Department of Corrections

Date: April 1, 2014 To: All DOC Adults in Custody From: Offender Information and Sentence Computation (OISC) Subject: Explanation of 20 Percent and 30 Percent Earned Time Eligibility Some crimes may qualify for different percentages of earned time, even if sentences were handed down on the same day for the same case. There are a few reasons why you may see different earned time percentages on one face sheet. Due to changes in the law, earned time eligibility is based on the date the crime was committed, the date of sentencing, and criminal history. For example, one person may receive 30 percent earned time for an Identity Theft sentence, while another person can only get 20 percent earned time for the same crime. The following chart explains the changes in earned time eligibility.

If you have any questions about your earned time eligibility or percentage, please contact the Prison Term Analyst at OISC for more information.

20 PERCENT vs. 30 PERCENT EARNED TIME ELIGIBILITY

Crime Date/Sentencing Date Maximum Earned Time Applied

Sentenced prior to 07/01/2009 20 percent unless crime is eligible and the court approves 30 percent on/after August 31, 2009 and prior to February 17, 2010

Sentenced (or resentenced) on or after 07/01/2009, for a crime committed prior to 02/17/2010

20 percent or 30 percent depending on the crime

Crime committed on/after 02/17/2010 and prior to 07/01/2011 Maximum 20 percent

Crime committed on/after 07/01/2011 and prior to 07/01/2013 20 percent or 30 percent depending on the crime and/or prior convictions served within five years of crime date

Crime committed on/after 07/01/2013 Maximum 20 percent
