2. Common knowledge on adverse effects requires precaution and carefulness, especialy in IBA’s
• IBA’s: enviromental impact assessment required
• SPA’s: strict application of article 6 EU-Habitatdirective:–Appropriate assessment–Alternative solutions–Imperative reasons of overriding
public interest.
Conclusions with regard to participation and decision making processes
• The application of art. 6 HD in SPA’s guarantees sufficient posibilities to ensure carefulness and the apply of the precautionary principle
• Elsewhere, the regular use of Enviromental Impact Assessments do need more juridical quarantees for the position of the enviromental aspects - including the precautionary principle - in the final decision making.
