placed on the table. Note : Earlier the operation and anesthesia charges were being collected by the OT staff from the patients and thereafter handed over to the concerned Surgeons / Anesthetists directly. In order to avoid direct cash transaction and ambiguity arising due to this procedure, the above procedure is being adopted. RESOLUTION NO. 9 : Considered. Resolved that the charges being collected from the Operation Theatre be deposited with Cantonment Fund Account. Thereafter necessary payment to the concerned Surgeons / Anesthetists be made through e-payments. RMO (Offg.) and CA to initiate necessary action.
10. CLOSURE OF OT MISCELLANEOUS FUND & INCREASE OF MEDICAL AND NON-MEDICAL IMPREST.
Reference Office Note dated 18th August,2017 from RMO (Offg.).To consider the closure of OT Miscellaneous Fund at SBI and transfer the OT amount to main PCB Account and also increase the Medical Imprest from Rs.10,000/- to Rs.25,000/- and non-medical from Rs.10,000/- to Rs.25,000/- for incurring various day to day expenditure towards maintenance / purchase of equipments /

instruments / requisites / furniture in order to provide efficient services to the patients visiting the Hospital.Connected papers are placed on the table.RESOLUTION NO. 10 : Considered. Resolved to close the OT Miscellaneous Fund Account at SBI and transfer the amount as on date to the Cantonment Fund Account. Further Board discussed regarding the enhancement of Medical as well as Non-Medical imprest amount. Chief Accountant brought to the notice of the Board that since Board is implementing digital payment, it will not be feasible to incur huge expenses such as purchase of medical equipments, repairs etc through cash payment and also the same will lead to audit objection in future and only minor expenses be incurred through the imprest amount. Matter discussed. Resolve to enhance the imprest amount as under :-
Medical Imprest : Rs. 15,000/-
Non-Medical Imprest : Rs. 20,000/-
11. INSTALLATION OF OLD X-RAY MACHINE AT GHORPADI DISPENSARY
Reference Office Note dated 30th August,2017 from RMO (Offg.).To consider the usage of old X-ray machine in Ghorpadi Dispensary so that the patients staying within the vicinity are benefitted and also revenue can be generated.Connected papers are placed on the table.Note : The old X-ray machine was being auctioned at the first attempt the highest offer was Rs.35,000/- and Second attempt was Rs.40,600/-. As per the AERB (Atomic Energy Regulatory Board) norms the agencies / individuals who are bidding must have AERB certifications and none of the previous bidders had the same. At present the cost of depreciation is Rs.1,27,077/- as per the Chartered Accountant . It is unlikely to get the same and hence it is recommended to repair this machine and the same may be installed at Ghorpadi Dispensary as the patients there are being referred to SVPCGH or Shanti Clinic at Sadhu Vaswani Mission for X-ray.RESOLUTION NO. 11 : Considered. CEO explained that since the X-Ray machine is in good condition, the same can be installed in other dispensary for the benefit of the residents of the Cantonment / general public. Matter discussed. Resolved that the existing X-Ray machine be installed at Ghorpadi Dispensary for the benefit of residents / general public.

12. ANNUAL MAINTENANCE CONTRACT IN RESPECT OF ELECTROMEDICAL EQUIPMENTS OF LAB CELL COUNTER (SYSMEX KX21)
To consider the proforma Invoice submitted by M/s. Transasia Biomedicals Ltd. for the Electromedical equipments of Lab Cell Counter (Sysmex KX21), which is an essential equipment used in Laboratory of SVP CGH for an AMC for a period of one year w.e.f. 01.10.2017 to 30.09.2018 amounting to Rs. 33,748/-. M/s. Transasia Biomedicals Ltd is the OEM for the said equipment.

RESOLUTION NO. 12 : Considered. Resolved to approve Annual Maintenance Contract by M/s. Transasia Biomedicals Ltd. for the Electromedical equipments of Lab Cell Counter (Sysmex KX21) at Rs. 33,748/- for a period of one year w.e.f. 1.10.2017 to 30.09.2018. RMO (Offg.) to initiate further action.
13. CONCESSION IN SVP CANTONMENT GENERAL HOSPITAL CHARGES ON RECOMMENDATION OF ELECTED MEMBERS OF THE BOARD Reference CBR No. 20 dated 13.10.2015. To consider the issue regarding rationalizing the concession in hospital charges being given by the Hospital on the basis of recommendation of Elected Members of this Board. In this regard, a Preliminary Slip No. 41 dated 30th August, 2017 has been issue by the Audit Authorities for reviewing to rationalize avoid loss to the Board.Connected papers are placed on the table.Note : The Board vide above referred resolution resolved to grant 50% concession to 10 patients and 100% concession to 5 patients per month including concession in respect of Neonatal ICU (NICU). RESOLUTION NO. 13 : Considered. Matter discussed in detail. All Elected Members demanded to continue the existing norms of exemption to be allowed by them. The RMO and the Chief Accountant informed the Board that during the Test Audit of Cantonment Board, Pune by a team of CAG, a serious objection has been raised as how and under which rule Members can give exemption in payment of medical expenses in SVP CGH. After detailed discussion, the Board resolved that exemption up to Rs. 15,000/- per year to each Member may be continued and for above Rs. 15,000/- sanction of the Competent Authority has to be obtained. The CEO dissented from the decision of the Board, being inconsistent regarding exemption in medical expenses by the

Elected Members and further as per rule, the matter will be referred to the PD DE, SC, Pune for final decision.
14. UNDUE DISPENSING OF MEDICINES TO OUT OF AREA SENIOR CITIZENS THROUGH SVP CGH
To consider note dated 9th September, 2017 from RMO (Offg.) recommending that the practice of dispensing the medicines to out of area senior citizens from the Stores and Special Stock should be abandoned and only free consultation and dispensing of medicines available in the OPD Pharmacy be continued. Connected papers are placed on the table.Note : SVP CGH is dispensing free medicines to senior citizens from the Stores and most of the medicines are very expensive and mostly prescribed by other Hospitals. It is also seen that that several senior citizens patients are out of area and are availing this facility. This is causing undue burden on hospital stores and also exhaustion of essential medicines during unpredicted shortage of medicine periods. Further this is also causing inconvenience to Cantonment area patients. There is an instance in news papers, which has been published in Sakal Times dated 3rd August, 2017 regarding shortage of medicines. RESOLUTION NO. 14 : Considered. RMO (Offg.) explained that several senior citizens are coming out of the area for free medicines and due to this there is unpredicted shortage of medicines being issued through Medical Stores & Special Stock. This issue can be resolved if the medicines are dispensed through OPD Pharmacy as available to the senior citizens of out of Cantonment area. Matter discussed. Resolved that the SVP CGH will only provide free consultation and medicines available in the OPD Pharmacy to the out of area senior citizens. RMO (Offg) to initiate necessary action.
15. INSTALLATION OF PRE-FABRICATED WORKSHOP FOR VOCATIONAL COURSES AT OPEN SPACE INSIDE THE PREMISES OF DR. AMBEDKAR MEMORIAL HIGH SCHOOL : PUNE CANTT.
To consider letter dated 18.08.2017 received from HM, Dr. AMHS regarding installation of pre-fabricated workshop of vocational courses sanctioned under Rashtriya Madhyamik Shiksha Abhiyan (RMSA) at Dr. Ambedkar Memorial High School. Under this Scheme, the Ministry of Human Resources Development and RMSA provides pre-fabricated vocational workshop of size 52’ x 26’ x 16’ (length x width x height), which is one of the mandatory requirement for conduction of vocational courses. The Authorities of MHRD and RMSA selected the open space in the premises of Dr. AMHS for the said workshop. The expenditure towards construction of pre-

fabricated workshop will be borne by the Government of Maharashtra. Connected papers are placed on the table.RESOLUTION NO. 15 : Considered. Resolved to grant permission for installation of pre-fabricated workshop of vocational courses sanctioned under Rashtriya Madhyamik Shiksha Abhiyan (RMSA) at Dr. Ambedkar Memorial High School. HM, Dr. AMHS to initiate further action.
16. ISSUE OF NOTICE UNDER SECTION 248 OF THE CANTONMENTS ACT, 2006 : BUNGALOW NO. 1 SHOLAPUR ROAD : GLR SY. NO. 662 : PUNE CANTT.
To consider issue of notice under Section 248 of the Cantonments Act, 2006 to Owner / occupier of property bearing B No. 1 Sholapur Road in respect of following unauthorized construction for which show cause notice has been issued on 18.08.2017 and also notice under Section 239 (1) dated 19.08.2017 & 239 (2) dated 19.08.2017 of the Cantonments Act, 2006 has been issued.‘Construction of mild steel frame structure measuring 20’0” x 15’0” x 15’ ht. approx. in mild steel angle frame work with BB masonary wall situated towards south-east side of the subject property.’Further the BB masonary work is in progress. The subject site is situated in outside the notified civil area of Pune Cantonment and land is under the management of DEO, Pune Circle, Pune.Connected papers are placed on the table. RESOLUTION NO. 16 : Considered. Resolved to issue notice under Section 248 of the Cantonments Act, 2006 giving 30 days of time, failing which further notice under Section 320 of the Cantonments Act, 2006 be issued by giving 10 days time.
17. ISSUE OF NOTICE UNDER SECTION 248 OF THE CANTONMENTS ACT, 2006 : SY. NO. 75-B GHORPURI VILLAGE : PUNE CANTT.
To consider issue of notice under Section 248 of the Cantonments Act, 2006 to occupier of property bearing Sy. No. 75-B Ghorpuri Village in respect of following unauthorized construction for which show cause notice has been issued on 13.07.2017 and also notice under Section 239 (1) dated 13.07.2017 & 239 (2) dated 18.07.2017 of the Cantonments Act, 2006 has been issued.‘Construction of partly ground floor measuring 12’ x 21’ x 9’6” ht. approx. and first floor measuring 12’ x 21’ x 9’6” ht. approx. in RCC

frame structure and BB masonary walls towards south-west side of the subject property.’Further work is in progress. The subject site is situated in outside the notified civil area of Pune Cantonment and land is under the management of Collector, Pune.Connected papers are placed on the table. 18. ISSUE OF NOTICE UNDER SECTION 248 OF THE CANTONMENT ACT 2006 : HOUSE NO. 95 WANOWRIE BAZAR : PUNE CANTT.
To consider the issue of notice under section 248 of the Cantonments Act 2006 to Smt. Fatimabee Babu Shaikh and others, HORs of the property bearing H.No. 95 Wanowrie bazar for having carried out following unauthorized construction for which show cause notice dated 31/07/2017 and notice under section 239(1) of CA 2006 dated 31/07/2017 have been issued.“Construction of Ground+2 structure measuring 15’2”x22’3”x 9’6” ht approx and slab projections measuring 15’2”x3’6” on First, Second and Terrace floor level built in MS angle and ‘T’ framework enclosed by BB masonry walls towards east side of the subject property.”Work is in progress. The subject property is held on Old Grant terms situated in bazar notified area in Wanowrie bazar under the management of Pune Cantonment board.Connected papers are placed on table.RESOLUTION NO. 18 : Considered. To consider the issue of notice under section 248 of the Cantonments Act 2006 to Mr. Shrawan Tukaram Kamble and Others, HORs of the property and Mr. Sunil Shrawan Kamble, occupant of property bearing H.No. 100 Wanowrie bazar for having carried out following unauthorized construction for which show cause notice

dated 31/07/2017 and notice under section 239(1) of CA 2006 dated 31/07/2017 have been issued.“Construction of part of Ground floor measuring (14’2”x13’0”)+(5’2”x2’7”) x 9’6” ht approx, first floor measuring 14’2”x15’7”x9’6”(ht) approx and Second floor measuring 10’2”x15’7”x9’6”(ht) approx in RCC framed structure with BB masonry walls towards mid south side of the subject property”
Work is in progress. The subject property is held on Old Grant terms situated in bazar notified area in Wanowrie bazar under the management of Pune Cantonment board.Connected papers are placed on table.RESOLUTION NO. 19 : Considered. 20. BUILDING PLAN : HOUSE NO. 154 GHORPURI VILLAGE : PUNE CANTT.
To consider building application dated 23.03.2017 received from Shri. Kishore Kisan Kadam & Ors., owners of H. No. 154 Ghorpuri Village requesting to sanction the building plan for proposed construction of building consisting ground floor for parking, first floor for residential purpose with balcony for residential purpose as shown on the plan and also submitted following document supporting the above proposal viz. Regd. Sale Deed, tax paid receipt, Parking Affidavit, Debris undertaking, Affidavit for demolition of existing unauthorized construction & Photographs of the existing structure. The Area / FSI Statement :-i. Area as per Sale Deed 1221.08 sq.ft.ii. Area of plot as per site condition 1221.08 sq.ftiii. Existing built up area to be demolished 354.90 sq.ft.iv. Existing built up area to be retained 500.00 sq.ft.v. Proposed built up area 662.82 Sq.ftvi. Proposed built up area and retained area 1162.82 sq.ft.vii. FSI Allowable 1.0viii. FSI Consumed 0.95
As per the report of the Engineering Department, the building plans are in accordance with the Building Bye laws and FSI restrictions & there is no objection from municipal point of view. The site bearing

H. No. 154, Ghorpuri Village is outside the notified civil area and is private land under the management of Collector, Pune. It is submitted that as per the opinion of CBLA, conditions may be incorporated in the sanction letter that party will demolish the unauthorized construction before starting construction. Ramesh Kisan Marathe, one of the co-owner had taken the sanction of partly building plan vide CBR No. 2 dated 29.04.1999 for his possession area as per Sale Deed. RESOLUTION NO. 20 : Considered. Resolved to approve the building plan under Section 238 of The Cantonments Act, 2006. The sanctioned building plans should be absolute in every particular. The building must be completed within 12 calendar months from the date of commencement of work. The sanctioned plans are valid for a period of two years as envisaged in Section 243 of The Cantonments Act, 2006. The date of commencement of construction should be intimated by the Applicant to the Cantonment Board Office as per the provisions of bye-laws. Notice of completion is to be given to the Board as required under Section 82 of the Cantonments Act, 2006.

Note : It is submitted that the local near Central Bank on MG Road is a very busy place, if NOC permitted by the Board for the said location, it would create traffic congestion.
Earlier, the Board vide CBR No. 27 dated 29.03.2017 had resolved to suggest alternative locations for erection of stainless steel bus shed for Sr. No. 2 above by the PMPML Authorities. A letter in this regard was also forwarded to the PMPML Authorities on 17.04.2017.
RESOLUTION NO. 21 : Considered. Matter discussed. Shri. Vivek M Yadav, Elected Member stated that the PMPML Authorities be informed that the permission will be granted subject to the condition that the advertisement rights on these bus sheds will lie with the Board. This can be a source for revenue generation to the Board. Matter discussed. Resolved that permission be granted to the PMPML Authorities for erection of stainless steel Bus Shed at the sites as shown at Sr. No. 1, 2, 3, 5 & 6 subject to concurrence of Army Authorities i.e. Station Headquarter in respect to Sr. No. 1,2 & 3 being erected on A-1 defence land.
As regards to Sr. No. 4, all the Elected Members of the Board brought to the notice that the site on MG Road near Central bank is congested and hence permission may not be granted. Board noted and approved the same. CEE to initiate further action.
22. ALLOTMENT OF ADDITIONAL SPACE IN THE EXISTING CANTONMENT COURT BUILDING TO JMFC COURT : PUNE CANTT.
Reference CBR No. 13 dated 15.07.2017.To note the structural audit report of the subject property submitted by M/s. Shantal Consulting Engineers, a consultant appointed by the Board. Connected papers are placed on the table.Note : A meeting chaired by Justice A S Oak & Justice A S Karnik, Hon’ble High Court, Mumbai was held on 03.06.2017 which was

attended by the CEO and technical staff of this Board. Further, this office vide letter dated 17th April, 2017 informed the Principal District Judge and Session Judge that due to the old age of the building i.e. above 100 years, the present condition of the building is ruinous, the floor, walls and wooden roof are in dilapidated condition and minor repairs will not serve the purpose. Further the Board vide CBR No.13 dated 15.07.2017 had considered the matter. CEO explained that the Court Authorities has already been informed that the existing building at 35 MG Road is beyond use and beyond economical repairs. On this the President Cantonment Board enquired with the Engineering Department whether it will be feasible to allot the addition space considering the old age of the building. AEE (Civil) stated that the existing building is in a dilapidated condition and hence considering the condition of the building, the additional space cannot be allotted. CEO further stated that a joint discussion was held with the Court Authorities, wherein they informed that efforts are being taken for allotment of alternative space by the Collector, Pune at Empress Garden. Therefore their request for allotment of additional space can be considered on conditional basis. Further the Vice President supported by all the Elected members suggested that since the existing building is in a ruinous condition, a joint inspection be carried out alongwith the Court Authorities & technical staff of the Board and thereafter, the matter be referred to the Board for taking amicable decision in this matter. Accordingly a letter dated 19.07.2017 was forwarded to the District & Session Judge for deputation of competent officials for joint inspection. Accordingly, a joint inspection was carried out on 27.07.2017 by a committee comprising of the Consultant of the Board, Asstt. Engineer – Grade I, PWD, Pune (on behalf of the Court Authorities) and technical staff of the Board wherein it is recommended that the structural audit be carried out. Accordingly structural audit of the said building has been carried out and the conclusion is as under :-i. The building structure at 35 MG Road, Pune Cannt. Presently
occupied by JMFC, Pune needs removal and / or major repair deteriorated components of dilapidated masonary structure in whole or part, otherwise the safety to the structure shall be hindered.
ii. Issues that promote moisture movement, should be addressed immediately.
iii. The building structure is of load bearing type and considering its present structural condition and location in seismic zone No. 3, it can be said that even during significant earthquake loads, this structure is likely to exhibit brittle fatal failure.
RESOLUTION NO. 22 : Considered. Mater discussed in length. The Board examined a discussed on the report of the structural audit as also mentioned on the agenda side. Considering the Structural

Audit, the Board is of the view that the building / room requested by the Court Authority is not in a condition to be used by a human being. The CEO informed the Board that during the meeting held in the office of the Principal District Judge, Pune and Chaired by the Hon’ble Justice, Mumbai High Court, CEO has assured the Hon’ble justice to provide the subject room after approval of the Board. After detailed discussion, the Board resolved to forward the Structural Audit Report to the Court Authorities in order to decide whether it is safe for the Court Authorities to use the building. After receipt of response from the Court Authorities on the Structural Audit Report submitted and if they find it fit to use the room / building on their risk and cost, they may use it on the following terms and conditions :- i. They will give undertaking that for any mishappening due to
un-usable / ruinous condition of the building, the Court Authorities will be responsible for any untoward incident and not the Cantonment Board.
ii. The Cantonment Board will not incur any expenditure for the repairing / maintenance of the said room / building because as per Structural Audit Report, any expenditure to be incurred in repairing of the building may invite audit objection, as during the first audit by the team of CAG, many objections has been raised against the expenditure on repairing.
iii. If the above terms and conditions are agreed to, they may use the subject room maximum for a period of two years.
The decision of the Board may be informed to the Court Authorities and after receipt of the same further necessary action will be initiated.
23. APPROVAL FOR CIVIL CONSTRUCTION MATERIAL TESTING LABORATORY : M/S. I R SOLUTIONS: PUNE CANTT.
To consider the proposal dated 25.05.2017 received in this office on 19.08.2017 from M/s. I R Solutions for approval of the firm for carrying out various civil construction material testing. The said lab has been granted accreditation from National Accreditation Board for Testing and Callibration Laboratories vide letter dated 02.08.2017. It is further submitted that the said firm has also been approved by the Pune Municipal Corporation for carrying out various civil construction material tests.

Note : The Board has executed Contract Agreement with CEIL for Third Party Inspection wherein there are three Laboratories authorized viz. CSRL, Durocrat & College of Engineering, Pune for carrying out various civil construction material tests. These laboratories are overburdened due to testing of various construction

materials from government, semi-government, private departments / agencies from Pune as well as adjoining areas. The charges for material testing shall be borne by the concerned contractor.

24. RENEWAL OF CONTRACT AGREEMENT : CERTIFICATION ENGINEERS INTERNATIONAL LTD (CEIL) FOR THIRD PARTY INSPECTION OF VARIOUS WORKS IN PUNE CANTONMENT
To consider letter dated 05.09.2017 received from Shri. S P Singh, Marketing Head, CEIL, Mumbai requesting this office to renew the contract agreement executed between Pune Cantonment Board for carrying out third party inspection of various works in Pune Cantonment for further period of one year w.e.f. 1st October, 2017 as per the existing terms and conditions. The existing contract is expiring on 30th September, 2017.

Note : The Board vide CBR No. 37 dated 29.04.2016 had resolved that the services of CEIL should be continued in all the tenders of various department for the year 2016-17. It is submitted that Test Audit was carried out by the office of Principal Director of Audit, Defence Services upto 2nd September, 2017. During the Test Audit Preliminary Slips were issued to all the Departments of the Board on various issues depicted during their Audit. Amongst the various preliminary Slips, PS No. 15 was issued with regard to engagement of CEIL for carrying out third party inspection without calling tenders. The PS have been duly replied by this office vide letter dated 14th August, 2017.
Further during the concluding conference held by the Audit Department on 1st & 2nd September, 2017 between the undersigned, sectional heads of the Board and Senior Audit Officers of Audit Department, with reference to the subject PS, they have not settled the observations stating that the justification submitted by this office for engagement of TPI without resorting competitive tendering process will be awaited in Audit. This office during the discussion stated that after the expiry period of CEIL, tenders will be invited by the Board for the subject work.
RESOLUTION NO. 24 : Considered. CEO brought to the notice of the Board that observations has been raised by the Audit Authorities regarding engagement of CEIL for carrying out third party inspection without calling tenders. CEO also brought to the notice of the Board that orders have been received from Higher Authorities for engagement of third party agency for inspection of various works. CEO further informed that as per the discussion held with the Audit Authorities during the conference it is suggested that it would be not feasible to carry out the third party inspection for Central Store and the Garden Dept and the same may be discontinued. Board noted the same. Matter discussed. Resolved to invite e-tenders for engagement of Third party agency for inspection of various works being carried out by the Board. Further resolved that extension be

granted to CEIL w.e.f. 1.10.2017 on the same terms and conditions of the contract till the finalization of the e-tender, whichever is earlier. Further resolved that the services of the CEIL for third party inspection for Central store and the Garden Dept be discontinued with immediate effect.
25. PERMISSION FOR LAYING OF OFC CABLE ON VARIOUS ROADS IN PUNE CANTONMENT

To consider letter bearing No. Defence/Mission mode/Project/ NFS/ 2862 dated 24.07.2017 received from the Southern Command, Signal Regiment requesting this office to grant permission for laying of OFC on various roads in Pune Cantonment to the length of 21.53 km. Connected papers are placed on the table.Note : In this regard, it is informed that a policy has been circulated for provisionizing of PNG infrastructure to OTM and Married Accommodation project to create Piped Natural Gas (PNG) pipeline infrastructure in all residential areas and unit lines of Defence vide Govt. of India, Ministry of Defence letter bearing No. B/87898/PNG/Lands/2016/95/SO(II)/D/Lands dated 1.03.2017. The said policy letter contains the procedure for mode of application and authority for execution of agreement for different categories of class of land, which are reproduced as under :-i. In areas where both Class A-1 and other class of defence land
is involved in Cantonment for laying of PNG infrastructure, the applicants / PNG company will have to apply to CEO, Cantt. Board. However, the Cantonment Board will have to obtain NOC from Station Headquarters for laying of PNG line on A-1 Defence land before the application is processed for sanction.
ii. The Licence Agreement will be signed by the Cantonment Board as per the provisions in the Cantonments Act, 2006.
iii. The Principal Director, Defence Estates / Command will be the sanctioning authority for grant of licence for use of Defence land for laying of PNG infrastructure / pipe line.
iv. The permission to use defence land to Government own PNG Companies for laying of underground pipe lines will be accorded at an licence fee @ Rs. 1/- per rmt.
v. The PNG Company will make a Security Deposit @ 5% of the cost of defence land (Class A-1 & Analogus to A-1) involved with the DEO. For other than A-1, the Security Deposit @ 5% will be paid to CEO, Cantonment Board. This deposit will be refunded on completion of the work after adjusting the cost of

rectifying any damages and rececouping any losses / claims etc.
vi. The initial period of the licence of defence land for PNG infrastructure / pipeline will be of 10 years. The licence can be renewed on expiry of initial licence period for a further period of 10 years at the option of the Lessee.
It is further submitted that the proposal received from Maharashtra Natural Gas Limited was forwarded to the Station Cell, HQ, DMSA for obtaining NOC vide this office letter dated 12.06.2017. Accordingly, the permission has been received from Station Cell HQ DMSA vide their letting bearing No. 1006/12/Gen/Q3(MNGL) dated 03.08.2017. The licence fee and security deposit to be paid by the MNGL is Rs. 34,150/- per rmt per annum and Rs. 2,40,08,400/- respectively.RESOLUTION NO. 26 : Considered. CEE informed the Board regarding the policy circulated vide Govt. of India, Ministry of Defence letter bearing No.B/87898/PNG/Lands/2016/95/SO(II)/D/Lands dated 1.03.2017 for provisionizing of PNG infrastructure to OTM and Married Accommodation project to create Piped Natural Gas (PNG) pipeline infrastructure in all residential areas and unit lines of Defence. Matter discussed. After detailed deliberations and discussions resolved to recommend the proposal submitted by Maharashtra Natural Gas Limited for laying of gas piped line in Pune Cantonment and Pune Military Station Area on various roads classified as Class A-1, B-2, B-4 & C lands. Further resolved that a detailed proposal be forwarded to the Competent Authority (PD DE, SC, Pune) for obtaining necessary sanction. CEE to initiate further action as per the terms and conditions depicted in the policy letter.

29. CONSTRUCTION OF MULTILEVEL CAR PARKING AT THE SITE ON LLOYD ROAD BETWEEN DR. COYAJI ROAD & STAVELY ROAD : PUNE CANTT.
Reference CBR No. 16 dated 29.05.2017. To consider letter dated 01.09.2017 received from M/s. Effective Architectural Services, Consultant for the said project appointment by the Board, informing that the alternative site instead of Opposite to Mangal Vihar Hotel on GT Road, the proposed feasible site would be on Lloyd Road between Dr. Coyaji Road and Stavely Road for the construction of multilevel car parking system. It has been further informed that the same design and drawings can be used for the proposed alternative site without any modifications. Connected papers are placed on the table.Note : A proposal dated 16.02.2017 for the proposed construction of multilevel car parking building on GT road opposite Hotel Mangal Vihar was forwarded to the Directorate, Defence Estates for obtaining necessary sanction of the Central Government for release of funds under their Budget Head for Grant-in-Aid for creation of Capital Assets amounting to Rs. 26,45, 58,147/-. Further, a letter bearing No. PCB/2017/GEN dated 13.04.2017 was received from Headquarters, Dakshin Maharashtra Sub Area wherein the proposed site shown for multi level parking is squarely opposite to the main entrance of Officer Mess of Headquarters, Southern Command, Pune, which is a very important and prominent institute of the Army, as it is very frequently visited by both Indian &

Foreign, Civil & Military dignatories. Also it is just 100 mtr. away from the aforesaid Officers Mess parking, here will create constant disturbance & pollution. Therefore it is imperative that alternate site for the same is selected. Further a letter dated 27.04.2017 has been received from the Directorate, Defence Estates, SC, Pune wherein it has been stated that the subject proposal has been partly examined and observed that the proposed site is opposite to Southern Command Officers Mess, hence the LMA may have objection to this project of ten floor and therefore requested to confirm that the project is agreeable to them and intimate the same to the Directorate before further scrutiny. Thereafter the matter was referred to the Board and the Board vide above referred resolution dated 29.05.2017 resolved that the matter may be placed before the Board after selection of alternative site in consultation with the Consultant. Accordingly a survey has been carried out jointly by the technical staff and the technical team of the Consultant and has proposed the said site. The proposed site is classified as Class C land under the management of the Board. RESOLUTION NO. 29 : Considered. Matter discussed. Resolved to approve the alternative site on Lloyd Road between Dr. Coyaji Road and Stavely Road for the proposed construction of Multi Level Car Parking building as per the approved estimates and drawings amounting to Rs. 26,45,58,147/-. Further resolved that necessary proposal be forwarded to the Competent Authority i.e. DGDE / MoD for obtaining necessary sanction out of Capital Asset Head.
30. DEVELOPMENT OF LAWN AND OTHER ASSETS AT GLR SY. NO. 544, DHOBI GHAT : PUNE CANTT.
To consider the issue of developing a lawn and other assets at the vacant land at GLR Sy. No. 544, Pune Cantt. which is classified as Class C land under the management of this Board. Connected papers are placed on the table.Note : Recently an encroachment drive was carried out at the site of GLR Sy. No. 544 jointly by the Engineering, Revenue and Health Department of the Board on 11.08.2017, wherein the unauthorized elements were removed. In order to safeguard the defence land from the encroacher, it is necessary to use the land for municipal purpose by developing a lawn and other assets by the Board, which can be used by renting the said lawn for marriage / any other functions in order to generate adequate revenue for the Board. RESOLUTION NO. 30 : Considered. CEO informed the Board that on 11th August, 2017 a major drive was carried out and many ongoing encroachments were demolished. There is still acute apprehension of further encroachment, as this piece of Class C land

costing approx. Rs. 2.70 crores is located on the main Shankarsheth Road. Further CEO pointed out that it is urgently required to put such costly land on civil use to protect it from encroachment. The Board felt that the vacant land can be developed into a open lawn by constructing a tin shed and a fencing / boundary wall to protect the said land from encroachment. The said lawn can be rented for marriage purpose. Shri. Atul V Gaikwad, Vice President stated that the Dhobis are using the area for drying the clothes. The same should be taken into consideration while developing the lawn. The Board noted the same. After detailed discussions and deliberations resolved to develop a lawn at the vacant site bearing GLR Sy. No. 544, Dhobi Ghat which is classified as Class C land. Also resolved to construct a fencing / boundary wall to protect the Government land from encroachment. The said work be undertaken through the existing contract approved by the Board for the year 2017-18. CEE and GO to initiate necessary action. CEO is authorized to issue the necessary work order and incur necessary expenditure.
31. APPOINTMENT OF CONSULTANT FOR CONVERTING THE EXISTING J J GARDEN INTO A MODERN PARK AT GLR SY. NO. 390/289 : PUNE CANTT.

Note : An advertisement was published in the local newspaper viz. Indian Express clubbed Loksatta on 18.07.2017 inviting expression of interest for appointment of Consultant for converting the existing J J Garden into a modern park at GLR Sy. No. 390/289. Accordingly advertisement was published in the local newspaper dated 20.07.2017. In response to the said advertisement, the aforesaid Three firms / companies have submitted their proposals alongwith professional fees for preparation of DPR. The financial bids of the three firms were opened on 07.08.2017.The Board vide above referred resolution dated 15.07.2017 had considered the matter and resolved to re-invite the subject quotation, since the rates quoted are on the higher side. Accordingly the tender was re-invited. In the first call the lowest received was Rs. 4,95,000/- excluding service tax. RESOLUTION NO. 31 : Considered. Resolved to approve the lowest rate quoted by Space Designers @ Rs. 3,3,6,000/- (inclusive of all taxes) for appointment of consultant for converting the existing J J Garden into a modern park at GLR Sy. No. 390/289. Necessary contract agreement be executed. CEO is authorized to issue the necessary work order and incur necessary expenditure.
32. EXTENSION IN TIME LIMIT : PERMISSION FOR LAYING 2200 MM CAST IRON WATER PIPE LINE FROM DHOBI GHAT TO CANTONMENT WATER WORKS ON SHOLAPUR ROAD : PUNE CANTT.
Reference CBR No. 66 dated 29.02.2016, Circular Agenda dated 08.07.2016, CBR No. 31 dated 22.10.2016, CBR No. 24 dated 25.01.2017, CBR No. 19 dated 29.05.2017 & CBR No. 51 dated 15.07.2017 To consider the letter bearing No. OW 475 dated 06.07.2017 received from the Executive Engineer, Cantonment Water Works, PMC requesting to grant extension in time limit upto 31st March, 2018, 2017 (i.e. for a period of Nine months) for completion of the subject work. It has been further mentioned that due to technical difficulties viz. shifting of existing service, traffic density and also due to non-closure of full traffic from Golibar Maidan to Mahmadevi Chowk by the Police Authorities, the work could not be completed. Accordingly, the decision of the Board was

communicated to the PMC Authorities vide this office letter dated 03.11.2016. Further the Board vide CBR No. 24 dated 25.01.2017 resolved to grant extension in time limit for a period of 04 (four months) w.e.f. 16.01.2017 to the PMC Authorities for laying of 2200 mm cast iron water pipe line from Dhobi Ghat to Cantonment Water Works on Sholapur Road. Accordingly, the decision of the Board was communicated to the PMC Authorities vide letter dated 09.02.2017. Further, the Board vide CBR No. 19 dated 29.05.2017 resolved to grant extension to the PMC Authorities for a period upto 30th June, 2017 (i.e. for a period of One month) for completion of the subject work. Accordingly, the decision of the Board was communicated to the PMC Authorities vide letter dated 01.06.2017. The PMC Authorities has now submitted the revised layout for laying of water pipelines from the ground of St. Mary’s Church to the length of 70 mtr. due to the various technical reasons. The PMC Authorities have further stated that the permission has been taken from the Church Authorities for the same. The said land is placed under the management of DEO, Pune Circle, Pune. The Board vide CBR No. 51 dated 15.07.2017 had resolved that a joint meeting be held with the PMC officials in the office of the President alongwith Vice President and all Elected Members & technical staff of Engineering Department to resolve the various issues. Accordingly a meeting was convened at the office of the Municipal Commissioner, PMC on 23.08.2017 wherein various issues was discussed. RESOLUTION NO. 32 : Considered. CEO brought to the notice of the Board that no action has been intimated by the PMC Authorities regarding the permission for joining the proposed drainage line of Ghorpuri Village, Bazar, Fatimanagar and Wanowrie Tannery area, as discussed during the joint meeting held in the office of the Municipal Commissioner, PMC on 23.08.2017. AEE (Civil) informed that a reminder will be forwarded to the PMC Authorities regarding the same. The Elected Members unanimously stated that NOC may not be granted since no concrete action has been intimated by the PMC Authorities. Further they suggested that a joint meeting be held in the Board with the PMC Authorities for detailed discussion on the various issues. Matter discussed. Resolved to conduct a joint meeting with the PMC Authorities in the Board for an amicable solution to the various issues and thereafter the issue regarding the granting of extension in time limit to complete the subject work will be considered by the Board.
33. PERMISSION FOR ROAD CUTTING FOR LAYING 500 MM DIA DIK-7 WATER PIPE LINE ON ROSS ROAD : GLR SY. NO. 491: PUNE CANTT.

Engineer, Cantonment Water Works, PMC, Pune requesting to this office to waive of the road cutting and rent charges payment payable as per the current STR amounting to Rs. 54,72,000/- and Rs. 13,68,000/- respectively. It is further stated that the PMC is not a commercial institute but it is the local body to supply water, which is a basic necessity for common citizen. To consider application dated 09.09.2015 received from Shri. Shaikh Moin Ismail and Mrs. Fatima alias Sana Moin Shaikh requesting for transfer of occupancy rights by way of Sale in respect of property bearing No. 1910 & 1910-A Blundell Road. The purchasers have executed and registered the Sale Deed without obtaining NOC from the Board.

Note : The property bearing House No. 1910 and 1910-A Blundell Road, GLR Sy. No. 390/1099 situated within the notified civil area of Pune Cantonment is class B-3 land held on old grant terms. As per site inspection of technical staff there is no encroachment on Government land, sub-division of site and unauthorized construction involved in the subject property. However, there is change of purpose involved in the subject property as the present usage of property is for residential cum commercial purpose. The purchasers have submitted a copy of building plan sanctioned vide CBR No. 4 (22 CAC) dated 25-07-1950 indicating shop in the subject property. The issue has also been examined by CBLA who has advised to refer the matter to PD DE for advice. The PD DE vide letter No. 3044/3/PC/DE dated 25.05.2015 has advised that, if the seller has to take NOC from the Board before effecting Sale / transfer and if no. such permission was taken, and if a report on such transaction is received, the same be considered by the Board only who have empowered under Section 67 (c) of the Cantonments Act 2006, to charge processing fee for maintenance of property record for entering / recording the names of purchasers in the GLR. The matter was discussed in Board meeting held on 29.02.2016 considered and resolved to pend the matter for detailed discussions in the next meeting.
RESOLUTION NO. 37 : Considered. The Board noted that there is a change of purpose involved in the said property as the property is used for residential cum commercial purpose. CBLA explained that it is revealed from the record there is old building plan sanctioned by

the Board vide CBR No. 4 (22 CAC) dated 25.07.1950 wherein shop has been shown on the ground floor of the subject property. Prior to the policy letter dated 16.11.1962, the Board was empowered to sanction the change of purpose, hence the mutation can be considered on the basis of Sale Deed dated 26.12.2012. However, the Sale Deed has been executed without obtaining NOC hence processing fees may be charged as per Section 67 of the CA, 2006 and CBR No. 1 (4 CAC dated 09.12.2015) dated 29.12.2015. Further it was brought to the notice of the Board that the Sale deed has been executed on 26.12.2012 and proposal is received on 05.05.2014, hence late fee under Section 81 (6) of CA, 2006 @ Rs. 10,000/- be collected from the applicant. After detailed deliberations and discussions resolved that CBLA may verify the details and be put up in the ensuing Board.
38. PERMISSION TO TRANSFER LEASEHOLD RIGHTS BY WAY OF GIFT DEED IN RESPECT OF HOUSE NO. 1447, BHIMPURA, GLR SY. NO. 390 / 2064 : PUNE CANTONMENT.

Note : The property bearing House No. 601 Sachapir Street, GLR Sy. No. 390/905 is Class B-3 land and held on Old Grant Terms. As per GLR maintained by this office the property stands in the name Mrs. Domitella Saldhana – Administrator of the property of Dr. F. F. Saldhana

Mrs. Domitella Saldhana expired on 12.11.1985 leaving behind three legal heirs viz. Mr. Joe Saldhana (son), Mrs. Mildred Saldhana (daughter), Mrs. May Saldhana (daughter).
However, the property was not transferred in the names of above mentioned legal heirs, since nobody applied for recording their names in the GLR as legal heirs of Late Domitella Saldhana.
Mr. Joe Saldhana made a Will dated 22.02.1985 and bequeathed the property on the name of Mr. Micheal Stephen Kedari for which a Probate was granted by Civil Court in Misc. Application No. 405/98 on 15-02-2000.
It is noticed that the Schedule of the property mentioned in the Probate also includes land, whereas a per GLR land beneath the structure belongs to and owned by the Central Government. Therefore, this office vide letter dated 18-08-2000 asked Mr. Michael Kedari to amend the Probate Order.
Advocate namely Mr. Joaquim F. Reis vide his letter dated 10.11.1997 raised an objection on behalf of his clients Miss. Mildred Saldhana& Miss. May Saldhana. The matter was referred to Advocate Shri. M. P. Bendre for his legal opinion who opined vide letter dated 21.03.2001 that there is no objection to record the name of Mr. Micheal Stephen Kedari for 1/3rd Share in the property after issuing a letter to Advocate Mr. Joaquim F. Reis. However, Mr. J. F. Reis, Advocate vide letter dated 17.04.2001, stated that, his clients namely Mrs. Mildred Saldhana and Mrs. May Saldhana are entitled for 2/3 share in the property and Mr. Micheal Stephen Kedari should get 1/3rd share in the property though it has mentioned in the Will of Joe Saldhana bequeathed the entire property in the name of Mr. Micheal Stephen Kedari.
This office issued a letter dated 07th August, 2001 seeking the opinion from Shri M.P. Bendre Advocate as to (i) whether Public Notice is required to be published for transferring 1/3rd share in the property on the name of Mr. Micheal Stephen Kedari. (ii) whether pending documents/information from Mr. Joquim Reis, Advocate regarding Death Certificate and Affidavit from his client the 1/3rd undivided share can be transferred on the name of Mr. Micheal Stephen Kedari.
Shri M P Bendre, Advocate opined that -
The Probate has already been granted in respect of a Will of Joe Saldhana by the Civil Court, Pune. It is granted in the name of Mr. Micheal Stephen Kedari. Probate is nothing but a proof of a Will. Probate is issued only after following a lot of procedure and Probate citation, Public Notices, etc The Board can act on the basis of

Probate and enter the name of Mr. Micheal Stephen Kedari in respect of 1/3rd share in the property in GLR. It is a Policy of the Board to issue Public Notice before the name of any person shall be entered in the GLR. Nothing prohibits the Board from following the policies laid down by the Board. Shri. M.P. Bendre, Advocate vide his letter dated 31-08-2001 further opined that, it is open to the Board to enter the name of Mr. Micheal Stephen Kedari in GLR before getting documents and information from Mr. Joquim Reis, Adv regarding death certificate and Affidavit from his client. On receipt of the opinion, a Public Notice was issued by this office on 09.10.2001 for transfer of 1/3rd undivided share in respect of House No. 601, Sachapir Street of late Joseph Saldhana on the name of Mr. Michael Stephen Kedari.
In the meantime Mr. Michael S. Kedari filed CS 488/02 against Pune Cantonment Board which was decreed by the Civil Judge Jr. Div. Pune vide Order dated 28.08.2003. The court has declared that the plaintiff Mr. Kedari as owner of the suit property by virtue of the Probated Will and the Court directed the Board to enter the name of Plaintiff Mr. Michel S. Kedari, in the GLR of the suit property.
Thereafter, Pune Cantonment Board filed an Appeal 762/2003 in the District Court against the said Judgment and Order. Hon’ble District Court vide its Order dated 29.07.2005 dismissed the Appeal and directed the Cantonment Board to enter the name of Plaintiff Mr. Michael S. Kederi in the GLR of subject property. Thereafter, this office has not filed appeal against the Order of Hon’able District Court.
Mr. Michael Kedari filed Darkhast No. 47/2013 for execution of order in Appeal No. 762/2003. The Court has directed the Cantonment Board to act according to Order of District Court in Civil Appl. No. 762/2003 failure on which will be viewed seriously and applicant i.e. Mr. Micheal Stephen Kedari will be at liberty to take further course of action under O.XXI of Civil Procedure Court.
It is submitted that, in the mean time Mr. Micheal Stephen Kedari has submitted an Affidavit duly noted and registered at Sr. No. 589/E dated 05.09.2005 in which he has confirmed that he has no objection to record the names of Mrs. Mildred Saldhana and Mrs. May Saldhana who are the legal heirs of late F. F. Saldhana alongwith his name in the GLR of the suit property. Thereafter, this office has issued a Public Notice dated 17.11.2005 inviting any claim/objection /interest for transfer of property in the names of Mr. Micheal Stephen Kedari, Mrs. May Monterio and Mrs. Mildred Irene D’Souza. It is stated that the said Public Notice was not published by the concerned in the local news papers. Mr. Micheal Stephen Kedari submitted another Affidavit duly noted and registered at Sr. No. 1209/06 dated 27.04.2006 confirming his statement to enter

other two legal heirs names along with his name in the GLR of the suit property. Further, Mr. Micheal Stephen Kedari has also submitted an Affidavit duly noted and registered at Sr. No. 443/13 dated 05.09.2013 in which he has stated that as per the Order passed by the Hobn’able Civil Judge, Sr. Judge, Pune and District Judge, Pune that Mrs. May MonterioD’souza and Mrs. Mildred Irene D’souza daughters of Dr. Saldhana have no right title and interest hence he withdraw the earlier Affidavit dated 27.04.2006 and filing the present Affidavit for recording his name in the GLR.
There are various unauthorized constructions carried out by the HOR /Tenant /Occupier in the subject property for which following notices were issued from time to time under various Sections of Cantonments Act 1924 and Cantonments Act 2006 and directing them to stop / remove the same :-

It is submitted that, the matter was referred to M/s Mulla & Mulla seeking their opinion for mutation of property giving facts that there are number of unauthorized construction involved in the property for which Board has issued demolition Notices and Appeal under Section 340 of the Cantonments Act 2006 are pending before the Appellate Authority. It has also been informed to M/s Mulla & Mulla that the Board vide Resolution No. 22 dated 24.09.2013 resolved to take an Undertaking /Affidavit for removal of unauthorized construction to stop commercial use of the property within a period of one month. Further, it has also been resolved that if the applicant fails to comply with the above conditions, then the Board is at liberty to take appropriate proceeding with Competent Authority for resumption of the property for public purpose on account of violation of terms and conditions of the Old Grant tenure and to protect the interest of Government of India, Ministry of Defence. Accordingly, the party was informed vide this office letter No.LS/601 Sachapir Street/13-14 dated 15.10.2013. Mr. MichailKedari has filed Indemnity Bond dated. 12.08.2013 wherein Mr. Michael Kedari undertaken to remove illegal and unauthorized construction which is carried out by tenants / occupiers at his own cost.

It is submitted that the office vide letter dt. 20.03.2015 asked opinion of M/s Mulla & Mulla whether the Board can challenge the order of District Court dated 29.07.2005 in Civil Appeal No. 762/2003. M/s Mulla & Mulla vide their letter No. DJK/SBJ/SG/7471 dated 27.05.2015 have now opined that, if Cantonment Board files Writ Petition against the Order in CA-762/2003, the High Court may not entertain the same on account of delay and latches and also failing of the Board to comply with Court Order and it has advised that the Cantonment Board should comply with the direction of the Court and transfer the property in the name of Mr. Micheal Stephen Kedari. The Board cannot impose an condition before the property is transferred in the name of Mr. Micheal Stephen Kedari and insist to submit Affidavit /Undertaking for removal of unauthorized construction and stoppage of change of purpose. However, transfer of property on the name of Shri. Micheal S. Kedari will not prevent the Cantonment Board from initiating and continuing action against Shri. Micheal Kedari.
All above facts were informed to the PD, DE, SC vide letter dated 08.09.2015 seeking their concurrence for resumption of the property in the interest of Govt. and the land should be used for public purpose.
The PD, DE, .SC vide their letter dated 23.09.2015 asked to obtain opinion from Cantonment Legal Adviser whether contents of Admission Deed supersedes court order as regards to ownership rights of the land.
The office has again sought opinion from Panel Advocate Shri M P Bendre. Advocate vide letter dated 30.11.2016. Shri. M. P. Bendre in his opinion dated 13.01.2017 pointed out that the relevant order has been modified by the District court and the decree has been substituted as follows-
(i) the suit is decreed with costs(ii) the defendant the Pune Cantonment Board is directed to give
effect to the Probated Will and enter the name of Plaintiff Mr. Michel S. Kedari, in General Land Register in respect of the suit property described in para 1 of the Plaint.
Advocate Mr. Bendre in para 16 of his opinion dated 13.1.2017 referred to the reported judgment of Bombay High Court AIR 2015 Bombay 280 that the Probate proves the Will but does not prove title of the property. He therefore opined that, entry in favour of Mr. Micheal Stephen Kedari can be made in the GLR as occupier of land bearing Sy. No. 390/905 and owner of house constructed on the said land.

The Board vide Resolution No. 22 dated 24.09.2013 resolved to carry out mutation in the name of Mr. Michael Stephen Kedari subject to production of Undertaking /Affidavit for removal of unauthorized construction to stop commercial use of the property within a period of one month. Mr. Michael Kedari had filed Indemnity Bond dated 12.08.2013 wherein Mr. Michael Kedari undertaken to remove illegal and unauthorized construction which is carried out by occupiers / tenants at his own cost.
Mr. Michael Stephen Kedari has now filed MA 1088/2014 under Contempt of Court Act before the Civil Court Pune against the Board / CEO seeking directions to hold the Opponent as guilty and responsible for committing contempt of Court for not following court order dated 29.7.2013 passed by Civil Judge Pune in Darkhast No. 47/2013. The case is pending.
RESOLUTION NO. 40 : Considered. CBLA explained the case in detail including orders passed by the Civil Court and District Court directing the Board to enter the name of Mr. Michael Kedari in the GLR. He invited specific attention of the Board that Mr. Michael Kedari has filed contempt petition against the Cantonment Board. He further pointed out that opinion has already been given by the Senior Counsels of the Board to mutate the name of beneficiary Mr. Michael Kedari in the GLR and thereafter to take further action for removal of unauthorized construction and against change of purpose. The Board honoured the orders passed by the Civil Court and District Court but since there is change of purpose and various unauthorized constructions involved in the subject property, the matter is required to be examined in detail on the point of change of purpose and removal of unauthorized construction. The Elected Members stated that a site inspection be carried out and thereafter appropriate decision be taken in the matter. Resolved that Elected Members will carry out site inspection and the Site Inspection Report be placed before the ensuing Board for further decision. Dr. D N Yadav, CEO of the Board dissented from the decision of the Board by stating that it is Courts Order to mutate the property, which must be complied failing which, ongoing execution petition / contempt petition may go against the authority of PCB. He also clarified that CEO will not be responsible for any untoward / coercive action by the Hon’ble Court.

To consider the issue of allotment of Kakasaheb Gadgil Playground for erection of temporary cracker stall for the period 22.09.2017 to 21.10.2017.Connected papers are placed on the table.Note : This office has initiated E-tender on 15.07.2017 for allotment of space at Kakasaheb Gadgil playground for erection of temporary fire cracker stalls for a period of 30 days with effect from 22.09.2017 to 21.10.2017. The technical bid was opened on 04.09.2017 at 1600 hours and after opening of the technical bid, it was found that no bid has been received. The Commissioner of Police, Pune City vide letter dated 18.08.2017 sanctioned the license for erection of temporary fire crackers for the period for a period of 30 days with effect from 2.09.2017 to 22.10.2017.Now, Fire Cracker stalls Vendors vide their letter dated 31.08.2017 has requested this Office to grant permission for allotment of space for erection of temporary fire cracker stalls for a period of 10 days only instead of 30 days contending that they have been allotted fire cracker stalls last year by the Board for a period of 10 days only.
In this connection, it is submitted that the Board during the last year had allotted temporary fire cracker stalls for a period of 10 days only since the Police Authorities had given permission for 10 days only.
RESOLUTION NO. 48 : Considered. CEO informed the Board that previous year the Fire Cracker Stalls were erected for 10 days on the basis of permission granted by the Police Authorities. During the current year Commissioner of Police, Pune City vide letter dated 18.08.2017 sanctioned the license for erection of temporary fire crackers for the period for a period of 30 days with effect from 2.09.2017 to 22.10.2017. CEO also brought to the notice of the Board that no bid has been received for the said tender for erection of stalls for 30 days. Further the Board noted the letter received from the Fire Cracker stall vendors requesting to grant permission only of 10 days instead of 30 days. Matter discussed. 49. SHIFTING / DEMOLITION OF STAFF QUARTERS LOCATED AT OLD FIRE BRIGADE : PUNE CANTT.
To consider the issue of shifting / demolition of staff quarters located at Old Fire Brigade adjacent to the upcoming Ravindranath Tagore Primary School Building.Connected papers are placed on the table.Note: The work of construction on New School building for Ravindranath Tagore Primary School is in progress and is likely to be completed by December, 2017. At present there are 7 Numbers of staff quarters located in the premises. RESOLUTION NO. 49 : Considered. Board noted the progress of work on the construction of Ravindranath Tagore English Medium School. CEE brought to the notice of the Board that the existing staff quarters is required to be demolished for additional space to the upcoming school and hence these staff residing in these quarters has to be shifted. Further he also stated that major repairs to the first floor of the Class IV quarters (8 quarters) at Ghorpuri Bazar is under progress and will be completed within a period of three months. CRS brought to the notice of the Board that there are 3 vacant quarters available in the premises of Ujwal Quarters at Sholapur Bazar. Matter discussed. Resolved to shift the occupants of the old fire briagade quarters either to the vacant quarters at Ghorpuri Bazar or Ujwal Quarters in Sholapur Bazar within a period of three months. CRS to take necessary action.Further resolved that after shifting the occupants, CEE to inspect the site and initiate necessary action for demolition.

RESOLUTION NO. 50 : Considered. Board perused the report submitted by the Chartered Accountant. Matter discussed. Resolved to approve the rate quoted by M/s. Focus Facility & Security Services @ Rs. 4,76,075/- per month for Housekeeping services in all schools of Pune Cantonment Board. The Vice President supported by all Elected Members stated that the hygienic condition of the toilets in the schools should be maintained and surprise visits will be carried out in order to assess the condition of the toilets considering the health of the children. Further the Board stated that if the toilets are not maintained hygienically, the contractor will be penalized. Board noted and approved the same.
51. REVISION OF RATES DUE TO REVISED BASIC PAY W.E.F 19TH
JAN, 2017 FOR PROVIDING 105 SAFAIKARMACHARIES WITHIN PUNE CANTONMENT LIMITS.
To consider the letter dated 19th May, 2017 received from Goodwill Ex-Servicemen Co. Op. Society Ltd. regarding revised basic pay w.e.f 19th Jan, 2017 for the subject work.

Note: Tender for the subject work has been awarded to M/s. Goodwill Ex-Servicemen Co.Op. Society for providing 105 safaikarmacharies on contract basis w.e.f. 01.04.2017 in Pune Cantonment Board as per work order dtd. No/HS/3/2017 dtd. 31.03.2017 amounting to Rs. 15,17,129.21 per month vide CBR No.56 dated 25.01.2017. The said firm has executed an agreement with the Board for the period of one year i.e. 01.04.2017 to 31.03.2018 for providing 105 safaikarmacharies on contract basis. The Proprietor Lt. Cdr. Ashok N. Shinkar (Retd.) of M/s. Goodwill Ex-Servicemen Co. Op. Society ltd. has requested to revise pay structure of 105 Safaikarmacharies provided by him vide letter dated 19th May, 2017, as the Pune city area has been upgraded from area “B” to area “A” w.e.f. 19th Jan, 2017, presently Board is paying Rs. 15,17,129.21/- per month. In support of revised pay structure he has submitted notifications issued by Gazette of India published on 19th Jan, 2017 & accordingly he has submitted wage calculations sheet per Safaikarmacharies per month as per wage structure of area “A”. The amount for providing these services thus gets revised from Rs. 15,17,129.21/- per month to Rs.24,98,282.80/- per month w.e.f. April, 2017. The matter was referred to Chartered Accountant Shri. Vinod S.Toshniwal for his expert opinion. The Chartered Accountant has opined vide letter dtd. 15.07.2017 stating that the wages are to be paid to the contractor, as per revised rates. However in the statement of revised rates, the contractor has charged the service tax @ 15%, and therefore the service tax charged Rs.3,103.46 per person, is not acceptable being the activities of cleanliness is exempt under the service tax, vide clause

no. 25 (a) of the notification no. 25 “Mega Exemption Notification” issued by the service tax department. Thus the amount for providing these services thus get revised from Rs.15,17,129.21 per month to Rs. 21,72,433.05 per month.
RESOLUTION NO. 51 : Considered. Board noted the Gazette Notification dated 19th January, 2017 and report received from the Chartered Accountant for revision of pay structure. Matter discussed. Resolved to revise the pay of Goodwill Ex-Servicemen Co. Op. Society Ltd for provision of 105 safaikarmacharies within Cantonment limits to Rs. 21,72,433.05 per month w.e.f. 52. E-TENDER IN RESPECT OF ENGAGEMENT OF 51 SECURITY PERSONNEL WITHOUT ARMS) FROM NON DGR SPONSORED AGENCIES.
Reference CBR No. 33 dated 15.07.2017.
To consider complaint received from Shri. B.D.Kute dtd.18.07.2017 & 27.07.2017 stating the following :-
i. As per Annexure A tender condition acceptance letter which is for 51 Nos. security personnel, the firm has mentioned 46 Nos. security personnel and the tender reference number and the number of security personnel is in-correct as per his acceptance letter.
ii. The Labour licence number RLCP-46(142)2013-L dated 28.06.2013 renewal date and date of expiry is fake/forged documents towards eligibility criteria.
iii. Validity of shop Act is not mentioned.iv. In Price bid service charges cannot be nil as per General
Finance Rules 2017 under rule 173 Transparency, competition, fairness & elimination of arbitrariness in procurement process.
v. Service tax/GST is also not quoted as per Service Tax Act, security services are nowhere exempted.

On 04.08.2017 a letter was issued to Vikramaditya Security Services asking clarification regarding labour licence issued by the Office of

Labour Commissioner, Pune-42. Further a show cause letter was also issued on 09.8.2017 as to why an action should not be taken against the said agency under the provision of Indian Penal Code for submitting forged documents and playing fraud with this office by suppressing the material facts with the intention to obtain the work order. In reply to the said show cause letter, Vikramaditya Security Services submitted the renewal copy of licence no. RLCP/46(129)/2017-L which is valid up to 01.08.2018. The said matter was referred to CBLA of Pune Cantonment Board for his opinion. The CBLA opined that since the licence on the date of submission of tender was not confirmed from the Licensing Authority the Board may forfeit the EMD of Rs.50,000/- of the said tenderer and recall fresh tenders.
RESOLUTION NO. 52 : Considered. The Board noted the opinion of CBLA. Matter discussed. Resolved to cancel the subject tender approved by the Board vide CBR No. 33 dated 15.07.2017 and forefeit the EMD amounting to Rs. 50,000/- deposited by Vikramaditya Security Services. Further resolved that fresh tenders be invited wherein the defaulting agency will not participate. CHS to take further action.

56. DEVIATION FOR WORK CONTRACT OF SUPPLY, INSTALLATION, TESTING & COMMISSIONING OF AIR POLLUTION CONTROL SYSTEM FOR CEMETRY AT MUKTI DHAM, DHOBI GHAT : PUNE CANTT.
To consider request of Shri. Atul V Gaikwad -Vice President, Pune Cantonment Board for provision of 3 additional pyres and S S hoods for collection of flue gases and smoke for Cemetry at Mukti Dham.Connected papers are placed on the table.Note : Tender was called for supply, installation and commissioning of Air Pollution Control System for Cemetry at Mukti Dham, Dhobi Ghat Pune Cantt., which was approved vide CBR No. 17 dated 15th April, 2017 and contract amounting to Rs. 73,92,903/- was allotted to M/s. Shilpa Electricals & Co. Under this work, the APC system will be installed with provision of two nos. of hoods, 45 mtrs. of SS ducting and 2 Nos. of pyres alongwith 30 mtrs. MS Chimney, blower, water scrubber and damper assembly shall be provided. The original scope of work only includes 2 pyres and 2 hoods, which can be used at a time for cremation of deceased bodies whereas, 5 pits have been provided under the entire renovation project of Mukti Dham. Hence for carrying out the aforesaid work for provision of 3 additional pyres, 3 hoods and 10 mtrs. SS ducting is required, which

can be carried out by giving 25% deviation to the total approved contact amount i.e. Rs. 18,48,225/- to the existing contract. RESOLUTION NO. 56 : Considered. AEE (Electrical) pointed out that erroneously the deviation limit has been shown as 25% amounting to RS. 18,48,225/- instead of 20% as per the General Conditions of the Contract. Board noted the same. Matter discussed. Resolved to approve the deviation limit @ 20% amounting to Rs. 14,78,580/- of the existing contract in respect of subject work for provision of 3 additional pyres, 3 hoods and 10 mtrs. SS ducting. AEE (Electrical) to initiate further action.
57. DEMOLITION OF EXISTING CLASS IV STAFF QUARTERS ‘A’ BUILDING AND RECONSTRUCTION OF THE SAME AT SHOLAPUR BAZAR, GLR SY.NO. 390/3048 : PUNE CANTONMENT.
Reference Circular Agenda dated 21.06.2016 approved vide CBR No. 1 dated 20.07.2016. To consider the drawings and estimates amounting to Rs. 3,73,08,360/- for proposed reconstruction of Class IV Quarter “A” building at Sholapur Bazar. The site bearing GLR Sy.No. 390/3048, which is classified as Class “C” land under the management of this Board. The existing building consists of Ground + 2 floors having 24 qrtrs. whereas the proposed building consists of Ground+ 3 floors having 32 quarters. The Board does not have adequate experience to prepare plans for Class IV quarters. Therefore drawings have been got prepared from the local practising Architect Ashok Narla. The suitability of the site, design, drawings prepared by Architect Ashok Narla have been authenticated by Cantonment Executive Engineer, Pune.
It is submitted that the detailed estimates and drawings may be forwarded to GE(N) for vetting.

To consider and approve the Assessed Rate / Market Rate for material and labour for murum / red bajri filling in layers at the site of Manure Yard @ Rs. 826/- per cmt.Connected papers are placed on the table. Note : The existing road at the site of Manure Yard towards north east side part was sunked down due to which it was difficult to carry out the dozing work of Manure heaps. It was therefore necessary to uplift the sunked road and resurfaced the same by providing murum filling having approximate size of this part of the road, which is around 338 mtr length and 7.50 mtr width. The subject work is being carried out through the present contract No. E/W/ VI/2017-18 for the work of reinstatement of the road cutting and widening of roads. Since in the said item rate contract rate for murrum filling is not mentioned in the contract, this office have assessed the same as per the prevailing mkt rate based on SSR 2010 by adding the current percentage quoted for the work of Term Contract which comes to Rs. 826 per Cmt . To consider Dte. letter bearing No. 8119/B/XXXXIII/DE dated 29.08.2017 wherein it has been intimated that since the applicants have not been recruited by following due procedures of Recruitment Rules, hence the engagement on permanent basis may lead to complications. However, the Board may enhance the remuneration given to them as they were appointed on fixed remuneration basis.

Rekha M Pateliya has been also engaged as Balwadi Ayah since 2006 and

The individuals were called for hearing by the then CEO and they submitted their plea stating that since they are working from years, they may be made permanent. They have also produced report of 1994 of Director of Social Welfare Maharashtra.
It is submitted that as per the sanctioned Scale Register of the Board, the posts of Balwadi Teacher and Ayah does not exist.
Thereafter this office vide letter dated 30th November, 2015 on the basis of letters received from Director, National Commission for Schedule Castes, forwarded a detailed report to the Directorate, SC Pune seeking necessary guidelines as whether they can be absorbed against existing vacancies. A reminder to the same was forwarded to the Directorate vide this office letter dated 21st
December, 2016. The Dte. vide letter dated 19th June, 2017 had raised certain observations, which has been duly replied by this office vide letter dated 03.08.2017. Further the Directorate vide letter dated 29th August, 2017 has issued necessary guidelines.
Further, it is submitted that Board vide CBR No. 2 dated 01.07.2017 has approved M/s. Ranjeet Hospitality for supply of manpower for the various departments of the Board viz. schools, hospitals, other departments etc. Now the HM, Shaheed Bhagat Singh Primary School and HM, Mahadji Shinde Primary School, where these individuals are working have submitted letters dated 11.09.2017 informing this office that these individuals are not signing the muster roll of Ranjeet Hospitality.
RESOLUTION NO. 63 : Considered. The Board noted the facts and also the letter dated 29.08.2017 received from the Directorate, SC, Pune. The Board also noted that the supply of manpower has been outsourced to M/s. Ranjeet Hospitality. Further the Board also noted that their remuneration has been enhanced. The Board noted that the individuals are not signing the muster, wherein the Elected Members opined that since the contract is outsourced, the individuals have to sign the muster maintained by M/s. Ranjeet Hospitability, in order to enable the contractor to make their payment. The Board noted and approved the same. Matter discussed. After detailed discussions and deliberations resolved that the individuals be informed that they cannot be recruited or engaged on permanent basis since the applicants have not been recruited by following due procedures of Recruitment Rules. Reference CBR No. 10 dated 15.07.2017.To consider the issue of bicentennial celebration to be held on 3 rd, 4th & 5th November, 2017. Various activities for bicentennial celebration of Pune Cantonment has been chalked out viz. a. Publication of special cover on 200 years of Pune Cantonment
through Postal Department, Maharashtra Circle.b. Documentary film on Development & Growth Story of Pune
Cantonment from 1817 to 2017 of 20 to 30 mins. Tender has been initiated for the same and the estimated cost will be Rs. 3.00 lakhs.
c. Three days celebration have been organized on 3rd, 4th & 5th
November, 2017 at Golibar Maidan or Race Course Ground (Venue to be finalized). i. Day 1 : 3rd November, 2017 – Inaugural function,
documentary film, six dance sequences performing on Indian folk in the evening from 7.00 pm to 10.00 pm. The chief guest is to be finalized for the inaugural function.
ii. Day 2 : 4th November, 2017 - 10 kms Cycle Rally in Pune Cantonment area for spreading the message of Clean & Green Pune, during the morning hours from 7.00 am to 9.00 am., Blood donation camp in SVP CGH from 10.00 am to 2.00 pm, cultural program by students of Cantonment Boards and grand play on life of Shivaji Maharaj (40 to 45 mins) from 7.00 pm to 10.00 pm.
iii. Day 3 : 5th November, 2017 – Walking plaza / Happy Street on MG Road showcasing various events like skating, yoga, painting, cycling, dance performances etc from 7.00 am to 9.00 am., classical music concert by renowned classical singers and musicians and closing ceremony from 7.00 pm to 10.00 pm.
Stage with lighting & sound system, CCTV, Security System, security guards with metal detector, earthing slots, exhibition area, VIP lounge, stalls showcasing the achievements of Pune Cantonment, welcome gate entries with theme of bicentennial celebration, hoardings, flex banners, tin shed barricading, buntings / hoarding on street light poles and roundels, sufficient area lighting, sanitation facilities, four portable toilets (2 male, 1 female & 1 specially abled persons), standby generators, water facility, security arrangement, fire fighting equipments, LED walls

and refreshments / dinner have been planned for the three days bicentennial celebration. The branding & public awareness about Pune Cantonment Board will be carried out through renowned local newspapers, FM Radio channel and digital media network before and after the event. To execute all the aforesaid activities, e-tender have been called on 4th September, 2017, which will be opened on 19th September, 2017. The estimated cost of this work is around Rs. 50.00 lakh. RESOLUTION NO. 65 : Considered. CEO explained the entire programme / events to be celebrated on the occasion of bicentennial year of Pune Cantonment. The Board unanimously decided to organize three days function in the first fortnight of November, 2017 and preferably from 3rd November to 12th
November 2017 due to ensuing Parliament Session. The Board also resolved to invite Hon’ble Raksha Mantri, Govt. of India / Hon’ble Chief Minister of Maharashtra / Army Chief. of Indian Army as Chief Guest. It is also decided that actual date of the function may be fixed as per the availability of the Chief Guest. Board noted and approved the same.
The Board approved three days events as mentioned on the agenda side. Further the Boards keeps it open to add / delete any event but related to the classical Indian Culture viz. classical dance, music, vocal music etc subject to daily event should not be exceeding more than three hours. CEO informed the Board about the Ram Leela Show being played in the region of Bengal & Bihar based upon the Ramayan written in Bengali. The Board also approved the same, if any performing team from Bihar / Bengal could be arranged to play in Pune.
Further CEO explained the day wise events / cultural activities to be conducted as shown on the agenda side. PCB suggested that light and sound show be displayed during this programme. CEO informed the Board that the tenders for documentary film and event management have been initiated and will be finalized shortly. The Board decided to approve the financial bid / tenders through Circular Agenda and it is also decided to start the job of documentary film at the earliest.
CEO further stated that he himself alongwith the staff of the Board visited the site of RWITC (Race Course) for finalization of venue for the bicentennial celebration. The Members of the Board also was of the view RWITC will be a perfect venue for the celebration. Matter discussed. Board noted and approved the venue of RWITC (Race Course, Pune) for the Bicentennial Celebration. A request letter be

forwarded to the Secretary, RWITC Ltd. for allotment of the said venue in the month of November, 2017.

CEO requested all the Board Members to take active participation in 200 years celebration of Pune Cantonment as it is going to be a grand event for which expenditure of Rs. 50.00 lakhs to Rs. 60.00 lakhs have been estimated and Board cannot incur such huge expenditure from Cantonment Fund. Hence various options for sponsorship / raising of CSR funds for conducting various events be explored. President, Cantonment Board suggested that around 50% expenditure can be borne by the Board and the balance 50% shall be raised through sponsorship / CSR funds. Further PCB stated that in this regard active participation of Elected Members for raising funds is expected. The Elected Members accepted and gave assurance that full participation will be given by them. Board noted and approved the same. Finally President Cantonment Board stated that the bicentennial celebration can be made a great success with the efforts, active participation and synergy of all the Members and staff of the Board. After discussing all the aspects of the event, the Board approved total expenditure of Rs. 60.00 lakhs to be incurred for the bicentennial celebration

7. Considered. Garden Oversear informed the Board that the Ber tree on the subject site had already fallen, which has been seen by the Chairman of the Committee. Since the tree had already fallen, the tree was removed from the subject site departmentally. The Board noted and approved the same. Further the GO brought to the notice of the Board that that the tree will be auctioned as per due procedure.
8. Considered. Resolved that permission is rejected for removal of Peepal tree from the said site.
9. Considered. Resolved to dispose of the said three trees from the site of construction of Sholapur Bazar Quarters through auction procedure.

68. TRANSPLANTATION OF TREES.
To consider the application dated 24.8.2017 received from Mr. Prashant Patil, Environment officer, M/s. Bharat Forge Limited, Mundhwa, Pune, requesting to grant permission for transplantation of trees. Connected papers are placed on table.
Note : In the company premises named, M/s. Bharat Forge Limited, Mundhwa, Pune- 36, three trees namely Mango trees ( 2 Nos.) & Umber tree ( 1 No.) are creating an obstruction for the proposed new construction work.
The organization further stated that, existing trees will be transplanted at suitable site within the company premises.
RESOLUTION NO. 68 : Considered. The Board viewed the photographs of the trees. The Elected Members stated that previous sanction were given to the company for transplantation, which needs to be reviewed. Matter discussed. Resolved that the matter be pended and brought before the Board after review of earlier cases.
69. ACTION INITIATED FOR REMOVAL OF ILLEGAL STALLS SITUATED AT WANOWRIE VEGETABLE MARKET, WANOWRIE BAZAR : PUNE CANTT.
To consider the representation dated 18.09.2017 received from Wanowrie Bazar Vegetable Market Mitra Mandal requesting this office for allowing to run the stall at the same place, which were removed by the Board on 14th September, 2017.

Note : There are 10-12 stalls erected by various hawkers in the said vegetable market without any sanction of the Board. Out of which 5-6 stalls were erected adjoining to the main road (Canning road), which creates hindrance to the flowing traffic. Accordingly, the Board jointly initiated action for removal of all these illegal stalls on 14th September, 2017 in the interest of general public.
RESOLUTION NO. 69 : Considered. CEO brought to the notice of the Board that as per the GLR Extract, the description the subject site is shown as Cantonment Market and the cost of the subject site is Rs. 95,84,107/-, which is a prime defence land adjoining to the main road. Further CEO also brought to the notice of the Board that the subject site has been inspected by himself and noticed the traffic congestion during the peak hours. Further he also informed that Hon’ble MP and Hon’ble MLA also discussed the issue and

requested to reinstate these illegal hawkers. The Board was of the opinion that only selling vegetable on hand carts be permitted at appropriate site. After detailed discussions and deliberations, resolved that vegetable vendors on hand carts be permitted at the site away from the main road. Meanwhile it has been decided on majority that an alternative site may be finalized after inspection jointly by President & Vice President. Thereafter the matter be again referred to the President, Cantonment Board for further decision. CHS & CRS to carry out regular inspection of the subject site in order to ensure that no stalls are erected and only handcarts for selling vegetables.
70. INTRODUCTION OF BREAST FEEDING CENTRE AT 35 MG ROAD : PUNE CANTT.
To consider letter dated 8th September, 2017 received from Smt. Priyanka R Shrigiri, Elected Member requested to allot the space at 35 MG Road for introduction of Breast Feeding Centre in the interest of general public. Further it is also suggested all the accessories viz. curtains, furniture, female attendant etc may be provided for facilitation the mothers to feed their babies.

RESOLUTION NO. 70 : Considered. Resolved to utilize the existing space at 35 MG Road for introduction of Breast Feeding Centre. CEE, CHS & CRS to inspect the site and put up the expenditure towards the various infrastructure to be provided for the Centre. CEO is authorized to incur the expenditure towards the same.
71. UTILISATION OF CSR FUND FOR MAJOR REPAIRS TO MATERNITY WARD IN SVP CGH : PUNE CANTT
To consider letter dated 26th August, 2017 received from the Trustee, Abbasbhai Kederbhai Abdujee Trust, Pune informing this office that the Trust would like to study detailed plan of ground floor of the Maternity Ward. As regards to the first floor, they are revert at a later stage. It has been further informed that after detailed study, a proposal will be forwarded to this office for further action.

72. DEVELOPMENT OF OPEN SPACE AT HOUSE NO. 721 TABOOT STREET FOR STORE ROOM / ROOM FOR HEALTH DEPT. : PUNE CANTT.
To consider the representation dated 21.08.2017 received from Shri. Manzur N Shaikh, Ex-Member, PCB and representation dated 14.09.2017 received from Smt. Rohinitai Kolhal requesting this Board not to carry out any construction at the vacant site of H. No. 721 Taboot Street but to develop a garden at the said site. Meanwhile, a letter dated 16.09.2017 has been received from Smt. Priyanka R Shrigiri, Elected Member wherein it has been requested to construct a Utility Centre for children, ladies and senior citizens.

Note : The property bearing GLR Sy. No. 390/722, House No. 721 Between Main Street & Taboot Street is classified as Class B-3 land under the management of this Board. The said site has been resumed by Government of India vide letter No. 584-AR/AP.4 dated 12.07.1935 and the possession taken on 18.06.1940. The said site admeasures an area of 1619.00 sq.ft. The present value of the said land is Rs. 65,30,167/-. The Board had made budgetary provision in the Revised Budget Estimates for the year 2017-18 to develop the open space.
RESOLUTION NO. 72 : Considered. CEO brought to the notice of the Board that said site has been resumed by Government of India vide letter No. 584-AR/AP.4 dated 12.07.1935 and the possession taken on 18.06.1940. The said site admeasures an area of 1619.00 sq.ft. The present value of the said land as per STR is Rs. 65,30,167/- and the market value is Rs. 1.50 crores approx. The Board also noted that the site was under illegal occupation for kabari in sheds, which have been removed by the Board in July 2017 and the said site has been inspected by the CEO and PCB in the presence of general public. CHS brought to the notice of the Board that there is no room / space in the adjoining area for storing health items and the said land can be utilized for same. Further the Board opined that a Citizen Facilitation Centre can be started at the said site for the benefit of the general public. Matter discussed. The Board considered the representation received from Manzur N Shaikh, Smt. Rohinitai Kolhal and Smt. Priyanka R Shrigiri, Elected Member. After detailed discussions and deliberations resolved that the ground floor be utilized for indoor games for children & sr. citizens. The first floor will be utilized for Store Room for the Health Department / CFC Centre. CEE & GO to initiate further necessary action.

73. EXTENSION FOR ROAD CUTTING PERMISSION TO MSEDCL FOR LAYING OF 132 KV UNDERGROUND CABLE IN GHORPURI AREA
To consider letter bearing No. 1967 dated 20.07.2017 from MSETCL requesting to grant extension upto April, 2018 for laying of 132 KV cable in Ghorpuri Area from Ghorpuri Railway Crossing upto Cantonment limit .

Note : The Board vide CBR No. 20 dated 30.04.2015 had granted permission for laying of 132 KV underground cable from 220 KV Magarpatta Sub Station upto Rastapeth Sub Station. The permission was communicated to MSETCL vide this office letter dated 12.10.2015 for total length of 1578 mtrs. on payment of road cutting charges of Rs. 45,45,000/-. Due to non-availability of permission from other Government Agencies, the MSETCL could not complete their work of laying of cable, hence they have requested to grant extension till April, 2018. Three sanctions have been given to MSETCL vide letter dated 12th October, 2015, 4th November, 2015, 23rd December, 2015 and 10th November, 2016. The rates have been enhanced for road cutting, as per prevailing rate approved vide CBR No. 22 dated 13.10.2015 @ Rs. 2,400/- for tar road and Rs. 3,300/- for interlocking footpaths. It is required to carry out excavation of 620 rmt. As per the revised rate, the road cutting charges for 992 sq.mtr. would be Rs. 32,73,600/-. MSETCL has already made a payment of Rs. 17,85,600/- i.e. payment @ Rs. 1,800/- per smt. Hence a balance payment of Rs. 14,88,000/- has to be paid towards the road cutting charges by the MSETCL.
RESOLUTION NO. 73 : Considered. Resolved to grant extension to MSETCL upto April, 2018 for laying of 132 KV cable in Ghorpuri Area from First Ghorpuri Railway Crossing upto the Cantonment limit near Anant Theatre except the stretch of Bhairobha Nallah subject to payment of balance road cutting charges amounting to Rs. 14,88,000/-. Further resolved that a joint inspection will be carried out by the MSETCL Authorities and technical staff of this Board to find out suitable option for laying of cable through stretch of Bhairobha Nalla since the Board is planning to widen the said bridge due to traffic congestion. AEE (Electrical) to initiate further action.
74. REMOVAL AND SHIFTING OF OVERHEAD LINES IN BHIMPURA LANE NO. 29 & TABOOT STREET
To consider the request of Ward Member Smt. Priyanka R Shrigiri for removal and shifting of overhead lines in respect of Bhimpura Lane

No. 29 and Taboot Street due to frequent power tripping, low voltage and short circuit problems.
MSEDCL has erected overhead line network to cater power supply to households in the area of Bhimpura Lane No. 29 and Taboot Street, which is overloaded and in bad condition due to which chances of electrocution and short circuit have been increased and few occurrences has been observed like burning of home appliances of the residents, hence it is required to remove the overhead line network and lay underground cable considering the safety and aesthetic value of the area. This office has approached MSEDCL to execute the work but there is no positive reply from these Authorities.
RESOLUTION NO. 74 : Considered. Resolved to approach the MSEDCL Authorities for removal and shifting of MSEDCL overhead lines to obtain estimates for the work of removal of over overhead lines from area of Bhimpura Lane No. 29 and Taboot Street. AEE (Electrical) to initiate further necessary action.
75. The issue of unauthorized stalls of chicken / mutton in Chhatrapati Shivaji Market will be discussed in the next meeting. CRS to prepare a detailed report on authorized / unauthorized stalls at Chhatrapati Shivaji Market. CHS to check previous records regarding trade licence issued, if any.
Further the Board decided to take action to close all the illegal stalls of chicken / mutton within the Cantonment limits by following due procedures. CHS and CRS will initiate necessary action.
