MEASURE E

IMPARTIAL ANALYSIS OF MEASURE E

This Impartial Analysis of Measure E has been prepared by the City Attorney pursuant to Section 9280 of the California Elections Code. Measure E requests that Upland voters consider whether to adopt Ordinance No. 1910, a legislative act which prohibits the development and operation of marijuana (cannabis) related uses within the City of Upland which are not allowed due to specific preemptive provisions of state law. Such a local prohibition against the conduct of marijuana uses is provided by state law which preserves the City of Upland's local land use controls concerning the activities in question. Ordinance No. 1910 replaces less specific Upland Municipal Code provisions dealing with marijuana uses with a new Upland Municipal Code Chapter 9.48. The ordinance is premised on a basic finding that the prohibition of delineated marijuana-related uses and activities will promote the health, safety and general welfare of the residents and businesses of Upland and visitors to Upland. Ordinance 1910 was passed by the Upland City Council on September 26, 2016 and now is presented to the electorate for its decision based on a qualified referendum petition.

The marijuana-related uses and activities which would be prohibited by Ordinance 1910 from occurring anywhere in the City of Upland include dispensing, cultivating, manufacturing, processing, storing, labeling, relabeling, packaging, repackaging, delivering, distributing or selling marijuana or marijuana-related products such as edibles in Upland. Particularly, Ordinance No. 1910 specifies that the following activities are prohibited in the City of Upland:

1. There is a prohibition against the cultivation of marijuana which includes a prohibition against germinating, planting, growing, harvesting, drying, curing, grading or trimming marijuana (cannabis). There is one exception to this cultivation prohibition specified in a preemptive provision of state law. That exception allows six (6) plants to be cultivated in a residence located in Upland.

2. There is a prohibition against the delivery of purchased marijuana or marijuana-related products to any location within the City of Upland.

3. There is a prohibition against the sale or dispensing of marijuana or marijuana-related products anywhere in the City of Upland except as specifically allowed under state law pursuant to the Compassionate Care Act. This will prohibit any marijuana retail outlet open to the general public from operating at any location in the City of Upland.

Any marijuana activity made illegal and prohibited if this measure is approved by the electorate of the City of Upland will constitute a violation of the Upland Municipal Code subject to appropriate criminal sanctions. In addition, any such illegal and prohibited activity is declared by Ordinance No. 1910 to be a public nuisance which may be abated in a civil proceeding through the issuance by the Court of a Temporary Restraining Order or a Preliminary or Permanent Injunction.

ARGUMENT IN FAVOR OF MEASURE E

This Argument in Favor of Measure E was submitted pursuant to Section 9282 of the California Elections Code. It is the opinion of the author(s), and has been printed exactly as submitted. The purpose of City of Upland Ordinance No. 1910 is to clarify the language in Upland's municipal code to expressly prohibit all illegal commercial marijuana-related uses and activities in the City.

Prior to the passage of Ordinance No. 1910, the Upland Municipal Code contained language that was less precise and less inclusive than the language in Ordinance No. 1910. The prior municipal code ordinance also does not include all possible commercial marijuana-related uses and activities, leaving the law unclear.

Ordinance No. 1910 is needed to clarify and maintain legal control over marijuana-related uses and activities in Upland. It closes legal loopholes and gives the City the ability to enforce local laws that provide residents and businesses with comprehensive protection from prohibited marijuana-related activities.

With this ordinance, the City will be able to enforce and prosecute all persons unlawfully establishing commercial businesses that involve marijuana or any of its products. It is a balanced and common sense approach to banning illegal marijuana businesses and sales in Upland.

Ordinance No. 1910 protects Upland by prohibiting the cultivation, possession, manufacturing, processing, storing, warehousing, testing, packaging, transporting, distribution and sale of marijuana beyond what is allowed under California state law.

It further provides significant flexibility for law enforcement to control current and future marijuana activities, and to further evaluate the impacts and consequences of California's new Adult Use of Marijuana Act.

This ordinance does not prevent the personal recreational use, indoor cultivation or use of marijuana by qualified medical patients pursuant to current California state law.

Upland has spent millions of dollars to enforce its vague ordinances against marijuana businesses and activities. This ordinance will make these enforcement actions less costly.

Please vote "yes" on Measure E to prohibit illegal marijuana-related businesses in Upland and to reduce our City's overwhelming legal expenses.

ORDINANCE NO. 1910

AN ORDINANCE OF THE PEOPLE OF THE CITY OF UPLAND, CALIFORNIA, REPEALING CHAPTER 9.48 OF TITLE 9 OF THE CITY OF UPLAND MUNICIPAL CODE AND REPLACING IT WITH A NEW CHAPTER 9.48 PROHIBITING MARIJUANA-RELATED USES AND ACTIVITIES, AND AMENDING RELATED PROVISIONS OF TITLE 17 (THE ZONING CODE) PROHIBITING THE DEVELOPMENT OF MARIJUANA RELATED USES

THE PEOPLE OF THE CITY OF UPLAND DO ORDAIN AS FOLLOWS:

SECTION 1: Title 9 of the Upland Municipal Code is hereby amended with therepeal of Chapter 9.48 (Mobile Marijuana Dispensaries) in its entirety and adding a newChapter 9.48 to read as follows:

Chapter 9.48 Marijuana-Related Uses and Activities Prohibited

9.48.010. Purpose.

The People of the City of Upland hereby find and determine that it is the purpose andintent of this Chapter to prohibit certain marijuana-related uses and activities, in order topromote the health, safety, and general welfare of the residents, businesses, and visitorsto the City. Except when preempted by state law, this prohibition includes marijuanarelated uses and activities, including marijuana dispensing, cultivation, transporting,distributing, processing, delivering, manufacturing, labeling, and/or testing, whether forrecreational, medical, or any other use, except that this prohibition does not apply toprohibit qualified patients and persons with identification cards to cultivate indoors,possess, and use marijuana for their own personal medical purposes only, as permittedby state law. Nothing herein shall be construed to authorize qualified patients to engagein the collective cultivation of marijuana as described by Health and Safety Code section11362.775, nor are they permitted to cultivate marijuana above limits established bystate law and guidelines for their own personal use. Nor shall anything herein beconstrued as permitting primary caregivers to cultivate marijuana indoors or outdoorsanywhere in the City.

9.48.020. Applicability

A. Nothing in this Chapter is intended, nor shall it be construed, to burden any defenseto criminal prosecution under the State law.

B. All the provisions of this Chapter shall apply to all property, public, and private,within the City.

C. All the provisions of this Chapter shall apply indoors and outdoors.

D. Nothing in this Chapter shall authorize criminal prosecution or abatement forviolations of this Chapter or any other provision of the Upland Municipal Codeinconsistent with the holding of Kirby v. County of Fresno 242 Cal.App.4th 940(2015).

9.48.030. Definitions

The following definitions apply to this Chapter:

A. "Marijuana" shall have the same definition as that set forth in California Health &Safety Code Section 11018. "Marijuana" shall include: "cannabis" as defined in

California Business & Professions Code section 19300.5(f); "cannabis concentrate"as defined in in California Business & Professions Code section 19300.5(g); "ediblecannabis product" as defined in California Business & Professions Code section19300.5(s); "manufactured cannabis" as defined in California Business &Professions Code section 19300.5(ae); "medical cannabis," "medical cannabisproduct," or "cannabis product" as defined in California Business & ProfessionsCode section 19300.5(ag); and "topical cannabis" as defined in California Business& Professions Code section 19300.5(al).

B. "Caregiver" or "primary caregiver" shall have the same definition as that set forth inCalifornia Health and Safety Code section 11362.7 (d) and (e).

C. "Person" shall mean any person, firm, corporation, association, club, society, orother organization. The term person shall include any owner, manager, proprietor,employee, volunteer and/or salesperson.

D. "Marijuana related use and activity" includes dispensing, cultivation, manufacture,processing, storing, testing, labeling, relabeling, packaging, repackaging,transporting, delivery, distribution, provision, or sale, or any combination thereof, ofmarijuana, except as set forth in California Business and Professions Code section19319, related to qualifying patients. "Marijuana-related use and activity" also hasthe same meaning as "commercial cannabis activity" set forth in California Businessand Professions section 19300.5 (j.).

E. "Cultivation" shall mean any activity involving the germinating, planting, growing,harvesting, drying, curing, grading, or trimming of cannabis.

F. "Delivery" shall have the same definition as set forth in California Business andProfessions Code 19300.5 (m). "Delivery" shall also have the same definition asset forth in California Health and Safety Code section 26001(h), if enacted."Delivery" shall not include transportation of marijuana or marijuana products by alicensed transporter traveling through the City on public roads to and from locationsoutside of the City where marijuana-related activities or uses are permitted.

G. "Dispensary" shall mean any location where marijuana or devices for the use ofmarijuana are offered, either individually, or in combination, and includes retailsales. "Dispensary" includes delivery services, mobile dispensing and distribution.

H. "Dispensing" shall mean any activity involving the provision of marijuana for anypurpose.

I. "Distribution" shall mean the provision and transport of marijuana between persons.

J. "Manufacturer" shall mean a person that conducts the production, preparation,propagation, or compounding of marijuana, either directly or indirectly or byextraction methods, or independently by means of chemical synthesis or by anycombination thereof, and includes packaging, repackaging, labeling, and/orrelabeling.

K. "Qualified Patient" or "Qualifying Patient" shall mean qualified patient and personswith identification cards as those terms are defined by the Health and Safety Codesection 11362.7.

L. "Testing Site" shall mean any facility, entity, or site in the City that offers or performstests of marijuana.

9.48.040. All Marijuana-Related Use and/or Activity Prohibited

To the extent not preempted by State law, all marijuana related use and activity isprohibited in the City of Upland. This prohibition includes those marijuana related usesand activities set forth herein.

9.48.050. Declaration of public nuisance

Any use, structure, or property that is altered, enlarged, erected, established,maintained, moved, or operated contrary to the provisions of this Chapter, is herebydeclared to be unlawful and a public nuisance and may be abated by the city throughcivil and/or administrative proceedings by means of a restraining order, preliminary orpermanent injunction, or in any other manner provided by law for the abatement of suchnuisances.

9.48.060. Violations

A. Violations of this Chapter shall be punishable as provided in this Code.

B. This Chapter is not the exclusive means for the abatement of marijuana-relateduses or activities within the City of Upland. The remedies set forth pursuant to thisSection shall be in addition to any other existing remedies for violations of theZoning Code, including but not limited to, any action at law or equity.

C. Violations of this Chapter are hereby declared a public nuisance.

ZONING REGULATIONS AND LAND USE

SECTION 2: The land use matrices located in the amended Zoning Code forResidential (17.04), Mixed-Use (17.05), Commercial (17.06), Industrial (17.07), andSpecial Purpose Zones (17.08), and any other land use matrices in the Zoning Codewhich use the term "Medical Marijuana Dispensary or Clinic," shall replace "MedicalMarijuana Dispensary or Clinic" with "Marijuana Related Use and Activity."

SECTION 3: Section 17.10.020(J) (1) of the Zoning Code shall be amended asfollows:

1. Marijuana-related use and activity shall be prohibited in all zoning districts andareas that are regulated by Specific Plans or planned unit developments.

SECTION 4: The term "Medical Marijuana Dispensary or Clinic" and the definitionthereof set forth in the Definitions of the Zoning Code shall be amended and replacedby the term "Marijuana-Related Use and Activity," which shall be defined as follows:

"Marijuana-Related Use and Activity" means dispensing, cultivation, possession,manufacture, processing, storing, testing, labeling, relabeling, packaging, repackaging,transporting, delivery, distribution, provision, or sale, or any combination thereof, ofmarijuana, and as defined in Title 9.48 of the Upland Municipal Code.

SECTION 5: Any provision of the City of Upland Municipal Code or appendicesthereto inconsistent with the provisions of this Ordinance, to the extent of suchinconsistencies and no further, is hereby repealed or modified to that extent necessaryto effect the provisions of this Ordinance.

SECTION 6: Should any provision of this Ordinance, or its application to any personor circumstance, be determined by a court of competent jurisdiction to be unlawful,unenforceable or otherwise void, that determination shall have no effect on any otherprovision of this Ordinance or the application of this Ordinance to any other person orcircumstance and, to that end, the provisions hereof are severable. The City Council of

the City of Upland declare that it would have adopted all the provisions of this ordinancethat remain valid if any provisions of this ordinance are declared invalid.

SECTION 7: This ordinance shall take effect immediately upon adoption by thevoters of the City of Upland.

ANÁLISIS IMPARCIAL DE LA MEDIDA E

El Abogado Municipal preparó este Análisis Imparcial de la Medida E de conformidad con la Sección 9280 del Código Electoral de California. La Medida E solicita que los votantes de Upland consideren adoptar la Ordenanza No. 1910, una propuesta legislativa que prohíbe desarrollar y llevar a cabo actividades en relación con la marihuana (cannabis), dentro de la Ciudad de Upland, que no sean permitidos por estipulaciones previas de la ley del estado. Dicha prohibición del uso relacionado con la marihuana está estipulada en la ley del estado, la cual preserva el control del uso del territorio local de la Ciudad de Upland con respecto a las actividades en cuestión. La Ordenanza No. 1910 reemplaza estipulaciones menos específicas del Código Municipal de Upland que tratan sobre el uso de la marihuana, con un nuevo Capítulo 9.48 del Código Municipal de Upland. La ordenanza se basa en la conclusión primaria que la prohibición del uso y actividades definidas en relación con la marihuana promoverá la salud, seguridad y bienestar general de los residentes y comercios de Upland y de los visitantes de Upland. La Ordenanza 1910 fue aprobada por el Concejo Municipal de Upland el 16 de septiembre de 2016 y ahora se presenta ante el electorado para su decisión basada en una petición de referendo calificado.

El uso y actividades en relación con la marihuana que la Ordenanza 1910 prohibiría en cualquier lugar de la Ciudad de Upland incluyen el despacho, cultivo, fabricación, procesamiento, almacenamiento, etiquetado, re-etiquetado, empaque, re-empaque, entrega, distribución o venta de marihuana o productos relacionados con la marihuana, como productos comestibles, en Upland. 1. 3. Cualquier actividad que quede determinada como ilegal y prohibida, si esta medida es aprobada por el electorado de la Ciudad de Upland, constituirá una violación al Código Municipal de Upland y quedará sujeta a las sanciones penales correspondientes. Además, cualquiera de dichas actividades ilegales y prohibidas queda declarada por la Ordenanza No. 1910 como perjuicio público que puede ser mitigado en proceso civil por medio de la emisión de una Orden de Restricción Judicial Temporal o Mandato Judicial Preliminar o Permanente.

ARGUMENTO A FAVOR DE LA MEDIDA E

Este Argumento a Favor de la Medida E fue presentado de conformidad con la Sección 9282 del Código Electoral de California. Es la opinión del (de los) autor(es), y ha sido impresa tal como fue presentada. El propósito de la Ordenanza No. 1910 de la Ciudad de Upland es aclarar el lenguaje del código municipal de Upland para prohibir expresamente todo el uso y actividades comerciales ilegales en relación con la marihuana en la Ciudad.

Previo a la adopción de la Ordenanza No. 1910, el Código Municipal de Upland contenía un lenguaje menos preciso y menos inclusivo que el lenguaje de la Ordenanza No. 1910. Además, la ordenanza anterior del código municipal no incluye todo el uso y actividades comerciales posibles en relación con la marihuana, lo que hace que la ley no quede clara.

Para aclarar y mantener el control legal sobre el uso y actividades en relación con la marihuana en Upland se hace necesaria la Ordenanza No. 1910. Esto permite cerrar lagunas legales y proporciona a la Ciudad la capacidad de aplicar las leyes locales, lo que proporciona una protección integral a los residentes y comercios contra las actividades prohibidas en relación con la marihuana.

Con esta ordenanza, la Ciudad podrá hacer cumplir y procesar a todas las personas que establezcan actividades comerciales ilegalmente, que involucren la marihuana y cualquiera de sus productos. Es un enfoque con sentido común y equilibrio para prohibir los negocios y ventas ilegales de marihuana en Upland.

La Ordenanza No. 1910 protege a Upland al prohibir el cultivo, posesión, fabricación, procesamiento, almacenamiento, bodegas, pruebas, empaque, transporte, distribución y venta de marihuana más allá de lo permitido por la ley del estado de California.

Proporciona, además, una flexibilidad significativa para que las autoridades controlen las actividades actuales y futuras de la marihuana, y para evaluar más profundamente el impacto y consecuencias de la nueva Ley de California del Uso de Marihuana por Adultos.

Esta ordenanza no impide el uso recreativo personal, el cultivo en áreas interiores o el uso de marihuana por pacientes médicos calificados de conformidad con la ley actual del estado de California.

Upland ha invertido millones de dólares para hacer cumplir sus ordenanzas ambiguas en contra de los negocios y actividades en relación con la marihuana. Esta ordenanza hará que estas medidas de cumplimiento sean menos costosas.

ORDENANZA NO. 1910

UNA ORDENANZA DEL PUEBLO DE LA CIUDAD DE UPLAND, CALIFORNIA, PARA REVOCAR EL CAPÍTULO 9.48 DEL TÍTULO 9 DEL CÓDIGO MUNICIPAL DE LA CIUDAD DE UPLAND Y SUSTITUIRLO CON UN NUEVO CAPÍTULO 9.48 EN EL QUE SE PROHÍBA EL USO Y LAS ACTIVIDADES EN RELACIÓN CON LA MARIHUANA, Y QUE ENMIENDE LAS ESTIPULACIONES RELACIONADAS CONTENIDAS EN EL TÍTULO 17 (EL CÓDIGO DE ZONIFICACIÓN) QUE PROHÍBE EL DESARROLLO DE USOS RELACIONADOS CON LA MARIHUANA

LAS PERSONAS DE LA CIUDAD DE UPLAND ORDENAN LO SIGUIENTE:

SECCIÓN 1: El Título 9 del Código Municipal de Upland queda modificado al revocar el Capítulo 9.48 (Dispensarios Móviles de Marihuana) en su totalidad y agrega un nuevo Capítulo 9.48 redactado de la manera siguiente:

Capítulo 9.48 Prohibido el Uso y Actividades en Relación con la Marihuana

9.48.010. Propósito.

Las Personas de la Ciudad de Upland encuentran y determinan que es el propósito e intención de este Capítulo prohibir ciertos usos y actividades en relación con la marihuana, para promover la salud, seguridad y bienestar general de los residentes, comercios y visitantes de la Ciudad. Excepto cuando esté previsto por la ley del estado, esta prohibición incluye el uso y actividades que se relacionen con la marihuana, entre ellos: el despacho, cultivo, transporte, distribución, procesamiento, entrega, fabricación, etiquetado, y/o pruebas, para fines recreativos, medicinales o cualquier otra clase de uso, excepto que esta prohibición no es aplicable a pacientes calificados o personas que tienen tarjetas de identificación para poseer, cultivar en áreas interiores y usar marihuana para fines medicinales propios, exclusivamente, según lo permitido por la ley del estado. Nada de lo aquí estipulado se deberá interpretar como autorización para que los pacientes calificados participen en actividades de cultivo colectivo de marihuana según lo descrito en el Código de Salud y Seguridad, sección 11362.775, ni tienen permitido cultivar marihuana para uso personal en cantidades superiores a los límites establecidos por la ley y directrices del estado. Además, nada de lo aquí estipulado se debe interpretar como autorización a los responsables de los cuidados primarios a cultivar marihuana en áreas interiores o exteriores en ningún lugar de la Ciudad.

9.48.020. Aplicabilidad

A. Ninguna parte del contenido de este Capítulo tiene la intención de ser, ni se deberá interpretar como impedimento para la defensa en cualquier procedimiento penal en virtud de la ley del Estado.

B. Todas las estipulaciones contenidas en este Capítulo serán aplicables a toda propiedad, pública y privada, dentro de la Ciudad.

C. Todas las estipulaciones contenidas en este Capítulo serán aplicables a áreas interiores y exteriores.

D. Ninguna parte del contenido de este Capítulo autoriza ningún procedimiento penal ni supresión por violaciones a este Capítulo o a cualquier otra estipulación del Código Municipal de Upland que no sea compatible con la consideración del caso Kirby v. County of Fresno 242 Cal.App.4th 940 (2015).

9.48.030. Definiciones

Las siguientes definiciones aplican a este Capítulo:

A. "Marihuana" tendrá la misma definición establecida en el Código de Salud y Seguridad del Estado de California Sección 11018. "Marihuana" incluye: "cannabis" según la definición del Código Comercial y Profesional de California sección 19300.5(f); "concentrado de cannabis" según la definición del

Código Comercial y Profesional de California sección 19300.5(g); "producto comestible de cannabis" según la definición del Código Comercial y Profesional de California sección 19300.5(s); "cannabis fabricado" según la definición del Código Comercial y Profesional de California sección 19300.5(ae); "cannabis medicinal," "producto medicinal del cannabis," o "producto del cannabis" según la definición del Código Comercial y Profesional de California sección 19300.5(ag); y "cannabis tópico" según la definición del Código Comercial y Profesional de California sección 19300.5(al).

B. "Responsable de los cuidados" o "responsable de los cuidados principales" tendrá la misma definición establecida en el Código de Salud y Seguridad del Estado de California sección 11362.7 (d) y (e).

C. "Persona" significará cualquier persona, empresa, corporación, asociación, club, sociedad u otra organización. El término persona incluirá a cualquier dueño, gerente, propietario, empleado, voluntario y/o vendedor(a).

D. "Uso y actividad en relación con la marihuana" incluye el despacho, cultivo, fabricación, procesamiento, almacenamiento, pruebas, etiquetado, re-etiquetado, empaque, re-empaque, transporte, entrega, distribución, suministro o venta, o cualquier combinación de las anteriores, de marihuana, excepto lo estipulado en el Código Comercial y Profesional de California sección 19319, relacionado con pacientes elegibles. "Uso y actividad en relación con la marihuana" tiene también el mismo significado que "actividad comercial de cannabis" establecido en el Código Comercial y Profesional de California sección 19300.5 (j.).

E. "Cultivo" significará cualquier actividad que involucre la germinación, siembra, cultivo, cosecha, secado, curado, clasificación o recorte de cannabis.

F. "Entrega" tendrá la misma definición establecida en el Código Comercial y Profesional de California 19300.5 (m). "Entrega" tendrá la misma definición establecida en el Código de Salud y Seguridad del Estado de California sección 26001(h), si ha sido aprobada. "Entrega" no incluirá el transporte de marihuana o de los productos de marihuana a cargo de un transportista certificado que atraviese la Ciudad en carreteras públicas, de y hacia sitios afuera de la Ciudad en donde el uso y actividades en relación con la marihuana sean permitidos.

G. "Dispensario" significará cualquier sitio donde se ofrezca marihuana o dispositivos para el uso de marihuana, ya sea de manera individual, o en combinación, e incluye ventas al por menor. "Dispensario" incluye servicios de entrega, despacho y distribución móvil.

H. "Despacho" significará cualquier actividad que involucre el abastecimiento de marihuana para cualquier propósito.

I. "Distribución" significará el abastecimiento y transporte de marihuana entre personas.

J. "Fabricante" significará una persona que lleva a cabo la producción, preparación, propagación, o mezcla de marihuana, ya sea directa o indirectamente o por métodos de extracción, o de manera independiente por medio de síntesis química o por cualquier combinación de las anteriores, e incluye el empaque, re-empaque, etiquetado, y/o re-etiquetado.

K. "Paciente calificado" o "Paciente elegible" significará una persona que llena los requisitos como paciente o que tiene tarjeta de identificación según los términos definidos en el Código de Salud y Seguridad sección 11362.7.

L. "Sitio de prueba" significará cualquier instalación, entidad o lugar en la Ciudad que ofrezca o lleve a cabo pruebas o ensayos de marihuana.

9.48.040. Prohibido el Uso y Actividades en Relación con la Marihuana

En la medida en que no esté previsto por la ley del Estado, todo uso y actividad en relación con la marihuana se prohíbe en la Ciudad de Upland. Esta prohibición incluye los usos y actividades aquí estipulados.

9.48.050. Declaración de perjuicio público

Cualquier uso, estructura o propiedad que sea alterada, agrandada, edificada, establecida, mantenida, trasladada u operada de manera contraria a las estipulaciones de este Capítulo, por este medio se declara ilegal y como perjuicio público y puede ser suprimido por la ciudad a través de acciones civiles y/o administrativas por medio de una orden de restricción, mandato judicial preliminar o permanente, o de cualquier otra manera prevista por la ley para la supresión de tales perjuicios.

9.48.060. Violaciones

A. Las violaciones a este Capítulo serán sancionadas según lo estipulado en este Código.

B. Este Capítulo no es un medio exclusivo para la supresión de los usos y actividades en relación con la marihuana dentro de la Ciudad de Upland. Las soluciones estipuladas de conformidad con esta Sección, serán adicionales a cualquier otra solución existente en cuanto a violaciones al Código de Zonificación, incluyendo pero sin limitarse a, cualquier acción conforme a derecho o equidad.

C. Las violaciones a este Capítulo quedan declaradas como perjuicio público.

REGLAMENTOS DE ZONIFICACIÓN Y USO DEL TERRENO

SECCIÓN 2: Las matrices sobre el uso del terreno del Código de Zonificación, según enmienda, para Zonas de Uso Residencial (17.04), Uso Combinado (17.05), Comercial (17.06), Industrial (17.07), y Propósito Especial (17.08), y cualquier otra matriz para el uso del terreno contemplado en el Código de Zonificación que utilice el término "Dispensario o Clínica de Marihuana Medicinal," deberá sustituir "Dispensario o Clínica de Marihuana Medicinal" con "Uso y Actividad en Relación con la Marihuana."

SECCIÓN 3: La sección 17.10.020(J) (1) del Código de Zonificación será enmendado de la manera siguiente:

1. Se prohíbe el uso y actividad en relación con la marihuana en todos los distritos de zonificación que están regulados por Planes Específicos o desarrollos de unidades planificados.

SECCIÓN 4: El término "Dispensario o Clínica de Marihuana Medicinal" y su definición establecida en las Definiciones del Código de Zonificación será enmendado y sustituido por el término "Uso y Actividad en Relación con la Marihuana," que quedará definido de la manera siguiente:

"Uso y Actividad en Relación con la Marihuana" significa el despacho, cultivo, posesión, fabricación, procesamiento, almacenamiento, pruebas, etiquetado, re-etiquetado, empaque, re-empaque, transporte, entrega, distribución, suministro o venta, o cualquier combinación de las anteriores, de marihuana, y según lo definido en el Título 9.48 del Código Municipal de Upland.

SECCIÓN 5: Cualquier estipulación del Código Municipal de la Ciudad de Upland o anexos del mismo que no sean compatibles con las disposiciones de esta Ordenanza, en la medida de tal incompatibilidad y no más allá, por este medio queda revocada o modificada en la medida que sea necesario para que entren en vigor las estipulaciones de esta Ordenanza.

SECCIÓN 6: En caso de que cualquier estipulación de esta Ordenanza, o su aplicación a cualquier persona o circunstancia, sea determinado como ilegal por un tribunal de jurisdicción competente, inejecutable o no válido de cualquier otra manera, dicha determinación no tendrá efecto en cualquier otra estipulación de esta Ordenanza o en la aplicación de esta Ordenanza a cualquier otra persona o circunstancia y, con ese fin, las estipulaciones aquí establecidas son separables. El Concejo Municipal de la Ciudad de Upland declara que adoptará todas las estipulaciones de esta ordenanza que conserven su validez si cualquiera de las estipulaciones de esta ordenanza fuera declarada sin validez.

SECCIÓN 7: Esta ordenanza entra en vigor de inmediato tras la aprobación de los votantes de la Ciudad de Upland.

Declaración de Derechos de los Votantes
