APPLICATION SUMMARY Applicant: Christopher Mellgren, CEO Request: Deviation for a reduced setback for a monument sign along the east side of Ben Hill Griffin Parkway at ten feet rather than the required fifteen feet defined by Land Development Code (LDC) Section 33-385 (a) (3). Location: The property is located at 20290 Grande Oaks Shoppes Boulevard. The applicant indicates the STRAP number is 25-46-25-E4-20000.0020. PROJECT HISTORY The subject property is part of a Development Regional Impact (DRI), known as Timberland and Tiburon. It was first rezoned from General Commercial (CG), Tourist Commercial (CT), and Planned Unit Development (PUD) to Mixed Use Planned Development (MPD) on March 3, 1997 (Zoning Resolution Z-97-010). The subject property is located within Area #3 on the approved Master Concept Plan and consists of 1.11 acres. Development Order approval was granted by the Village of Estero on July 29, 2016 for the development of Valvoline and Dunkin Donuts. The concrete monument sign design was approved with conditions by the Design Review Board on June 14, 2017. STAFF ANALYSIS A revised application with revised plans and details (See Attachment A and B) was submitted to Staff on June 26, 2017. The applicant has now requested a setback reduction from 15 feet to 10 feet for the Dunkin Donuts/Valvoline concrete monument sign which is currently under construction on Ben Hill Griffin Parkway. The purpose is to construct a monument sign closer to Ben Hill Griffin Parkway for better visibility, according to the applicant. Zoning Board had several questions about the sign and setback, and requested additional information and suggested that the concrete monument sign should be re-located and placed closer to the Dunkin Donuts/Valvoline access road. The Board had concerns related to sight line issues with the proposed location of the sign. It was suggested that the applicant submit photos showing the location of the sign at the required setback and the requested setback. The case was continued. RECOMMENDATION Staff does not recommend approval of the sign setback. Granting the request could set a precedent along Ben Hill Griffin Parkway. Signs within the vicinity of the subject site are in compliance with Section 33-385 (a) (3) for monument signs. Additionally, the applicant has not provided any justification for the deviation, nor have they illustrated how the deviation would enhance the project. Section 34-373 (a) (9) of the Land Development Code states; “A schedule of deviations and a written justification for each deviation requested as part of the master concept plan and accompanying documentation including sample detail drawings illustrating how each deviation would enhance the achievement of the objectives of the planned development and will not cause a detriment to public interests”. This information has not been provided to assist Staff and the Planning and Zoning Board in their review. ATTACHMENTS
