Notice of Compensation payable to Owner and Licenseeof Delicensed Premises.

WHEREAS the Licenses Reduction Board did on the18th day of August, 1927, duly determine, in accord-ance with the Licensing Act, 1911, that the licensedpremises named or described in the first column of theschedule hereto should be deprived of its license, andthe said Board has awarded compensation in respectof such deprivation to the owner and licensee of suchpremises.

Now, therefore, notice is hereby given, pursuant toSection 93 of the said Act, that the amount of com-pensation so awarded in respect of such licensed pre-mises is as set out in columns II. and III. of the saidschedule opposite the name or description of the pre-mises, the amount in column II. being payable to theowner of the premises, and that in column III. to thelicensee thereof.

MARINERS and others arc hereby notified that theOuter Buoy on the South side of the Denham Anchor-age, Shark Bay, will be replaced by an A.G.A. WhiteFlashing Light Buoy situated approximately Latitude25 deg. 53 min. 30 secs. South; Longitude 113 deg. 14mins. East.

The Outer Buoy on the North side of Denham Chan-nel will remain as at present. The other three buoys onthe North side of the Channel will be removed and twoA.G.A. Flashing Light Buoys will be installed.

The first Light Buoy on the North side will be a RedA.G.A. Flashing Light situated approximately Latitude25 deg. 56 mins. South; Longitude 11.3 deg. 18 mins.East.

The second Light Buoy on the North side will be aWhite A.G.A. Flashing Light situated approximatelyLatitude 25 deg. 58 mins. 30 secs. South; Longitude113 deg. 22 mins. 30 sees. East.

These three light buoys will show a flash every threeseconds thus:

BELMONT PARK ROAD BOARD.By-laws relating to Buildings.

WHEREAS by "The Road Districts Act, 1919," theRoad Board of any District is empowered to make By-laws for all or any purposes in the said Act mentioned,the Belmont Park Road Board, in pursuance of thepowers vested in the said Board, under and by virtueof the said Act, and of every other authority enablingit in that behalf, cloth hereby make and publish thefollowing By-laws:

Interpretation.

"Act" means "The Road Districts Act, 1919.""Basement" means a storey or portion of a storey

partly below the level of the ground, the ceiling of whichis not less than five feet above the adjoining ground(irrespective of any excavation made to comply withthese By-laws).

"Cellar" means a storey or portion of a storey belowthe ground level, the ceiling of which is less than fivefeet above the adjoining ground.

"Cement mortar" Means a mortar composed of onepart of cement to three or fewer than three parts ofsand.

"Commercial building" means a building used orconstructed or adapted to be used wholly or in part forcommercial purposes.

"Dwelling-house" means a building used, constructed,ca' adapted to be used wholly or in part for human habi-tation, but does not include other than the dwelling-house portion (if any) of a. commercial building.

"District" means the Belmont Park Road District."habitable room" means any living room, and in-

cludes all rooms intended or adapted to be used forthe purpose of sleeping or eating or the cooking of food.

"Wall":"Divisional Hall" means a wall (other than an ex-

ternal or party wall) which subdivides any floor of abuilding' and carries any load in addition to its owndead weight..

"External wall" means an outer wall of a building,not being a party wall, even though adjoining a wall ofanother building.

"Partition wall" means a wall subdividing any floorand not carrying any load other than its own deadweight.

"Board" means the Belmont Park Road Board."Surveyor" means the person appointed by the Board

for the time being as Building Surveyor or actingBuilding Surveyor for the Belmont Park Road District.

1. Applications, Plans, and Notices.Before the erection of a building is commenced two

copies of the plans and specifications, together with thecost of such building, and an application in writing forapproval thereof, shall be submitted to the Board.

Provided that the Board may, if it see fit, dispensewith the necessity for the submission of plans and speci-fications, and reduce or dispense with the payment ofa fee with any application for approval to make minoralterations in an existing building, or to erect a build-irg to be used exclusively for the purpose of a green-house, conservatory, summerhouse, private boathouse,fuel shed, tool house, cycle shed, aviary, verandah, orthe like: Provided also, that any building (other than averandah or an aviary) used or intended to be used forthe keeping of domestic animals shall be wholly detachedfrom any dwelling-house: Provided also, that where itis desired to make some minor alterations to a buildingnot materially affecting its stability, lighting, ventila-tion, or size of rooms, the application may in the firstplace be made without submitting. plans and specifica-tions, which shall, however, be submitted if the Boardso require.

The application shall describe the building and showthe purpose for which the building is to be used.

The plans shall consist of a general plan and eleva-tions, and a block plan. The block plan shall show therelation of the building to ;the boundaries of the siteend to other buildings or structures thereon.

The specifications shall describe the construction andmaterials of which the building is to be built, and themethod of drainage, sewerage, and water supply, andstate whether the materials will be new or second-hand,and, if second-hand materials are to be used, shall giveparticulars.

When giving approval, the Board may impose a con-dition that forty-eight hours' notice shall be given priorto the covering of any or all of the following works inorder that they may be inspected, that is to say, trenchesbefore foundations are laid, foundations before trenchesarc filled in, and drains before they are covered in.

2.Fees and Permits.No person shall continence any building, erection, or

structure, or any addition or alteration to any building,erection, or structure without having first obtained fromthe Surveyor a written permit for the commencementof same, and without having first paid to the Board thefees in respect thereof set forth in these By-laws.

Each building, erection, or structure must be com-pleted within the undermentioned specified time fromthe date of issue by the Board of the permit there-f or :

(a) Brick, stone, or cementsix months.(b) All other buildingsthree months.

The fees payable in respect to buildings, erections, orres shall be as follows:

idcense for new buildings of wood, iron, or asbes-tos-2s.

License for new buildings of brick, stone, or con-creteSs.

for alteration or additions to existing build-ing-2s. (3d.

3.--General Provisions.Each building in a terrace of buildings or in a pair

of semi-detached buildings shall be .deemed to be aseparate building for the purpose of this By-law.

Every building shall be provided with one or moreproper manholes in the ceiling's so as to give access forelectrical and other fitting.

4. Site, Healthiness of.A person. shall not, without the written permission of

rite BOard, erect a building upon any site which shallhave been filled with any material impregnated withbeenI m: with animal or vegetable matter, or upon whichany such matter may have been deposited, unless andmail such matter shall have been properly removed byexcavation or otherwise from such site and depressionsfilled in with clean

Every person who shall erect a building shall causethe subsoil of the site of such building to be effectuallydrained wherever in the opinion of the Board the damp-MSS of the site renders such a precaution necessary.

No person shall commence to build any structure with-( ut having first provided proper and sufficient sanitaryaccommodation to the satisfaction of the Board for allpertiOlIS engaged or employed upon such structure.

Motor garages not exceeding three hundred squarefeet in floor area may be built in iron, brick, stone orconcrete, or other non-inflammable material anywhere inthe district, provided that the Board may require

(a) that any such motor garage be fifty feet distantfrom the frontage of any road or street (ex-cept in special cases where the iphysical con-figuration of the ground precludes such distancehieing observed) ;

(b) that any such motor garage be five feet distantfrom the frontage of any other road or street;

that any such motor garage be 10 feet distantfrom any building used as a dwelling-house onthe same allotment or on, any allotment ad-joining;

(d) that the motor garage complies otherwise with allthe conditions and limitations of this By-law in.regard to buildings.

Fowl-houses of not more than two hundred squarefeet in area and not more than six feet in height maybe erected at rear of any dwelling, provided that thenearest portion of such fowl-house is at least 30 feetfrom any building used as or intended for a dwelling,and at least four feet from the boundary of land not inhie same occupation.

Fowl-houses of larger area may be erected if at adistance of at least 50 feet from any street and 40tieet from any dwelling-house and at least four feetfrom the boundary of land not in the same occupation:Provided that the roof and walls are covered with gal-vanised iron. or other :fire-resisting material, approvedby the Surveyor, and that the building shall not he morethan seven feet high.

The Board may refuse or postpone approval to buildupon a site which is unhealthy by reason of its liabilityto dampness, unless and until the site has been rendereddry, sound, and well drained to the satisfaction of theBoard.

If the Board so direct in any particular case, thewhole or part of the ground surface or site of a dwellingshall be covered with a layer of good cement concrete,or tarred metal, rammed solid, and at least four inchesthick.

5.Position of Building Site.No building which is intended to be used or which shall

be used as a dwelling-house, and no addition to any suchbuilding shall be built, constructed, or erected withina distance of twenty feet measured horizontally fromthe building line of the street or road the building isintended to or shall front.

Except as hereinafter provided no building with anexternal wall of wood which is intended to be used orwhich shall he used as a dwelling-house, and no addi-tion with an external wall of wood to any buildingwhich is intended to be used or which shall be used ase, dwelling-house shall be built, constructed, or erected

(a) within a distance of four feet measured hori-zontally, of any street, road, lane, or right-of-way at the side of any such building; or

'(b) within a distance of ;four feet, measured hori-zontally, of any land not in the same possessionor oceupation. Provided always, that any suetbuilding or addition may abut on the build-ing line of any street, road, lane, or right-of-way at the side of such building, or he lessthan the pfoseribed distance therefrom, or fromland not in the same possession or occupation,or from a building or erection with an externalwall of wood: Provided that the wall or wallswhich abut on or face within the preseribeddistance such street, road, lane, or right-o f-way or land or building, or ereetion, as thecase may be, shall be of concrete at least sixinches in thickness, or of brick or stones atleast 81/:, inches in thickness, projecting in allcases at least one inch beyond the woodworkfront and back and at least one foot six inchesthrough the roof covering of gutter adjoiningthe same.

6.--Access to Bear.Where there is no public and convenient access to

the rear of the site of any building for the removalof nightsoil the building shall be so designed as to leaveoutside the building a way of access at least four feetwide from a public. road to the privy closet, and forthe removal of garbage and refuse.

7.Outbuildings.In the case of an application to erect (as appurtenant

to any building) any outbuilding from the use of whichunpleasant noises, unpleasant odours, or unusual risk offire may reasonably be expected to rise, the Board maydetermine in what position upon the allotment such out-Imildin.g may be erected.

S.Materials.The Board may define any portion of its district, and

by resolution prohibit the erection within that portion,of buildings with external walls of materials other thanbrick, stone, or concrete, or the like materials.

9.TentsCanvas. Buildings.The, Board may grant, subject to conditions, or refuse

permission to erect a structure of calico, canvas, orother textile material, and if any such structure iserected without the Board's permission, may order itsdemolition.

10.Materials and Workmanship.Materials which have been used in the construction of

any cesspit, drain, or sewer, or which for any otherreason are dangerous to health, shall not be used inI he erection of any building.

Faulty or unsuitable materials shall not he used inany building.

Every part of a building shall be erected and finishedoff in a good and workmanlike manner.

Bricks used in any building shall be good, hard, andwell burnt,. and if old or second-hand shall be thor-oughly cleaned and approved by the Board in Writingbefore being so used.

All brick or stone chimneys shall be constructed ofample flue, to be well plastered or pargetted inside forthe full height, and no timber of any description will

allowed to be built into the brickwork. The Boardgive authority to erect iron chimneys, but in the

erection they shall lie laid on either stone or concretebase and free from all woodwork.

Hearths of stone, brick, cement, or iron of approveddimensions shall be placed in front of all fireplaces.

11.Testing Materials.The Board may test any building materials, and pro-

hibit the use of such materials as are proved unfittedfor the purpose for which they were intended to be used.

12.--Timber Construction.All timlers used in any buildings shall be of good

sound ma e. iii, free from rot, free from large andloose knots, am; free 'front shakes, and free from anyin wrf cot ;i' is it-he rimy the strength of the timber mayIle impaired.

(i) Stumps shill not be less than 4in, x 4in. jarrahor other approved timber, spaced 5 feet centreto centre, alD1 fixed on 6in. x 11/iin, sole-plates.Stumps shall lw tarred and sunk at least halftheir length in the ground, provided that nostumps sit ill lie less than 2 feet in the ground.Tarring is to extend fm' inches above theground surface.

(ii) Studs and ceiling joists shall not be less than4111, x 2iii., spaced not more than 2 feet apart,centre to centre, properly secured and braced.Studs and ceiling joists of 3in. x 2in. may beused, provided they are spaced 1Sin. apart,centre to centre, properly braced and secured.Where studs of '3in, x 2iu. are used the angleor corner studs shall be of 3in. x 3in.; where 4in.by 2in.. stuns are used, the angle studs shallhe of x

(iii) shall not be less than 3in. x 2in., spacednot, more than 3 feet, centre to centre, in the'a se of iron roofs, and ].S inches, centre tocentre, in the case of slate, tile, or other similarroofs; lin. x 2in. rafters may be used, butmust be spaced at 2 feet centres for slatesor tiles. and not more than 3 feet apart forany type of roof. All rafters must be securelylir:twat with purlins and collar ties.

(iv) Floor joists shall not be less than 4in. x 2in.,spaced 1 Sin, a part, centre to centre.

(v) bearers shall not be less than 4in. x 3in.,spaced not more than 5 feet apart.

No framing timber in any building shall be notchedor checlwd out to receive bracing or otherwise so as toreduce ifs cross sectional area more than one-sixth.

13.Awnings and Verandahs.The hoard may require that any or all awnings or

verandahs proposed to he erected over a public placeshall lie of the cantilever type. No verandah shall beenclosed for living or sleeping purposes without thehoard's written consent.

14.Footings.Every person who shall erect a building of 'brick,

stone, or the like shall construct every wall or such build-ing', unless built upon a hard rock foundation, to restupon proper footings, or upon a sufficient beam.

He shall cause the projection of the bottom of thefootings On each side of such wall to be at least equalto one-half the thickness of the wall at its base, unlessan adjoining wall interferes, or unless the wall is uponthe boundary of the land, in which case the projectionmay be omitted on the side of the boundary, or wherethe wall adjoins.

TIe shall also cause the diminution of the footings tolie in re-ular offsets, unless the footings he of conerete.The from the bottom of such footings to the baseof the wall shall be at least equal to two-thirds of thethickness of the wall at its base: Provided that whenthe footings are of reinforced concrete the Board maypermit the height to be less: And, provided further,that it shall not in any case he less than 12 inches.

Footings to walls of brick in cement mortar (3 to ] )shall be the same width and height as those to wallsof the same thickness not built in cement mortar.

Vermin plates shall be provided to all walls other thanbrick, stone, or concrete.

15.:Dampeourse.Every person who shall erect a building shall provide

and insert damp-proof courses of lead,, slate bedded incement, or 'natural asphalts: Provided that the Boardmay permit the runisslon of damp-proof courses fromclosets, outbuilding's, and the like structures.

Where material which is not slate, natural asphalte,or lead of a mininmm weight, of two pounds Iper squarefoot under walls not exceeding 40 feet in height, orthree pounds per square foot under walls exceeding 40feet in height is desired to' he used, the applicant shallsubmit to the hoatd evidence that the material to heused. has been approved by the Board of Health, or,Calling such evidence, that the material is a good andeffective damp-proof course.

Damp-proof courses shall be inserted in walls to theirfull width and in such 'manner that there shall be noopen spaces, cracks, or gaps in the damp-proof coursesalong the full length of the walls.

Damp-proof courses shall lie inserted in walls in suchpositions and in such manner that

(a) moisture from the earth shall be prevented fromreaching the lowest ,floor timbers or the wallsabove the underside of the lowest floor joists, or,where solid floors :Ire laid, shall be preventedfront reaching higher than 1/, inches abovesuch floors;

(b) where floors are below outside ground level, mois-ture shall be prevented from reaching inner faceof miter walls;

where cavity walls are used, moisture penetratingouter portion of walls shall he prevented fromreaching the floor timbers, or the inner por-tion or face of walls above the undersideof the lowest floor timbers, or, where solidfloors are laid, shall be prevented from reachinghigher than. 33/4 inches above such floors;

moisture penetrating: the chimney, parapet, orother walls above roof shall be prevented fromreaching in any part the inner walls or theinner portion of inner face of :outside wallsbelow the upper side of the ceiling joists iueither case;

(e) moisture penetrating the outer portion of cavitywalls shall he prevented from reaching. theinner portion or inner face of such walls shoveor about window, door, and other frames oropen i ngs.

'ln cavity walls the cavity shall extend not less than41/, inches below 'damp-proof course.

This clause shall apply to walls constructed of brick,stone, or concrete, and to walls of any material readily.permeable by water.

'Wolls--Structure.Every person who shall erect a [wilding shall cause

the external walls thereof` to he constructed of brick,stone, concrete, I imber, or other material approved bythe Board.

If built of brick, stone, conerete, or the like, the OK-ternal walls shall, except where herein provided to thecontrary, in' Het less flan 9 inches in thickness; Pro-vided that the walls of sheds, laundries. outhouses, :oilthe like, not. exceeding 10 feet in height, limy, it theBoard so permit, be of 144, 'inches thickness.

C=avity walls many he built, provided the two sectionsare securely tied. together by a sufficient number of wireties or other effective method, and when used the com-bined thickness of the inner and outer parts shall hedeemed to be the thickness of the wall.

Bottoms of all cavities shall be carefully raked 'outbefore the completion of the building, and all ties keptfree from mortar droppings.

Where cavity walls are used ltoles shall be leftat foot of cavity not more than six feet apart and overall damp -proof courses inserted to protect walls weep-holes 'shall he left not more than three feet apart.

Notwithstanding anything to the contrary in thisclause, the Board may penult the erection of dwellingsnot more than two storeys in height of concrete withwalls of less than the prescribed thickness, if satisfiedthat such proposed dwellings will be hygienic and struc-turally sound.

20.--Other Booms.Every habitable MOM which is not a roma wholly or

partly in the roof of a building shall be not less thannine feet in height: Provided that bays, inglenooks,and recesses for furniture may be added to suell roomswith ceiling's of a less height than nine feet, but theceilings of such hays, and inglenooks shall not be lessthan six feet eight Mello.; in height.

21. Mounts for places of Assembly.A. building in which there is :1 room designed, intended

Such exits ;ma staircases earl the passages connectingthem shall be of a iotal width calculated in the pro-portion of 20 inch, . for every 600 superficial feet ofhoer area, or fraction thereof, iii such room; but nopassage, stair, or exit shall be less than three feet sixinches in width, not more than 10 feet in width.

Such stairs shall be uniform throughout with risersnot more than seven inches high and treads not lessthan 10 inches wide exclusive of nosings, if any. Eachflight of stab's shall contain not less than three normore than fifteen risers. There shall be hand-rails oneach side, securely fixed, and staircases over six feetin width shall have a centre hand-rail.

The stairs and landing shall be of such strength as tohe capable of carrying with absolute safety the largestnumber of people who may be reasonably expected touse them at one time.

All doors used as exit doors from any such room shall,except where otherwise approved, he hung- in two folds,fitted with "panic" bolts and be made to open out-

wards towards the thoroughfare or way. All doorsbetween such rooms and the open air shall lie hung soas not to obstruct, when open, any gangway, passage,stairease, or landing. A door shall not open imme-diately upon a flight of steps, but a lauding of at leastequal depth to the width of the door shall be providedlietween such steps mid such doorway.

for every 1,000 cubic feet or part thereof of air spacein the room there shall be 24 square inches at the leastof unobstrueted ventilation to the outer air by meansof air-bricks situated at or near the level of the ceilingor :my other efficient Means.

24 .-11 oomsW ludo w 8.Every habitable room, or room or alcove, iii which

:food is intended or likely to be stored or prepared, andevery bathroom, enclosed laundry, and privy-ekiset shallhave at least one verti,.:d windoW opening directly tothe outside air. One-half at least of such ,window shallbe constructed to open to its full extent, and so thatthe opening may extend to the top of the window:Provided that in a -pantry any other system of ventila-thm may be substituted for windows if the Board besatisfied that such system is equally efficient.

25.BedroomsAdditionat Ventilation.In every bedroom or room intended or adapted to be

used for sleeping and having only one window, thereshall be jirovided eross ventilation by means of at least21 square inches of unobstructed opening ill some wallof the room other Own that in which the window is situ-ated. Such opening may be by an additional window,Ii re-place, fanlight, air-briek, or any suitable means.

26.--Height of Windows.The top of a window of an enclosed laundry or of a

kitchen, or alcove, or room in which food is intendedla' likely to be stored or prepared shall not be less thansix .feet eight inches front the floor.

27.Size of Windows.The window or windows of any room shall have a

superficial area (clear of the sash frame) not less thanone-tenth of the floor area of the room, or (if the fol-lowing size be greater than one-tenth of the floor area)not less than 10 square feet for the windows of a kit-chen or alcove or room in which food is intended. orlikely to be prepared, not less than six square feet, forthe windows of an enclosed laum'iry, not less than 31hsquare feet for the windows of a bathroom, not lessthan two square feet for the windows of a privy-closet,and not less than I i2 square feet for any other room.

2S..Laundries and Kitchens.A dwelling of tftty kind shall not be erected with the

kitchen and laundry combined in one room.

29.Windows.Any windows the top of which is more than 12 feet

above either the ground or any external flat surface orslightly sloping roof sufficient for safety shall be soeonstructed that it can be cleaned from the interior ofthe building.

30.--DrainageLevels.Every person who shall erect a building shall con-

struct the lower storey of such building at such a levelthat, in the opinion of the Board, it may be practicableto construct a drain sufficient for the idiom-I-nal drainageof such

31.Miscellaneous.The Board may permit the enclosure and use of any

of any skylight in any building if such skylight be, inthe opinion of the Board, in such a condition as to bedetrimental to health or dangerous.

U.Existing Building's.If in the opinion of the Board any building has been

allowed to fall into an unsafe or insanitary conditioneither by faulty construction or any other cause, theBoard may give notice in writing to the owner or occu-pier to repair said building', and in the event of no:lotion being taken within seven clays by the said owneror occupier to remedy- any defect complained of in thesaid notice, the said owner or occupier shall be liable toa fine, as hereinafter provided, until such time as thebuilding shall be placed in a safe and sanitary condition,and the owner or occupier will be liable for all chargesincurred in doing the necessary works, and, moreover,if in the opinion of the Board any building does notwarrant the expense of repairing, the owner, after re-ceiVia g notice, sb tI 1 remove the building, within seven(7) days; failing this lie will be liable to a fine as here-inafter mentioned, to remove the building after receivingthe notice; the Board may remove saute and charge theowners with the cost of so doing and recover the sautein any court of competent jurisdiction and/or sell thematerial to cover the cost of taking clown.

34.--Removal of Buildings.o building or erection shall lie removed into and

or re-erected in the Road District or removedHim Itie part of the district to and erected and re-

ernmited in another part thereof unless the owner orper.,:on carrying out the removal first obtain written per-mission front the Board to do so. Before such permis-sion shall lie granted not less than seven (7) clear days'notice in writing shall be given to the Board or theSurveyor of the desire to remove and erect or re-erectsuch building or erection.

Such notice shall contain or lie accompanied by thefollowing:

(a) Particulars of the situation of building which itis proposed to remove.

(it) Particulars of the situation of and plan of theland upon which it is proposed to erect or re-erect or place such building, showing the pro-posed position thereon, and a tracing copy ofsuch plan to lie retained by the Board.

(e) A Idan giving the dimensions of the building andany proposed alterations or additions theretoand a tracing copy of such plan to be retainedby the Board.

(a) A specification giving particulars of the con-struction of the existing building and of thealterations and. additions (if any) which it isintended to make when the building is erectedor re-erected.

(e) Evidence satisfactory to the Board that suchhouse has not been condemned as dilapidated,insanitary or unfit for human habitation, anda certificate from the Health Officer of theRoad District from which the building is pro-posed to lie removed that within a reasonabletime prior to date of removal no case of dis-ease of an infectious or contagious nature hasoccurred therein.

(f) Such further particulars in writing regarding the-imine as shall be sufficient to enable the Boardor its Surveyor to determine if all the pro-

No building or erection that has been condemned asdilapidated, insanitary, or unfit for human habitationshall be removed into or re-erected within the RoadDistrict.

No building or erection in which any case of infec-tious or contagious disease has occurred during the pre-ceding six months shall be removed into or re-erectedwithin the Road District.

No removed building shall be occupied until the Sur-veyor shall have certified in writing that all the pro-visions of this By-law have been observed and compliedwith in respect of such building.

Nothing herein contained shall prevent the alterationof the position of any building within the boundariesof the land on which the same stands: Provided thatin its altered position it shall comply in all respectswith this By-law, and that in the progress of such re-moval the building be not taken on to any street, road,or public place.

No dwelling shall consist of less than three main roomsof a total of not less than 300 isqUare feet, and nobuilding or rooms thereof shall be occupied for livingpurposes until at least three main rooms shall have beencompleted according to the plans and specifications sub-mitted to and approved by the Board.

The Board may in special cases grant permission forthe erection of a dwelling-house containing not lessthan two rooms.

35.Proportion of site which may be covered.A dwelling-house, together with its appurtenances to

be erected on an allotment, shall not occupy more thantwo-thirds of such allotment, and the minimum of un-occupied area shall not be less than 500 superficial feet:Provided that this shall not prevent the Board fromgranting approval to the erection of a dwelling-houseoccupying more than two-thirds of an allotment, orwith a minimum of unoccupied area of less than 500superficial feet, in replacement of an existing dwelling-house which occupies more than two-thirds of that allot-ment, or has a minimum of unoccupied area of less than500 superficial feet, as the case may be: Provided,also, that where situated on a site considered by theBoard to be an established shopping locality, the Boardmay permit a building which is to be a shop and dwelllug combined to occupy not more than four-fifths of theallotment, subject to the 'Inbuilt upon area being notless than 500 square feet.

Provided also that a garage erected at a low level, theroof of which serves as a portion of the garden, yard,or court, shall not be included as a building in calcu-lating the proportion of the area of the allotment thatmay be occupied by a building.

After the adoption of this By-law all subdivisions orre-subdivisions of allotments must be such as to havea frontage to a street or road of not less than 50 linealfeet and a depth of not less than 140 lineal feet. Suchsubdivisions and resubdivisions must be lodged with theBoard for approval before commencing to build, andshall apply throughout the whole of the Belmont ParkRoad District.

No shop shall be built on land having a frontage ofless than 18 feet to a street or road and an averagedepth of 130 feet. There shall be back access fromright-of-way 10 feet wide at least. For the purposes ofthis clause the Board may agree to a subdivision withfrontages less than 50 feet, but notwithstanding anysuch approval no dwelling shall be erected upon thesubdivided land except in accordance with these By-laws.

No land upon which any dwelling-house has beenerected shall thereafter be reduced in area below theminimum area prescribed by this By-law. Provided al-ways, that notwithstanding anything hereinbefore pro-vided to the contrary the Board may on application inwriting setting forth the grounds of the application,under special circumstances, and for special causes, andat a meeting of which due notice has been given to eachmember, declare that the provisions of this By-laweither in whole or in part shall not apply to any par-ticular area of land.

No building shall be erected in such a position thatit shall lie between another building or any part thereofand street unless such other building has a direct andunobStructed access to some other street at least 16 feetwide.

36.Space outside Windows on side Land.If there be, any side wall of a dwelling-house in which

it is proposed to provide a window or door opening,that wall shall be set back (throughout its whole length)

from the side-line of the allotment to a distance of threefeet, in the ease of a dwelling of one or two storeys, orto a distance of five feet, in the case of a dwelling ofmore than two storeys.

37.Kitchen, Laundry, end Bathroom Fittings.Every dwelling -hours shall be provided with a com-

pletely enclosed. bathroom, or combined bathroom anillaundry, and with wash-tubs and copper, or other meansof washing clothes, and the water laid thereto. Thefloor surfaces of bathrooms on any floor, and of laun-dries when above the ground floor, shall be of imperviouSmaterial properly graded and drained. The wash-tubs,copper, and bath shall not be placed in the kitchen.

One bathroom in each lwelling-house shall have atleast 30 square feet of floor area and a combined bath-room and laundry shall have at least 56 square feet offloor area. Provided that the Board may in any easewhere. it considers that a bathroom or laundry could bedispensed with, exempt any building from the aboveprovisions, but such exemption shall be given by reso-lution of the Board.

38.EnforcementInspeetionCutting into Building.The Board may order the opening, or cutting into, or

pulling down of any work where the Board has reasonto believe or suspect that anything has been done incontravention of the Act or of any By-law, and in theevent of the work being found to have been done incontravention of the Avt or of the By-laws, the person.doing the work shall be required to comply with theAct or the By-laws, and shall bear the full cost of suchpulling down, opening, or cutting into and of compliancewith the Act or the By-laws.

In the event of the work being found to have beendone in accordance with the requirements of the Actand the By-laws, the cost of such pulling down, open-ing, or cutting into, as well as the cost of reinstatement,shall be borne by the Board.

The Surveyor or his representative shall have powerto enter at any time upon ally building in course oferection for the purpose of inspecting the said building,and may require the production of the approved plansthereof, which are to be available on the building dur-ing working hours whilSt the building is incourse of construction.

89.Inspection before Occupation.Before permitting any person to occupy or use any

anconipleted building, and forthwith upon completionof any unoccupied building, the person by or in conse-quence of whose order the building, is being erected shallgive notice to the Board.

Forthwith upon receipt of notice as aforesaidthe Board shall instruct the proper servant tomake an inspection, and such servant shall in-spect and report to the Board whether or not thebuilding has been erected in accordance with this By-law and without material deviation from the approvedplans and specifications, but this shall not be read topermit any alteration whatever in the position of thebuilding on the site.

Such report shall not be deemed to be evidence (inthe event of any prosecution hereunder) that this By-law has been complied with.

40.Penalties.Any person who erects a building in contravention

of this By-law, or any person who neglects to complywith any provision set forth therein, shall be liable toa penalty not exceeding Ten pounds, and also a dailypenalty of One pound per day for any continuance ofthe offence.

No. 21 of 1927.THIS Agreement, made in pursuance of "The indus-trial Arbitration Act, 1912-1925," this twenty-seventhday of August, one thousand nine hundred and twenty-seven, between The Shop Assistants and Warehouse Em-ployees' Industrial -Union of Workers, -W.A., :DenmarkBranch (hereinafter called " the Union"), of the onepart, and J. H. North; Nockolds Bros.; R. Nockolds;H. & E. Rickey; Denmark Co-operative Company,Limited, and H. S. Craig, being persons, firms, or com-panies carrying on retail business in the State of West-ern Australia (hereinafter called "the Employers"), ofthe other part, witnesseth, that for the considerationshereinafter appearing the parties hereto mutually cov-enant and agree the one with the other as follows:

1. Area.This Agreement shall be limited in itseffect to the area comprised within a radius of tenmiles from the Post Office, Denmark.

2. Term.This Agreement shall operate as from theday of the date hereof, and shall continue in force fora period of three years, subject to the right of eitherparty to apply to the Court of Arbitration at any timeafter the expiration of twelve months from such date,and at the end of any succeeding twelve months fromthe date of any such application, to amend this Agree-ment.

3. Definitions.In this Agreement, unless the contextotherwise indicates:

The term "Shop Assistant" includes employees inCountry Order Departments, cashiers, and carpet andlinoleum layers and planners.

The term "Casual Hand" shall mean an employeeengaged by the hour and who may be put off or leavethe employer's service at any moment without notice.Provided, a casual hand shall be employed for not lessthan four hours in any one clay.

The term "Weekly Hand" shall mean an employeeengaged by the week and whose employment shall beterminable by not less than one week'r, notice on eitherside. Such week's notice cannot be continued fromweek to week. Provided that any worker employed fora period of four consecutive weeks or less shall beclassed as a casual hand and paid not less than theminimum rate of wages herein prescribed for a casualhand, but this proviso shall not apply in cases where a.worker employed as a "weekly hand" has been dis-pensed with for incompetence or unsuitableness or anycause referred to in paragraph 12 hereof.

4. Hours.Excepting as mentioned in Subclauses(a) and (b) hereof, forty-seven hours shall constitute aweek's work for males and forty-four hours for femalesand males under 16 years of age, and shall be workedbetween 8 a.m. and 5.30 p.m. on every Monday, Tues-day, Wednesday, and Thursday, and between 8 a.m. and6 p.m. on Fridays and 8 a.m. and 12 noon on Saturdays.Not more than one hour shall be deducted for meals.The exceptions referred to are:

(a) Messengers, cleaners, and employees in shopscomprised in the Fourth Schedule of "TheFactories and Shops Act, 1920" (exceptingrestaurants, coffee palaces, boarding-houses, andhotels), whose hours of work shall not exceed47 per week for males and forty-four per weekfor females and males under 16 years of age,and shall be worked to suit the convenience ofthe employer.

(b) On the day mutually agreed upon by the partiesto be observed as Christmas Eve, for the pur-pose of a late shopping night, the ordinaryhours of work may be extended and ordinaryrates of wages shall be paid for such extended.time.

5. Overtime:(1.) In the computation of overtime each day shall

stand alone, excepting in the case of workersmentioned in Clause 4, Subsection (a), whoseovertime shall commence, in the ease of males,after forty-seven hours have been worked inany one week, and in the case of females andjunior males under 16 years of age, after forty-four hours have been worked in any one week,

(2) Overtime shall be at the rate of time-and-a-halffor the first four hours and thereafter at therate of double time.

(3) Excepting as provided in Clause 4 (b) all workdone on Saturday afternoons, Sundays, andholidays set out in Clause 6 (a) shall be paidfor at the rate of double time.

6. Holidays:(a ) The following days 8101 be observed as holidays

and paid for, namely:New Year's Day, An-niversary Day, Good Friday, Easter Saturday,Easter Monday, A nsas, Pay, Labour Day,'Foundation Day, Christmas Pay, and BoxingDay.

(b) A holiday of one week on full pay shall be grantedto each employee on -completion of each yearof service. An employee not completing oneyear of service shall be granted pay in lieu ofholidays in proportion of the length of his orher service. Provided, that when an employeeis entitled to holidays 1 this clause he shallonusreceive at least two weeks' notice from hisemployer of the date when it will be convenientto the employer that such employee should takehis holidays. Provided further, that this clauseshall not apply in the case of any employeesummarily dismissed for misconduct or derelic-tion of duty.

7. Wages.Basic wage, males, £4 5s. per week;females, £2 5s. lld, per week.

(a) Adults.The minimum weekly rate of wage pay-able to adult workers shall be as follows:

Males: Shop assistants, storemen, carters, des-patch hands, packers in all Departments or Stores,£4 15s. per week.

Females: Shop assistants in all Departments orShops other than Groceries, £2 16s. per week.

Canvasser and Collector, £4 19s. 6d. per week.(But where such canvasser or collector provides

his own bicycle he shall be paid an additional2s. 6d. per week.)

(b) Juniors.The minimum weekly rate of wage pay-able to junior shop assistants, storemen, despatch bands,and anissengers shall be a.s follows:

juniors, plus 11/0d. per hour.8. Any person, whether junior or adult, employed

as a canvasser and/or collector shall be paid the fulladult minimum wage.

9. Nothing herein contained shall entitle the em-ployer to reduce the wage of any worker who, at thedate of this Agreement, was being paid a higher rateof wage than the minimum prescribed for his or herclass of work.

10. Higher Duties.--A worker who is required to dowork which is entitled to a higher rate under this Agree-ment than that which he or she actually performs shallbe entitled to payment at the higher rate whilst so em-ployed.
