As I’ve become more familiar with the office operations, I have found some additional regular fees that are institutional knowledge but not specifically listed on the fee schedule. The proposed fee schedule update addresses these items and includes modifications related to the Mobile Tower Siting ordinance being considered. New Fees Related to Ordinance L-2016-1 Mobile Tower Siting (page 8 of proposed fee schedule): Per our consultation with Attorney Anita Gallucci of Boardman Clark, State Statute allows the Village to charge up to $3,000 for a new tower and the lesser of the Village’s minimum building permit fee ($130) or $500. The Village’s Street Opening is currently $150. Including a fee to ‘Occupy the Right-of-Way’ is allowed by State Statute. For a tower the proposed fee is the same as a Street Opening = $150. While researching fees charged by other communities, I found many allow occupancy of the street or right-of-way for construction dumpsters, storage pods or similar purposes. They charge for temporary occupancy on a per day basis. This is rarely allowed in the Village but in the past we have used the old Street Opening permit application. I have modified the Street Opening form (included) to allow for Right-of-Way Occupancy as well and proposed a $5.00 per day fee with a maximum of 30 days. Zoning Fees (page 5 of proposed fee schedule): Stormwater Review – We started using a new building permit form January 1, 2016 which includes fees for Stormwater Compliance Review and Floor Area/Height Limitation Compliance Review by the Village Engineer. The compliance review fees have been $150 and now included with the Building Permit Fees. Inspection Fees: A number of fees were not previously included on the fee schedule but were on the permit applications and office reference sheets: • HVAC – Air Conditioning = $60 • HVAC – Commercial Properties = $10 per $1,000 value of HVAC expenses • HVAC – Additional or Red Tag Inspections = $50

• Plumbing – Sanitary or Storm Sewer, Septic By-Pass = $15/100 ft • Building (Residential): Plan Review – Revisions (unless requested by plan reviewer) = $50 – This
would be a new fee. There is a similar fee in place for commercial properties ($100). This situation occurred this year when a new home was being built and the plan changed a couple of times requiring the building inspector to do a second review of the plans

Plan Commission Conditional Use Permit Review Lake Mendota Drive Projects
The Plan Commission shall forward its written advisory recommendation to the Village Board within thirty (30) days after receipt of the application from the Zoning Administrator. The Plan Commission shall recommend approval, approval subject to specified conditions, or denial. A recommendation for denial shall include the reasons, including which standards contained in the Plan Commission review are found not to be met.
A conditional use shall be approved under this paragraph only if the applicant demonstrates by clear and convincing evidence the following:
1. Views of Lake Mendota from points off the lot on which the development or excavation proposed will not be adversely affected. Will not be adversely effected in any significant way.
2. Erosion will not be increased. Erosion will not be increased. The project will likely
mitigate existing erosion.
3. The flow of surface water will not be changed so as to adversely affect other lots, the lake and other aspects of the natural environment. Erosion will not be increased. The project will likely mitigate existing erosion.
4. Infiltration of surface water into the ground will not be adversely affected. Infiltration
will be improved as stormwater requirements are imposed.
5. Access to properties and structures by firefighters and other emergency personnel will not be adversely effected: The project will greatly improve the ability for emergency personnel to access the property and home and the ability to stage a response on the driveway.
The Plan Commission shall review the application according to the standards below. No application shall be recommended for approval by the Plan Commission unless it finds that the following conditions are met:
1. That the establishment, maintenance or operation of the conditional use will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare.

Finding: The project will improve existing safety issues on the property and improve the comfort and general welfare of the property owner and access to others on the property.
2. That the uses, values and enjoyment of other property in the neighborhood for purposes already permitted shall be in no foreseeable manner substantially impaired or diminished by the establishment, maintenance or operation of the conditional use and the proposed use is compatible with the use of adjacent land.
Finding: The proposed project conforms to Village zoning regulations in the R-3 district and is compatible with adjacent properties. Impacts do not substantially impair or diminish uses and enjoyment of other property.
3. That the establishment of the conditional use will not impede the normal and orderly development and improvement of the surrounding property for uses permitted in the district, and will not be contrary to an adopted comprehensive plan of the Village.
Finding: Yes.
4. That adequate utilities, access roads, drainage and other necessary site improvements have been, are being or will be provided.
Finding: Yes.
5. That the establishment, maintenance or operation of the conditional use is unlikely to increase the level of traffic congestion or reduce the level of safety at any point on the public streets.
Finding: The ability to access the garage and driveway may increase safety on the street by reducing the need to park on the street, and generally improving the ingress and egress.
6. That the conditional use shall conform to all applicable regulations of the district in which it is located.

Finding: Yes.
7. That the conditional use does not violate flood plain regulations governing the site.
Finding: Yes.
8. That, when applying the above standards to any new construction of a building, or an addition to an existing building, the Plan Commission and Board shall bear in mind the statement of purpose for the zoning district such that the proposed building or addition at its location does not defeat the purposes and objectives of the zoning district.
Finding: Yes.
The Plan Commission shall also evaluate the effect of the proposed conditional use upon:
• The maintenance of safe and healthful conditions.
Finding: The project will improve upon safe and healthful conditions through improvements to the ability to access and use the property.
The prevention and control of water pollution including sedimentation.
Finding: Stormwater and erosion control requirements triggered by this project will prevent and control pollution and sedimentation.
• Existing topographic and drainage features and vegetative cover on the site.
Finding: No detrimental effect.

• The location of the site with respect to floodplains and floodways of rivers and streams.
Finding: There are no floodways or plains in the area.
• The erosion potential of the site based upon degree and direction of slope, soil type and vegetative cover.
Finding: The project will decrease erosion potential as it will trigger compliance with the village stormwater management regulations.
• The location of the site with respect to existing or future access roads.
Finding: n/a
• The need of the proposed use for a shoreland location.
Finding: n/a
• Its compatibility with uses on adjacent land.

Skating Rink / Hockey Boards Condition of the Heiden Haus field: • Water drains through the ground making it difficult to make ice unless there is frost in the
ground. • The uneven ground results in varied thickness of ice and the ground becomes exposed in
some areas by February 1 when the sun is higher in the sky. • The soccer and other activities during the summer and fall have worn away much of the grass
cover. Dark spots of dirt absorb heat from the sun melting ice more rapidly. Hockey Boards Installation: • At one time there were 54 4’x8’ boards create a ~60’ x ~160’ hockey rink. For the last 10+
years there were 49 boards for a ~63’ x ~153’ hockey rink. • Each board is made of ¾” plywood and 2x4s. They are pretty heavy. • The Crew uses the skid steer to move the boards. • Wood angle brackets are attached to the boards and 12” spikes are driven into the ground to
hold up the boards. Best if there is frost in the ground. Difficulties in 2016: • To have enough frost in the ground to be able to make good ice, we need day and night
temperatures to remain below 20o for a week. In 2016, the weather didn’t cooperate until mid-January. Temps have been up and down significantly. There wasn’t much frost in the ground at any time this year.
• The Crew started to make ice on January 9, had good ice by January 15 and lost most of the ice by February 1 (bad spot on more than half of the ice sheet).
• The lack of grass during the fall and wet weather made the field very sloppy and it was difficult to move the boards out on the field with the skid steer without creating significant ruts in the ground.
• There was no frost in the ground to drive the anchor spikes into for the hockey boards. The crew intended to put in the hockey boards on top of the ice but they never got a good sheet established and the forecast was for more warm temps.
What can be done in the future to improve the skating and hockey rinks? The Heiden Haus field is a multi-use, multi-season facility. The needs of the ice rink must be considered along with the needs of soccer, land rec and other community uses of the field. • Excavate and replace the soil on the field with a clay base that holds the water*. Install drain
pipe(s) to allow the field to drain in the spring. Pros: Easier to flood, don’t need frost in the ground Season would probably start earlier and last longer Cons: Cost Clay base would hold water during other times of year too causing standing water
after heavy rain which would affect soccer and other activities To keep clay base intact, we would have to prohibit tent stakes being driven into
the ground on the field
• Install a surface liner on top of the grass Pros: Don’t need to change the soil base Easier to flood, don’t need frost in the ground Cons: Waunakee tried a liner for one year, found gas bubbles were created on warm
days that floated to the top and exposed the liner Potential for skates to tear the liner, then need to repair/replace the liner
