PRESCRIPTION MONITORING PROGRAM

Virginia’s Prescription Monitoring Program is in its 10th year of operation. The Program began in response to concerns about abuse and diversion of controlled substances. Giving prescribers access to a patient’s record of controlled substances is seen to have a number of advantages: 1) with access to a patient’s controlled substance prescriptions, a prescriber can make better clinical decisions for the patient; 2) the prescriber can better identify if a patient has a problem with substance abuse for purposes of diagnosis, treatment and referral; 3) clues to diversion can be spotted and dealt with appropriately.

Beginning with the collection of Schedule II drugs in Southwest Virginia, the Program’s scope has grown dramatically over the past decade. Now all Schedule II, III and IV drugs dispensed by pharmacies in the Commonwealth or operating into the Commonwealth must be reported to the Program. Over 13 million prescriptions will be logged by the Program this year, and it will answer over 1 million requests for patient information.

Most requests come from prescribers; pharmacists and law enforcement also routinely make requests of the Program. The good news is that about 85% of the most prolific prescribers of controlled substances are signed up to use the Program. But controlled substances still manage to make it onto the street, and even if you only write a few prescriptions a month for substances that can be abused, the Program can be useful to you, good for your patients and good for the health of the public.

Two aspects of the Program should be mentioned. The law now allows a practitioner signed up with the Program to delegate access to an unlimited number of licensed healthcare professionals under his/her direct supervision. A busy practitioner can have licensed staff make requests of the Program when he/she was too busy to do so previously. Also, the Program is interoperable with 10 other states. Not only can you check a patient’s prescription history in Virginia, but also in Ohio, Indiana, Connecticut, Michigan, South Carolina, North Dakota, Arizona, Kansas, New Mexico, and South Dakota.

Subject: Availability of Risk Evaluation and Mitigation Strategy (REMS)-compliant training under the REMS for all extended-release/long-acting opioid analgesic drug products.

Dear VIRGINIA BOARD OF MEDICINE:

Extended-release and long-acting (ER/LA) opioid analgesics' are approved for the management of chronic moderate-to-severe pain in the U.S., and can be safe and effective in appropriately selected patients when used as directed. However, opioid analgesics are also associated with serious risks and are at the center of a major public health crisis of increased misuse, abuse, addiction, overdose, and death. The U.S. Food and Drug Administration (FDA) determined that a Risk Evaluation and Mitigation Strategy (REMS) was necessary to ensure that the benefits of ER/LA opioid analgesics continue to outweigh the risks of adverse outcomes (addiction, unintentional overdose, and death) resulting from inappropriate prescribing, abuse, and misuse.

Several months ago, you received a letter announcing the REMS for all ER/LA opioid analgesic drug products, which explained that the principal components of this REMS are:

a) Prescriber training on all ER/LA opioid analgesics, b) the Patient Counseling Document on Extended-Release/Long-Acting Opioid Analgesics(PCD), and c) a unique Medication Guide for each ER/LA opioid analgesic drug product.

REMS-Compliant Training Programs The purpose of this letter is to provide notification of the upcoming availability of REMS-compliant training on ER/LA opioid analgesics- provided at a nominal to no cost to prescribers. REMS-compliant training is a critical component of the ER/LA Opioid Analgesics REMS program and constitutes essential safety education for prescribers. REMS-compliant training will:

(a) be delivered by accredited CE providers; (b) cover all elements of the FDA Blueprint for Prescriber Education for Extended-Release and Long-Acting Opioid Analgesics ("FDA Blueprint'); (c) include a post-course knowledge assessment; and (d) be subject to independent audit of content and compliance with applicable accrediting standards. REMS-compliant training will focus on the safe prescribing of ER/LA opioid analgesics. The FDA developed core messages to be communicated to prescribers in the FDA Blueprint, which will be used by accredited CE providers to design and deliver REMS-compliant training courses. The FDA Blueprint is available at http://www.fda.gov/ downloads/Drugs/DrugSafety/lnformationbyDrugClass/UCM277916.pdf The core messages include:

• Understand how to assess patients and determine which may be appropriate for treatment with ER/LA opioid analgesics.

• Be familiar with how to initiate therapy, modify dose, and discontinue use of ER/LA opioid analgesics. • Be knowledgeable about how to manage and monitor ongoing therapy with ER/LA opioid analgesics. • Know how to counsel patients and caregivers about the safe use of ER/LA opioid analgesics,

including proper storage and disposal. • Be familiar with general and product-specific drug information concerning ER/LA opioid analgesics.

REMS-compliant training for prescribers also includes information on weighing the benefits and risks of opioid therapy and how to recognize evidence of, and the potential for, opioid misuse, abuse, addiction, and overdose. REMS-compliant training may also be offered by academic institutions or learned societies independent of REMS- related funding. We encourage you to successfully complete REMS-compliant training from an accredited CE provider to improve your ability to prescribe these medications more safely.

' The branded and generic drug products subject to this REMS include all:a) extended-release, oral-dosage forms containing: hydromorphone, morphine, oxycodone, oxymorphone, or tapentadol; b) fentanyl and buprenorphine-containing transdermal delivery systems;and c) methadone tablets and solutions that are indicated for use as analgesics.

Requested Action We ask you to encourage your licensees to successfully complete REMS-compliant training to improve their ability to prescribe these medications more safely. Under the REMS, prescribers are strongly encouraged to do all of the following:

• Train (Educate Themselves)-Complete REMS-compliant training offered by an accredited provider of continuing education (CE) for their discipline.

• Counsel Their Patients -Discuss the safe use, serious risks, storage, and disposal of ER/LA opioid analgesics with patients and their caregivers every time you prescribe these medicines. Use the enclosed Patient Counseling Document on Extended-Release/Long-Acting Opioid Analgesics (PCD) to facilitate these discussions. Prescribers can re-order or print additional copies of the PCD from www.ER-LA-opioidREMS.com.

• Emphasize Patient and Caregiver Understanding of the Medication Guide- Stress to patients and their caregivers the importance of reading the Medication Guide that they will receive from their pharmacist every time an ER/LA opioid analgesic is dispensed to them, as information may have changed.

• Consider Using Other Tools- In addition to the PCD, there are other publicly available tools to improve patient, household, and community safety when using ER/LA opioids, as well as compliance with conditions of treatment, including Patient-Prescriber Agreements (PPAs) and risk assessment instruments. NEW LAWS (effective July 1, 2013)

LYME DISEASE

Practitioners regulated by the Board of Medicine and their in-office designees will have a new responsibility to meet as of July 1, 2013. Law was passed this year that requires all patients who are tested for Lyme Disease to receive specific language about testing for Lyme. Here is the bill that was passed; it contains the specific language you must use with all such patients to be in compliance with the law.

§ 54.1-2963.2. Lyme disease testing information disclosure.

A. Every licensee or his in-office designee who orders a laboratory test for the presence of Lyme disease shall provide to the patient or his legal representative the following written information:

"ACCORDING TO THE CENTERS FOR DISEASE CONTROL AND PREVENTION, AS OF 2011 LYME DISEASE IS THE SIXTH FASTEST GROWING DISEASE IN THE UNITED STATES.

YOUR HEALTH CARE PROVIDER HAS ORDERED A LABORATORY TEST FOR THE PRESENCE OF LYME DISEASE FOR YOU. CURRENT LABORATORY TESTING FOR LYME DISEASE CAN BE PROBLEMATIC AND STANDARD LABORATORY TESTS OFTEN RESULT IN FALSE NEGATIVE AND FALSE POSITIVE RESULTS, AND IF DONE TOO EARLY, YOU MAY NOT HAVE PRODUCED ENOUGH ANTIBODIES TO BE CONSIDERED POSITIVE BECAUSE YOUR IMMUNE RESPONSE REQUIRES TIME TO DEVELOP ANTIBODIES. IF YOU ARE TESTED FOR LYME DISEASE, AND THE RESULTS ARE NEGATIVE, THIS DOES NOT NECESSARILY MEAN YOU DO NOT HAVE LYME DISEASE. IF YOU CONTINUE TO EXPERIENCE SYMPTOMS, YOU SHOULD CONTACT YOUR HEALTH CARE PROVIDER AND INQUIRE ABOUT THE APPROPRIATENESS OF RETESTING OR ADDITIONAL TREATMENT."

B. Licensees shall be immune from civil liability for the provision of the written information required by this section absent gross negligence or willful misconduct.

2. That the provisions of this act shall expire on July 1, 2018.

NALOXONE ADMINISTRATION PILOT PROGRAMS

Law was passed this year that will allow the Department of Behavioral Health and Developmental Services to coordinate pilot programs for naloxone administration in the community, evaluate their impact and report to the General Assembly in 2014. Below are the elements of the law that was passed. Sections were placed in the Civil Remedies title and the Drug Control Act.

A. Any person who:

In good faith and without compensation, administers naloxone in an emergency to an individual who is experiencing or is about to experience a life-threatening opiate overdose shall not be liable for any civil damages for ordinary negligence in acts or omissions resulting from the rendering of such treatment if such administering person is a participant in a pilot program conducted by the Department of Behavioral Health and Developmental Services on the administration of naloxone for the purpose of counteracting the effects of opiate overdose.

X. Notwithstanding the provisions of § 54.1-3303 and only for the purpose of participation in pilot programs conducted by the Department of Behavioral Health and Developmental Services, a person may obtain a prescription for a family member or a friend and may possess and administer naloxone for the purpose of counteracting the effects of opiate overdose.

2. That the Department of Behavioral Health and Developmental Services, in cooperation with the Department of Health, the Department of Health Professions, law-enforcement agencies, substance abuse recovery support organizations, and other stakeholders, shall conduct pilot programs on the administration of naloxone to counteract the effects of opiate overdose. The Department of Behavioral Health and Developmental Services shall evaluate, implement, and report results of such pilot programs to the General Assembly by December 1, 2014.

NURSES AUTHORIZED TO CARRY AND ADMINISTER OXYGEN

An amendment to the Drug Control Act will now allow a prescriber to make oxygen available to registered and licensed practical nurses to possess and administer in emergency medical situations. Here is the language of the law:

D. Pursuant to an oral or written order or standing protocol issued by the prescriber within the course of his professional practice, such prescriber may authorize registered nurses and licensed practical nurses to possess (i) epinephrine and oxygen for administration in treatment of emergency medical conditions and (ii) heparin and sterile normal saline to use for the maintenance of intravenous access lines.

REVOCATION FOR SEXUAL BOUNDARY VIOLATIONS

A bill has been passed into law that provides for a 5-year period of revocation when the Board of Medicine revokes a practitioner’s license for a sexual boundary violation. Here is the language of the law:

§ 54.1-2408.2. Minimum period for reinstatement after revocation.

When the certificate, registration or license of any person certified, registered or licensed by one of the health regulatory boards has been revoked, the board may, after three years and upon the payment of a fee prescribed by the Board, consider an application for reinstatement of a certificate, registration or license in the same manner as the original certificates, registrations or licenses are granted; however, if a license has been revoked pursuant to subdivision A 19 of § 54.1-2915, the Board shall not consider an application for reinstatement until five years have passed since revocation. A Board shall conduct an investigation and review an application for reinstatement after revocation to determine whether there are causes for denial of the application. The reinstatement of a certificate, registration or license shall require the affirmative vote of three-fourths of the members at a meeting. In the discretion of the board, such reinstatement may be granted without further examination.

And here is 54.1-2915(A)(19):

19. Engaging in sexual contact with a patient concurrent with and by virtue of the practitioner and patient relationship or otherwise engaging at any time during the course of the practitioner and patient relationship in conduct of a sexual nature that a reasonable patient would consider lewd and offensive;

PRACTITIONER-PHARMACIST COLLABORATIVE PRACTICE AGREEMENTS

Law was passed that expands the role of pharmacists in collaborative agreements between physicians and pharmacists. Regulation must be promulgated to implement this change in the law. Here is the new language:

1. That §§ 54.1-3300 and 54.1-3300.1 of the Code of Virginia are amended and reenacted as follows:

§ 54.1-3300. Definitions.

As used in this chapter, unless the context requires a different meaning:

"Board" means the Board of Pharmacy.

"Collaborative agreement" means a voluntary, written, or electronic arrangement between one pharmacist and his designated alternate pharmacists involved directly in patient care at a single physical location where patients receive services and a practitioner of medicine, osteopathy, or podiatry and his designated alternate practitioners (i) any person licensed to practice medicine, osteopathy, or podiatry together with any person licensed, registered, or certified by a health regulatory board of the Department of Health Professions who provides health care services to patients of such person licensed to practice medicine, osteopathy, or podiatry; (ii) a physician's office as defined in § 32.1-276.3, provided such collaborative agreement is signed by each physician participating in the collaborative practice agreement; (iii) any licensed physician assistant working under the supervision of a person licensed to practice medicine, osteopathy, or podiatry; or (iv) any licensed nurse practitioner working as part of a patient care team as defined in § 54.1-2900, involved directly in patient care which authorizes cooperative procedures with respect to patients of such practitioners. Collaborative procedures shall be related to treatment using drug therapy, laboratory tests, or medical devices, under defined conditions or limitations, for the purpose of improving patient outcomes. A collaborative agreement is not required for the management of patients of an inpatient facility.

"Dispense" means to deliver a drug to an ultimate user or research subject by or pursuant to the lawful order of a practitioner, including the prescribing and administering, packaging, labeling, or compounding necessary to prepare the substance for delivery.

"Pharmacist" means a person holding a license issued by the Board to practice pharmacy.

"Pharmacy" means every establishment or institution in which drugs, medicines, or medicinal chemicals are dispensed or offered for sale, or a sign is displayed bearing the word or words "pharmacist," "pharmacy," "apothecary," "drugstore," "druggist," "drugs," "medicine store," "drug sundries," "prescriptions filled," or any similar words intended to indicate that the practice of pharmacy is being conducted.

"Pharmacy intern" means a student currently enrolled in or a graduate of an approved school of pharmacy who is registered with the Board for the purpose of gaining the practical experience required to apply for licensure as a pharmacist.

"Pharmacy technician" means a person registered with the Board to assist a pharmacist under the pharmacist's supervision.

"Practice of pharmacy" means the personal health service that is concerned with the art and science of selecting, procuring, recommending, administering, preparing, compounding, packaging, and dispensing of drugs, medicines, and devices used in the diagnosis, treatment, or prevention of disease, whether compounded or dispensed on a prescription or otherwise legally dispensed or distributed, and shall include the proper and safe storage and distribution of drugs; the maintenance of proper records; the responsibility of providing information concerning drugs and medicines and their therapeutic values and uses in the treatment and prevention of disease; and the management of patient care under the terms of a collaborative agreement as defined in this section.

"Supervision" means the direction and control by a pharmacist of the activities of a pharmacy intern or a pharmacy technician whereby the supervising pharmacist is physically present in the pharmacy or in the facility in which the pharmacy is located when the intern or technician is performing duties restricted to a pharmacy intern or technician, respectively, and is available for immediate oral communication.

Other terms used in the context of this chapter shall be defined as provided in Chapter 34 (§ 54.1-3400 et seq.) of this title unless the context requires a different meaning.

§ 54.1-3300.1. Participation in collaborative agreements; regulations to be promulgated by the Boards of Medicine and Pharmacy.

A pharmacist and his designated alternate pharmacists involved directly in patient care may participate with a practitioner of medicine, osteopathy, or podiatry and his designated alternate practitioners (i) any person licensed to practice medicine, osteopathy, or podiatry together with any person licensed, registered, or certified by a health regulatory board of the Department of Health Professions who provides health care services to patients of such person licensed to practice medicine, osteopathy, or podiatry; (ii) a physician's office as defined in § 32.1-276.3, provided such collaborative agreement is signed by each physician participating in the collaborative practice agreement; (iii) any licensed physician assistant working under the supervision of a person licensed to practice medicine, osteopathy, or podiatry; or (iv) any licensed nurse practitioner working as part of a patient care team as defined in § 54.1-2900, involved directly in patient care in collaborative agreements which authorize cooperative procedures related to treatment using drug therapy, laboratory tests, or medical devices, under defined conditions and/or or limitations, for the purpose of improving patient outcomes. However, no person licensed to practice medicine, osteopathy, or podiatry shall be required to participate in a collaborative agreement with a pharmacist and his designated alternate pharmacists, regardless of whether a professional business entity on behalf of which the person is authorized to act enters into a collaborative agreement with a pharmacist and his designated alternate pharmacists.

No patient shall be required to participate in a collaborative procedure without such patient's consent. A patient who chooses to not participate in a collaborative procedure shall notify the prescriber of his refusal to participate in such collaborative procedure. A prescriber may elect to have a patient not participate in a collaborative procedure by contacting the pharmacist or his designated alternative pharmacists or by documenting the same on the patient's prescription.

Collaborative agreements may include the implementation, modification, continuation, or discontinuation of drug therapy pursuant to written, patient-specific or electronic protocols, provided implementation of drug therapy occurs following diagnosis by the prescriber; the ordering of laboratory tests; or other patient care management measures related to monitoring or improving the outcomes of drug or device therapy. No such collaborative agreement shall exceed the scope of practice of the respective parties. Any pharmacist who deviates from or practices in a manner inconsistent with the terms of a collaborative agreement shall be in violation of § 54.1-2902; such violation shall constitute grounds for disciplinary action pursuant to §§ 54.1-2400 and 54.1-3316.

Collaborative agreements may only be used for conditions which have protocols that are clinically accepted as the standard of care, or are approved by the Boards of Medicine and Pharmacy. The Boards of Medicine and Pharmacy shall jointly develop and promulgate regulations to implement the provisions of this section and to facilitate the development and implementation of safe and effective collaborative agreements between the appropriate practitioners and pharmacists. The regulations shall include guidelines concerning the use of protocols, and a procedure to allow for the approval or disapproval of specific protocols by the Boards of Medicine and Pharmacy if review is requested by a practitioner or pharmacist.

Nothing in this section shall be construed to supersede the provisions of § 54.1-3303.

OTHER NEWER LAWS NOW IN EFFECT

Physical therapists no longer have the authority to supervise the practice of athletic trainers.

Registered nurses employed by and physician assistants working in continuing care retirement communities now have the authority to pronounce death under certain circumstances.

Surgery, and who can perform it, has been more fully defined in the law. Surgery now means the structural alteration of the human body by the incision or cutting into of tissue for the purpose of diagnostic or therapeutic treatment of conditions or disease processes by any instrument causing localized alteration or transposition of live human tissue, but does not include the following: procedures for the removal of superficial foreign bodies from the human body, punctures, injections, dry needling, acupuncture, or removal of dead tissue. For the purposes of this section, incision shall not mean the scraping or brushing of live tissue.

No person shall perform surgery unless he is (i) licensed by the Board of Medicine as a doctor of medicine, osteopathy, or podiatry; (ii) licensed by the Board of Dentistry as a doctor of dentistry; (iii) jointly licensed by the Boards of Medicine and Nursing as a nurse practitioner; (iv) a physician assistant acting under the supervision of a doctor of medicine, osteopathy, or podiatry; (v) a licensed midwife in the performance of episiotomies during childbirth; or (vi) acting pursuant to the orders and under the appropriate supervision of a licensed doctor of medicine, osteopathy, podiatry, or dentistry.

Users of Virginia’s Prescription Monitoring Program can now delegate to an unlimited number of licensed healthcare professionals under their direct supervision the authority to access the Program to request reports.

The Board of Medicine now licenses behavior analysts and assistant behavior analysts. Behavior analysis is widely used in the assessment and treatment of patients with autism and autistic spectrum disorder.

Law has been passed that authorizes physician assistants to perform fluoroscopy. However, regulations that specify the training that must take place prior to the performance of fluoroscopy have not yet been approved.

MAINTENANCE OF LICENSURE The Federation of State Medical Boards (FSMB) is spearheading a project for Maintenance of Licensure (MOL), similar to the effort of the American Boards of Medical Specialties’ Maintenance of Competency initiative that most of its member boards have implemented. Several boards of medicine are working with FSMB to figure out the nuts and bolts of the program and how best to implement it. COMPENSATED COMMUNITY SERVICE OPPORTUNITY AS A LOCAL MEDICAL EXAMINER Are you a fan of TV shows like CSI, Law and Order, and Criminal Minds or of novels by such authors as Grisham, Baldacci and Cornwell? As a licensed Virginia doctor, you have the opportunity to enter the real world of medicolegal death investigation by performing a valuable community service and assisting law enforcement within your locality while receiving monetary compensation. Serving the citizens of Virginia as a part-time Local Medical Examiner (LME) is not only rewarding but extremely interesting as it allows you, the physician LME, to enter the intriguing and restricted world of medicolegal death investigation and still maintain your full time medical practice. There are many benefits to being appointed Local Medical Examiner in your community and it requires only a small investment of your time, about an hour for each case investigated.

1. As an agent of the Commonwealth of Virginia you would be compensated $150 for every case you accept under the jurisdiction of the Office of the Chief Medical Examiner to investigate with an additional $50 for every non-hospital death scene you choose to visit as part of your investigation and for every cremation permit you certify for a funeral home.

2. While acting as LME you will not require any additional malpractice coverage as your medical examiner work as an agent of the Commonwealth is covered by the Commonwealth of Virginia.

3. As a LME you will be eligible to attend free biannual LME training programs provided within

the districts by the Office of the Chief Medical Examiner for 8 hours of CME credit per program. 4. While functioning as a LME you will get to know the law enforcement officers and

Commonwealth’s Attorneys within your community expanding your professional acquaintances and work partners from your interaction with them as a LME.

5. Through your LME duties you will be performing a very critical community service for the

individuals who reside in your locality by ensuring that those who die a violent or unnatural death have their cases thoroughly and properly investigated and their cause and manner of death appropriately certified.

6. As a Virginia LME you will be working within a nationally recognized, statewide medicolegal

death investigation system with four separate district offices employing fulltime, board certified forensic pathologists to perform autopsies on your medical examiner cases and fulltime medicolegal death investigators to assist you with your investigations and the minimal paperwork required for case completion.

DMV MEDICAL DISABILITY PLACARDS

The Department of Motor Vehicles (DMV) will be implementing an amendment to Virginia Code Section 46.2-1241that refers to the issuance of temporary disabled parking placards. Effective July 1, 2013, health care providers will be able to certify in advance that a patient will be temporarily disabled subsequent to an upcoming medical procedure. This means that with a provider’s certification, DMV will be authorized to issue a temporary disabled parking placard for up to 6 months, prior to the patient undergoing the procedure.
