The Fair Labor Standards Act (FSLA)- This law applies to all workers in any occupationsand requires employers to pay the federal mini-mum wage as well as overtime pay for all workover 40 hours per week.

Migrant and Seasonal Agricultural Workers ProtectionAct (MSPA)- This law requires that employersprovide a written description of the terms andconditions of work, including compensation,pay all wages owed when due, provide trans-portation in safe, insured vehicles, and complywith all federal and state safety and health standards if housing is provided.

Service Contract Act (SCA)- This law applies whenworking for a contractor performing servicessuch as such as tree planting, thinning, brush-ing, and data collection on Federal Lands. Itrequires that the employer (contractor) pay theprevailing wage for the type of work performedand provide extra payments in lieu of benefits,paid holidays and paid vacations.

Davis-Bacon Act (DBA)- This law is similar to theService Contract Act in requirements to payprevailing wage for the type of work performedand provide extra payments in lieu of benefits,paid holidays and paid vacations. DBA appliesto construction work done on Federal lands,such as trails and building construction, andalso requires that the employer submit certifiedpayroll that documents the wages thatthey paid.

Contract Work Hours and Safety Standards Act(CWHSA)- This law requires that workers be paidtime and a half whenever they work more than40 hours per week when working on a federalcontract, among other provisions.

Occupational Safety and Health Act (OSHA)- This lawis designed to create safe, healthy workplaces for all workers.

Act (SCA) applicable to forest workers. Following theSCA provisions is a list of national resources andorganizations as well as groups serving the PacificNorthwest region for forest workers who may havequestions or concerns.

The Service Contract Act (SCA) is a law created in 1965that establishes basic provisions for people doingservice work on federal lands and federal contracts.The law specifies worker rights and protections relat-ed to fair compensation and benefits, employee noti-fication of basic rights and prevailing wages, enforce-ment, and steps for workers to submit claims of vio-lations. This fact sheet is provided to inform forestworkers of our rights under this law.

What Work is covered by the SCA?The SCA applies to all service work on Federal lands.This includes tree planting, thinning, spraying, piling, burning, wild land fire fighting, and more.Most of this work is done on lands managed by theU.S. Forest Service (USFS) and the Bureau of LandManagement (BLM).

Worker Protections and Provisions under the SCAThe SCA establishes the following legal rights of forest workers:

Minimum “prevailing wage” (differs by type of work and location)Fringe benefits (including paid vacation days and the provision of health benefits or a wageincrease of equal value)Employer provision of required uniforms or safety equipmentSafe working conditions

It is important to keep in mind that all of theseprovisions are specified for each contract, and thatemployers are obligated to inform workers ofthese provisions for each individual contract. Infact, employers must provide employees with twopieces of paper for each and every contract:

1) Form WH-151 – Rights of Workers2) Form WH-153 – Agreement between

Contractor and Worker [stating the prevailing wage and benefits]

Employers are also required to post this informa-tion in a place where workers will see it. One other important protection is the requirement ofemployers to post a bond of $10,000 with theDepartment of Labor (DOL). The DOL holds thismoney as insurance to pay workers the wages theyare due in the event that an employer fails to paythem.

Enforcement of the SCAThe Wage & Hour Division of the U.S. Department of Labor is responsible for determining the prevail-ing wage and benefits for each federal contractunder the SCA and the Secretary of Labor isauthorized and directed to enforce the provisionsof the Act. However, though the SCA is a Federallaw and it applies to work done of Federal land orcontracts, complaints should be filed with StateLabor departments. In Oregon, Washington andCalifornia the State Labor offices enforce the SCA.

It is very important to be aware that the LaborDepartments only respond to worker complaints.There is no agency-initiated enforcement of theSCA by those authorized and directed to enforcethe law. Once they receive a complaint, however,there are specific steps the Labor departments follow (see page 8).

hen you call a State Labor office to file a complaint, the person who answers the

phone will listen to your complaint, write itdown, and give it to someone else who decideswhether or not to investigate. The person whomakes that decision will call you back at home afew days after you file the complaint.

The process can be long and frustrating, but workers need to follow through with the process so that employers do not repeat the same violationsagainst other workers. It is very important for work-ers to realize that you are responsible for keepinggood records of the employers you work with, thelocations of the land where you work, and the num-ber of hours you work. The Labor offices say thatmost claims are not acted upon because workershave insufficient information or workers fail to follow through with the grievance process.

In order to help Labor Departments to enforce the SCA, workers should keep accurate records including the following information:

Number of hours worked each day [keep regular hours separate from overtime hours]Locations of the units where you work [at least the name of the forest or nearest town]Name of the contractor or companyemploying you for each location.Type of work [planting trees, thinning, piling, fire fighting, etc.]Wage you should be paid [how much didyour employer say you would be paid?]

1. Make sure you have the necessary information ready (as much as possible from the list above)2. Call the State Labor office for the state where your employer’s office is located. Or call the U.S.

Department of Labor.3. If it would help, call a worker organization like the AFWH and ask for our assistance. 4. Be patient and persistent – it is likely you will receive the wages you are due.5. Be sure to notify the Labor office if you move or change your phone number during

this process.
