The comment on the definition of “regulated article” was noted but as this term is defined in Article II of IPPC, it is not possible to amend its definition to explicitly include beneficial organisms. As regards to the term “test”, for beneficial organisms which are not regulated, the term “(official) analysis” can be used. For the TPG’s response to the comment on the definition of “visual examination” see comment 166, part 2.3. Absence of a term in the Glossary does not preclude its use in ISPMs when used appropriately. 4. Noted

Probably same terms in food safety and phytosanitary may be confuse, because they are same words but has different sense. Contamination in food safety has other meaning.

So the modification of the term by adding "of a pest" cannot be applied. Seeing that all the references to phytosanitary measures in the IPPC refer to the "narrow" inrterpretation - New Zealand does not agree with much of the supporting text.

Considered but not incorporated. The TPG refers to previous SC and TPG discussions on the interpretation of “phytosanitary measure” but does not wish to reopen the discussion.

Some ISPMs use the term “exclusion” or derivates with their common meaning (e.g. ISPM 15, ISPM 22 and ISPM 27). Deleting the qualifier would make it difficult to use the term for these other purposes. The use of a qualifier is also consistent with other Glossary terms, such as “control”,

IPPC Article VII (Requirements in relation to imports), paragraph 3, specifies that: “A contracting party may apply measures specified in this Article to pests which may not be capable of establishment in its territories but, if they gained entry, cause economic damage.”

By using the term "introduction" (i.e. “The entry of a pest resulting in its establishment”), the concept of exclusion could be misinterpreted as if it would only apply to pests which can establish, in conflict with the quoted Article.

For this reason, we suggest to replace “introduction” by “entry or establishment” in the proposed definition, so that it is clear that the applied phytosanitary measures may address either entry or establisment or both.

The term could be revised to correctly reflect its meaning. Pre-clearance, as a phytosanitary measure, became more important than before, since it minimize rejections in the entry point of the importing country and save import clearance time. The current definition of “Pre-clearance” is: “Phytosanitary certification and/or clearance in the country of origin, performed by or under the regular supervision of the national plant protection organization of the country of destination [FAO, 1990; revised FAO, 1995]”

The proposed revision by Bahrain will clearly define the term, since the term “Phytosanitary action” which Bahrain propose to add is already defined by ISPM#5 as: “An official operation, such as inspection, testing, surveillance or treatment, undertaken to implement phytosanitary measures [ICPM, 2001; revised ICPM, 2005]”

would correctly reflect a harmonized understanding of the term. This is underlined by the variety of comments received on the deletion of “pre-clearance” during the first consultation. “Pre-clearance” is used three times in ISPM 20, but other ISPMs and the new annex to ISPM 20 proposed for adoption at CPM-12 (2017) do not use the term (because countries could not agree on its meaning and definition). The TPG also recalled that it took the IPPC community 12 years to agree on the content of the annex that deals with only a minor part of what pre-clearance means worldwide. In the annex the concept is clear and therefore does not warrant a term. Should countries wish to have pre-clearance defined in the future, they may suggest that the term be included on the List of topics for IPPC standards. However, it is noted that the term may still be used by countries if they deem it is useful, and that this does not necessitate its definition in the Glossary.
