Police Department Funding and Criminal Justice System Reform

Transferring Funds and Defunding● Elizabeth Alcantar, Mayor, Cudahy, CA, worked on the effort to decrease the sheriff

department’s budget, to be diverted to community programming (6/23/20)● Gregorio Casar, Councilmember, Austin, TX, proposed a bill with $93-123M worth of

changes to the Austin Police Department, which will ensure major reinvestment into services that make the community safer.

○ Reinvestments include: a new family violence shelter, permanent supportive housing, mental health response teams, victim services, a violence prevention office, gun violence intervention, substance use services, food access, youth programming, abortion access, and public health response to the pandemic.

○ The bill also removes functions from the APD and makes them independent, removing Internal Affairs from the police department, and making forensics independent (8/4/20)

● Jillian Johnson, Mayor Pro Tem, Durham, NC, (as a council member) led the push for higher wages for city workers rather than increased police spending (2019)

● Janice Li and Rebecca Saltzman, BART Board Directors, San Francisco, CA, proposed an amendment that would immediately shift $2 million from additional police officers to unarmed ambassadors instead (6/19/20)

● Teresa Mosqueda, City Councilmember, Citywide/Position 8, Seattle, WA○ Announced a launch to an inquest and is committed to the following principles:

■ Will not pass the Mayor's 2020 revised budget until the council goes through a simultaneous transparent deep dive into SPD's funding.

■ Defunding the police by ideally 50% and using those resources to invest back into communities the city has failed.

■ Invest in black-led organizers, organizations creating change so that they can continue to hold the city accountable.

■ Create anti-racist low barrier housing, investing in equitable transit, provide permanent supportive housing, providing housing options for survivors of violence and more.

■ Working with council colleagues, community organizations that are black-led, and leaders around the nation to adopt policies and procedures to transform the police department into a department that can truly serve and protect ALL of its residents

■ All members of council expressed support for this budget inquisition and to reinvest into community safety and stability

○ Signed onto a joint letter from elected officials throughout the Seattle region to send a unified and sole message: deescalate, defund the police, and reinvest in what makes our communities safe and healthy (6/8/20)

● Mariah Parker, Commissioner, Athens, GA, pitched a plan to defund police by 50% in the next ten years and fund a committee to study the plan for $50,000. Although the proposal was cut out of the final budget, most elements of the 50/10 Plan were adopted; such as bringing in house EMS dispatch for 911 calls, funding a third mental health co-

Use of Force Reforms● Luis Alejo, County Supervisor, Salinas, CA, condemned the killing of George Floyd and in

a referral called for a broad review and “community dialogue” of the county Sheriff’s Office use of force policies, as well as recruitment and training, inclusion of language and cultural sensitivity, crisis management, and dealing with people who have mental health conditions (6/9/20)

● Jesse Arreguin, Mayor; and Rigel Robinson, Council Member, Berkeley, CA, introduced and passed a far-reaching policy that, among other things, bans the use of tear gas (6/9/20)

● Park Cannon, 58th District; Bee Nguyen, 89th District; Renitta Shannon, 84th District; and Erica Thomas, 39th District, State Representatives, GA, filed a bill that requires law enforcement departments to create a “use of force” database that the public can access (1/17/20)

● Melvin Carter, Mayor, St. Paul, MN, updated the city’s use of force policies, which, notably, will help the police department distinguish between passive and aggressive resistance, more clearly define an officer’s duty to intervene, and increase the instances when medics must be called to a scene (6/5/20)

● Gregorio Casar, Councilmember, Austin, TX, helped pass items to ban tear gas, ban sonic weapons, ban facial recognition, ban munitions against protestors, and begin moving public dollars away from over-policing (6/11/20)

● Joaquin Castro, Congressman, 20th District, TX, reintroduced the Pride Act, which requires state & local law enforcement to track use of force incidents between civilians and officers (6/4/20)

● James Harnett, Commissioner, District 2A08, Washington, DC, helped pass emergency legislation to ban the use of chokeholds, ban the local police department from purchasing military equipment (and moving to sell/destroy what they already have), require the release of body camera video within 72 hours of a significant use of force, and remove the role of police unions in mediating disputes over the use of force (6/9/20)

● Leslie Herod, State Representative, 8th District, CO, introduced and passed SB20-217: Enhance Law Enforcement Integrity, which will enact several provisions to prevent police brutality and increase transparency and accountability in law enforcement, including: reining in use of deadly force by officers; ending qualified immunity; requiring public reporting on policing; preventing the rehiring of bad actors; creating a duty to intervene statute; restricting the use of chemical agents and projectiles; and mandating body cameras, creating penalties for tampering (6/12/20)

● Ras Smith, State Representative, 62nd District; and Zach Wahls, State Senator, 37th District, IA, introduced and passed the More Perfect Union Plan. This plan: bans police chokeholds, makes it illegal to rehire police fired for misconduct, and allows the Attorney General to investigate police misconduct (6/4/20)

● Miro Weinberger, Mayor, Burlington, VT, released updated use of force policy (6/5/20)● Braxton Winston, City Councilor, Charlotte, NC, introduced and passed a motion to stop

investigation or adjudication of alleged job-related misconduct by a law enforcement officer is not a personnel record for purposes of the Public Information Act; it also authorizes a custodian to deny inspection of specified records relating to alleged job-related misconduct by a law enforcement officer, subject to specified conditions (10/1/17)

○ Introduced body camera legislation, requiring all police officers employed by the Baltimore City Police Department to be personally equipped with digital audio and video recording devices (12/4/14)

● Lisa Bender, President; Phillipe Cunningham, Member; and Jeremiah Ellison, Member, City Council, Minneapolis, MN, drafted an ordinance to dismantle police and instead provide community safety and violence prevention department (6/26/20)
