Are you living in the world today? If so, you are being inun-dated with political advertisements. Some will thrill you andothers will disgust you, but it is the way of these great UnitedStates. Anyone, short of slander, can say what they want to say.

As an interior designer in the state of Texas, I too want to beable to practice my profession without intrusion or supervisionof someone else. I have proven myself in a career that is close to30 years by education, experience, examination and life longlearning. And thankfully I continue to grow and evolve in thisprofession.

Please don't sit on the sideline while everything passes you by- make the commitment today, to get involved and have avoice in your profession. If you know a legislator, let us know. Ifyou would be willing to walk the block for a legislator or stuffenvelopes, let us know. If you do nothing else, join TAID andallow us and your dollars to work for you.

QUESTIONS FOR THE EXECUTIVE DIRECTOR

I am glad at any time to answer any questions or address concernsthat anyone has. One question that was recently posed was -

How does the new Texas Residential Construction Commissionwork with my registration as an interior designer?

HB730 which formed the Texas Residential ConstructionCommission during the last legislative session, was an Act relatingto residential construction, including certain warranties, buildingand performance standards, and dispute resolution; providing anadministrative penalty.

Sec. 401.003. DEFINITION OF BUILDER.(c) The termdoes not include any business entity or individual who has beenissued a license by this state or an agency or political subdivi-sion of this state to practice a trade or profession related to oraffiliated with residential construction if the work being done bythis entity or individual to the home is solely for the purpose forwhich the license was issued.

Therefore, if you are a registered interior designer in the stateof Texas, you are regulated under the Texas Board of ArchitecturalExaminers and not the Texas Residential Construction Commission.

When you applied to the Texas Board of Architectural Examinersthe application material you completed was for purposes of licen-sure as an Interior Designer in Texas. As such, NCIDQ has notevaluated an application documenting your eligibility for anNCIDQ Certificate.

If you wish to receive an NCIDQ Certificate number, you mustsubmit a completed application to have your eligibility deter-mined. A copy of this application is available on the NCIDQwebsite (www.ncidq.org). You may also call the NCIDQ officeat 202-721-0020 to request a copy by mail. Details on the eligi-bility requirements are also available from the office and website.

West RegionThere was no rest this summer for the West Region as the

TAID Board had mandated for all the regions to gear up andget busy preparing for the coming legislative session this fall!This meant we needed to put our STRATEGIC PLAN inACTION by first spreading the work among more than justour small West Regional Board.

We have contacted members in our outlying cities such asEl Paso, San Angelo, Lubbock, and others so that we wouldhave viable resources that could better call and update ourTAID roster, as well as help us with our number one priorityin this extensive area, getting new members!

Our regional board feels that this area has long been laggingin support of TAID and it is our duty to see that we changethis trend. Therefore, we are making more new contactswith designers and others we see daily, such as reps and manu-facturers, and asking for their support, not only by joiningTAID, but especially by making PAC contributions. We arehoping that by encouraging involvement and participationof our members, we will not only strengthen the overallcomplexion of TAID statewide, but especially our local network.

We are well on our way to completing our assignments ofmembers to legislators, with several assigned to each. Withthose assignments in place, we will be ready when the timecomes to start lobbying these legislators on behalf of title regis-tration in the fall once a bill has been drafted and assigned anumber.

All in all, it has been a very productive summer, and we arelooking forward to an even busier fall. Our proudest accom-plishment was the donation from the Midland-Odessa-SanAngelo Association of the Texas Chapter ASID of $2,500.00to TAID in August! A great big thank you to this ASID asso-ciation for the donation, which came from our area’s CEPH’sand other various activities to help boost the TAID coffers!

Gulf Coast RegionThe Gulf Coast Regional Board is hard at work organizing a

CEPH Day for Friday, October 8, 2004 at the Decorative Centerof Houston. David Hildebrand, Gulf Coast Regional VPMembership, is overseeing the coordination efforts of outstandingspeakers with topics that range from “A Spec of Green” by ErinTilyou / Shaw Carpets to “Creating the Built Environment–Issuesand trends in Design” by Cathy Comeaux / Landscapeforms. Tofind out more information and to sign up please call the TAIDoffice at 281/257-3523. We know that you can obtain contin-uing education hours from numerous sources, but please rememberthat the course fees are actually contributions to support TAID,which is made possible through the generous donation of timeand materials from our speakers and their companies. We havealways had a full house in past years, so sign up now!

Unfortunately we must report that our region was asked recentlyto accept the resignation of Mary Piette, as the Vice President ofthe Gulf Coast Regional Board. Mary did an excellent job ofleading this newly formed group, and she will be sorely missed.We wish her all the best in her new endeavors. Due to herexperience with leading this region, TAID has solicited the assis-tance of Jane Page Crump to fill in the Vice President role throughthe end of 2003, at which time the State Board will elect the new

Regional VP. Many thanks to Jane Page for bringing her expe-rienced leadership to our group as we continue to plan excitingnew activities for the upcoming year.

We are pleased to report that the first of the TSA Interior DesignTask Force Committee and the TAID Practice Act Committeemet in Houston in early July. The meeting was held at the officeof our former regional board member, Amy Lopez. The twogroups are working on improved coordination and communi-cation before the 2005 legislative session begins in January.

The Gulf Coast Regional Board in conjunction with James andJane Page Crump, and other supporters honored Texas StateRepresentative Martha Wong on August 5th at the Crump’s beau-tiful home. Representative Wong spoke about her district,pressing issues that are being worked on now and those thatwill be worked on during the 79th session including our practiceact. The turnout for the event was outstanding, including membersof the architectural and interior design community as well as theChinese community of Houston.

We thank you one and all for your continued support.

Northeast RegionOn July 21st, TAID Northeast Region presented Cathy

Hendricks’s, ASID, IIDA, Executive Director of the Texas Boardof Architectural Examiners (TBAE), “the Board Rules….TBAEand you…” at the WTC during the lunch hour.

Cathy gave us a valuable update on how several of the new rulesdirectly affect interior designers. Thank you Cathy, your presen-tation and the question and answer session was, as always, veryeducational and informative. It is always an honor to have youspeak to our organization.

We would also like to thank Market Center Custom Draperiesfor underwriting the luncheon and the World Trade Center fortheir continued support of TAID.

In the last few weeks your regional board has been hard at workcalling, faxing and emailing each member in an effort to updateour files as well as advising you of your Senator and Representativeto help our Adopt-A-Legislator effort in preparation for the upcoming Legislative session in January 2005. If we have not reachedyou, please feel free to contact Pearl, at the TAID office, or oneof us with your current voting address or any other informationthat might have changed or that has been added!!

The Northeast Region has continued to offer CEPH classesthrough the wonderful support of the WTC and it’s show-rooms on July 23rd and September 24th as we will again onNovember 19th offering 8 hours of CEPH’s towards the annualTBAE requirements.

During the last year we have offered CEPH’s at the WTC everyother month. It would not have been possible without the continuedsupport of the wonderful professionals that offer their informa-tion, time and expertise to us on an ongoing basis. South RegionAdopt-a-Legislator

We have started our Adopt-a -Legislator program.. The inte-rior designers' lobbyist, Jay Brown, says it is very important foreach legislator to have an interior designer (preferably more thanone) in their district call them about the interior design issuesduring the legislative session coming up. When our bill is inspecific committees or it is going for a vote in the Senate or House,those legislators need to be called by one of their constituents (inthis case an interior designer who lives in their district) and tellthem that the bill they are to make a decision on is important tointerior designers and why.

You may be receiving a call from a TAID board member askingthat you give your legislator a call. It will only take a few minutesof your time, but will make a big difference in our success.

CEPH's We are finalizing the details of our upcoming day of CEPH's.

It will be November 11th. Please save the date.

You will be receiving notices in the mail soon with class info.We will have all 8 hours, including the barrier free requirement.Several of the courses will be about "green design". As always yourfull 8 hours will cost TAID members only $200.00. Look forthose notices soon.

We’ve all seen them: rooms that, if they were people, would bearrested for disturbing the peace. They are the rooms that havetoo much clutter and not enough charm, rooms with poor trafficflow, art that’s the wrong scale, accessories that shout ratherthan whisper. Rooms that no interior designer could enter withoutdoing a little visual rearranging.

Pat McWhorter-Giddiens of Wimberleyhas seen such rooms when she’s beencalled in after aesthetic disaster ha struck.“People start making decisions on theirown, but then the rooms don’t cometogether like they thought,” she said,adding the most common mistake shesees by do-it-yourselfers is a “a fear ofcolor.”

“Often, they’ve just painted (a newhouse) all off-white. It’s hard to tell some-body like that, ‘You’re going to have torepaint to bring in some color,’” shesaid. “Most people, depending on thescope of the project, can save money by hiring a designer fromthe start.

San Antonio has about 200 interior designers, said Robin Black,an interior designer with 34 years of experience. She also serveson the state board for the Texas chapter of American Society ofInterior Designers, and is past chairwoman of the San Antoniochapter of ASID. Interior designers are trained in space planning,Black said. For example, she can figure out how to seat 70 peoplein a restaurant using specified tables and chairs while upholdingthe client’s desired theme as well as wheel chair accessibility codes.

“We create beauty and order,” Black said. Besides offering

guidance on air quality, lighting and building codes, interiordesigners also can purchase furniture, fabrics, paint, and wall andfloor coverings.

“Interior designers have a chance to see a lot of stuff that as acivilian wandering around you wouldn’t have a chance to see, saidNancy Lloyd, former executive director of the Texas chapter ofASID. In Texas, Interior Designers have been licensed for more

than 14 years, Lloyd said.“Designers actually do work in a field

that can affect the health, safety andwelfare of a person using their services,”she said. “Interior Designers have aneffect on the quality of atmosphere andenvironment. It’s not just picking paintand colors.” The Interior DesignersLicensing Act passed by the TexasLegislature in 1990 is a title act, whichmeans people cannot advertise them-selves as Interior Designers unless theysatisfy the licensing requirements, Lloydsaid. Interior decorators or arrangersare not licensed or policed by the Texas

Board of Architectural Examiners, Black said. And they are notnecessarily cheaper to hire than Interior Designers, she noted.

Most Interior Designers are members of aSID or the InteriorDesigners Association, or both, like herself, she said. Black hasdesigned homes and businesses all over the country, includingthe offices of the San Antonio Chamber of Commerce.

McWhorter-Giddiens, who says she’s worked on every kind ofspace except boats, planes and trains, says the ideal client is “some-body who’s open, that’s excited about the project, able to commu-nicate. If they can say what they don’t like, that’s almost as helpfulas saying what they like.”

This method of support allows you to spread your commit-ment over a period of twelve months or even quarterly if that isa better fit for you. It allows DESIGN PAC an even and predictablelevel of strength so that we can better plan our strategy over thespan of the election cycle.

TBAE News(TEXAS BOARD OF ARCHITECTURAL EXAMINERS)

Is your license up-to-date? IF NOT, YOU MAY SOON FINDTHAT YOU HAVE TO TAKE THE NCIDQ EXAM IF YOUWANT TO BE AN INTERIOR DESIGNER IN TEXAS. Don’tlet this happen to you! The following information is extremelyimportant and we hope that you will read it thoroughly andcontact TBAE if you have any questions about it. This will notonly seriously impact the interior designers who are in jeopardyof losing their licenses, but will also affect their employees whoare working to get licensed, because they need to be workingfor someone who is licensed. Although we have publicized thisin our last two newsletters, we want the interior design commu-nity to help us get the word out and make sure no one has missedthis information. We do not want any interior designer to losetheir license.

A new law went into effect on September 1, 2003 that mandatesautomatic cancellation of a license that has been expired for morethan one year. The interior designers whose licenses expiredon December 1, 2003 will be the first group affected and willhave their licenses cancelled by operation of law on December2, 2004, if they have not renewed. The late fees must be paidand all continuing education requirements must be completedbefore TBAE can renew the license.

A LICENSE CANCELLED BY OPERATION OF LAWMAY NOT BE REINSTATED. TO GET A NEW LICENSE,THE APPLICANT WILL HAVE TO COMPLETE THESAME REQUIREMENTS AS ANY OTHER NEW APPLI-CANT WHO HAS NEVER HAD A LICENSE. THEY MUSTSUBMIT THE APPLICATION FORM FOR REGISTRA-TION BY EXAMINATION, PAY THE APPLICATION FEEOF $100.00, AND HAVE THEIR QUALIFICATIONS EVAL-UATED BY THE BOARD. THIS INCLUDES THOSE THATWERE REGISTERED UNDER THE GRANDFATHERCLAUSE. THEY MUST HAVE THE REQUIRED EDUCA-TION, AND THE REQUIRED EXPERIENCE UNDER ALICENSED INTERIOR DESIGNER OR ARCHITECT,AND THEY WILL HAVE TO TAKE THE NCIDQ EXAM,

EVEN IF THEY HAVE TAKEN IT BEFORE. THE CURRENTFEE FOR THE NCIDQ EXAM IS $770.00. SELF-EMPLOY-MENT EXPERIENCE WAS ACCEPTABLE FOR QUALI-FYING UNDER THE GRANDFATHER CLAUSE, BUTIS NOT ACCEPTABLE FOR NEW APPLICATIONS. An interior designerwhose registration has already been revoked by the Board for non-payment of fees will still be able to reinstate that license accordingto Rule 5.76. This new law makes it even more important that you send theBoard a written change of address, including your signature, whenyou move. Renewal notices are sent out approximately 6 weeksbefore each renewal deadline. Please mark this on your calendar.If you do not get a notice, check the registrant list on our website to see if TBAE has your correct address. The renewal formis available on our web site and it is your responsibility to payyour renewal fee even if you do not receive the renewal form.

In the coming legislative session, we anticipate the possiblepassage of an interior design practice act. If the act passes, itwill regulate not just the use of the title, but also the practice ofinterior design.

TBAE News(TEXAS BOARD OF ARCHITECTURAL EXAMINERS)

Governor Rick Perry has appointed Alfred Vidaurri, Jr., AIA,of Arlington to the Texas Board of Architectural Examiners fora six-year term. Mr. Vidaurri is an architect and principal withFreese and Nichols, Inc., Engineers, Architects, and EnvironmentalScientists in Fort Worth, Texas.

He received his bachelor and graduate degrees in architecturefrom the University of Texas at Arlington. His specialized areasof focus and experience include master planning, program manage-ment, and architectural design in higher education, municipal,and healthcare areas. Mr. Vidaurri is one of four architects on the

nine-member board whose purpose is to protect the health, safety,and welfare of the public by ensuring that architects, landscapearchitects, and interior designers are qualified to practice theirprofessions.

We extend a cordial welcome to Mr. Vidaurri and look forwardto his participation on the board.

During the 78th legislature session, (Acts 2003, 78th Leg., ch. 331, § 5.03, eff. Sept. 1, 2003) legislation was passed that said:

The design of the seal must be the same as the design used bythe board, except that the words "Registered Interior Designer,State of Texas" must be used instead of "Texas Board of ArchitecturalExaminers."

The TBAE Board has adopted the following design for use byall professionals. This rule is effective immediately, however theBoard has voted to allow you to use your old seal until January 1,2006, without penalty.
