Chapter 1 General

1.1 Project Background

The Yangqiao Ship Lock is one of the major hydraulic structures which make up the

Fenquan River Hydraulic Engineering Project. The Lock directly concerns water

transportation of mass goods in Linquan County, since the water route finally joins with

the Yangtze River after taking the path of the Fenquan River, the Shaying River, the

Huaihe River and the Beijing-Hangzhou Great Canal. Linquan County is featured by

fertile land and abundant natural resources, which make it a national commercial grain

production base and one of the important energy industry bases in China. The direct

heartland of the Linquan spans across Linquan County, Fuyang County and Yingshang

County, and its indirect heartland can extend as far as Henan Province, cities along the

Huaihe River, Jiangsu, Zhejiang and Shanghai. Insomuch as the direct heartland is

concerned, Linquan is an important coal industry-pillared Chinese city as well as an

important transportation hub in East China. Apart from that, the city is a center of

commerce & trade and a regional hub of processing industries. With diverse

characteristics and advantages, Linquan promises an optimistic future outlook.

As national economy grows and resources development proceeds in the heartland, the

Ship Lock is witnessing increasing throughput handling accompanied especially by the

staggering production capacity of Linquan Chemical Engineering Co, Ltd. and the

constant growth of agricultural & sideline product processing. It is anticipated that the

annual throughput will rise to 4.80 million tons in 2020 and 6.1 million tons in 2030. Seen

from this perspective, the Yangqiao Ship Lock Extension Project (hereinafter referred to

as “the Ship Lock”, “the Project” or “the Work”) is a very important one.

The Ship Lock is set to be extended against Grade IV ship lock criteria, with a 500t

design tonnage for barges. A 180m-long chamber will be constructed, totaling a specified

volume of 180×12×3.5m (Length*Width*Water Depth at Lock Sill). The Project involves

a capital investment of approximately RMB161 million, including RMB9.958 worth of

environmental protection facilities. The Project plans to involve a construction period of

two years; that is, it is set to be completed and commissioned at the end of 2015. As for

construction plans, the Project will comprise the chamber, upstream & downstream lock

heads, upstream & downstream navigation channels, upstream & downstream approach

channels, berthing structures, highway bridge & link road, sluice gate &

electromechanical equipment, and control panel room & management facility.

Ambient Noise Level

Ambient noise level shall meet the Grade 2 and Grade 4a requirements of the

Ambient Noise Level Standard (GB3096-2008). Areas 30m of Building Line X017 shall

meet the Grade 4a requirements of the Ambient Noise Level Standard (GB3096-2008).

For the remaining areas, the Grade 2 requirements of the same standard shall apply. See

Tab. 1-2 for specific standard values. For noises in construction, refer to Emission

standard of environment noise for boundary of construction site (GB12523-2011), and see

Tab. 1-3 for specific values.

Surface Water Quality

  The Fenquan River shall meet the Grade IV water quality requirements of the Surface

Water Quality Standard (GB3838-2003). See Tab. 1-4 for specific values. The

impoundment in the Yangqiao Ship Lock is used primarily for field irrigation, water

transportation and industrial/domestic water along the route of the Project. Tail water

discharge shall meet the Grade 2 requirements of the General Wastewater Discharge

Control Standard (GB8978-1996). See Tab. 1-5 for specific values. The assessment

defines vessel waste discharge shall comply with the requirements of the Vessel Pollutant

Discharge Control Standard (GB3552-83). See Tab. 1-6 for specifics.

The Soil & Water Conservation Report for the

Fenquan River Yangqiao Ship Lock Project,

3. Maintain construction machinery as appropriately as reasonable in order to

sound barrier walls. Abide strictly by the Construction Site Noise Emissions

Control Standard. Forbid the use of big-noise equipment during night operation.

5. Reinforce safeguards and protective measures during the blasting of the old

ship lock. Issue prior notice to local residents before blasting operation. For

avoidance of hearing impairment, workmen and local residents are forbidden to

remain in the restricted area.

6. Arrange for the routes and time schedule of construction vehicles rationally.

Implement driving speed limits. Strengthen transport regulation for trucks nearby

the Site. Try the best not to blow horns so that traffic noise resulting from

congestion can be avoided.

7. Select construction vehicles according to the Allowable Noise Standard for

Motor Vehicles (GB1495-79). Prohibit non-conforming vehicles and equipment

from entering the Site.

8. Implement work ethics and install simple mobile noise barriers near the source

of noise. Surround the Site with enclosures to cut down on the travel distance of

noise.

1. Locate the Site as far from residential areas as possible, i.e. at places with less

interference to residential areas.

2. For the sake of dust prevention, promptly haul spoil out of the Site and cover

sand and cement with coverings. Sprinkle water on the Site and roads regularly to

effectively reduce fugitive dust. Wash the truck tires in time. Haul roads for earth

and mortar transport must be inspected and cleared to ensure tidiness.

3. Load spoil to a height below the baffle plates to reduce transport loss. Control

the speed of construction vehicle below 40km/h to reduce secondary fugitive

dust. Forbid the entry of construction machinery and vehicles if they fail state

exhaust emissions standards.

4. Surround sand/gravel storage yards with wind barriers. Locate stowage at

proper places to reduce potential fugitive dust. Clear broken sacks and cement

dust away from the ground in time. Sprinkle water on hauling roads from time to

time to keep the pavement humid. Cover the pavement with braided bamboo

mats and straw bags to reduce fugitive dust generated by passing vehicles and

wind. Store cement materials and the like at separate places. Clean away cement

dust in time away from the ground.

5. Enclosure the Site while the Work is going on. Surround the Site with railings

or barriers to reduce the impact of fugitive dust on neighborhoods.

6. Cover or sprinkle water on the excavated earth and haul it away as soon as

possible.

1. Ensure the GAR in the Ship Lock Area and on both banks of the

approach channel meets the environmental requirements. Plant trees within

20m of both sides of the ship lock management facility and the approach

channel.

2. Make every endeavor to reduce the duration and frequency of whistles

when getting into or out of the ship lock and the approach channels. Close

the door of the engine room. High-pitched and low-pitched whistles must

be available. Only the low-pitched whistle is allowed in and near the ship

lock.

3. Place gradual limits on the intensity of the whistling sound of vessels in

inland rivers. Make every effort not to blow the whistle at night in or near

the ship lock.

Chapter 3 Environmental Management Responsibilities

3.1 Environmental Management Organizations and Responsibilities

The following organizations are responsible for environmental management

during the construction period: APPSCI, Contractor, ESE and External Environmental

Consultant (EEC) (see Fig. 3-1). APPSCI takes environmental management

responsibilities during the operation period.

The following information describes the specific responsibilities of the above

stakeholders.

(1) Anhui Provincial Transport Dept. (Foreign Investment Administration Office)

Foreign Investment Administration Office (“FIAO”). Also, the FIAO is responsible

for liaising and coordinating with the World Bank.

(2) Anhui Provincial Port & Shipping Construction Investment Group (APPSCI)

APPSCI is responsible for total environmental management at the construction

stage. An Environmental Protection Branch accountable to one or two Environmental

Management Commissioners (“Commissioner”) will be set up as a subordinate to the

APPSCI Project Office. The Commissioner takes the following responsibilities:

Under the supervision and instruction of the APPSCI Project Office as well as

provincial/local/municipal level-environmental protection authorities, forestry

administrations and water conservation authorities, the Commissioner is responsible

for total environmental management. During the construction period, the

Commissioner shall submit to the Transport Department of Anhui Province

environmental management & monitoring reports on an annual basis, or data required

for preparation of such reports on a semiannual basis.

The Commissioner shall employ environmental monitoring agencies to conduct

environmental monitoring during the construction period and provide support for

environmental monitoring work.

The Commissioner shall ensure that the environmental management plans are

included in the bid proposals and the Agreement apart from supervision of the

pollution prevention & control measures adopted by the Contractor. In case that any

construction team breaches the environmental protection regulations or fails to take

pollution control & prevention measures, the Commissioner shall immediately notify

the construction team and the APPSCI Project Office. In case of any pollution

incidents, the Commissioner shall assist in addressing the incident.

The Commissioner shall ensure the environmental management plans are included

in bid proposals and the Project Supervision Agreement. The Commissioner will

supervise and participate in project supervision.

The Commissioner shall employ external environmental consultants (EEC) to

provide onsite technical support, supervision and instructions during the construction

period. Also, the EECs shall review the implementation of the environmental

protection measures. The Commissioner shall provide the Contractor with

environmental protection instructions and on-the-job training for project supervisors

and the Contractor. The Commissioner also assists the Owner to prepare semi-annual

reports.

(3) Contractor

The Contractor is responsible for implementing specific environmental pollution

control measures detailed in the environmental management plans and the Agreement,

making environmental working plans for the Agreement, reporting to the Project

Supervision Engineer on newly-emerging environmental problems or cultural relics

discovered by chance during construction, and coordinating & communicating with

local stakeholders on a continuous basis. The Contractor shall require the

Subcontractors to appoint one or two full-time environmental monitors to in charge of

environmental management and provide periodical training for workmen and

foremen.

(4) Environmental Supervision Engineer (ESE)

The Project Supervision Company shall, as specified by the Agreement, appoint

an Environmental Supervision Engineer (ESE) to be in charge of the following

responsibilities:

The ESE will, on behalf of the APPSCI Project Office, assess whether the Project

design complies with the requirements of the environmental impact assessment and

the environmental management plans, especially the requirements for Site

environmental managements and environmental impact control measures.

The ESE will supervise the Contractor’s Site environmental management system

(including performance, experience and incident responses) and give directives on

remediation, if applicable.

The ESE will supervise the Contractor’s implementation of the environmental

management plans and inspect & confirm the procedure, parameters, places,

equipment and results relevant to the environmental supervision plans.

The ESE shall report to the APPSCI Project Office on the execution of the

environmental management plans.

(5) External Environmental Consultant (EEC)

The APPSCI Project Office will employ external environmental consultants (EEC)

to supervise the execution of environmental management plans. The EEC directly

enters into the Consultancy Agreement with the Owner and assumes responsibility

independent of the Contractor and the Project Supervision Engineer. The following is

the duties of an EEC.

An EEC assists the Owner to provide training and consultation services.

An EEC reviews the environmental protection measures taken by the Contractor on

the advice of the Project Supervision Engineer.

An EEC assists with the preparation and submission of semiannual reports to the

APPSCI Project Office and the World Bank.

The APPSCI Project Office employs an environmental monitoring agency to

execute the environmental monitoring plans prescribed by the environmental

management plans.

(7) Anhui Provincial Environmental Protection Dept. and Municipal/County-level Environmental Protection Bureaus

The Anhui Provincial Environmental Protection Dept. is responsible for

supervising and managing the environmental protection work of the Project,

coordinating with relevant organizations and entities to provide environmental

protection services, reviewing environmental impact reports, supervising the

execution of environmental action plans, conducting acceptance test for

environmental protection facilities built for the Project, confirming the applicable

environmental laws, regulations and standards, and guiding municipal/county-level

environmental protection bureaus to supervise environmental management during the

construction and operation period.

Under the directions of the Anhui Provincial Environmental Protection Dept.,

Fuyang Municipal Environmental Protection Bureau and Liquan Environmental

Protection Bureau are responsible for overseeing environmental action plans executed

by the Owner, enforcing environmental management laws and standards, coordinating

with different sections to make concerted efforts in environmental protection, and

overseeing the construction, completion and operation of environmental protection

facilities in proper jurisdiction.

3.2 Environmental Monitoring Plans

Environmental protection efforts made during the preparation, construction and

operation stages will be monitored. See Tab. 3-1 for details on the governing

authorities, contents and objectives of the action plans:

environmental standards.

3.3 Environmental Supervision

Environmental supervision shall be conducted for the Work in an active way to

realize “clean production” in compliance with the Notice on the Performance of

Environmental Supervision for Public Transport Projects (issued by the Ministry of

Transport). The policy is intended to minimize ecosystem damage, maximize

ecosystem restoration during the construction work, conform to the environmental

protection requirements and make noise, waste gas and wastewater emissions meet

the relevant criteria. The relevant stakeholders shall ensure adequate investment in

environmental protection projects while securing that ecosystem protection/restoration

and aquatic environment protection efforts proceed in pace with the Work.

Environmental supervision is an important condition for the implementation of

environmental protection measures. As an important supplementary step for the

entirety of Project supervision focusing primarily on Work quality, environmental

supervision helps lay the groundwork for the environmental protection acceptance

procedure of the Work.

The ESE is an important role in the management and supervision hierarchy. For

this Project, it is very important to ensure the integration of the ESE into the ESE

system; in other words, the environmental supervision responsibility is specifically

defined and integrated into the Project Supervision Engineer Employment Agreement.

Meanwhile, the EEC is introduced into the Project supervision mechanism. The

EEC directly enters into an employment agreement with the Owner independent of

the Contractor and the ESE. The EEC assists the Owner in training, consultancy

services and review of the environmental protection measures taken by the Contractor

on the advice of the ESE. The EEC also assists with the preparation of semiannual

environmental monitoring reports during the operation of the Project as requested by

the World Bank.

3.4 Contractor Management

The Contractor is responsible for environmental protection at the construction stage

of the Work. The FIDIC Civil Work Evaluation Standard Form Contract thus provides

in Chapter19.1: “In the entire process of construction, completion and rectification of

other defects, the Contractor shall take every reasonable measure to protection the Site

and surrounding environment so as to prevent the Work from generating pollution,

noise or other consequences that may cause personal or financial damage or hindrance

to the public.”

For this Project, the Contractor will play a key role in the construction work,

especially in regard of environmental management, pollution control & prevention,

etc. Therefore, the following requirements are made of the Contractor.

A powerful contractor shall be selected so that the environmental management

plans can be effectively executed;

The Contractor and the Engineer shall receive training on environmental

protection and management before commencement;

Environmental impact control measures for the construction period shall be

included in the Bidding Document of the Contractor as well as in the Agreement as a

contractual requirement for the Contractor.

The Contractor is required to monitor its own environmental activities and submit

environmental performance reports on a weekly basis, which are to be reviewed and

approved by the APPSCI Project Office and the work supervision team.

The Contractor shall provide each subproject with one fulltime environmental

monitor, who is to receive further training programs in order to be fit for their job.

Throughout the construction stage, the Contractor shall communicate and consult

with the areas near the Site and post notices in each and every individual construction

site to provide the public with information on specific types and time schedules of

work. At the same time, contact information about the contact persons shall be

provided to facilitate communication of public complaints and proposals on the Work.

Chapter 4 Environmental Monitoring Plans

Purpose

Environmental monitoring is a must for both the construction stage and the

operation stage. Its purpose is to provide a basis for grasping full and dynamic

information of the Project in a timely way, understanding the local environmental

quality changes brought by the Project, understanding the scope of such changes,

obtaining dynamic information on environmental quality during the operation period

and feeding back information in a timely way to the governing authorities for

environmental management.

Monitoring Agency

Environmental monitoring for the construction and operation period involves

many aspects (e.g. noise emissions, the aquatic environment and ecology) and

requires highly sophisticated monitoring personnel and apparatuses. Therefore, it is

suggested that the Owner entrust the job to accredited professional entities.

Monitoring program

The environmental monitoring covers noise, water quality and ecological environment. The detailed monitoring tiem, frequency and items are listed in Table 4-1 and Table 4-2.

In addition to routine monitoring conducted by professionals in professional agency according to relevant regulations, the contractor and construction supervision unit can also carry out other monitoring.

Noise monitoring near the construction machinery and sensitive point with portable noise meter;

Visual checking of dust caused by temporary detour, piling yard of powder material, disturbed surface soil and transport trucks;

Visual checking of water quality of Fenquan River at upstream and downstream of approach channel site , and water quality of the rivers,and fish ponds into

which wastewater from the construction sites and camps is discharged.

Drawing on experiences from environmental management of other WB project, the contractor should be responsible for environmental supervision. Thus, the contractor and construction supervision unit shoud submit environmental monitoring report to the WB project office of Provincial Transport Department. Furthermore, they are required to report to the WB project office immediately when unexpected environmental pollution accident happens. The contractor can apply proper pollution control measures including professional agency to conduct monitoring. All of the monitoring facilities should be included in bidding documents so that bidding can meet the requirements and they can become parts of the contract. Meanwhile, the contractor and the construction supervisor should pay attention to these requirements. Anhui Provincial Transport Department and other environmental management and supervision agencies can aslo select good contractor according to these requirements.

Monitoring staff from the contractor and construction supervision unit should be trained before carrying out environmental monitoring. Transport Department will review monthly environmental rerport and check daily monitoring on site. The requirements about monitoring and reporting will be included in bidding documents and contracts with the contractor and construction supervision unit.

Environmental Monitoring Report

Construction Phase

During the construction phase, the Environmental Management Section should commission local environmental monitoring station to carry out monitoring according to construction periods of the channel improvement project.

During the construction phase, environmental monitoring report should be submitted monthly to the Construction Section and Municipal Environmental Protection Bureau.

Operation Phase

The monitoring results should be formally submitted twice a year to the WB project office of Transport Departmen or APPSCIG. The WB project office (APPSCIG) should collate and archive these reports. The envionmental monitoring reports are the basis for the WB and Provincial Environmental Protection Bureau to valuation the achievement of environmental protection, environmental impacts and the need of extra environmental protection measures for unexpcted impacts.

The main contents of the environmental monitoring plan include:

Estimation of Monitoring Cost

The monitoring cost at the construction phase is estimated as: 50,000 RMB * 2 years=100,000 RMB. The monitoring cost at the operation phase is estimated as: 50,000 RMB * 3 years=150,000 RMB. The monitoring results at first three years of the operation phase will be checked with prediction of environmental impacts. The monitoring program after that will be revised according to the results in first three years.

In addition, 50,000RMB will be remained for monitoring of emergency accident.

The cost of other monitoring conducted by the contractor and supervisor is included in contract price.

Chapter 5 Staff Training

Successful implementation of a Project environmental management plan depends

on the knowhow and working experience of environmental management and

environmental management staff. Meanwhile, with constant developments and

progress in science & technology, it is of vital importance to provide staff training and

improve the staff organization structure. Staff training programs may be provided

either at home or abroad. Overseas training shall be provided in countries with mature

experience in terms of roadwork construction and operation/management systems.

Domestic training programs may be provided in the form of lectures given by experts

from universities, environmental research institutes and professional consulting

agencies.

A retrospect of earlier experience indicates that the Contractor and the Project

Supervision Company must be strict with themselves in stepping up environmental

protection efforts. Even if such self-inspection is not the ultimate end, it can help them

develop a consciousness of environmental protection and help the Environmental

Management & Monitoring Authority better perform supervision responsibilities. The

Contractor, the Project Supervision Engineer s and their superiors must undergo

training programs in order to conduct self-inspection.

Chapter 7 Miscellaneous

Information Exchange

Environmental management requires information exchange between different

sections or positions within the same organization as a necessary step. Meanwhile, the

organization shall release relevant information to external third parties (stakeholders

and the general public).

Internal information exchange may take the form of meetings and bulletins. There

shall be at least one formal meeting every month and all information shall be recorded

and put on file.

  There shall be external information exchange once every half year or once a year.

Minutes shall be kept of meetings with the cooperators and put on file.

Records

The organization shall establish a well-developed recording system in order for the

environmental management system to function effectively. Records shall be kept of

the following aspects:

Applicable laws and regulations;

Permits and licenses;

Environmental factors and relevant environmental impacts;

Training programs;

Inspection, verification and maintenance activities;

Monitoring data;

Nonconformance;

Effectiveness of remedial and preventative measures;

Information about related parties;

Reviews;

Assessments;

  Besides, necessary control shall be exercised for the above records, including the

identification, collection, categorization, storage, management, maintenance, enquiry,

intended life period and destruction.

Reports

In the implementation of the Project, the Contractor, the Project Supervision

Company and the APPSCI Project Office shall report in time to the governing

authorities on such information as the progress of the Work, the implementation of the

environmental management plans (EMP) and the environmental monitoring results.

There are primarily the following three kinds of report:

Detailed EMP records maintained by the Environmental Monitoring Authority and

the Contractor. Reports shall be immediately submitted to the APPSCI Project Office;

Progress reports (e.g. monthly, quarterly and annual reports) prepared by the

APPSCI Project Office. These reports shall include such information about the

progress of EMP as the progress of implementation and effects;

EMP execution reports for the Project. Such reports shall be submitted to the World

Bank on a semiannual basis.

The EMP execution reports may include the following primary contents:

Implementation of the training programs;

Progress of the Project, e.g. the completed length of river channel improvement,

and construction process of the service area and the bridge;

Public complaints (if any). If any public complaint is lodged, the claims, solutions

and public satisfaction shall be recorded.
