EXECUTIVE SUMMARY

The proposed project for Pasig BLISS, more popularly known as CanioganBLISS because of its location in Barangay Caniogan, is one of twenty three (23)sub-projects of the Community Sanitation Project Phase I, which is a componentof the World Bank-assisted Manila Second Sewerage Project (MSSP).

The project is intended to reduce the current wastewater pollution discharged tothe Marikina/Pasig River by the one hundred forty four (144) residential unitswithin the Caniogan BLISS compound. The project invclves the improvement andrehabilitation of the sewerage system in the compound. Specifically, the projectincludes the construction of sewer lines to intercept sewage flows from existingcommunal septic tanks as well as raw wastewater flows from buildings withoutseptic tanks. An underground centralized sewage treatment plant (STP) will beconstructed to treat the wastewater flows.

Approvals for the project were obtained through a community consultationprocess, through the Homeowners' Association Board officers. An endorsementletter from the Barangay Council of Barangay Ugong was obtained to facilitatethe process. Finally, a Memorandum of Agreement (MOA) among Manila WaterCompany, Home Guaranty Corporation (HGC), and the Homeowners'Association Board in Caniogan BLISS was executed.

In conformity with the requirements of the Department of Environment andNatural Resources (DENR), an Environmental Compliance Certificate (ECC)NCR-2000-10-04-0218-120 issued pursuant to P.D. 1586 was secured for theproject.

I. BASELINE ENVIRONMENTAL CONDITIONS

Caniogan BLISS is a government settlement housing project implemented in the1980s to provide homes for public officials and the less fortunate. The housingproject is situated in the heart of Pasig City, within a one-kilometer radius fromthe City Hall. It is located along Colonel Licsi street, Barangay Maybunga whichis just a few meters away from Dr. Sixto Anonio Avenue (west), Pasig BoulevardExtension (south) and C. Raymundo Avenue (east). The area is bounded byprivate lots on the west, southeast and northwest sides and Colonel Licsi Streeton the east and southeast.

The Caniogan BLISS compound has a total land area of fourteen thousand twohundred seventy four (14,274) square meters, more or less, 17% of which areresidential areas, 4% roads, and 79% parking spaces, playgrounds and commonareas. The housing compound is composed of nine (9) four-story, walk-up,residential buildings with sixteen (16) units per building and an estimatedpopulation of 900 individuals.

Floral population within the compound constitutes ornamental plants and a fewfruit trees, which were planted by the residents. Faunal population is limited tohousehold pets and stray animals. The area is characterized by a relatively evendistribution of precipitation during the year. Like in most parts of Metro Manila,the community has two distinct seasons: the dry season during the months ofNovember to May and the wet season during the months of June to October.

Existing Sewerage System

At present, there are seven (7) existing communal septic tanks serving the nine(9) residential buildings. However, only four (4) of the seven (7) tanks arefunctional. The rest have been bypassed and wastewater flows directly to thenearest drainage. Due to the poor maintenance of the communal septic tanks,some buildings opted to construct their own septic tanks. The discharge istapped to the drainage line along Colonel Licsi Street and eventually drains toMarikina River.

The sewerage system in Caniogan BLISS consists of Cast Iron Pipe sewernetwork laid during the development of the area, except for some new pipes,made of Polyvinyl chloride (PVC), laid by individual units who installed theirindividual septic tanks.

The sewer network was designed so that wastewater flows will be directed toseven (7) communal septic vaults. At present, the sewerage system of CanioganBLISS is not maintained. Some of the clean-outs are buried and can be hardlylocated. Many sewer lines are either clogged or broken so that some residentsopted to construct their own septic tanks or directly tapped to the drainage. Whilethe other four (4) communal septic tanks are still functional, most residents stillcomplain about the maintenance cost and arrangements.

II. ENVIRONMENTAL IMPACTS AND MITIGATING MEASURES

1.2 PROJECT LOCATION

The proposed project for Caniogan BLISS is a sub-project of the CommunitySanitation Project, which is a component of the World Bank-assisted MSSP.

The service area is the entire Caniogan BLISS. The project site is in Colonel LicsiStreet, Barangay Caniogan, Pasig City which is easily accessible from either thePasig Boulevard extension via C-5 road or the C. Raymundo Avenue via OrtigasAvenue extension. Figure 1 presents the location map of the project

1.3 PROJECT RATIONALE

In Metro Manila, untreated/partially treated domestic wastewater is the majorsource of pollution of inland waters. Most residential houses in Metro Manilatreat their wastewater by means of septic tanks, which do not provide adequatetreatment to satisfy the DENR requirements for wastewater effluent standards.Moreover, majority of septic tanks in Metro Manila is not properly maintained.This situation has led to the deterioration of the Marikina/Pasig River and otherinland waters. The DENR has estimated that around 60% of the pollution load toPasig River come from domestic discharges.

There is therefore an urgent need to establish collection and treatment methodsthat will help reduce the pollution load to inland waters. The provision of anefficient and cost-effective sewage collection, treatment and disposal is theprimary objective of the Community Sanitation Project under the MSSP.

This project specifically aims to address the problems of inadequate wastewatertreatment and disposal in Caniogan BLISS as shown by the analysis of theeffluent of one of the septic tanks in the area (see Table 1 below). In CanioganBLISS, wastewater, either from the septic tanks or straight from the households,discharge to the drainage pipes along Colonel Licsi Street, and eventually find itsway to Marikina River. Figure 2 shows the existing sewer network in CanioganBLISS.

The project will help reduce public health risks and environmental pollution fromuntreated/partially treated domestic wastewater by providing a sustainablesanitation and sewerage facility. It will also serve as a good illustration of propersanitation especially to the neighboring communities near Pasig and MarikinaRivers.

1.4 DESCRIPTION OF PROJECT PHASES

1.4.1 Pre-Operational / Construction Phases

1.4.1.1 Construction Plan

The project is scheduled for bidding in December 2001. Construction isexpected to commence in March 2002 and project completion is targeted inAugust 2002 (180 calendar days).

Figure 3 shows the implementation schedule for the project. Manila WaterCompany will undertake the project implementation.

1.4.1.2 Total Surface Development Block

The service area is approximately 1.4274 hectares and is estimated to have acurrent population of approximately 900. The project will serve only theresidential establishments within Caniogan BLISS. Any increase in population isnot considered because there are no further planned development within thecompound that would significantly affect the quality and/or quantity of wastewaterdischarges.

1.4.1.3 Estimate of Total Land Area to be Opened for Civil Works

Civil Works will include the STP construction, and the laying of sewer lines toconnect existing communal septic tanks and buildings without septic tanks to theSTP. The STP will be located underground in a 120 square-meter lot. Sewerlines totaling 262 meters will be opened for civil works. Figure 4 shows thesewer network layout plan for the project.

1.4.1.4 Major Openings and Construction Activities

The complete sewerage system will include the following components:

* Collection sewers (diameter=150 mm) with a total estimated length of 245meters to connect the 5 communal septic tanks, 5 individual septic tanksand buildings without septic tanks to the STP

* 15 sewer manholes and 7 junction boxes with average depth of 1.5 meters* Underground STP with a design capacity of 161 m 3/day and land

allotment of 120 m2

* Sewer line (diameter=150 mm) with a total estimated length of 17 metersfrom STP discharge point to existing storm drainage

1.4.1.9 Total Manpower Requirement

The project will be bid out based on World Bank procedures. The winning bidderwill provide contractual work for a period of around 180 calendar days. Thecontractor will provide skilled and unskilled workers to carry out the scope ofworks as detailed in the bid documents. The scope of works includes:

1.4.2 Operational Phase

1.4.2.1 Project Operation Schedule and Duration

Completion of construction is expected by August 2002. Start-up operations willbegin immediately after project completion.

1.4.2.2 Process Technology and Activities

The project will be bid on the basis of performance specifications for the STPTreatment Process:

* Wastewater flows were computed on the basis of a per capita water demandof 200 liters per day and a 70% wastewater discharge. Storm infiltration wasestimated at 10% of the total flows. A peak factor of 1.5 was added in thecomputation of design flows to determine pipes sizes and capacity of STP.

* The influent flow characteristics were based on random laboratory analysesof septic tank effluent in Caniogan BLISS and the other project sites. Theinfluent quality assumptions are shown in Table 3 below:

Process Scheme of STP

The STP to be constructed in Caniogan BLISS will be below ground. The onlyaboveground structure will be the control room/panel.

The STP treatment process will provide secondary treatment to septic tankeffluent. It is expected that bidders will propose different process technologiesbased on the performance specifications in the bid documents. Some factorswhich will be considered in selecting the STP treatment process are:

A general scheme for the treatment process is illustrated in Figure 5.

1.4.2.3 Waste Production Scheme

Up to 2005, sludge produced in the treatment process will be transported to acentralized Septage Sea Disposal Station located in J.P. Rizal St, Brgy, WestRembo, Makati City. Mobile vacuum tankers will collect the sludge produced inthe STP.

A long-term disposal scheme for biosolids from the STP will be as soilconditioner for sugarcane and corn in Pampanga. Experiments done incoordination with the Sugar Regulatory Administration on the use of sludge inenhancing the soil quality of lahar-covered areas and the growth of crops such assugarcane, corn and bittergourd resulted in the issuance of a temporary licenseissued by the Fertilizer and Pesticide Authority. The license allows the use ofsludge in growing similar crops.

Sludge generated from the STP can also be treated in the 600 cu.m/day septagetreatment facility which is expected to be operational by 2004. This facility is partof the Sanitation Component of the Pasig River Rehabilitation Project. Thefacility will be operated by Manila Water Company. Stabilized sludge may alsobe used as filling material.

1.4.2.4 Manpower Requirement

Manila Water Company will assign an LLDA and DENR-accredited PollutionControl Officer (PCO) who will be responsible for the compliance of the STP withgovernment regulations. The PCO will have trained operators/crew who willmonitor and manage the operation of the sewer network.

Since the STP operations will be operated largely by automation, regularmaintenance works will include declogging of sewer lines and removal of sludgefrom the STP site and the communal septic tanks. The STP operator will visit theproject site daily. Monitoring of the effluent quality will be the joint responsibilityof the PCO and the Central Laboratory of Manila Water Company.

The community has also agreed to provide a liaison officer who will coordinatewith Manila Water Company personnel on the proper operations of the STP andthe sewer network. A 24-hour Customer Service Hotline (1627) is available toaccept complaints and other emergency reports. Manila Water Company hassewer network repair crews who work in regular round-the-clock 8-hour shiftsand who are readily available for any emergency work.

1.4.3 Abandonment Phase

Upon completion of the project scope, the contractor will remove all temporarystructures and facilities installed during the construction phase. All pavementswill be restored. The cost of abandonment will be incorporated in the overall costof the project. Manila Water Company will issue a certificate of final acceptanceonly upon completion of all abandonment works by the contractor and uponturnover of the STP operations.

2.0 BASELINE ENVIRONMENTAL CONDITIONS

2.1 STUDY METHODOLOGY

This Initial Environmental Examination (IEE) was prepared in compliance with theWorld Bank's Operational Directive 4.01 on Environmental Assessment. An IEEwas previously carried out according to the DENR Administrative Order No. 96-37, for which an Environmental Compliance Certificate (ECC) dated Oct. 4, 2001has been issued by the DENR-Regional Office (Annex 3).

2.2 LAND

2.2.1 Land Resource Utilization

Caniogan BLISS has an estimated land area of 1.4274 hectares. Approximately17% of the total area is devoted to residential use, 4% to roads, 79% recreationaluse, chapel, parking area, and other common-use facilities.

2.2.2 Physiography and Geology

Caniogan BLISS is on a relatively flat plain sloping downward to Dr. SixtoAntonio Avenue and Marikina River in the east.

Soil type found in the site is quaternary alluvium which is characterized by detritaldeposits, mostly silt, sand and gravel.

2.2.3 Vegetation and Wildlife

The proposed site for the STP is in a 120-square meter lot in a vacant areabetween Building I and Building 9. Figure 6 shows photographs of the proposedsite.

2.2.4 Land Acquisition Assessment

Manila Water will be allowed to use a parcel of land for the STP by way of a grantof perpetual easement from the owner/developer of the community, which in thisproject is the Home Guaranty Corporation (HGC). The STP site is free frominformal settlers.

2.3 Water

2.3.1 Inventory of Water Bodies

Marikina River is located approximately 150 meters northwest of CanioganBLISS. Wastewater flows from the compound enters the communal septic tanksthen the drainage system before discharge to the Marikina River.

At present, the Marikina and Pasig River do not meet the Class C standards (i.e.,suitable for propagation and growth of fishes, recreational uses and industrialwater supply) especially during the summer months when there is no sufficientriver flow. At these times, the BOD in Pasig River reaches 120 mg/L which is 12times higher than the permitted level for Class C water; DO drops to zero; andtotal coliforms exceed the MPN/100 ml standard by up to several thousanddegrees.

The current BOD loading entering the Pasig River is estimated at 242 tons/daywhich is 21% above the river's estimated maximum assimilative capacity.Domestic wastewater contributes 168 tons/day of BOD. Without any sewerageor sanitation interventions, the pollution load entering the river is expected toincrease to 269 tons/day in year 2005, which is expected to come from domesticsewage.

2.3.2 Water Quality (Surface/Ground)

Surface Water QualitY. Pollution loading to Marikina and Pasig Rivers will bereduced since septic tanks and raw wastewater from the project area will nolonger be discharged directly to the creek. Effluent from the plant will comply withDENR Effluent Quality standards sufficient for Class C waters.

Ground Water Quality. Since septic tank effluent will undergo further treatment inthe plant, the possibility of contaminating the aquifers due to leachate from septictank discharge or from raw wastewater will be eliminated. Seepage from plantoperations will be non-existent.

2.4 AIR

Pasig City experiences only two types of weather conditions, rainy season andthe dry season. Rainy season occurs between the months of July and October,while the dry season occurs between November and June. Mean annualtemperature is 27.40C and average annual relative humidity is 77% for MetroManila.

Air quality within Caniogan BLISS is moderately unpolluted. However, outsidethe compound is a national road (Pasig Boulevard Extension), and two busyavenues (Dr. Sixto Antonio Avenue and C. Raymundo Avenue) where public andprivate vehicles exhaust vehicle*fumes contributing to minor air pollution in thearea especially during rush hours.

2.5 PEOPLE

2.5.1 Population

The estimated population of Caniogan BLISS based on the present number ofresidential units (144), is around 900. Majority of the residents are low- tomiddle-income earners.

2.5.2 Project Affected Persons

During construction, the project will cause noise nuisance to the nearby residentsof the site and will add to the traffic outside of the compound. Once operational,the project will directly affect the residents of the entire Caniogan BLISS. Thesanitation of the community will be improved when the new sewer system isoperational.

Manila Water will assign skilled personnel to operate and maintain the system upto approved standards.

3.0 ALTERNATIVES

Caniogan BLISS is considered a priority area for the improvement of sanitationconditions based on the following factors:

* It has a relatively high population density.* The existing sanitation facilities are inadequate to comply with the DENR

effluent standards.* The communal sanitation and drainage systems in the compound are not

maintained.* Some buildings are directly discharging raw wastewater to the drainage.

Only two sites were identified as possible locations for the STP. The abandonedtennis court near Building 5 and Building 7 and the vacant area near Building 9and Building 1. The latter site was chosen as the STP site because of itselevation and size. The project will also discourage informal settling in the site.

4.1.1 Impacts During Construction Phase

A. Air Quality

During the implementation of the project, an increase in emission of dust andsuspended particulates will occur in the vicinity of the STP site and excavationsfor the sewer pipes. This can be attributed to civil works such as excavation,disposal of excess soil and other related construction activities. Another causewill be emission of fumes and other air pollutants of the vehicles to be used.

B. Water Quality

There is minimal effect on the quality of water in Marikina and Pasig Rivers sincethe site is quite distant from these bodies of water. Wastewater resulting fromwashing of tools and equipment may affect the turbidity of the drainage flows.

C. Noise

Noise will be generated during the construction of the project due to theoperation of equipment and construction activities. Considering that theproposed site for the project is near the residential buildings, proper mitigatingmeasures will be done to ensure that the equipment and activities will cause littleor no disturbance to the residents.

Heavy equipment will be monitored to operate only in short periods of time toavoid sustained high level of noise. The operator of heavy equipment will berequired to pause work for 10-15 minutes after every two (2) hours of operation.The use of heavy equipment will be strictly prohibited from 6:00 P.M. until 8:00A.M. on weekdays. Residents will be given prior notice at least one (1) daybefore use of any heavy equipment on Saturdays. Use of heavy equipment willbe prohibited during Sundays except for special or emergency activities thatneed immediate action.

D. Ecological Effects

Since there are no rare, endemic species of flora and fauna in the project area,project implementation has minimal impact on the overall terrestrial ecology ofthe Caniogan BLISS. Some plants and trees will be unavoidably cleared duringcivil works.

4.1.2 Impacts During Operation Phase

A. Air Quality

There will be minimal effect on the air quality during the operational phase of theSTP. Aside from the occasional odor nuisance, there will be no adverse effecton air quality. The performance specifications for the STP treatment processspecifically state that the facility should have odor control mechanisms. ManilaWater Company will not accept the turnover of the STP by the contractor if thefacility continuously emits unpleasant odors. Permanent solution(s) to addressany odor nuisance will be the responsibility of the contractor.

B. Water Quality

Without wastewater treatment, Caniogan Bliss accounts for an estimated 32kgBOD 5/day loading to Culiat Creek. The implementation of the project willcontribute to the improvement of the quality of water in Culiat Creek by reducingdischarge of untreated/partially treated wastewater. From a pollution loading of32 kg BOD5/day, loading will be reduced to 3-8 kg BOD 5Iday, or a 75-85% BODreduction, when the STP becomes operational. The implementation of theproject will contribute to the improvement of the quality of water in the nearbycreek by reducing discharge of untreated/partially treated wastewater.

C. Socio-Economic

A flat sewer charge equivalent to 50% of the water charge will be included in thewater bill once the STP is commissioned. This fee will help cover the costs of theoperations and maintenance of the STP and the sewer network. Thisarrangement was clearly explained to the community during the consultationprocess. The consultation done with the community is explained in Chapter 6.0.

The general sanitation conditions in the project area will significantly improve.The project will reduce, if not eliminate the threat of water borne diseases suchas diarrhea and typhoid, which are more costly to manage.

D. Sludge Disposal and Management

The existing septic tanks in the area produce an estimated 6kg of sludge peryear. The table below illustrates the sludge production averages for variouswastewater treatment processes. Also indicated is the estimated sludgeproduction of the STP considering each type of treatment.

The bidders for the project may propose any of the above wastewater treatmentprocess or their modifications. Cost and operational efficiency are among theconsiderations for awarding the bid.

In the interim (i.e. up to 2005), sludge produced in the treatment process andcollected from the communal septic tank will be transported to a Septage SeaDisposal Station located in J.P. Rizal Ave., Brgy, West Rembo, Makati City.Vacuum tankers will collect the sludge produced in the STP and collected in thecommunal septic tank.

A long-term alternative is the disposal of sludge and septage to the lahar areas inPampanga. The sludge can be usecl as soil conditioner for sugarcane and corn.Experiments done in coordination with the Sugar Regulatory Administration onthe use of sludge in enhancing the soil quality of lahar-covered areas and thegrowth of crops such as sugarcane, corn and bittergourd resLilted in the issuance

Starting 2004, a septage treatment facility will also be available to treat sludgeand septage from the STP. This facility is part of the Sanitation Component of thePasig River Rehabilitation Project. Manila Water Company will operate theseptage treatment facility. Stabilized sludge may also be used as filling material.

The implementation of the project is projected to produce minimal adverseenvironmental impacts. Moreover, the long-term benefits from the project suchas improved sanitation conditions within the compound, lesser risk of waterbornediseases, and reduction in pollution will more than compensate for the negativeeffects that this project will cause during construction and operation.

Mitigating measures will be implemented to minimize, if not eliminate anyadverse impact that the project may cause. Measures to enhance the existingenvironmental conditions in the project site shall be implemented, as needed.

4.3 UNAVOIDABLE AND RESIDUAL IMPACTS

Unavoidable and residual impacts are those that occur as a result of naturalcalamities such as floods caused by typhoons or heavy rains, earthquakes andthe like. Appropriate measures will be done to anticipate these impacts and toimplement contingency action plans.

The procedures to be used during the sampling and analysis will be based on thestandard methods prescribed in DENR Administrative Order No. 34 and 35.Annex 5 presents a sample monitoring sheet of effluent quality used by ManilaWater Company.

6.0COMMUNITY CONSULTATION PROCESS

The development of the project included a community consultation process,which followed the procedures listed below:

1. Endorsements were obtained for the project from the Barangay Captain(Annex 6) and the Home Guaranty Corporation, which owns the commonareas in the compound (Annex 7).

2. The project was explained to the Homeowners' Association Board membersin a series of meetings. The Board requested the Project DevelopmentOfficers (PDOs) to do an educational campaign to educate their members onthe benefits of the project in general meetings attended by the homeowners.

3. In the educational campaign, more emphasis was given on the health andenvironmental benefits. Actual interviews were conducted regarding thedifficulties in maintaining the present system.

4. With the agreement of the homeowners gathered in the general assemblies,the Homeowners' Association Board executed a Board Resolution givingfavorable endorsement to the project (Annex 8).

This Certificate is issued subject to the following conditions:

1. PRE-CONSTRUCTION AND CONSTRUCTION STAGE:

1. That all amenities/utilities (e.g. recreational areas, parking areas, drainagelines, paved areas, etc. ) affected by the project shall be immediatelyrestored and rehabilitated;

2. That the proponent shall conduct orientation for resident engineers andcontractor who will undertake and implement the project to apprise themof the conditions/stipulations of this ECC and the necessary measures thatwill mitigate adverse environmental impacts and submit report withinfifteen (15) days from date of orientation;

3. That a billboard measuring 0.5 meter by 1.0 meter, bearing "NCR-2000-to - o4 -0218-120 issued pursuant to P.D. 1586" shall be displayed

in a conspicuous location at the project site for identification and guidance;

8. That in case of abandonment or indefinite work stoppage, the projectproponent shall submit a written notification thirty (30) days before thescheduled abandonment/work stoppage and to restore the site to itsoriginal condition or provide safety and protective measures to preventadverse environmental impacts that may be caused by the project;

9. That restoration works/grading of the exposed grounds shall beimmediately undertaken for safety, enhancement and. ecologicalpurposes;

10. That this Certificate shall be posted in a conspicuous place in theAdministration's Office for easy reference and guidance;

11. That the proposed Environmental Monitoring Program must beimplemented, the report and/or result under oath of said monitoring andon the compliance with each of the conditions of the ECC shall besubmitted to this Office annually;

12. That a written notification shall be made to the DENR-NCR for approval, incase the project proponent cannot comply with any of the conditions fortechnical reasons; and

13. That the project proponent shall allow DENR-NCR personnelwith proper identification card and travel/mission order to conductinspection/monitoring of the project without prior notice to overseecompliance to ECC conditions.

Non-compliance with any of the above stipulations and/ormisrepresentations in the IEE submitted by the proponent will be sufficient causefor the suspension or cancellation of this Certificate and/or imposition of a fine inan amount not to exceed Fifty Thousand Pesos (P50,000.00) for everyviolation thereof pursuant to Article IX, Section 6.0, DENR Administrative OrderNo. 37, Series of 1996. This ECC is not a permit rather it is a certification thatthe proponent has committed to undertake or implement mitigation measures toreduce the negative impacts to acceptable level.

With the privatization of MWSS, Manila Water Company, Inc. was giventhe right to exclusively provide water and sewerage services to the Easternpart of Metro Manila, which includes Pasig City. In line with its serviceobligations, the MWC has elected to develop and improve the sewerage systemsof the Caniogan BLISS Project (hereinafter referred to as "Pasig BLISS").

WHEREAS the sewerage system in Pasig BLISS has been in existencesince June 1981 and requires repair and rehabilitation due to degradationcaused by age and natural deterioration;

WHEREAS the present condition of sanitation in the area may presenthazards to the health of the residents of the community;

WHEREAS the existing sewer treatment facility needs to be upgraded sothat the wastewater effluent will meet environmental standards;

WHEREAS, The said project was properly endorsed by the Home Guaranty Corporation, BarangayCouncil of Caniogan and supported by City Ordinance # 18 series of 2000 released by the office of CityCouncilor and Chairman on Health and Sanitation, Robert C. Eusehio;

WHEREFORE, RESOlVED as it is hereby resolved, that the Pasig BLISS Homeowners Association,through the incumbent majority of the Board of Directors, has approved the implementation of the said nobleproject, which will commence as soon as possible;

As the sole provider of wastewater services in the Eastern part of Metro Manila,Manila Water Company will upgrade the sewerage and sanitation systems inCaniogan BLISS. Specifically, Manila Water will construct an undergroundwastewater treatment plant that will collect and treat wastewater from households.The treated wastewater that will come out from the treatment plant will beenvironmental-friendly and will meet the standards of the DENR. The systemproposed by Manila Water will eliminate the need for you to maintain yourcommunal septic tanks and the pipes that collect wastewater from the buildings.The whole wastewater system will be operated and managed by trained personnelof Manila Water.

Licsi St., Barangay Caniogan, Pasig City, representedherein by its President, Mr. Teodorico 0. San Agustin, thereunto dulyauthorized;

WITNESSETH THAT -

WHEREAS, under its Charter (Republic Act No. 6234, as amended), the MWSS hasjurisdiction, supervision and control over all watenNorks and sewerage systems within itsfranchise which includes, among others, Pasig City;

WHEREAS, by virtue of and pursuant to a Concession Agreement dated February 21,1997 (the "Concession Agreement") executed by and between the MWSS and MWCI, MWSSgranted to MWCI, as concessionaire/contractor/agent, the sole right to manage, operate andmaintain all fixed and movable assets required to provide water delivery and sewerage servicesin the East Service Area (which includes Pasig City) of the franchise area of MWSS;

WHEREAS, HGC owns and holds title to the common areas in the Pasig Bliss Project("Pasig Bliss"), consisting of areas which include the septic vaults and sewer lines from eachbuilding to the septic vaults (the "Sewerage System") located within the compound of the PasigBliss, Col. Licsi St., Brgy. Caniogan, Pasig City, Metro Manila;

WHEREAS, in line with a program initiated by MWCI in pursuance of the ConcessionAgreement, MWCI has offered to take over the operation and maintenance of the SewerageSystem, and HGC and Pasig BLCA have accepted said offer, upon and subject to the terms,conditions and stipulations hereinafter set forth;

NOW THEREFORE, for and in consideration of the foregoing premises and of the terms,conditions and stipulations herein contained, the parties hereto have mutually agreed to thefollowing:

ARTICLE I

RIGHTS AND RESPONSIBILITIES OF MWCI

1.1 MWCI shall, at its expense operate, manage and maintain theSewerage System, including the Sewage Treatment Plant (the4STP"), referred to in Article 2.1 her-of, which shall be constructedby MWCI, at its expense. The ownership of the STP shall pertainto MWCI during the effectivity of the Concession Agreement.

1.2 MWCI shall provide HGC and the Pasig BLCA with the details ofthe sewerage plan, including the Iccation and the size/area of theland requirement for STP.

1.3 As operator of the Sewerage System, MWCI shall be responsiblefor ensuring that the wastewater effluent from the SewerageSystem and treated at the STP shall comply with all national andlocal environmental laws and standards. Commencing from thedate of commissioning of the STP, MWCI shall have the soleliability for any charges or fines that may be assessed in case ofany violation of the said environmental laws and standards, whichare not the result of or due to the acts, fault or negligence of HGCand/or any locator/homeowner of Pasig Bliss.

1.4 If deemed necessary by MWCI for the proper and efficientfunctioning of the Sewerage Systenm and the STP, MWCI shall, atits expense and after due consultation with the Pasig BLCA, makeany addition and/or modification on the Sewerage System and/orthe STP.

1.5 Any loss and / or damage to any person or property, or any othercase or suits that may be filed against HGC which may be causedby the construction of the STP will be the responsibility of MWCIand MWCI hereby holds HGC free and harmfree from any liabilityor responsibility therefor.

1.6 MWCI shall provide HGC and/or the locator / homeowner of PasigBliss with information related to the treatment performance of theSTP as HGC and/or any locator / homeowner may request inwriting.

1.7 MWCI shall bill, collect and receive payments from thelocators/homeowners of sewer charges in accordance with therates allowed under the Concession Agreement. The sewercharges shall be incorporated in the MWCI water bill commencingfrom the date of commissioning of the STP.

ARTICLE II

RIGHTS AND RESPONSIBILITIES OF HGC

2.1 HGC shall provide a gratuitous perpetual easement on anappropriate piece of land in the common areas as determined inthe sewerage plan referred to in Art. 1.2 hereof, on which the STPwill be constructed.

2.2 HGC shall retain ownership of the land whereon the STP isconstructed until turnover to the proper party in accordance to law.

2.3 HGC shall grant to any authorized representative(s) of MWCI, itscontractor, and assigns the right-of-way (ingress to and egressfrom) to the premises of Pasig Bliss for theconstruction/installation, operation, management andmaintenance, as the case may be, of the Sewerage Systemand/or the STP and for the execution/performance of allnecessary and related works/activities in connection therewith.

ARTICLE IlIl

RIGHTS AND RESPONSIBILITIES OF THE PASIG BLCA

3.1 The Pasig BLCA shall ensure and guarantee to the authorizedpersonnel/representative(s) of MWCI, its contractors, successors,and assigns, free ingress to and egress from the SewerageSystem for the execution/performance of all works and activities inconnection with the installation/construction, operation,management and maintenance of the Sewerage System.

3.2 The Pasig BLCA shall provide a liaison personnel who shallcoordinate with the MWCI and/or its contractors during theconstruction activities

3.3 The Pasig BLCA shall ensure that the homeowners/locators ofPasig BLISS are duly notified of MWCI's construction, operationand maintenance of the Sewerage System and shall cause suchhomeowners/locators to assist and cooperate to the extentpossible, MWCI in this connection.

DURATION OF AGREEMENT

This Memorandum of Agreement, which shall take effect on the date of itsexecution by both parties, shall be co-terminus with the Concession Agreementand be binding also to the successors, assigns and transferees of the parties.
