made in the long-term reauthorization of

the surface transportation program and the

annual appropriations process.

President Signs Final FY 2011 Funding

measures over the past six

months, funding for highways

remains at the FY 2010 levels

of $41.1 billion and does not

include $293 million in surface

transportation earmarks or

$650 million in supplemental

highway investments provided

from the federal general fund.

Airport Improvement Program

investments also continue at

$3.52 billion—the same amount

as FY 2010.

High speed rail is “zeroed

out” in FY 2011. The bill cuts

the New Starts Program, which

funds fixed rail transit projects,

in FY 2011 by $400 million to

$1.6 billion and rescinds $280

million of the funds provided to

the program in FY 2010. Other

cuts to transportation include

rescinding about $630 million in

unused earmarks from legislation

enacted in the 1970’s through

1998’s TEA-21 and lowering the

Department of Transportation

discretionary grants program

(the TIGER II program) from

$600 million in FY 2010 to $528

million this year.

Also included is a rescission

of $2.5 billion in unobligated

highway contract authority—

rescissions do not lower

highway investment, but can

constrain how states use federal

funds.

FedEx Endorses Fuels Tax Increase

FedEx President and CEO

Fred Smith and officials from

several state departments of

transportation told members

of the Senate Environment and

Public Works Committee April

14 a multi-year reauthorization

(D-Mont.) suggested a two-year

reauthorization bill might be

necessary if Congress is unwilling

to raise the revenues necessary

to grow highway and transit

investment under a six-year

measure. Baucus also chairs

the Senate Finance Committee,

which has jurisdiction over

Highway Trust Fund revenue

sources.

GAO Recommends Improvements For Future Grant Programs

The Government Accountability

Office (GAO) released a

March 30 report calling for

improvements in how the U.S.

DOT implemented both the

Transportation Investment

Generating Economic Recovery

(TIGER) and High Speed Rail

competitive grant programs.

Specifically, GAO recommends

documenting key decisions for

all major steps in the award

process, including reasons

for acceptance or rejection

of grant applications. GAO

also recommends limiting

the influence of geographic

selection. Republican leaders

of the House T&I Committee

used the reports to criticize

the Obama Administration’s

transparency during the

implementation of the grant

programs.

DOT Provides Emergency Highway Relief Funds

U.S. Secretary of Transportation

Ray LaHood announced

April 11 the Federal Highway

Administration will provide

$319 million from its emergency

relief program to 28 states and

two territories to reimburse

them for damages to roads

and bridges caused by natural

events. Recipients include:

Alabama, Alaska, American

Samoa, Arizona, Arkansas,

Colorado, Connecticut, Florida,

Illinois, Iowa, Kentucky,

Massachusetts, Minnesota,

Mississippi, Missouri, Montana,

Nebraska, New Hampshire,

New Jersey, North Carolina,

North Dakota, Puerto Rico,

Rhode Island, South Dakota,

Tennessee, Texas, Utah,

Washington, West Virginia,

and Wyoming. View additional

ARTBA-Supported 1099 Repeal Becomes Law

President Obama April 14

signed H.R. 4 into law, which

repeals a controversial provision

of 2009’s healthcare reform

law. The provision would have,

beginning in 2012, required

businesses to file IRS Form

1099s with the government

for every vendor with which

it transacted business of

$600 or more in a calendar

year. ARTBA, individually

and through coalitions, urged

Congress to repeal the provision

citing the enormous paperwork

burden it would impose during

an economic recovery. The

enactment of H.R. 4 is a

legislative victory for all ARTBA

members.

House Panel Hears Testimony on 3% Withholding

The House Small Business

Committee April 13 heard

testimony on various tax issues

that affect the ability of firms to

grow and create jobs. A roofing

contractor from Stratford,

Wis., told the committee an

impending change in the tax

code could prevent many small

businesses from competing

for government contracts.

The provision, set to go into

effect in 2012, would require

a three percent withholding

for government contracts—

including transportation

projects—at all levels—city,

state, and federal. ARTBA

and its colleagues in the

Government Withholding Relief

Coalition continue to urge a

delay and full repeal of this

provision.

ARTBA Urges Small Business Panel to Study Impacts of Regulations

ARTBA submitted written

comments April 13 urging

the U.S. Small Business

Administration to assess the

effects on small businesses

of regulations promulgated

by the U.S. Department of

Transportation (DOT) and

the Environmental Protection

Agency (EPA). With regards

to DOT regulations, ARTBA

focused on the Disadvantaged

Business Enterprise program,

hours of service for construction

drivers and the use of

proprietary products. As for

the EPA, ARTBA stressed

reforms to air, water and

hazardous substance proposals

and the need to streamline

the environmental review

and approval process for

transportation projects.

Don’t Classify Coal Ash “Hazardous,” ARTBA Says

ARTBA April 14 urged the

House Subcommittee on

Energy and the Economy to

pass H.R. 1391, the “Recycling

Coal Combustion Residuals

Act of 2011.” The legislation,

introduced by Rep. David

McKinley (R-W.Va.), would

prohibit the U.S. EPA from

classifying recycled coal ash as

a “hazardous substance.” In its

statement, ARTBA explained

that without coal ash, concrete

would become more expensive

and less durable and detailed its

role in reducing greenhouse gas

emissions and oil consumption.
