problems. That the City is primarily a residential community, surrounded by other residential, business, manufacturing and recreational centers. That this fact, coupled with the presence of large centers of entertainment in the midst of and in close proximity to the City, causes vehicular traffic to, from, through and within the City at times to attain dimensions totally disproportionate to the size and population of the City. That on frequent occasions the population within the City is increased as much as five-fold in the space of two hours, and tens of thousands of motor vehicles enter or pass through portions of the City within an hour, with the result that abnormal traffic problems result which cannot be met or solved by the mere increase in law enforcement personnel. That any hindrance of the flow of such vehicular traffic causes delay, traffic congestion, accidents and imminent peril to both life and property within the City. That the sale of any commodity from a vehicle or to a person in a vehicle on any major traffic arterial in said City peculiarly adds to the local traffic congestion, delay and hazard to life and property. That strict enforcement of traffic laws alone is insufficient to cope with the situation. That it is not possible to employ sufficient police officers adequately to control such unique traffic problems, not only because of the present manpower shortage, but particularly because of the fluctuating volume of such vehicular traffic. That it is therefore necessary to remove and prevent, so far as is possible, all factors which contribute to or cause any interference with or retardation of the movement of vast numbers of motor vehicles in the City. ;oh3; DIVISION 3.\REGULATIONS

3233. - SELLING AND DISTRIBUTING ON STREETS RESTRICTED.

No person shall by any means engage or participate in the business or practice of disseminating, distributing, passing out, giving out, handing out, selling, offering for sale or soliciting for the sale of any sheet, dodger, handbill, circular, letter, booklet, newspaper or any other printed, typewritten, mimeographed or written matter of any kind, or any goods, wares, merchandise or commodity of any kind whatsoever:

(1)From any vehicle in a public street; or

3234. - SAME. AUTOMOBILE, MOTOR TRUCK OR VEHICLE.

No person shall sell, barter or exchange or offer for sale, barter or exchange, any goods, wares or merchandise, fruit, vegetables, eggs, chickens or other fowl, or any farm or country produce, from any automobile, motor truck or other vehicle, while any such automobile, motor truck or vehicle is upon or parked on any portion of any public street, highway, alley or other public place in the City. The provisions of this Section shall not prevent or restrict the sale of any such articles at retail from any such automobile, motor truck, or other vehicle, to any of the residents of the City at their places of residence, in compliance with all other applicable provisions of this Code.

     It is unlawful for any person to sell or offer for sale, or operate any vehicle or conduct any business for the purpose of causing the sale or for offering for sale, any goods or services from any vehicle parked, stopped or standing upon any public street, alley,  parkway, sidewalk or other public property in the city except in accordance with all applicable provisions of the code and in compliance with each of the following requirements.     (A)     Such vending shall be only by means of a vehicle duly registered and licensed by the state with an unladen weight of less than 6,000 pounds.     (B)     Such vending shall be limited to public streets only and shall not be permitted upon any alley, parkway, sidewalk, or other public property.     (C)     Each operator shall possess and at all times  display in conspicuous view upon each such vehicle a city business license pursuant to Chapter 110 of this code of ordinances.     (D)     Each operator shall possess and at all times  display in conspicuous view upon such vehicle an unexpired and unrevoked operator's permit issued pursuant to § 122.15.     (E)     It is unlawful for any vendor to sell or offer for sale any goods or services from any vehicle pursuant to this section unless such person shall possess and at all times while conducting such vending maintain upon his or her person an unexpired and unrevoked vendor's permit issued pursuant to § 122.16.     (F)     It is unlawful for any operator to permit or allow any vendor under such operator's control, direction, charge or employ to vend any goods or  services from any vehicle pursuant to this section unless such vendor possesses an unexpired and unrevoked vendor's permit issued pursuant to § 122.16.     (G)     Each operator causing the sale of or offering for sale any produce or other food item for which a food handling permit or other health permit is required by law shall possess and at all times display such required permit(s) in conspicuous view upon such vehicle.     (H)     No vending from such vehicle shall be permitted within 100 feet of any intersection of two or more public streets nor within 500 feet of any public or private elementary, junior high, or high school.     (I)     No vending from such vehicle shall be

permitted for a period of time in excess of ten minutes in any one location and said vehicle must be moved a distance of not less than 100 feet between consecutive stops at which vending occurs.     (J)     No vehicle shall be parked, stopped, or left standing in any manner which blocks or impedes vehicular access to any driveway or restricts the free movement of other vehicles upon the public street.     (K)     Each vehicle shall be equipped with a trash  receptacle of a size adequate to accommodate all trash and refuse generated by such vending.     (L)     Each vendor shall pick up and deposit in the trash receptacle on the vehicle any paper, cups, wrapper, litter or other refuse of any kind which were a part of the goods or services supplied from the vehicle and which have been left or abandoned within 25 feet of such vehicle on any public property other than in a trash receptacle provided for such purposes.  No vendor or operator shall dispose of any trash or refuse in any such public or private trash receptacle  other than a trash receptacle owned, operated or otherwise provided by and under the control of such vendor or operator.     (M)     No vending shall be permitted except after the vehicle has been brought to a complete stop and  parked adjacent to the curb in a lawful manner.     (N)     Any vehicle from which vending occurs  pursuant to this section shall have the name, address and telephone number of the holder of the operator's permit permanently affixed on both the left and right sides of the vehicle.  Such information shall be in contrast to the color of the background upon which the letters are placed.     (O)     No vending shall be permitted by an operator or conducted by any vendor except between the hours of 9:00 a.m. and 8:00 p.m. of each day.     (P)     Any use of amplified sound making devices, including vehicle horns, to advertise, draw attention to or announce the presence of any such vehicle  shall comply with the limitations and provisions set forth in §§ 130.40 et seq. of this code of ordinances. No amplified sound making devices shall be used for such purposes upon any public street immediately contiguous to any residentially zoned property within the city. Nonamplified sound-making devices shall be permitted for such purposes provided such sounds shall not be made while the vehicle is stopped, parking or

otherwise in a stationary position; and such sounds shall not be audible to a person with normal hearing for a distance of more than 200 feet.     (Q)     Any operator or vendor using scales or any other weighing or measuring devices shall have all such scales and devices inspected and sealed by the Weights and Measures Division of the Los Angeles Department of Agriculture.     (R)     All foods, beverages, utensils and equipment offered for sale or utilized on vending vehicles shall at all times be protected from contamination and pollution by dust, dirt, flies, vermin, rodents, animals, unnecessary handling, droplet infection, overhead leakage, insecticides, rodenticide, cleaning compounds and other poisonous or deleterious substances, and all other forms of contamination.     (S)     Any ice cream truck shall be equipped at all times, while engaged in vending in a residential area, with signs mounted on both the front and rear and clearly legible from a distance of 100 feet under daylight conditions, incorporating the words "WARNING" and "CHILDREN CROSSING".  Each sign shall be at least 12 inches by 48 inches wide, with letters of a dark color, at least four inches in height, a one-inch wide solid border, and a sharply contrasting background.     (T)     The driver of the ice cream truck shall be required to place an orange cone at the left rear portion of the vehicle after the vehicle has been stopped and parked adjacent to the curb.     (U)     No ice cream trucks shall be permitted to vend on streets with a speed limit of more than 25 miles per hour.     (V)     The driver of the ice cream truck shall have an unobstructed view for 200 feet in both directions along the street and of any traffic on said street.     (W)     Unless otherwise waived by the city police department and, in addition to other equipment required by law, each food vending vehicle shall be equipped with the following:          (1)     A convex mirror mounted so that the occupant of the driver's seat can see the area in front of the truck which is obscured by the vehicle's hood.          (2)     A back-up alarm audible for a distance of at least 100 feet.

The uses of these areas are public and there is no vested right to do commercial business upon the public land or property.B.     Vending, peddling, selling and/or soliciting on public lands, right-of-way or property is prohibited. No person shall vend, peddle, sell and/or solicit any merchandise, goods or service on a public street, sidewalk, park, parkway, median, land, property or any other land or property under the control of the City of Bellflower, except as provided in Subsection (C) of this section.C.     Vending, Peddling, Selling and/or Soliciting on Public Lands, Rights-of-Way or Property—Exceptions. No person shall vend, peddle, sell and/or solicit any merchandise, goods or services on any publicly-controlled lands, rights-of-way or property controlled by the City of Bellflower, except for: 1) the sale of printed materials as allowed by this title; or 2) for special events as determined by the City Council of the City of Bellflower; or 3) newspapers, periodicals, magazines and other constitutionally protected forms of free speech; 4) portable retail food and merchandise vending activities within the Town Center Plaza and immediate vicinity, as determined by, and pursuant to, the approval with or without conditions of the City Manager; or 5) other vendors within the public right-of-way as approved by the City Manager or his/her designee.

5.56.070 Sale of goods and merchandise from a motor vehicle.A. Permit Required. The Municipal Code of the city of Bell Gardens provides for licensing and/or permit procedure for the conduct of certain business activities. This subsection does not repeal nor amend those provisions for the lawful conduct of business activities when properly licensed or permitted. This subsection does not intend nor is it meant to prohibit, prevent or hinder activities of political, economic, religious or sociological ideas when such activities are noncommercial.The city council finds and determines that the use of its public streets, sidewalks, rights-of-way and other public property is essentially for public purposes. Further, there is no vested right to do commercial business upon public streets, sidewalks, rights-of-way and other public property. The purpose and intent of this subsection is to further clarify the regulation of the sale of goods, merchandise and/or food from a motor vehicle in addition to the existing provisions of this code. It is the intent and purpose of this subsection to clearly state that the regulations shall apply to all operations involving the selling of goods, merchandise and/or food from a motor vehicle wherever and however situated in the city.The sale of goods, merchandise and/or food from a motor vehicle is transient in nature and is not allowed at a permanent location on premises within the city. It is further found that because of the mobility of a motor vehicle from location to location, vendors selling goods, merchandise and/or food

It is unlawful for any person to sell or offer for sale, or operate any motor vehicle or conduct any business for the purpose of causing the sale of goods, merchandise and/or food from any motor vehicle parked, stopped, or standing upon any private property, public street, alley, parkway, sidewalk or other public property in the city of Bell Gardens except in accordance with all applicable provisions of this section and in compliance with each of the following requirements:

1. All vendors and operators shall keep and maintain their equipment in a neat, clean and safe condition and shall conduct all vending operations in a neat, orderly, safe and sanitary manner.2. All sales activities shall:

a. Be conducted at a distance of more than five feet from any public or private building or the property line of any business premises and at a distance of at least 10 feet from any entrance to any public or private building or business premises;b. Not be permitted for a period of time in excess of one hour per 12-hour period at any one location. Any such motor vehicle must be moved a distance of not less than 200 feet between consecutive stops at which sales and/or service activities occur; andc. Not be located within 100 feet of the nearest part of the street entrance to any stationary or fixed restaurant, cafeteria, lunch counter, or other eating facility dispensing victuals; provided, however, that if said stationary or fixed facility is not directly accessible from the street, the 100-foot distance shall be measured from

the nearest part of the street entrance to the building or property which is the nearest entrance to the eating facility open and available to the public.

3. No sales activity shall be conducted in a manner which disturbs, accosts, confronts, harasses, badgers or annoys any person.4. It is unlawful for any person to sell or offer for sale any goods, merchandise and/or food from any motor vehicle pursuant to this code unless such person possesses at all times while conducting such commercial business upon his or her person an unexpired and unrevoked business permit issued pursuant to this code.5. It is unlawful for any person to stop, stand or park a catering truck upon any street for the purpose of dispensing victuals under any circumstances in violation of stopping, standing or parking prohibitions or restrictions either shown by signs or curb markings or as otherwise provided by the State Vehicle Code or the health, safety, fire, traffic, business or other regulations set forth in this code or state law.6. No person shall dispense victuals from any portion of a catering truck on any street in any manner which causes any person to stand in that portion of the street which is between the catering truck and the center of the street.7. Persons who dispense victuals under the provisions of this section may not do so unless at that time they provide or have available, in a conspicuous place in the immediate vicinity of the catering truck, a litter receptacle which is clearly marked with a sign requesting its use by patrons.8. After dispensing victuals at any location a catering truck operator, prior to leaving the location, shall pick up, remove and dispose of all trash or refuse which consists of materials

originally dispensed from the catering truck, including any packages or containers, or parts of either, used with or for dispensing the victuals.9. The city council may restrict the operation of catering trucks in any public right-of-way by resolution after a public hearing.

C. Penalty. Any person who violates any of the provisions of this section shall be deemed guilty of an infraction which shall be punishable as follows:

1. For a first offense, a fine not exceeding $100.00;2. For a second offense within a period of 12 consecutive calendar months, a fine not exceeding $200.00;3. For each additional violation during the same 12-month period, a fine not exceeding $500.00 for each such additional violation;4. At the discretion of the city prosecutor, any person who violates BGMC 5.32.010 more than five times may be charged and convicted of a misdemeanor and be punished by a fine not to exceed $500.00, or imprisonment for a term not to exceed six months or both.

This provision does not preclude other methods of enforcement, including, but not limited to, seeking injunctive relief or instituting nuisance abatement proceedings.D. Exceptions.

1. The city council or designee may issue, upon application, temporary motorized street vending permits to be valid for no more than five days during special public events. Notwithstanding the provisions of this chapter, such temporary permits may authorize sale of nonfood items.2. The provisions of this chapter shall not apply to persons delivering articles from a store or other fixed place of business or distribution, upon the order of, or by agreement with, a customer. 4-2-704: RESTRICTIONS AND PROHIBITIONS:

Peddlers shall be subject to and shall comply with the following restrictions and prohibitions:

A. Shall not go in or upon any private residential property for the purpose of selling or disposing of any goods, wares, or merchandise, unless the consent of the owner or occupant of such private residence shall first be obtained.

B. Shall not between the hours from eight o'clock (8:00) P.M. to nine o'clock (9:00) A.M., make any outcry, blow a horn, ring a bell, or use any sound devices or musical instrument upon any of the streets, alleys, parks, or other public places of this city where sound of sufficient volume is emitted to be capable of being plainly heard upon the streets, alleys, parks, or other public places, for the purpose of attracting attention to any goods, wares, or merchandise which the permittee purposes to sell.

C. Shall not keep, maintain, or operate any lunch, meal, or eating cart, wagon, truck, or stand used in selling popcorn, peanuts, candy, or any other article of food or drink in or upon any public street or other public place within two hundred feet (200') of the nearest property line of any property on which a public school building is located.

D. Shall not sell, offer for sale, give away, distribute, solicit the sale of, or expose for sale any fruit, vegetables, peanuts, popcorn, candy, ice cream, article of food, or any goods, wares, or merchandise upon the grounds of any public school without first having obtained the written permission of such school or of the superintendent or assistant superintendent of the Beverly Hills schools or the school board of the Beverly Hills Unified School District.

E. Where food of any kind is dispensed from a vehicle, pushcart or other conveyance, shall maintain a clearly designated litter receptacle in the immediate vicinity, marked with a sign requested use by patrons; and provided further, prior to leaving the location, shall pick up, remove, and dispose of all

B. No person shall park or stand on any street any lunch wagon, eating cart or vehicle or pushcart

from which tamales, peanuts, popcorn, candy or other articles of food are sold or offered for sale,

without first obtaining a written permit to do so from the city traffic engineer which shall designate the

specific location in which such cart shall stand.

C. No person shall park or stand any vehicle or wagon used or intended to be used in the

transportation of property for hire on any street while awaiting patronage for such vehicle or wagon,

without first obtaining a written permit to do so from the city traffic engineer which shall designate the

specific location where such vehicle may stand.

D. Whenever any permit is granted under the provisions of this section, and a particular location to

park or stand is specified therein, no person shall park or stand any vehicle, wagon or pushcart on any

location other than as designated in such permit. In the event that the holder of any such permit is

shall name the City of Compton as an additional insured under the policy, and shall contain a statement of obligation on the part of the insurance carrier to notify the City of Compton of any material change, cancellation or termination of such insurance. Nor shall any vehicle operator, vendor or peddler park or stand in one (1) location for more than ten (10) minutes, except that catering trucks may park or stand for no more than thirty (30) minutes. Any vehicle or catering truck operator intending to park or stand for more than the prescribed limit must first obtain a written permit from the City Council of the City of Compton to do so. Said permit shall be carried at all times within the vehicle and presented to an enforcement officer on demand.       Any permit approved by the City Council under the provisions of this subsection shall set forth the location in which such operator, peddler or vendor shall be permitted to park or stand, and shall designate hours and length of time during which such operator, peddler or vendor shall be permitted

The health certificate shall be renewed before June 30th of each year and shall be presented to the City of Compton before issuance of a business license renewal. § 11.09.215  CONDITIONS FOR PERMIT.

Hawking shall mean advertising, promoting or soliciting customers for the sale of any goods, wares or merchandise, whether or not a sale takes place.

(3)Peddle and peddling shall mean: (a) hawking or selling any goods, wares or merchandise, including liquids or edibles for human consumption, by traveling or going by any means of locomotion whatsoever from place to place, from house to house or business to business, or (b) hawking or selling any goods, wares or merchandise, including liquids or edibles for human consumption, from or on the street, on any public property or on any private property without the permission of the owner or other person in possession and control of the property.

(4)Solicitation shall mean the request, directly or indirectly, of money, credit, property, financial assistance or other things of value for the commercial or retail sale of goods, wares or merchandise by taking an order for delivery and promising later delivery of such goods, wares or merchandise. Individuals engaged in commercial solicitation for future delivery solely as an incident to engaging in a business otherwise licensed under this chapter and for which the employer has a current, valid license shall not be deemed to be engaged in the business of commercial solicitation.

(b)License fee waivers. Veterans, as defined by Business and Professions Code §§ 16001 and 16001.5, shall not be required to pay a license fee to hawk, peddle or sell goods, wares or merchandise owned by them, except alcoholic beverages.

(c)Identification requirements. All licensed peddlers and solicitors licensed pursuant to this chapter shall carry an original business license, along with picture identification, at all times when peddling.

(d)Operating requirements.(1)

nonmotorized device or operate any nonmotorized device for street vending purposes while parked, stopped or standing upon any public street, highway, alley, sidewalk or parkway in the city.(b)      It is unlawful for any person to street vend from any vehicle or commercial vehicle unless the driver of such vehicle or commercial vehicle has brought such vehicle to a complete stop and is lawfully parked adjacent to a curb. Such vehicle or commercial vehicle shall be deemed to not be lawfully parked for purposes of this chapter if it is parked in any of the following locations:

Chapter 5.36 of this code.H.    Signs used in conjunction with a vehicle shall be affixed to or painted on the vehicle.I.      Vehicles shall not be stationed for purposes of offering food, beverage or product for sale in any location which creates an obstruction to the normal flow of vehicular or pedestrian access, within ten feet of any intersection, driveway, or public or private building entrance, or in any space not designed for vehicular parking.J.      A person may sell products from a vehicle parked on any public street, alley or highway only when all of the following are met:

K.    No vending, peddling or soliciting from a vehicle shall be permitted for a period of time in excess of two hours in any one location.L.     Any vehicle used for vending, peddling or soliciting must be moved a distance of not less than two hundred feet between consecutive stops at which sales and/or service/activities occur.M.    The owner or operator of an itinerant restaurant shall not stop or cause to be stopped such restaurant for the purpose of selling food more than two items at the same location in one twelve-hour period, said periods commencing at twelve noon and twelve midnight, or remain in a single location for more than one hour.N.    Itinerant restaurants shall park within the required off-street parking areas, property setbacks, or driveway areas of properties on which they are temporarily located for the purpose of selling food in a manner not

Nonamplified sound making devices shall be permitted for such purposes provided: (i) such sounds shall not be made while the vehicle is stopped, parking or otherwise in a stationary position; and (ii) such sounds shall not be audible to a person with normal hearing for a distance of more than two-hundred feet.          O.      Any operator or vendor using scales or any other weighing or measuring devices shall have all such scales and devices inspected and sealed by the Weights and Measures Division of Los Angeles County.          P.       All foods, beverages, utensils and equipment offered for sale or utilized on vending vehicles shall at all times be protected from contamination and pollution by dust, dirt, flies, vermin, rodents, animals, unnecessary handling, droplet infection, overhead leakage, insecticides, rodenticide, cleaning compounds, and other poisonous or deleterious substances, and all other forms of contamination.          Q.      Each vehicle shall be equipped with a sign mounted to the rear of the vehicle warning of the presence of children. Said sign shall be in letters in sharp contrast to the background and shall be of such size, shape and color as tobe readily legible during daylight hours from a distance of fifty feet. B.   No person shall park or stand on any street, any lunchwagon, eating cart or vehicle, or pushcart from which tamales, peanuts, popcorn, candy or other articles of food are sold or offered for sale without first obtaining a written permit to do so from the city council which shall designate the specific location in which such cart shall stand.C.   No person shall park or stand any vehicle, or wagon used or intended to be used in the transportation of property for hire on any street while awaiting patronage for such vehicle or wagon without first obtaining a written permit to do so from the city council which shall designate the specific location where such vehicle may stand.D.   Whenever any permit is granted under the provisions of this section and a particular location to park or stand is specified therein, no person shall park or stand any vehicle, wagon, or pushcart on any location other than as designated in such permit. In the event that the holder of any such permit is convicted in any court of competent jurisdiction for violating any of the provisions of this section, such permit shall be forthwith revoked by the city council upon the filing of the record of such conviction with the city council, and no permit shall thereafter be issued to such person until six months have elapsed from the date of such revocation.

for more than 30 minutes in a residential zone, or 60 minutes in a non-residential zone, during any three-hour period and shall not return to any location within one-half mile of each prior location where the person sold or displayed liquids or edibles within said three-hour period. Said three-hour period shall commence upon the Peddler’s departure from the last location where peddling occurred. Any person described in this section, during all of the time which he or she is at any such location, shall maintain the location in a neat and orderly condition, pick up and dispose in a sanitary manner all debris, garbage, papers, litter and other things which detract from the sanitation, safety and appearance of such premises, and otherwise comply with the California Health and Safety Code. obtaining a permit from the city as required by Section 5.50.010 of this title.     (d)     No peddler shall stand or park any motorized vehicle for more than ten minutes on any side of a street that abuts a zoning district in which residential uses are the principal land use nor shall any peddler stand or park any motorized vehicle for more than thirty minutes on any street in any other area of the city. Regardless of the length of time parked at any particular location, no peddler shall park within five hundred feet of an area where he or she previously parked in the preceding four hours.     (e)     No person shall peddle from a vehicle products other than peddler using a motorized vehicle shall carry any  goods or food outside a ten foot radius encircling the motorized vehicle.     (f)     No peddler shall park or stand a motorized vehicle used for peddling in a manner which causes a hazard to vehicular or pedestrian traffic.     (g)     No peddler shall park a motorized vehicle in a residential zone from the hours of eight p.m. through seven a.m. of the next succeeding day.     (h)     No peddler shall sell or offer for sale any food from a motorized vehicle unless he or she maintains a clearly designated litter receptacle in the immediate vicinity of the vehicle, marked with a sign requesting use by patrons. Prior to leaving the location, the peddler shall pick up, remove and dispose of all trash or refuse which consists of materials originally dispensed by the peddler, including any packages or containers, or parts thereof, used with or for dispensing such food.     (i)     Between eight p.m. and seven a.m., the peddler shall not make any outcry, blow a horn, ring a bell, or use any sound devices or musical instrument upon any of the streets, alleys, parks or other public places of this city where sound of sufficient volume is emitted to be capable of being plainly heard upon the public sidewalks or streets, public parks or other public places, for the purpose of attracting attention to any goods, wares, merchandise or food which the permittee proposes to sell.     (j)     No peddler shall keep, maintain or operate any motorized vehicle used in selling food products in or upon any public street or other public place within two hundred feet of the nearest property line of any

property on which a public school building is located. This prohibition will not apply if the school principal gives the peddler written permission to park on school property to sell, give away, distribute or offer to sell any food products.     (k)     No peddler shall persistently and importunately peddle any goods, merchandise, wares or food to any member of the public after such member of the public expresses his or her desire not to purchase anything from the peddler.     (l)     No peddler shall intentionally or deliberately obstruct the free movement of any member of the public on any public sidewalk or street or in any public place.     (m)     No peddler shall peddle any items to a captive audience.     (n)     No peddler shall threaten any injury or damage to any member of the public who declines to purchase any items being peddled, if such threat, whether by word or gesture, would make a reasonable person fearful.     (o)     No peddler shall peddle or attempt to peddle to the occupants of vehicles standing or moving upon any public street or highway. Nothing in this paragraph shall be construed to prohibit peddling to the occupants of any vehicle that is lawfully parked.     (p)     No peddler shall park or stand the motorized vehicle in violation of any conditions included in the permit as provided under Section 5.08.120 of this title.     (q)     No peddler shall peddle from any motorized vehicle which has not been identified in the application.     (r)     No peddler shall stop, stand or park any motorized vehicle in violation of any provision of the California Vehicle Code or the La Puente Municipal Code.     (s)     No peddler shall peddle any food unless the items being sold comply with all applicable food labeling requirements established by the state of California and the peddler has all required permits, including, without limitation, Health permits, to sell such items.     (t)     No peddler shall peddle any goods from any motorized vehicle which does not have insurance as required under state law for operating the motorized vehicle.     (u)     Peddling from a motorized vehicle shall be

other refuse of any kind which were a part of the goods or merchandise supplied from the vehicle and which have been left or abandoned within twenty-five feet of such vehicle on any public property other than in a trash receptacle provided for such purposes. No vendor or operator shall dispose of any trash or refuse in any such public or private trash receptacle other than a trash receptacle owned, operated, or otherwise provided by and under the control of such vendor or operator.    N.  No vending shall be permitted except after the vehicle has been brought to a complete stop and parked adjacent to the curb in a lawful manner.    O.  Any vehicle from which vending occurs pursuant to this section shall have the name, address, and telephone number of the holder of the operator’s permit permanently affixed on both the left and right sides of the vehicle. Such information shall be in letters not less than four inches in height and shall be in contrast to the color of the background upon which the letters are placed.    P.   Except for vending from a vehicle on private property to provide meals for those living or working on such private property, no vending shall be permitted by any operator or conducted by any vendor except between the hours of nine a.m. and five p.m. Monday through Friday of each week.    Q.  No amplified sound making devices shall be used to draw attention to, or announce the presence of, such vehicle upon any public street immediately contiguous to any residentially zoned property within the city. Nonamplified sound making devices shall be permitted for such purposes provided (1) such sounds shall not be made while the vehicle is stopped, parking, or otherwise in a stationary position; and (2) such sounds shall not be audible to a person with normal hearing for a distance of more than two hundred feet.    R.   Any operator or vendor using scales or any other weighing or measuring devices shall have all such scales and devices inspected and sealed by the weights and measures division of Los Angeles County.    S.   All foods, beverages, utensils and equipment offered for sale or utilized on vending vehicles shall at all times be protected from contamination and pollution by dust, dirt, flies, vermin, rodents, animals, unnecessary handling, droplet infection, overhead leakage, insecticides, rodenticide, cleaning compounds, and other poisonous or deleterious substances, and all other forms of contamination. SEC. 80.73.  UNLAWFUL PARKING – PEDDLERS – VENDORS.

     (a)     It shall be unlawful for any person to stop, stand, or park any vehicle, wagon, or pushcart for the purpose of peddling, hawking, displaying or offering for sale therefrom any goods, wares, merchandise, fruit, vegetables, beverages, or food of any kind, on any street within this City except as provided for in this section. (Amended by Ord. No. 174,284, Eff. 12/8/01.)     (b)     Catering Trucks.  (Amended by Ord. No. 150,561, Eff. 3/19/78.)

     1.     Definitions:  (Amended by Ord. No. 173,264, Eff. 6/26/00.)  For the purposes of this Section, the following definitions shall apply:

     A.     “Street” shall mean all that area dedicated to public use for public street purposes and shall include, but not be limited to, roadways, parkways, alleys, sidewalks and public ways.     B.     “Catering truck” shall mean any motorized vehicle designed primarily for dispensing victuals.  For purposes herein, the term “catering truck” shall include any trailer designed primarily for dispensing victuals but only if attached to a motor vehicle at all times during which victuals are being dispensed.  “Catering truck” shall not include any other trailer or any wagon or pushcart, either propelled or drawn by motorized or other force, or any other vehicle incidentally used for dispensing victuals.     C.     “Dispense or dispensing” shall mean peddling, hawking, displaying for sale, soliciting the sale of, offering or exposing for sale, selling or giving away.     D.     “Victuals” shall mean fruit,

meat, vegetables, beverages or food of any kind, nutritious or otherwise, dispensed in prepared, packaged or other form suitable for immediate ingestion or consumption by human beings.  For purposes herein, victuals shall not include other goods, wares or merchandise.

     2.     Restrictions:     A.     (Amended by Ord. No. 173,264, Eff. 6/26/00.)  The dispensing of victuals shall be permitted on any street except at or from:

     (1)     Any trailer, wagon or pushcart not included within the definition of “catering truck”, except as may be authorized under Section 42.00 of this Code.     (2)     (Deleted by Ord. No. 174,284, Eff. 12/8/01.)     (3)     Any location within 100 feet of the nearest part of:

     (i)     any intersection, or     (ii)     (Deleted by Ord. No. 174,284, Eff. 12/8/01.)

     (4)     Any location within 200 feet of:

     (i)     Balboa Park, Banning Park, Robert Burns Park, MacArthur Park, the following portions of Griffith Park:  Riverside Drive between the Glendale Boulevard off-ramp and Los Feliz Boulevard, between the Los Angeles River and the City limits (Betty Davis Picnic Area); and Ferndell Drive between Los Feliz Boulevard and Red Oak Drive.     (ii)     The roadway of

any freeway on-ramp or off-ramp.

     (5)     Any location within 500 feet of the nearest property line of any school.  In the event of a conflict between any of the above specified distances and a greater distance otherwise required by law, said greater distance shall prevail and be controlling.

     B.     No person shall stop, stand or park a catering truck upon any street for the purpose of dispensing victuals under any circumstances in violation of stopping, standing or parking prohibitions or restrictions either shown by signs or curb markings or as otherwise provided by the State Vehicle Code or the health, safety, fire, traffic, business or other regulations set forth in the Los Angeles Municipal Code.     C.     No person shall dispense victuals from any portion of a catering truck on any street in any manner which causes any person to stand in that portion of the street which is between the catering truck and the center of the street.     D.     Persons who dispense victuals under the provisions of this section may not do so unless at that time they provide or have available in a conspicuous place in the immediate vicinity of the catering truck, a litter receptacle which is clearly marked with a sign requesting its use by patrons.     E.     After dispensing victuals, at any location, a catering truck operator, prior to leaving the location, shall pick up, remove and dispose of all trash or refuse which consists of materials originally dispensed from the catering truck, including any packages or containers, or parts of either, used with or for dispensing the victuals.

No. 177,620, Eff. 7/23/06.)  No catering truck shall remain parked at any residential location for the purpose of dispensing victuals, or at any residential location within a half mile radius of that location, for a period of time, adding together all time parked at each residential location, which exceeds 30 minutes.  Upon the elapse of that period of time, any catering truck that continues to be used for the purpose of dispensing victuals must be parked at a location more than half a mile distant, as measured in a straight line, from the location where the vehicle was parked at the beginning of the 30-minute period, and the vehicle shall not return to that location for at least another 30 minutes from the time of departure or relocation.  The requirement that a vehicle must be parked one-half mile distant shall only apply if the new parking location is in a residential area.     No catering truck shall remain parked at any commercial location for the purpose of dispensing victuals, or at any commercial location within a half mile radius of that location, for a period of time, adding together all times parked at each commercial location, which exceeds one hour.  Upon the elapse of that period of time, any catering truck that continues to be used for the purpose of dispensing victuals must be parked at a location more than half a mile distant, as measured in a straight line, from the location where the vehicle was parked at the beginning of the one hour period, and the vehicle shall not return to that location for at least another 60 minutes from the time of departure or relocation.     G.     (Added by Ord. No. 173,264, Eff. 6/26/00.)  Notwithstanding the provisions of Municipal Code Sections 114.04 and 114.05, no person

shall drive or operate a catering truck for the purpose of dispensing victuals unless such catering truck is equipped with an audible alarm which can be heard at a distance of 100 feet from the vehicle, which will be automatically activated in the event the vehicle backs up.  Such alarm must be installed within six months of the effective date of this regulation.     H.     (Amended by Ord. No. 173,854, Eff. 5/11/01.)  No person shall lease, sublease or rent a catering truck to any other person knowing that such person does not possess one or more valid licenses or permits required by the City or by the County of Los Angeles in order to dispense victuals from a catering truck. Provided, however, this provision shall not apply to any license or permit which cannot be secured until the vehicle is in the possession of the lessee, sublessee or renter.  Notwithstanding the provisions of Sections 11.00(m), 80.76, 80.76.1 and 80.76.2 of this Code, a violation of this provision shall be punishable by a civil penalty of $500.00 for the first offense and $1,000.00 for the second and each subsequent offense.

     (c)     (Deleted by Ord. No. 174,284, Eff. 12/8/01.)     (d)     No person shall park or stand any vehicle, or wagon used or intended to be used in the transportation of property for hire on any street while awaiting patronage for such vehicle, or wagon without first obtaining a written permit to do so from the Department which shall designate the specific location where such vehicle may stand. No permit shall be issued for any such location within the Central Traffic District.  (Amended by Ord. No. 134,523, Eff. 7/17/67.)     (e)     No person shall stand or park a vehicle upon any street for the purpose of displaying such vehicle for sale by sign or otherwise.  (Amended by Ord. provisions of this section and a particular location to park or stand is specified therein, no person shall park or stand any vehicle, wagon, or push cart on any location other than as designated in such permit. In the event that the holder of any such permit is convicted in any court of competent jurisdiction, for violating any of the provisions of this section, such permit shall be forthwith revoked by the Department upon the filing of the record of such conviction with it, and no permit shall thereafter be issued to such person until six (6) months have elapsed from the date of such revocation.  (Amended by Ord. No. 134,523, Eff. 7/17/67.)     (g)     (Amended by Ord. No. 173,264, Eff. 6/26/00.) Notwithstanding the provisions of Section 11.00(m) of this Code, every violation of any of the provisions of this Section which is punishable as an infraction, shall be punished by a fine of not less than $100 for the first violation, $200 for the second violation and $250 for each subsequent violation within one year.

THE CONTROL OF THE CITY:a. Findings: The city council finds and determines that its public lands (which include streets, sidewalks, parks, parkways, medians, and any lands or properties under its control) are to be used only for public purposes. The use of these areas is public and there is no vested right to conduct commercial business upon those public lands or properties.b. Vending, Peddling, Selling And/Or Soliciting On Public Lands, Rights Of Way Or Property; Regulated Or Prohibited:

1. No person shall vend, peddle, sell or solicit any merchandise, goods or services on a public street, sidewalk, park, parkway, median, land, real property or any other land or property under the control of the city. With respect to operators of commercial vehicles engaged in

vending upon a street, subsection 13-7b2 of this section shall be deemed controlling in the event of conflict with this subsection 13-7b1.2. The operator of any commercial vehicle shall not vend, peddle, sell or solicit any merchandise, goods, or services on a public street under the control of the city without conforming to all of the following:

(a) The vehicle owner or operator first shall have obtained a business license from the city clerk and shall have paid any required permit fee.(b) The vehicle operator and any assistant thereto shall conduct such commercial activities only between the hours of nine o’clock (9:00) A.M. and five o’clock (5:00) P.M.(c) The vehicle operator shall first bring the vehicle to a complete stop, and shall have lawfully parked the vehicle adjacent to the street curb.(d) The vehicle operator shall not park the vehicle within five hundred feet (500') of a public school or park or within two hundred fifty feet (250') of another vehicle engaged in vending,peddling, selling, or soliciting.(e) The vehicle owner or operator shall have obtained for each vehicle owned or operated thereby a comprehensive liability insurance policy which shall protect the owner, the operator and the city (as an additional insured) under the policy with types and amounts of coverage as follows: Bodily injury and property damage liability insurance, five hundred thousand dollars ($500,000.00) for each person and two million dollars ($2,000,000.00) in the aggregate; personal injury liability, one million dollars ($1,000,000.00) each occurrence; workers’ compensation and

employer’s liability, one million dollars ($1,000,000.00) each accident. The owner or operator of the vehicle shall furnish a certificate of insurance countersigned by an authorized agent of the insurance carrier on a form of the insurance carrier setting forth the general provisions of the insurance coverage. This countersigned certificate shall name the city as an additional insured under the policy, and shall contain a statement of obligation on the part of the insurance carrier to notify the city clerk by certified mail, return receipt requested, of any material change, cancellation or termination of such insurance. The required certificate shall be furnished by the owner or operator of the vehicle to the city clerk as a condition precedent to the city clerk issuing a business license for such vending, peddling, selling or soliciting and a copy thereof shall be carried at all times in the vehicle.(f) Every vehicle owner and operator shall consent to a background investigation by the city’s law enforcement personnel.(g) Every vehicle owner or operator involved in the sale or provision of food products of any kind within the city shall obtain and openly display a health certificate from the Los Angeles County department of health on each vehicle operated within the city for such purpose.

c. Exemptions: Except as provided in subsection 13-7b2 of this section, no person shall vend, peddle, sell and/or solicit any merchandise, goods or services on any publicly controlled lands, rights of way or property controlled by the city, except:

1. When the activity occurs at events as determined by the city council to be special events and the city specifically approves the

conducting of such activity at such special event by such person.2. When the activity involves the selling of books, newspapers, periodicals, magazines and other constitutionally protected forms of free speech.

d. Grounds For Revocation:1. In the event that the holder of any permit issued pursuant to this section is convicted in any court of competent jurisdiction for violating any of the provisions of this section, the permit shall be revoked by the city clerk upon the filing of the record of such conviction with the city clerk, and no permit shall thereafter be issued to that person or firm until six (6) months have elapsed from the date of the revocation.2. In the event that the holder of any permit issued pursuant to this section is convicted in any court of competent jurisdiction for violating any of the provisions of this section after being reissued a permit within a twelve (12) month period and after being convicted for a first time offense of said subsections within a twelve (12) month period, the city clerk shall permanently revoke said permit and immediately thereafter notify city council of said action(s)/violation(s). No permit pursuant to this section shall thereafter be reissued to the person, firm, business or company. (Code 1972 §28-8; Ord. #125, §1; Ord. #1271, §1; Ord. #1379, §6)
