Message From The PresidentDouglas J. Brocker, PresidentTenth Judicial District Bar
The Future of Professionalism: Raising the BarProfessionalism among members of the Bar is an intentional and dynamic process. It does not occur accidentally or by default. One of the primary reasons the WCBA and Tenth Judicial District Bar enjoy such a high level of profes-sionalism among its members is the long-stand-ing, wide-ranging and continuing efforts of our Professionalism Committee. Over the years, this joint Committee has continued to create new and innovative programs that promote profes-sionalism among WCBA and Tenth members. It also regularly serves as the pilot program for efforts that are later implemented statewide.
The Committee is responsible for creating our Professionalism Creed, writing regular articles on professionalism in the Bar Flyer, establish-ing the pilot Professionalism Support Initiative intervention program, publishing Practicing Law: Wake County Lawyers’ Observations on Professionalism, and coordinating the annual Professionalism Roundtable Discussion at the

October Meeting
T he October meeting of the Wake County Bar Association will be held on Oct. 6, 2009, at the
Woman’s Club. Lunch will be served at 12:15 p.m. The business meeting will begin promptly at 12:30 p.m. and the Professionalism Roundtable Discussion will begin at 12:45 p.m.
The Professionalism Committee, chaired by Lori Vitale, and the CLE Committee, chaired by Julia Wicker, have once again joined hands to pres-ent both a Professionalism Roundtable Discussion during lunch and a program titled “Professionalism and Ethics for Practitioners” which will be held im-mediately following lunch.
On behalf of the Professionalism Roundtable Discussion Subcommittee, Collin Cook will begin the luncheon discussion. The CLE Committee, chaired by Julia Wicker, will follow up with a program presented by Bruno DeMolli, NC State Bar Auditor. (See details in the announcement on this page.)

WCBA October luncheon, among various other programs and projects. All of these efforts resulted in our Committee receiving the ABA’s GambrellProfessionalismAward,probablythemost prestigious professionalism award given to bar organizations across the nation.
Notcontenttorestonitslaurels,theCommitteehasembarkedondevelopingtwonewambitiousprojectsthisyear.WCBAPresidentGaskinsdiscussed the new pilot mentoring program in hisMaymessage.Itisanticipatedthatthispro-gram, directed at new lawyers in the Tenth and WCBA, will coordinate and share resources with a similar new program for students at Campbell Law School. The mentoring program is expected to begin in 2010, once Campbell gets settled in its new location in the capital city.
At its meeting last month, the Professionalism Committee decided to move forward with another new program that it has been discuss-ing for the better part of a year. The program is entitled: Raising the Bar: Recognizing Acts of Professionalism. The primary purpose is to allow WCBA and Tenth members to nominate other attorneys for notable acts of professional-ism. For almost 20 years, the WCBA has recog-nized one member a year to receive the Joseph Branch Award, in recognition of a long and exemplary career of professionalism. The new program is similar but is designed to recognize specific acts of professionalism among members of the Bar, rather than an entire career.
The nominee will receive a letter from the Committee about the recognition and the
option of potentially having information about the nomination publicized to members of the Bar. The Committee anticipates periodically writing an article or report in the Bar Flyer summarizing the nominations and the underlying specific acts of professionalism. These nominations also may be mentioned briefly at future bar meetings or luncheons.
The Committee hopes that this new pilot pro-gram will recognize notable professional actions and encourage continuing professionalism among members of our Bar. This type of recog-nition is important for new lawyers, members who have practiced in other locations before joining our Bar, and our existing members. As our membership continues to expand, it is not possibleforallofourmemberstoknowoneanother as was true when this proud tradition of professionalism began. For these reasons, it is increasingly important to recognize and publi-cize the types of actions that distinguish our Bar as a model of professionalism.
For this program to be successful, we need the participation of members nominating other attorneys. Copies of the nomination form and instructionsareprintedonpage7ofthiseditionof the Bar Flyer. Memorial Scholarship FundBrian O. Beverly, Endowment Scholarship Award and Oversight Committee Chair
The WCBA Memorial Scholarship Fund is a means for individuals and firms to make donations in the memory of, or in honor of, WCBA members. The e-mail address used to send the e-mail was [email protected]. After reading the e-mail, Lucy Lawyer sent the following response to Patty Plaintiff:

Severalweekslater,LucyLawyerwascontactedbyMr.Rich,thechiefexecu-tiveofficeratLargeCorporation.Mr.Richinformed Lucy Lawyer that an employee, Patty Plaintiff, had filed a lawsuit against Large Corporation, and that Large Corporation wanted to hire Lucy Lawyer to defend against the suit. Lucy Lawyer agreed to represent Large Corporation and was retained as defense counsel.
Remembering that Patty Plaintiff had e-mailed her from what appeared to be PattyPlaintiff’sworke-mailaddress,LucyLawyerfoundoutfromMr.RichthatLarge Corporation is able to access Patty Plaintiff’sworke-mailaccount.ShethentoldMr.RichhemightwanttohavetheLarge Corporation IT department monitor Patty Plaintiff’s e-mail account and to save any incoming and outgoing e-mails from Patty’s account.
Monthslater,Mr.RichprovidedLucywith
a digital copy of all of the recent e-mail correspondencefromPatty’sworke-mailaccount. After reviewing the material providedbyMr.Rich,LucyLawyersenta letter to Patty Plaintiff’s lawyer, Andy Attorney, asserting that she was in posses-sion of e-mail correspondence and e-mail attachments between Patty Plaintiff and Andy Attorney pertaining to Patty Plaintiff’s dispute with Large Corporation. The letter further stated that although no one at Large Corporation had read the e-mails yet, Lucy Lawyer believed that any potential privilege attached to the communications had been waived by use of Large Corporation’s e-mail system.
Andy Attorney responded with a letter informing Lucy Lawyer that the e-mails and attached documents were privileged com-munications belonging to Patty Plaintiff for which there had been no waiver of privilege and requesting the immediate return of the e-mails to Patty Plaintiff.

OnMonday,September21,2009,theWakeCountyBarAssociationsponsoredaceremonial session of the Superior Court forWakeCounty.Inthissession,heldintheMeymandiConcertHalloftheProgressEnergyCenterforthePerformingArts,thecourt was opened and called to order so thattheHonorableRipleyE.RandandtheHonorablePaulGessnercouldhearmotionsfor the admission and subsequent swearing-in of individuals who passed the July Bar examination. These 113individuals are now fully and duly licensed to practice law in thecourtsoftheStateofNorthCarolina.
MelissaA.Essary,DeanofCampbellUniversity’sNormanAdrianWigginsSchoolofLaw,providedastirringkeynotespeechencouraginglawyerstomakeadiffer-ence. She emphasized the importance of relationshipsanddoingactsofkindness,statingthatnoactofkindnessistoosmall.She encouraged everyone to help, serve, and lead. Additionally, she emphasized the importance of professionalism.
A reception followed the ceremony. The Swearing-in Ceremony Committee of the WakeCountyBarAssociationwaspleasedto offer this opportunity for new lawyers to be sworn in before the court in a collegial andwelcomingevent.MembersoftheWakeCounty Young Lawyers, as well as some alum-ni from that group, were available for new lawyers who did not have a personal sponsor.

Committees of the Wake County Bar Associationand Tenth Judicial District Bar
The Athletics Committee directs the basketball league, softball league, annual golf tournament and the annual tennis tournament.
* The Bar Candidate Interview Committee is responsible for arranging and conducting bar candidate interviews for the February and July bar examinations.
The Bar Flyer Committee oversees the publishing of the monthly Wake Bar Flyer.
** The Bench-Bar Committee serves as a liaison between the Bar and members of our judiciary in Wake County.
The CLE Committee coordinates and plans local Bar CLE programs.
The Directory Committee oversees the membership online directory.
The Endowment Scholarship Award and Oversight Committee oversees the selection of the winners of annual memorial scholarships and the investment of memorial scholarship funds.
* The Facilities/Public Records Committee coordinates the needs of the attorney workspace in the Wake County Courthouse and coordinates the needs of the Wake County Bar office at the Bar Center.
* The Fee Dispute Resolution Committee of the Tenth Judicial District Bar exists to resolve disputes involving fees between lawyers and clients.
* The Grievance Committee investigates complaints against members of the Tenth Judicial District Bar and makes recommendations of whether probable cause exists for finding a violation of the Rules of Professional Conduct. (Must be licensed in NC for 5 years.)
The History Committee collects and organizes records and other items that pertain to the history of the Wake County Bar Association.
** The Lawyers Support Committee provides assistance to lawyers in need, including promotion of the BarCARES program.
** The Long Range Planning Committee is charged with looking ahead to propose programs to meet the needs of our membership in the years to come.
The Membership Services Committee from time to time surveys the membership and makes recommendations to the Board as to additional services that would benefit its members.
* The Memorial Committee is responsible for a semi-annual program where deceased members of the Bar are memorialized.
** The Professionalism Committee is charged with exploring ways to promote professionalism among attorneys.
The Professionalism Award Committee oversees the selection of the recipient of the Justice Branch Professionalism Award.
The Public Service Committee coordinates community projects that Wake County Bar members can participate in as a group.
The Social Committee, traditionally one of the most active in the Wake County Bar Association, plans the Holiday Party, Fall Social, Family Picnic, Afterwork Socials, and other social functions throughout the year.
The Summer Programs Committee coordinates an annual summer clerk orientation program.
** The Swearing-In Ceremony Committee coordinates the semi-annual swearing-in ceremonies for new attorneys who have passed the bar exam.
** The Technology Committee explores available technology that will enable the Bar and the justice system to work more efficiently and effectively for the profession and the public.

PLAYERS: Tournament will be limited to members of the Wake County Bar Association and law clerks. Men and Women.
FORMAT: Doubles Tourney I (Open Division) - Open to all players. Partners will be randomly assigned and regu-larly changed in Round Robin play involving several rounds. This is the main draw.
Doubles Tourney II (Championship Division) - Open to intermediate and advanced players. Partners should sign up as a team. Teams will not change in Round Robin play involving several rounds.
COST: Entry/Court fee of $3.00 per person is requested with your entry form. Check should be made payable to “Wake County Bar Association.”
TROPHIES: Trophies will be awarded to winners and runners-up of both divisions. Refreshments and food will be provided for all players and spectators.
